Abstract

This research aims to describe the role of religious figures in the process of drafting regulations at the sub-district level, especially in Pulo Brayan Darat II Subdistrict, East Medan District. This research uses descriptive research with a qualitative approach with field research. The research location was carried out at the Pulo Brayan Darat II Subdistrict Office and the Al-Ma'ruf Sidorukun Mosque. The results of this research show that in drafting regulations in Pulo Brayan Darat II Subdistrict, religious figures have a quite significant role. This is because the drafting of regulations in the area was carried out through open and deliberative discussions involving community leaders and other community representatives, such as mosque youth and youth organizations. Meanwhile, the role of religious figures in drafting regulations is in accordance with the perspective of fiqh siyasah, because according to fiqh siyasah, religious figures are good role models for society, provide solutions to society's problems, implement amar ma'ruf and nahi munkar, and form a society that is lawful. good and moral role models to create a safe, peaceful and prosperous community life.

Abstract

Political parties are a bridge that connects people's hearts and minds, and people's  demands are accommodated in political parties. That is the existence of political parties in Indonesia, especially those that support presidential elections from a sharia perspective. The question in this case is how to understand the role of political parties in realizing democratic post-conflict local elections and what their views are on achieving democratic post-conflict local elections. Which discusses the role of political parties in supporting presidential elections from a political-legal perspective. The data collected regarding the history of political parties comes from books that use historical theoretical analysis to discuss political parties to date. The research results show that political parties are a bridge to communicate dissatisfaction in social life. According to Law Number 10 of 2008 and Decree Number 2 of 2008, the aim of political parties is to realize the national ideals of the Indonesian nation, as regulated in the State Constitution. Republic of Indonesia in 1945. Political parties in Indonesia have an important role in the functioning of democracy because they are part of society and are the means and means of society in conveying their aspirations and ideas for the realization of democratic values in national life. and stated within the framework of Bhinneka Tunggal Ika, all these letters are in line with the verses of the Koran and Hadith which are the source of siyasah fiqh law.

Abstract

Menurut Pasal 7 UUD Negara Republik Indonesia Tahun 1945, seorang warga negara Indonesia harus berusia minimal 35 tahun dan maksimal 60 tahun untuk menjadi presiden. Pada tahun 2019, Mahkamah Konstitusi (MK) memutuskan untuk membatalkan pedoman ini dan memberikan jaminan sebanyak mungkin kepada para pejabat untuk mengelolanya sesuai dengan siyasah dusturiyyah yang berhubungan dengan pedoman dan aturan negara. Penyelidikan ini diyakini dapat melihat pilihan Pengadilan Dilindungi menurut sudut pandang siyasa fiqih. Penjelasan mengenai strategi penyidikan dimuat dalam pemeriksaan ini yang menggunakan metodologi hukum standar. Hasil pemeriksaan menunjukkan bahwa putusan Mahkamah Konstitusi tidak bertentangan dengan fiqih siyasah. Keputusan ini merupakan upaya Pengadilan Suci untuk memberikan kesempatan kepada koordinator untuk memutuskan batas usia otoritas sesuai dengan kebutuhan dan kondisi negara.

Abstract

Human rights are rights inherent in a person that no one can contest. Therefore, the state's role in protecting these rights is also responsible for creating prosperity in social life. The problem formulation in this research is the role of the state in protecting human rights in Indonesia from an Islamic legal perspective. This research uses qualitative research methods with a descriptive approach. The findings in this research are the role of the state in protecting human rights Humans in Indonesia have been given such attention as can be seen from the many laws and regulations regarding Human Rights whose aim is to protect the rights of humans themselves. Islam also views the obligations of the state in carrying out its role as protector of human rights for all its people, must be maximal and every right must be fulfilled, because these rights absolutely come from Allah SWT and no one can interfere with them. However, in practice discrimination against human rights is still often encountered because injustice originating from the ruler himself.

Abstract

Untuk dapat memahami persyaratan calon presiden dan wakil presiden, perlu merujuk pada undang-undang yang mengatur pemilihan presiden dan wakil presiden, yakni Pasal 169 Undang-Undang Nomor 7 Tahun 2017 tentang Pemilihan Umum. Undang-Undang tersebut mengatur syarat calon presiden dan wakil presiden. Syarat kewarganegaraan menjadi poin kritis dalam menentukan kelayakan seorang individu untuk mencalonkan diri sebagai presiden atau wakil presiden. Undang-Undang Pemilihan Umum menetapkan bahwa calon presiden dan wakil presiden harus bertakwa kepada Tuhan Yang Maha Esa, Aspek usia juga menjadi syarat yang harus dipenuhi oleh calon presiden dan wakil presiden. Calon presiden serta wakilnya minimal harus berusia 40 tahun pada saat dilantik. Penetapan batasan usia ini bertujuan untuk memastikan bahwa calon presiden dan wakil presiden memiliki pengalaman dan kedewasaan yang memadai dalam memimpin Negara. Syarat ketiadaan pidana menjadi unsur penting dalam menilai integritas calon presiden dan wakil presiden. Pemimpin Negara di Indonesia memiliki peran yang sangat krusial dalam mengelola dan mengarahkan kebijakan negara. Dalam perspektif fiqih siyasah, yang merupakan cabang ilmu fiqih yang membahas masalah-masalah pemerintahan dan kepemimpinan, posisi kepala negara atau pemimpin kementerian negara memegang peran yang sangat penting. Untuk memahami lebih dalam tentang konsep fiqih siyasah dalam konteks kementerian negara, kita dapat menjelajahi beberapa aspek kriteria dan tanggung jawab yang seharusnya dimiliki oleh pemimpin negara. Penelitian ini menggunakan metode penelitian hukum yuridis-normatif, yang dikenal sebagai penelitian hukum kepustakaan. Metode ini melibatkan penelusuran literatur yang relevan untuk kemudian dianalisis.

Abstract

This research aims to explore the concept and implementation of social justice development from the perspective of Islamic jurisprudence. In analyzing fiqh texts and Islamic siyasa concepts, this research explores the principles that can guide the development of social justice in society. Through research findings, it is hoped that deeper insight can be gained about how the values ​​of justice in siyasah fiqh can be applied in the social context that is currently developing rapidly. In an effort to achieve this goal, researchers will conduct in-depth studies of various important theories and concepts in Islamic jurisprudence and involve various resources to enrich understanding of key issues related to the development of social justice. Researchers will also discuss several concrete cases from the real world to provide examples of how the principles of justice in siyasah fiqh can be implemented effectively in practice. Through this research, it is hoped that a more comprehensive understanding of the concept of social justice development can be obtained from the perspective of siyasah fiqh. It is also hoped that the important findings from this research can contribute to the development of social justice development theory and practice more broadly. As a result, we can strengthen the foundation of human values ​​and morality in our society and advance shared prosperity.

Abstract

As a country with a majority Muslim population, Indonesia faces unique challenges in harmonizing the principles of Siyasah Fiqh with a secular government system. Efforts to understand and adapt Islamic principles to government policies are an important step in achieving this harmonization. Comparison with practices in other Muslim countries can provide additional insight into the suitability and sustainability of the policy of prohibiting multiple positions in Indonesia. Indonesia's government system, which adheres to a "presidential system," places power in the hands of the president. In this context, the prohibition on holding concurrent positions as Deputy Minister is regulated by Law Number 39 of 2008. This prohibition aims to ensure clear focus and responsibilities for the Deputy Minister, in accordance with the principles of Siyasah Fiqh. Juridical-normative legal research methods are used in this analysis, with emphasis on relevant literature. This research is descriptive and exploratory in nature, discussing aspects such as legislative politics, foreign policy, monetary politics, war politics and tactics. From the perspective of Siyasah Fiqh, the prohibition on holding multiple positions can be understood as implementing the principles of justice, transparency and accountability in government governance. These principles encourage the placement of officials based on competency and specialization, avoiding conflicts of interest, and ensuring efficient performance.

Abstract

The Shiffin War in 657 AD caused divisions among Muslims. This war ended with arbitration which was not accepted by Ali bin Abi Talib, thus triggering a split into three political factions, namely the Khawarij, Muawiyah and Shiite groups. The Shiites believe that Ali bin Abi Talib was the elected caliph and the first imam after the Prophet Muhammad SAW. They believe that the highest leadership in Islam is the imam, not the caliph. The concept of imamate in the Shiite school of thought is based on the belief that Ali bin Abi Talib is the heir of the Prophet Muhammad SAW. The Shiite sect is divided into several groups, including Shiite Imamiyah, Shiite Ismailiyah, and Shiite Zaidiyah. Each group has a different view of the imamate. Shiite Imamiyah and Shiite Ismailiyah do not recognize the leadership of Abu Bakr, Umar and Uthman. However, the Zaidiyah Shiites recognize the leadership of Abu Bakr, Umar, and Uthman, but only as caliphs, not imams. During its heyday, the Shiite school of thought was able to build a civilization and contribute to Islamic civilization. One example is the Fatimid dynasty which ruled Egypt in the 10th to 12th centuries AD.

Abstract

This article was written in order to find out more deeply about the influence of social media on democracy from a religious perspective. This analysis can help understand how social media can influence democratic processes and how this influence can be managed to ensure that social media contributes to strengthening democracy. This article concludes that in Islam there are guidelines and values that must be followed to disseminate information, including in political matters. You can express yourself on social media, but it must be within the framework of sharia.

Abstract

This journal explores the intricate relationship between religion and state within the framework of Fiqh Siyasah, a branch of Islamic jurisprudence focusing on governance and politics. Religion, conceptualized as a set of obligations toward God, society, and oneself, serves as a guiding principle for human conduct across various aspects of life. Fiqh Siyasah emphasizes the crucial role of the state in implementing Islamic law on a broader societal scale. In the context of Fiqh Siyasah, the state transcends its administrative and political dimensions, emerging as an institution facilitating the application of Islamic principles in daily life. The leader, or imam, is entrusted with moral and spiritual responsibilities, not only to the community but also to Allah, requiring adherence to criteria such as justice, knowledge, and competence in managing the affairs of the people. Examining historical cases such as the Rashidun Caliphate provides an ideal model for understanding the balanced relationship between religion and state in Islam. The classical Islamic era demonstrates a symbiotic relationship, where religion and state mutually support and complement each other. However, contemporary challenges arise with the dynamics of globalization and diverse concepts of modern Islamic states.
