Abstract

Pemilihan umum kepala daerah (pemilukada) yang dilakukan oleh rakyat secara langsung tidak bisa dinafikan telah menawarkan pesona tersendiri. Disamping dianggap telah membuka ruang bagi partisipasi rakyat dalam kehidupan politik formal dan memilih kepala daerah yang dibutuhkan, juga akan menuntut tumbuhnya kepekaan elite politik terhadap isu yang kontekstual dan akuntabilitas atas kinerja kandidat yang terpilih oleh rakyat. Pada saat yang sama harus diakui bahwa pemilu kepala daerah yang dilakukan dengan cara instan dan belum didukung sikap politik masyarakat yang rasional kalkulatif seperti sekarang ini sesungguhnya riskan terjerumus ke dalam situasi yang kontraproduktif. Pelaksanaan pemilu kada di berbagai daerah di satu sisi terbukti berpotensi memicu terjadinya konflik horizontal yang makin terbuka, baik atas dasar perbedaan adeologi, kepentingan, maupun identitas sosial politik yang lain. Di sisi lain, sekalipun tak jarang pemilu kepala daerah yang telah berlangsung dengan sukses, ternyata juga tidak ada jaminan bahwa pemimpin daerah yang terpilih kemudian terbukti mampu mendongkrak kinerja pembangunan secara signifikan. Berdasarkan berbagai implikasi negatif plus alasannya bersifat teknis, pemilu kepala daerah secara langsung yang memakan biaya besar dan tidak efisien telah memunculkan wacana pergantian sistem pemilihan umum kepala daerah langsung dengan memakai sistem tak langsung, seperti pemilihan oleh DPRD (usulan PBNU) atau pengangkatan gubernur oleh presiden (rekomendasi Lemhannas).

Abstract

The realization of the  2004 and 2009 elections of the President and Vice President may be compared in terms of the quality and quantity. Qualitatively, the two elections are characterized by various dishonety  and violations,  although the violations may not yet be  called sistematic, massive and structured  ones. In general the elections may be held peacefully and  safely, with little political tensions. Quantitatively, the 2009 election improved in terms of the number of voters, level of women participation, votes of the elected candidates, and increase in the  presidential threshold. There were, however,  some disputes on the election results in either 2004 or 2009. And the Constitutional Court of Law  administered the case  not only based on the qualitative disputes or the numbers of votes as determined by the General Election Commission (KPU) but also on the qualitative natures concerning with the process.

Abstract

The main objective of this study is to find the implication of the election regional government system. responsibility in regional government system is extremely vital on establishing regional government. It is analyzed from the character and kind of responsibility. The character and kind of responsibility not only has juridical meaning, but also has philosophical meaning in the context of Indonesian philosophy, which is reflected in governmental system of Indonesian Republic Unity State. Constitutional base, variety, maintaining and developing the real governmental principles, and law state basis are the primary pillars in determining the character and kind of responsibility in regional government system.  Responsibility concerning its position in regional government system that keep refer to the system of regional household. Responsibility is vital in establishing the governance is oriented to the principles of regional government establishment that includes general principles of good government and the principle of good governance. Beside that, the responsibility and accountability in the context of state administration and the aspect of public service as well. The principle and system of managing the distribution of regional matters, changes on managing the establishment of regional autonomy, and urgency of the development on the future of nation and Indonesian Republic Unity State.

Abstract

To control money politics occuring in the direct election of  local leaders,  there are four forms of participation the non-governmental organizations  in Malang regency can take, namely:  firstly,   making studies and holding discussions and also coalition to unite various parties  in order to eliminate money politic, so a good gorvernance  is created:  secondly, giving political education to the people in order to build their maturity and awareness on the importance of just general election and good governance;  thirdly,  making direct monitoring on the implementation of  direct election of the local  leader and fourthly,  giving pressure to the local government  and the local house of representative to  create good governance consistently and  seriously.

Abstract

The implementation of the  article 18 verse (4) of the 1945 Constitution, namely the law no 32, 2004 on the Local Government, as changed in the law no.8, 2005 and the law no. 12, 2008,   stipulate that the candidates of the local head and of the vice local head  are elected in a couple through a direct  local head election by the people, instead of by the Local House of Representative. In such elections, it is possible to occur  deceitful practices or criminal acts, as regulated  in the articles of 115-119 of the local government law. Therefore, it is necessary to understand about the existence of formulative policies on the head election as an anticipative step in realizing a democratic and transparent local head election.

Abstract

Theoretically, the problems deal with the attitude of the law enforcers, especially the judges, to take sides in considering the procedural  or substantive justices. The 1945 Constitution or the  legislation on the justice power and on Constitutional Court of Law actually oblige the judges to realize  the substantial justice in law enforcement. The judges  are not the sounders  of the laws, since human beings are never able to make perfect legislation. It is the judges who should interpret the legislations in order to realize the substantial justice.

Abstract

In this local autonomy era, there is merely little information the people may access about the operation of the government through either electronic or printed media which are provided with by local governments. However, important information is still difficult to obtain, as a result, it is thought that  the operation of local governments is not fully transparent and is not yet good governance-based. One of important tools to realize good governance is a public information openness. The momentum of such an openness becomes real when the Parliament  legalized the 2008 Law no 14 on the  Public Information Openness on April 3, 2008. The law comprehensively regulates the  duties of the public officers/bodies in giving an access to information, documents and data  which are integrated as an inherent part of the function of government bureaucracy, reinforced by strict sanctions for those breaking them.

Abstract

Empirically, the journey of the Indonesian government sees the term impeachment. However, its implementation has not been well-structured, since it is merely based on the political power in the Majelis Permusyawaratan Rakyat (MPR), not on the proving mechanisme in the court. This case makes the impeachment of the President Soekarno and Abdurrahman Wahid be bad records for the history of the president impeachment in Indonesia. In the future, such an impeachment attributivelly is under the authority of the Constitutional  Court.
