Abstract

Jumal Konstitusi Volume IV No. 2, November 2011 Pusat Pengkajian Konstitusi (Puskasi) Fakultas Hukum universitas Widyagama bekerjasama dengan Sekretariat Jenderal dan Kepaniteraan Mahkamah Konstitusi Republik Indonesia menerbitkan Jurnal Konstitusi dengan mengetengahkan beberapa bahasan seputar hukum konstitusi. Bahasan pertama dibuka oleh Abdul Mukhtie Fadjar yang membedah mengenai Usul Perubahan Kelima UUD 1945: Belaiar dari pengalaman Perubahan UUD 1945 Tahun 1999-2002. Hal ini terkait dengan upaya Dewan Perwakilan Daerah (DPD) menggagas Perubahan Kelima Undang-undang Dasar Negara Republik Indonesia Tahun 1945 (UUD 1945), setelah kegagalan atas gagasan serupa oleh DPD Periode 2004-2009 yang kurang mendapatkan respon positif. Selanjutnya Djoko Imbawani Atmadjaja mengkaji tentang bagaimana membangun hukum untuk kesejahteraan. Bertolak dari upaya hukum mewujudkan negara kesejahteraan, Fatkhurohman menyajikan bahasan tentang demokrasi deliberatif, demokrasi pancasila dan demokrasi konstitusional. Dalam konteks pengakan hukum, Zulkamain mengupas hal-hal terkait hambatan penegakan hukum terhadap pelaku kejahatan korporasi dalam sistem peradilan pidana Indonesia.

Abstract

The Local Representative Assembly (DPD) in the periode of 2009-2014  states to the  public on the proposal of the fifth change of the 1945 Constitution using “a new package”  with  “the consolidation of democracy and  national true identity”. The DPD should learn from experiences of the first up to fourth changes, either procedurally or substantially.

Abstract

The ideal of Indonesian people to establish the Republic of Indonesia is to build a prosperous and just social and state life. In order to reach such an ideal,  any action in contradiction to  morality and humanity, except through right and just regulations,  is not allowed.

Abstract

Corporate crime is an extra ordinary crime that should be fought against with great efforts.  Such efforts, however, are inversely proportional to the policies in the criminal laws serving as a base for their enforcement. This present research would focus on three problems, namely the criminalization of the corporate crime in Indonesia, the system of corporate responsibility adopted, and the concept of the system of corporate responsibility that will be applied. The research results showed that the criminalization in all forms of corporate crimes, according to the positive criminal law in Indonesia, was recognized as crimes. However, the arrangement between one criminal code and the others varies. The system of the criminal responsibility adopted in the positive law in Indonesia tends towards the identification and delegation theories where those who do the mistakes and the source of authorities they possess would be examined. However, comprehensively, the stipulations in one criminal law and the others are different.  In the draft of Indonesia Criminal Code, it is not explicitly stated that the criminal would be condemned, so that it can be interpreted that the criminal should not be responsible for the crime he does since the criminal responsibility has been moved to the corporation.

Abstract

The management of conservation areas in Indonesia is important not due to the fact that Indonesia is  a mega biodiversity country,  to its close relationship with is local cultural diversity. The policy in managing the conservation areas is applied for those where the community, in terms of local wisdom, has applied the conservation values themselves. But it is the community  possesing the local wisdom values that is not protected  or marginalized. Viewed from the analysis of legal substance, there are some aspects that may result in  why any policies on  the management of conservation areas of the natural resources  haven’t given any legal protection  for reservation and the continuation of the functions of the natural resources:   biocentrism of the management of conservation areas, too dominant roles of the government/country, no recognition and protection of access to conservation areas and rights to master and to make use of the natural resources for local people; quasi roles of the people; prerequisite to  regulate the state’s rights. Phylosophically, juridically, and sociologically, local wisdoms posses important (strategic) values as a base for making policies on conservation in an unique way in Indonesia.  In order to reach a policy with a local wisdom-based conservation management , legal regulations accommodating local wisdoms and   bureaucrats  (managers of National Parks) have bravery in positioning themselves to solve any hindrances in formal legality to create substantive justice are needed.

Abstract

The use of the impure negative ‘stelsel’ in the land law system in Indonesia might make the  bureaucratic system and the public service of the National Land Agency not work  well.  The system  shows many weaknesses and ill-structures. And its main weakness is that the government issues some evidence of ownership in the form of certificate  that may function as a formal evidence, where the evidence of land possesion is marked by a land certificate as a absolute  evidence. But the government is not responsible for the validity  of either physical or juridical data in the certificate. Moreover, the government does not regulate how the  National Land Agency should be responsible for issuing the certificate on the rights to the land. The National Land Agency   should be designed to support democratization and the establishment of clean and good governance, namely a government that may grow into a rational, transparent government, and  that possess a competitive attitude among departments in giving services, that support law enforcement and that is willing to  give a public accountability  regularly.  In reality, the bureaucratic system in the National Land Agency is quasi in nature, since it is characterized by suspense and conflicts among various  social structure with various interests based on the operation and exploitation, as a result, the social justice as idealized by the state will not be reached.
