Abstract

In imposing a criminal decision, the judge must really understand whether the decision handed down has reached the target for the purpose of sentencing. The judge's decision is the culmination of a case that is decided and tried by the judge. The criminal system according to positive law, judges have the freedom to determine the severity of the crime to be imposed on the defendant between the general minimum to the special maximum. In 2020, Supreme Court Regulation Number 1 of 2020 concerning Guidelines for Criminalization Articles 2 and 3 of the Law on the Eradication of Corruption Crimes was established, which regulates the range of sentencing based on clarification of punishment covering state losses, aspects of error, aspects of impact, and aspects of the defendant's guilt. Therefore, judges as the spearhead of justice need to accommodate these fundamental values.The purpose of this paper is to examine the decisions of the Jakarta District Court Number 38/Pid.Sus-TPK/2020/PN Jkt.Pst and the Jakarta High Court Number 10/PID.TPK/2021/PT DKI in the decision-making process whether they are in accordance with the principles of justice in decision making. The writing method used in this study uses a normative juridical approach, the primary data needed are the Criminal Code, the Criminal Procedure Code, Law Number 31 of 1999 which has been amended by Law Number 20 of 1999. 2001 concerning Eradication of Criminal Acts of Corruption, Supreme Court Regulation Number 1 of 2020 concerning Guidelines for Criminalizing Article 2 and Article 3 of the Law on the Eradication of Criminal Acts of Corruption, Central Jakarta District Court Decision Number 38/PID.SUS-TPK/2020/PN JKT.PST , and the Decision of the Jakarta High Court Number 10/PID.SUS-TPK/2021/PT DKI, the secondary data needed are textbooks related to judges' considerations in sentencing, research results, works from legal circles, magazines, Newspapers, internet, and others related to the problem to be researched. The entire data was obtained by means of literature study and then analyzed using the theory of justice.Based on the results of this study, it shows that the basis for legal considerations by the judge in the decision of the Pinangki Prosecutor at the District Court is not in accordance with the theory of justice, while at the High Court it cannot be said to be correct. This can be seen in the judges' considerations that have not accommodated the values of certainty, justice and also the benefits of the law itself. Moreover, the High Court did not show the severity of the crime, instead it reduced the sentence. Whereas the suspect's status as a law enforcer or a prosecutor who should not violate a special obligation of office. Therefore, the judge in making his decision must be careful, avoiding as little as possible inaccuracies in every decision making.

Abstract

This study aims to provide an overview of defense cooperation as part of defense diplomacy in order to improve a country's military capability by looking at the considerations, objectives, principles, and scope. The type of research used is explanative research, while the type of data used in this study is secondary data. The data collection technique used in this research is library research by finding and collecting secondary data through scientific books related to the subject matter discussed. In addition, articles from the internet were collected to support the data in completing this research. The data analysis technique used was a qualitative content analysis data analysis technique, namely the author analyzed secondary data, then used theory to explain a phenomenon or event that the author studied. Defense cooperation is an international transaction carried out by two or more countries for a specific purpose, namely the "national interest" of cooperating countries, using a treaty or in writing and formally. This cooperation is very sensitive and will involve state sovereignty, security, stability, and people's welfare.

Abstract

Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Lapangan Kerja disusun dengan menggunakan pendekatan Omnibuslaw. Berbagai masalah konflik agraria yang terjadi di Indonesia adalah penolakan masyarakat dalam aspek lingkungan terkait peristiwa yang terjadi di Desa Wadas, Kecamatan Bener, Kabupaten Purworejo. Tujuan dari makalah ini adalah untuk mengetahui ruang lingkup pengaturan izin dan pembebasan lahan untuk pembangunan Bendungan Benar di Desa Wadas, Kecamatan Bener, Kabupaten Purworejo dan Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja yang mengakibatkan risiko bencana bagi pertambangan di Desa Wadas, Kecamatan Bener, Kabupaten Purworejo. .Metode yang digunakan dalam makalah ini adalah metode penelitian yuridis normatif menggunakan pendekatan hukum, pendekatan konseptual, dan pendekatan kasus.Hasil penulisan menunjukkan bahwa Bendungan Bener sebagai Proyek Strategis Nasional (PSN) ditetapkan melalui Peraturan Presiden Republik Indonesia Nomor 56 Tahun 2018 tentang Percepatan Pelaksanaan Proyek Strategis Nasional (PSN). Keputusan Gubernur Jawa Tengah Nomor 590/41/2018, Nomor 539/29/2020, dan Nomor 590/20/2021 ditetapkan Tentang Persetujuan Penetapan Lokasi Pengadaan Tanah. Peraturan kebijakan perizinan lingkungan hidup untuk kegiatan usaha pertambangan andesit untuk pembangunan Bendungan Bener di Kabupaten Puworejo: 1). Penyederhanaan perizinan: Pasal 1 angka 35 Undang-Undang Nomor 32 Tahun 2009 tentang Perlindungan dan Pengelolaan Lingkungan Hidup diubah menjadi persetujuan lingkungan atas Undang-Undang 11 Tahun 2020 tentang Cipta Kerja. 2). Amdal: UU 11 Tahun 2020 tentang Cipta Lapangan Kerja Pembuatan Amdal sebagai uji kelayakan dan perizinan usaha mengakibatkan peran masyarakat terbatas, seperti peran pemerhati lingkungan dan organisasi lingkungan (LINGKUNGAN). 3) Undang-Undang Kebijakan Pengadaan Tanah Nomor 11 Tahun 2020 tentang Cipta Lapangan Kerja diatur dalam bentuk Peraturan Pemerintah tentang Pelaksanaan Pengadaan Untuk Pembangunan untuk kepentingan umum. Dengan demikian merevisi Undang-Undang Nomor 2 Tahun 2012 tentang Pengadaan Tanah untuk Pembangunan untuk kepentingan umum. Kemudian sentralisasi kewenangan dan kemudahan Proyek Strategis Nasional (PSN) dalam Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja berpotensi berdampak pada peningkatan risiko dan kerentanan. Perizinan dan pembebasan lahan justru menyebabkan penyusutan ruang hidup dan mengundang konflik dan kriminalisasi warga yang mempertahankan ruang hidupnya.Kata kunci: Omnibus Law; Izin; Pembebasan Lahan; Risiko Bencana Kerusakan Lingkungan; Desa Wadas.

Abstract

Feminist Legal Theory, as an analytical framework that focuses on the role of gender in law and policy, has become an important highlight in the context of national development policy. This research aims to investigate the contribution and application of Feminist Legal Theory in research and implementation of national development policies in Indonesia.Using an interdisciplinary approach, this research involves literature analysis, policy case studies, and interviews with relevant stakeholders. This research identifies gender issues in various aspects of national development, including access to education, health, employment and political participation.The research results highlight the role of Feminist Legal Theory in identifying and examining gender stereotypes in law and policy, as well as advocating for the need for policy change to achieve gender equality and social justice. This research also reveals the positive impact of a feminist perspective in changing policy orientation from a masculinity-based approach to an inclusive approach that pays attention to gender differences

Abstract

This article aims to determine the relationship between the central government and the village government in village financial reporting which is reviewed in a normative juridical manner through a statutory approach. Currently, the village government has a heavy burden because in addition to having to provide services directly to the community, it must make village financial reports both to the regional government and the central government. Based on these problems, this article has several formulations including (1) How to regulate the relationship between the central government and village governments in village financial reporting; and (2) How to Model the Relationship between the Central Government and the Village Government in the future in village financial reporting. This article is an article with a normative juridical type with a statutory approach and a conceptual approach. The relationship between the Central Government and the Village Government has occurred directly since the birth of the Village Law, the Village Government has an extra burden because it has to carry out all forms of instructions or rules made by the Central Government, especially in terms of Village Financial Reporting, so that the relationship between the Central Government and the Village Government seems formal and rigid, this can be seen from the various rules and policies from the central government that must be implemented by the village government, especially in the field of village financial reporting. There needs to be an arrangement that places more emphasis on the recognition of the village substantially through empowering the village government, and a simpler village financial reporting system through facilitation with an integrated village financial accountability reporting system.

Abstract

Sexual violence is all acts carried out with the aim of obtaining sexual acts or other actions directed at someone's sexuality of their relationship status with the victim. This paper will formulate forms of victims' rights and efforts that can be made by victims if their rights are not fulfilled as well as legal protection for victims of sexual violence. The formulation of the problem of writing includes the form of rights of victims of sexual violence that often occurs in the university as well as the rights of legal protection for victims of criminal acts of sexual violence based on the TPKS. Permendikbud aims to guarantee protection for victims by guaranteeing the rights of victims. In the end, the existence of this regulation is intended to foster a campus life. TPKS seeks to prevent and recover victims as a fulfillment of the rights of victims of violence. In this case, it aims to prevent all forms of sexual violence, create an environment without sexual violence and ensure the non-recurrence of sexual violence. These regulations ultimately fulfill the rights of victims. Thus, the presence of the Minister of Education and Culture and the TPKS Law are legal protection and legal certainty for victims of violence by involving stakeholders in order to achieve the objectives of handling, protecting and recovering victims. The type of research used in this paper is normative juridical. The results of the discussion are presented descriptively.
