Abstract

Hukum yang berlandaskan UUD Negara RI Tahun 1945 tidaklah semata-mata diukur kesesuaiannya atau bertentangan tidaknnya dengan bunyi teks pasal-pasal UUD tersebut, melainkan harus dinilai dari nilai atau acuan moral konstitusi tersebut, dalam hal ini konstitusionalisme yang terkandung dalam pembukaan UUD Negara RI Tahun 1945 dan makna yang terkandung atau yang tersembunyi di balik teks pasal-pasal Konstitusi. Agar semua hukum di Indonesia dalam segala bentuk dan manifestasinya berlandaskan UUD Negara RI Tahun 1945, seharusnya semua pengujian hukum perundang-undangan (undang-undang dan peraturan perundang-undangan di bawah undang-undang) menjadi kewenangan MK dan dibuka kemungkinan ada mekanisme “constitutional complain”, dan “constitutional question”, yang sebagai konsekuensinya harus dibuka “kran” untuk perubahan lagi terhadap UUD Negara RI Tahun 1945. Any law which is based on the 1945 Constitution of the Republic of Indonesia is not merely meausured in terms of its suitability with or opposition to  the texts of the articles of the Constitution, but is evaluated from the values or moral reference of the constitution, namely constitutionalism contained in the preamble of the 1945 Constitution dan the meanings explicitly or implicitlay stated in the texts of articles of the Constitution. In order  to make all laws in Indonesia in their all forms and manifestations be based on the 1945 Constitution, all tests for law (laws and regulation under the laws) should be under the authority of the Contitution Court.  It necessary to establish a mechanism for “constitutional complaints” and “constitutional  questions”, as a consequence, a ‘faucet” for making any changes to the 1945 Constitution should also be opened.

Abstract

The decision made by the Constitution Court in a case decision No. 5/PUU-V/2007 abbrogated the Article 56 and 59 of the 2004 Law No. 32 as a basis for allowing an individual candidate to participate in an election of  local heads. From the result of this research, it is found out that the existence of an individual candidates in a election of a local head is in line with the spirit of the 1945 Constitution namely giving an equal opportunity to every citizen to run the government since the condition of political parties that have not yet become conducive instruments to prepare candidates of leaders at all levels of state organization. If a local head is from an individual candidate, no substantial implication is on the effectiveness of the working relationship between  the local head and the Local Parliament in terms of making local regulation, deterining  local budget and  of the function of control of the local parliament. It is also the case of the head and vice head of Garut coming from individual candidates, there is no substantial implication on the effectiveness of working relationship  between the local head and the local parliament of Garut.

Abstract

Ultra petita merupakan prinsip yang harus dihindari oleh seorang hakim dalam memberikan putusan terhadap perkara yang ditanganinya agar putusan yang dibuatnya menjadi legal. Telah lama prinsip ini disepakati untuk perkara-perkara di bidang hukum perdata. Selanjutnya doktrin ultra petita ini juga masuk dalam lingkup semua bentuk penyelesaian perkara. Akan tetapi yang perlu diperhatikan ruang lingkup dari masing-masing lapangan hukum akan membedakan pengertian dan ruang lingkup dari ultra petita. Ultra petita is a principle that should avoided by a judge when s/he is making a decision on a lawsuit to make his/her decision legal.  It has long been agreed with for cases in the field of civil law.  It should be remembered, however, that the scope of each field will differentiate the nature and the range of ulta petita

Abstract

In order to renew law, judges are not merely to be trumpets of laws, but also to make laws through law discovery (rechtsvinding), although they are limited by accountable methods viewed from law science. This makes judges serve as law enforcers and also law reformers.  Therefore, judges should make use of all their abilities to discover laws, by making interpretations (including  constitutional intepretation), commonly  employed such as grammatical, teleological or sociological, systematical or logical, historical, comparative and futuristic interpretations. Besides the law interpretation method, constitutional interpretation method may also be employed, such as textual, original, doctrinal, prudential, structural and ethical interpretation methods

Abstract

Pemilihan umum kepala daerah (pemilukada) yang dilakukan oleh rakyat secara langsung tidak bisa dinafikan telah menawarkan pesona tersendiri. Disamping dianggap telah membuka ruang bagi partisipasi rakyat dalam kehidupan politik formal dan memilih kepala daerah yang dibutuhkan, juga akan menuntut tumbuhnya kepekaan elite politik terhadap isu yang kontekstual dan akuntabilitas atas kinerja kandidat yang terpilih oleh rakyat. Pada saat yang sama harus diakui bahwa pemilu kepala daerah yang dilakukan dengan cara instan dan belum didukung sikap politik masyarakat yang rasional kalkulatif seperti sekarang ini sesungguhnya riskan terjerumus ke dalam situasi yang kontraproduktif. Pelaksanaan pemilu kada di berbagai daerah di satu sisi terbukti berpotensi memicu terjadinya konflik horizontal yang makin terbuka, baik atas dasar perbedaan adeologi, kepentingan, maupun identitas sosial politik yang lain. Di sisi lain, sekalipun tak jarang pemilu kepala daerah yang telah berlangsung dengan sukses, ternyata juga tidak ada jaminan bahwa pemimpin daerah yang terpilih kemudian terbukti mampu mendongkrak kinerja pembangunan secara signifikan. Berdasarkan berbagai implikasi negatif plus alasannya bersifat teknis, pemilu kepala daerah secara langsung yang memakan biaya besar dan tidak efisien telah memunculkan wacana pergantian sistem pemilihan umum kepala daerah langsung dengan memakai sistem tak langsung, seperti pemilihan oleh DPRD (usulan PBNU) atau pengangkatan gubernur oleh presiden (rekomendasi Lemhannas).

Abstract

The realization of the  2004 and 2009 elections of the President and Vice President may be compared in terms of the quality and quantity. Qualitatively, the two elections are characterized by various dishonety  and violations,  although the violations may not yet be  called sistematic, massive and structured  ones. In general the elections may be held peacefully and  safely, with little political tensions. Quantitatively, the 2009 election improved in terms of the number of voters, level of women participation, votes of the elected candidates, and increase in the  presidential threshold. There were, however,  some disputes on the election results in either 2004 or 2009. And the Constitutional Court of Law  administered the case  not only based on the qualitative disputes or the numbers of votes as determined by the General Election Commission (KPU) but also on the qualitative natures concerning with the process.

Abstract

The main objective of this study is to find the implication of the election regional government system. responsibility in regional government system is extremely vital on establishing regional government. It is analyzed from the character and kind of responsibility. The character and kind of responsibility not only has juridical meaning, but also has philosophical meaning in the context of Indonesian philosophy, which is reflected in governmental system of Indonesian Republic Unity State. Constitutional base, variety, maintaining and developing the real governmental principles, and law state basis are the primary pillars in determining the character and kind of responsibility in regional government system.  Responsibility concerning its position in regional government system that keep refer to the system of regional household. Responsibility is vital in establishing the governance is oriented to the principles of regional government establishment that includes general principles of good government and the principle of good governance. Beside that, the responsibility and accountability in the context of state administration and the aspect of public service as well. The principle and system of managing the distribution of regional matters, changes on managing the establishment of regional autonomy, and urgency of the development on the future of nation and Indonesian Republic Unity State.
