Abstract

Generally, implementation of a development project requires law peripheral in the form of agreement. Agreement is important to give a legal fundament in activity to finalizing building project till finish. Basically, every party involving in an implementation of construction contract is main party that have signing up construction, that is bath of employer and developer ones. To be able to the happening of contractual terms between construction service feeders and construction service user hence they must bind itself in an agreement based on principle of agreement reached. Abstract

ABSTRAK Tujuan penelitian ini adalah untuk mengetahui penegakan hokum pidana terhadap tindak pidana money politic pada penyelenggaraan pemilihan umum oleh calon anggota legislatif pada pemilu 2019 di Kabupaten Gorontalo, dan untuk mengetahui apa saja yang menjadi faktor penghambat penegakan hukum pidana terhadap pelaku tindak pidana money politic oleh calon anggota legislatif pada pemilu 2019 di Kabupaten Gorontalo. Jenis Penelitian yang digunakan oleh peneliti dalam menyusun Penelitian ini adalah jenis Penelitian normatif-empiris, Adapun pendekatan yang digunakan oleh peneliti dalam menyusun penelitian ini adalah, antara lain: Pendekatan Perundang-Undangan (Statue Approach); Pendekatan kasus (case approach). Hasil penelitian ini menunjukkan bahwa Penegakan Hukum Terhadap Tindak Pidana Money Politic Oleh Calon Anggota Legislatif Pada Pemilihan Umum masih belum maksimal, hal ini dibuktikan dengan data di Bawaslu Kabupaten Gorontalomasih banyaknya pelanggaran tindak pidana money politic yang dilakukan oleh calon anggota legislatif dan masih banyak pelanggaran tindak pidana money politic yang tidak diproses sampai ketahap penyidikan karena tidak cukup bukti. Dalam menjerat para calon anggota legislatif yang melakukan tindak pidana money politic Bawaslu, dan Kepolisian, masih dihadapkan pada beberapa faktor-faktor hambatan yang melatar belakangi sehingga berpengaruh pada penerapan sistem peradilan pidana terhadap tindak pidana pelanggaran tindak pidana money politic. Kata Kunci : Penegakan Hukum; Tindak pidana; Money Politic Calon Anggota Legislatif. ABSTRACT The purpose of this study is to determine the enforcement of criminal law against money political crimes in the implementation of general elections by legislative candidates in the 2019 election in GorontaloDistrict, and to find out what are the factors inhibiting criminal law enforcement against perpetrators of money political crime by prospective members. legislative elections in 2019 in GorontaloDistrict. The type of research used by researchers in compiling this research is a type of normative-empirical research. The approaches used by researchers in compiling this research are, among others: the statutory approach (Statue Approach); The case approach (case approach). The results of this study indicate that Law Enforcement Against Money Politic Crime by Legislative Candidates in the General Election is still not maximal, this is evidenced by data in Bawaslu GorontaloRegency that there are still many violations of money political crimes committed by legislative candidates and many violations. money political crime which is not processed until the stage of investigation because there is insufficient evidence. In ensnaring candidates for legislative members who commit money political crimes, the Bawaslu and the Police, they are still faced with several background obstacle factors that affect the application of the criminal justice system to the crime of money political crime.

Abstract

Basically, judges are the main actors organizing judicial power and at the same time as guardians of justice for litigants. Judge decisions that reflect law and justice simultaneously are not easy to realize. The objectives of this study are 1). To find out and analyze the development of progressive legal teachings through judges' decisions in court. 2). To find out and analyze the teachings of progressive law through judges' decisions and their influence on justice. The research method used is normative. The approaches taken are as follows: a). statute approach. b). Conceptual approach. c). Case approach. The sources of legal materials used consist of primary legal materials, secondary legal materials and tertiary legal materials. While the analysis used in this research is descriptive technique and comparative technique. The conclusions of this research are 1). The development of progressive legal teachings through judges' decisions in court is a must and cannot be negotiated anymore. 2). That the teachings of progressive law through judges' decisions and their influence on justice to answer the demands of the times today that judges' decisions are no longer only identical to the written legal rules contained in the law as taught by positivism, but judges' decisions are as much as possible able to provide welfare for the parties to the dispute and justice seekers and society in general.

Abstract

The purpose of this study is to examine the settlement mechanism of Cyber Harassment experienced by public figures considering that in this disruptive era of technology, more and more cases like this have emerged. The research approach method used is the statute approach and the case approach. The results of the study are that the settlement of cyber harassment disputes against public figures can be resolved through litigation and non-litigation mechanisms. It is possible to settle through this litigation route, even though in substance the legal regulations regarding cyber harassment have not been described concretely in positive law in Indonesia, departing from the understanding that there is an IUS principle. novit curia. The legal consequence, of course, is that judges are prohibited from objecting, let alone refusing a case submitted by the community and having the obligation to examine and try and give legal decisions on these legal issues. The next option apart from litigation is the non-litigation route. The author concludes that in resolving Cyber Harassment disputes against public figures if you choose a non-litigation route to be resolved, an alternative form of dispute resolution that can be used and is considered more suitable as a media for dispute resolution is mediation. Suggestion, To the Indonesian people in general and public figures in particular, must be brave to fight for their rights and make complaints or reports to the authorities so that losses arising from violations of their constitutional rights can be recovered and the state through its power tools can guarantee legal protection to victims at the same time providing a deterrent effect to the perpetrators to realize order and security in the life of society, nation, and state.

Abstract

This article is a study of the legal politics of regulating self-defense actions in Indonesia as well as describing the practice of law enforcement against acts of self-defense. This article will be analyzed normatively using a statutory approach and case approach. The results of the analysis show that tha act of self-defense regulated in the Criminal Code as the basis of criminal law in Indonesia shows the principles of the rule of law, as well as being a form of protection for citizens in defending their lives, especially in situations of threats and crimes.Factually, there are actions from law enforcement not continuing the law enforcement process of self-defense actions as felt by Irfan and Rofiqi in Tangerang and by Amaq Shinta in lombok. However, there are still differences in the settlement and handling of cases rleated to acts of self-defense as experienced by ZL in Malang. This Actually shows that there is injustice because there is process that influences criminal policy so that it has an impact on not fulfilling a sense of justice for every citizen as one of the guarantees in a legal state like Indonesia.

Abstract

Abstract This study aims to identify the laws and regulations that regulate women's human rights and analyze them using them to determine the effectiveness of these laws and regulations in protecting women's human rights during the pandemic. The research was conducted using normative legal research methods using a conceptual approach and a statutory approach. The collection of legal materials is carried out using a literature study and the legal materials will be analyzed using Feminist Legal Theory. The results of the study show that there are several women's human rights that have been regulated in Indonesian laws and regulations, including: (1) The right to be free from gender discrimination (UU HAM); (2) The right to justice and gender equality (UU HAM, UU PKDRT); (3) The right to get protection as a victim (UU PKDRT); (4) The right to recognition and respect for human rights in all matters relating to citizens (UU Kewarganegaraan); (5) The right to be free from racial discrimination (UU PTPPO); (6) Political Rights (UU Parpol, UU Pemilu); and (7) The right to be free from discriminatory treatment against a social group that is still underdeveloped (UU Parpol, UU Pemilu). With regard to these laws and regulations, by focusing only on aspects of legal protection, namely protection against violence (both physical and sexual) against women, it shows that the existing legal umbrella is not effective enough to protect women. This is because the existence of laws and regulations alone cannot guarantee the implementation of women's human rights. Legislation must be followed by gender-sensitive law enforcement and no less important is a cultural change in society.

Abstract

There are normative issues related to the concept of commodity goods with the object of warehouse receipts and social issues regarding the benefits of warehouse receipts for grain or rice farmers. Therefore, it is necessary to evaluate the regulation of the object of the warehouse receipt system so that it has a unique contribution to small farmers. The research applied in this research is juridical-empirical with a qualitative approach. The fact shows that rice farmers do not want to use the Warehouse Receipt System (WRS) because of the high cost and tend to choose the People's Business Credit program. Based on the study of the concept of commodities and benefits, it is necessary to change regulations related to the concept of WRS objects so that it is better to equate it with the concept of commodities. Grain or rice is a staple food that is excluded from the WRS object following the commodity concept because it has access to subsidies and special incentives from the government for national food security. Smallholders do not need to store rice in warehouses as in the WRS procedure to gain access to credit. This study shows that the government is reviewing the regulation of WRS objects in Indonesia so that it is beneficial for small farmers in particular.

Abstract

AbstrakPerkembangan kontemporer perlindungan HAM telah jauh berkembang hal ini dapat di lihat banyak kawasan regional yang telah mengatur prinsip-prinsip HAM dalam piagam pendirian contohnya Piagam ASEAN dan African Union Constitutive Act. ASEAN dan  Africa Union (AU), di anggap sebagai representatif perlindungan HAM di kawasan regional akan tetapi berbeda dengan AU, ASEAN  masih jauh tertinggal secara konsep hal ini di buktikan masih kuatnya prinsip kedaulatan negara dan prinsip non-intervensi di kawasan ASEAN. Adapun yang menjadi rumusan masalah yaitu adanya diskursus terkait penerapan prinsip non intervensi, kedaulatan negara dan intervensi kemanusian yang menjadi inti permasalahan penegakan HAM di ASEAN. Penelitian ini menggunakan Metode Penelitian Hukum Normatif, menggunakan pendekatan konsep dan pendekatan perbandingan. Untuk dapat mengatasi permasalah pelanggaran HAM di ASEAN maka: (1) ASEAN perlu melakukan pertemuan antar negara guna memperoleh penyelesain permasalahan HAM di dasarkan atas kemufakatan; (2) ASEAN perlu melakukan peninjauan kembali terhadap penerapan prinsip kedaulatan negara dan non intervensi dengan melihat perkembangan hukum internasional kontemporer (3) ASEAN perlu berkomitmen penuh terhadap AICHR guna mendukung ekosistem perlindungan dan penegakan HAM di ASEAN.

Abstract

Forest and land fires not only cause losses to the country of origin where the fire occurred, but also have an impact on other countries in the form of transboundary smoke pollution. The occurrence of transboundary smoke pollution that causes disruption to the environment of other countries is an act that is contrary to the principles of international law, especially those governing international environmental law. This research examines the worst forest and land fires that occurred in Riau. This research uses a doctrinal approach with consideration of research targets in the form of laws and regulations by examining the accuracy of arrangements, relations between norms and testing the norm system. The research approach analyzes legal theory, jurisprudence, and legal philosophy, and does not avoid the use of certain facts as support in research analysis. In this approach, the author analyzes the distributor's responsibility in the case of transboundary haze pollution in Riau. The result is that the parties responsible in the case of transboundary air pollution or Transboundary Haze Pollution in addition to the polluter, namely palm oil companies in Riau, also involve the state, in this case the Indonesian government as the party authorized to grant licenses and supervise the business licenses that have been issued, as well as being responsible as a contributor, namely the state of Singapore because of its financing to companies that cause air pollution in Riau. As well as making financiers, namely banks, one of the distributors in cross-border pollution in accordance with the polluter pays principle, which is the main principle that the polluter must be the payer.

Abstract

Abstrak Kewajiban ganti rugi terhadap korban pada dasarnya telah dapat dikatakan sebagai pemenuhan restorative justice dimana merupakan konsep keadilan yang sedang ingin dicapai dalam pembaharuan hukum pidana di Indonesia. Oleh karena itu tujuan penulisan ini untuk menguraikan pentingnya bentuk perlindungan hukum kepada korban penipuan transaksi jual beli online dilihat dari perspektif Undang-Undang Informasi dan Transaksi Elektronik sekaligus untuk mendeskripsikan apakah ganti rugi sebagai pidana tambahan dapat ditetapkan sebagai upaya melindungi korban penipuan melalui transaksi jual beli online. Metode penelitian yang digunakan dalam tulisan ini adalah penelitian yuridis normatif dengan menggunakan pendekatan konseptual dan pendekatan perundang-undangan. Hasil penelitian dalam tulisan ini menunjukan bahwa Undang-Undang Informasi dan Transaksi Elektronik hanya mengatur tentang pidana pokok terhadap pelaku tindak pidana penipuan transaksi jual beli online dan tidak secara tegas mengatur tentang ganti rugi yang mestinya didapatkan oleh korban dari tindak pidana penipuan melalui transaksi jual beli online. Pentingnya ganti rugi dalam bentuk restutusi sebagai pidana tambahan agar supaya ganti rugi tidak hanya menjadi opsi untuk melindungi korban tetapi menjadi kewajiban untuk dipenuhi oleh setiap pelaku tindak pidana ketika tindak pidana yang dilakukannya berakibat kerugian bagi korban penipuan transaksi jual beli online. Abstract Obligation to compensate victims basically could be said as a fulfillment of restorative justice which is the concept of justice that is being achieved in the renewal of criminal law in Indonesia. Therefore , the purpose of this paper is to describe the importance of legal protection for victims of online trading transaction fraud from the perspective of the Information and Electronic Transaction Law, also to describe whether compensation as an additional crime can be determined as an effort to protect victims of fraud through online trading transactions. The research method used in this paper is juridical normative, used a conceptual and statute approach. The results of this study indicate that the Electronic Information and Transaction Law only regulated the principal crimes against the perpetrators of fraudulent acts of online trading transactions and did not explicitly regulate the compensation that should be obtained by victims of fraudulent criminal acts through online buying and selling transactions. The importance of compensation in the form of restutution as an additional crime so that compensation is not only being an option to protect victims but also as the obligation which should be fulfilled by every criminal offender when their crimes had disadvantaged the victims of fraudulent online trading transactions.
