Abstract

Legal problems due to cross border insolvency are increasingly complex. The United Nations has issued the 1997 Model Law on Cross border Insolvency (CBI) to help countries solve their CBI problems. However, this model law is not effective because very few countries adopted it. The legal problem studied is why very few countries adopted the model law and how to overcome the ineffectiveness of the model law. The results of the study indicate that the lack of adoption of the model law caused by: the model law is only a non-binding legislative text; Too much flexibility encourages deviations from the provisions; do not want to reduce their sovereignty, status quo, international cooperation recommended by the model law is not always of primary interest, and many countries have been bound by international agreements on regional CBI which are considered more relevant than the model law.  The solutions that can be suggested to overcome the ineffectiveness of the model law on CBI are national bankruptcy laws mechanism; the International Treaties and Conventions mechanism; Rules, Regulations, Principles and Guidelines mechanisms and protocol or adhoc agreements.

Abstract

This study analyses defamation via social media towards Flaurence Saulina Sihombing case. The study raises the elements of contempt in Law Number 11 of 2008 which was converted into Law Number 19 of 2016 con Electronic Information and Transactions (EIT) and compare it with the humiliation under the Criminal Code. The purpose of this study was to determine whether the prosecution on Florence Saulina Sihombing meet the elements of contempt in accordance with the prohibited stipulation under Article 27 paragraph (3) Electronic Information and Transactions Law. This research using normative juridical approach. The source of the data is secondary data source that the data obtained from the literature by studying three legal materials, namely: primary legal materials, secondary legal materials, tertiary legal materials that will be classified and systematized. The conclusion shows that the case Flaurence Saulina Sihombing meet a subjective element in the form of intentionally actions. This actions undertaken by Florence met the element strike action. The object in the form of honour based on Article 27 Law Number 11 of 2008 which was converted into Law Number 19 of 2016 on Electronic Information and Transactions (EIT). The writer tends to confirmly agree with the Yogyakarta District Court via Decision Number 382/Pid.B/2014/PN Yyk of 2015.

Abstract

AbstractThe study aims to obtain a management model (BUMD) of Local government-owned corporate in accordance with good corporate governance, those able to contribute that means both in term of shareholder or in term of stakeholder side. This research is empirical by using Satatute Aproach, Analytical and conceptual Aproach. Data used is primary data and seconadary data with instrument observartion, interview, and questionnaire. Sample is taken by using purposive sampling technique with dependent and independent variables. Data of the research is analyzed by using qualitative and quantitative analyses. Results of the research indicated that synchronization and harmonization of law products vertically and horizontally regulating management of BUMD. Vertical synchronization is conducted according to hierarchy of legislation order pattern and horizontal synchronization is conducted by analyzing about how far legislative rule regulating BUMD has a consistent functional relationship. Alternative models of BUMD management in attempts of realizing good corporate governance consist of two models, namely: The first is concept of BUMD Non-persero management by using “independent self-management’. Local government as authority can execute ‘policy intervention’. The policy intervention is conducted in order to achieve goal of the BUMD Non-persero as a local government owned business with tasks of running social mission, public use, people well-being, and managing natural resource that very important for human life. The policy intervention is conducted by reenacting rule of local government such as rules of goverNomorr/Mayor/Regent that are regulating substantively strategic plan of the BUMD. The second is management of BUMD persero by using holding company with type of ‘Programmed Procedure with combined business groups”. The programmed procedure is selected because local government has diverse types of business..AbstrakPenelitian ini bertujuan untuk memperoleh sebuah model pengelolaan Badan Usaha Milik Daerah sesuai dengan prinsip-prinsip tata kelola perusahaan yang baik (good corporate governance). sehingga mampu memberikan konstribusi yang berati baik dari sisi shareholder maupun dari sisi stakeholder. Penelitian ini merupakan penelitian empiris dengan menggunakan pendekatan perundang-undangan, (Satatute Aproach), pendekatan konseptual (Analytical and conceptual Aproach). Data yang digunakan berupa data primer dan data sekunder yang diperoleh dengan menggunakan insntrumen observasi, wawancara dan kuisioner. Penarikan sampel dilakukan dengan cara purposive sampling dengan variable bebas dan terikat. Analisis data dilakukan dengan analisa kualitatif dan kuiantitatif. Hasil penelitian menunjukan perlunya dilakukan sinkronisasi dan harmonisasi produk hukum secara vertikal dari produk hukum dan horizontal yang mengatur tentang pengelolaan BUMD. Sinkronisasi secara vertikal dilakukan menurut hirarki tata urutan perundang-undangan dan sinkronisasi secara horizontal dilakukan dengan cara melakukan analisis seberapa jauh peraturan perundang–undangan yang mengatur tentang BUMD mempunyai hubungan fungsional secara konsisten. Alternatif model pengelolaan BUMD dalam rangka mewujudkan Good Corporate Governance dapat dilakukan dengan dua model yaitu : Konsep pengelolaan BUMD Non Persero dengan menggunakan swakelola mandiri. Kewenangan Pemerintah Daerah selaku pemegang otoritas dapat melakukan intervensi kebijakan, dengan menerbitkan peraturan kepala daerah baik peraturan Gubenur/Walikota/bupati yang secara subtansi mengatur tentang rencana strategis BUMD tersebut. Konsep pengelolaan BUMD persero dengan menggunakan model holding company dengan tipe prosedur terprogram dengan group usaha kombinasi. Dipilihnya model holding company dengan tipe prosedur terprogram karena tipe atau karakter jenis usaha yang ada di pemerintah daerah beragam.Kata kunci : Model Pengelolaan BUMD, Good Corporate Governance

Abstract

The issue of the article is "What are the implications of village institutional governance for village governance institutional governance?". The legis ratio of Law Number 6 of 2014 states in Article 18 B paragraph (2) of the 1945 Constitution of the Republic of Indonesia, while the subject matters prescribed includes two main material types of different villages. This study uses a normative legal research method with a prescriptive conceptual approach and statute approach. The theoretical basis used is the rule of law, the theory of legislation, the concept of local government,;the concept of authority, and the concept of M-P-F-A-A-C. The results showed that the village government regulated by Law Number 6 of 2014 is not an autonomous village but an independent village, not a customary law community unit and not a formal government. While the implications for governance in the Meaning aspect, happened to shift in the meaning of village government institutions from time to time; in the Positioning, the institutional status of village government as state-corporatism is a deviation in the administrative logic of local government; in the Functioning, the imposition of technocratic local government institutional function work is unrealistic to the institutional function of a self-governing community; in the Authorizing, authority over the principle of Recognition and Subsidiarity that is apparent from the government is outside the principle of decentralization; in the Actuating, the work apparatus of the village is not solid yet, showing poor regulation which also technocratic in Government Regulation Number 43 of 2014 Jo. Government Regulation Number 47 of 2015; in the Controlling, construction of checks & balances carried out by Village Council (BPD) are still ineffective due to weak apparatus competence and low community participation in the policy making process. In conclusion, Law Number 6 of 2014 has a 'contra-productive' implication for village governance institutional governance, therefore Law Number 6 of 2014 needs to be reformulated

Abstract

Efforts to resolve human rights violations in Indonesia have been failed. It raises the question of the cause of the failure and the solution that must be taken to overcome it. The factors causing the failure of the settlement of human rights violations: (1) weak substance of legislation, especially Law number 26 Of 2000 on the Human Rights Court; (2) issues of authority and institutional relationships that are not synergistic especially between Komnas HAM and the Attorney General; (3) weak political will from the Government. The solution offered in overcoming the failure of the completion of human rights violations: (1) improve the substantial weaknesses in Law number 26 Of 2000 on the Human Rights Court by replacing it through the establishment of a new Act on Human Rights Court; (2) to organize institutional relations between Komnas HAM and the Attorney General in order to be synergistic in handling cases of human rights violations; (3) to re-establish the Truth and Reconciliation Commission (KKR); (4) The ruling government must have strong political will to resolve various cases of human rights violations with the support of civil society groups.

Abstract

AbstractThe purpose of this research is to explain the concept of law of consumer finance in the future, that consumer finance is characterized by Indonesia. The method used is normative legal research (legal research), with the approach of the statute and philosophy. Legal materials used in the study include legal primary, secondary and tertiary and supported with interviews. Legal material is then analyzed in such a way and poured in the form of a diskriptif analysis. The results of this research provide consumer finance law concept bids forward, namely consumer finance are characterized by Indonesia, which are based on religious, humanitarian, nationality, democracy and social justice. Consumer finance law characterized by  an  Indonesia  that  regulates  the  equivalence of  the  position  of  consumer  finance  companies  and consumers, legal protection for consumer finance companies as well as consumers, as well as paying attention to process contracts, and dispute resolution with the approach of the conscience, in the form of regulation-level legislation, with the hope of better guarantee legal certainty.Key words: Legal concept, consumer Finance, Future.AbstrakTujuan penelitian ini ialah untuk memamaparkan tentang konsep hukum pembiayaan konsumen di masa yang akan datang, yaitu pembiayaan konsumen yang bercirikan Indonesia. Metode yang digunakan ialah metode penelitian hukum normatif (legal research), dengan pendekatan undang-undang (statute approach) dan pendekatan filsafat (philosophy approach). Bahan hukum yang dipergunakan dalam penelitian ini meliputi bahan hukum primer, sekunder dan tersier dan ditunjang dengan wawancara. Bahan hukum kemudian dianalisis sedemikian rupa dan dituangkan dalam bentuk tulisan secara diskriptif analisis. Hasil penelitian ini memberikan tawaran konsep hukum pembiayaan konsumen ke depan, yaitu pembiayaan konsumen yang bercirikan Indonesia, yaitu berdasarkan religius, kemanusiaan, kebangsaan, demokrasi dan keadilan sosial. Hukum pembiayaan konsumen yang bercirikan Indonesia yang mengatur kesetaraan kedudukan perusahaan pembiayaan konsumen dan konsumen, perlindungan hukum bagi perusahaan pembiayaan konsumen maupun konsumen,  serta memperhatikan proses kontrak, dan penyelesaian sengketa dengan pendekatan nurani, dalam bentuk peraturan setingkat undang-undang, dengan harapan lebih memberikan jaminan kepastian hukum.Kata kunci: Konsep Hukum, Pembiayaan Konsumen, Masa depan.

Abstract

AbstractHistorically, domestic workers has been around a long time. Their domestically roles made them often underestimated. However, the legal protection they are still very concerned, even until now Indonesia has no law regarding the protection of domestic workers, because domestic workers act of Indonesia has not been enacted. Whereas legal protection to domestic workers is urgent considering the number of cases of abuse and violence against domestic workers, particularly female domestic workers, without any handling or legal process well. Therefore, the authors are interested in examining how the application of the theory of gender equality and inquity for domestic workers act.This research results: Firstly, the bill is needed to protect of domestic workers. Secondly, A worker of either sex is the same as other workers must be paid a fair wage and good treatment as a dignified human being. Thirdly, The aim of this act should be the process of formalizing the PRT even though the workings area of domestic workers are in domestic area. AbstrakSecara historis, pekerja rumah tangga telah ada sejak lama. Peran mereka di dalam ranah domestik membuat mereka sering diremehkan. Namun, perlindungan hukum mereka masih sangat kurang, bahkan sampai sekarang Indonesia tidak memiliki Undang-undang perlindungan pekerja rumah tangga. Perlindungan hukum bagi pekerja rumah tangga sangat mendesak keberadaannya mengingat jumlah kasus pelecehan dan kekerasan terhadap pekerja rumah tangga, terutama PRT perempuan, semakin bertambah. Oleh karena itu, penulis tertarik untuk meneliti bagaimana penerapan teori kesetaraan dan keadilan gender bagi pekerja rumah tangga.Hasil penelitian menunjukkan bahwa: Pertama, Indonesia sangat memerlukan UU untuk melindungi atau pekerja rumah tangga, sehingga RUU PRT mendesak untuk segera diundangkan. Kedua, Seorang pekerja baik perempuan maupun laki-laki mempunyai kedudukan yang sama, sehingga harus mendapatkanhak- haknya dengan baik sebagai manusia yang bermartabat. Ketiga, harus ada Formalisasi PRT walaupun kerja bidang pekerja rumah tangga berada di wilayah domestik tetapi hak-haknya sebagai pekerja harus diakui dan disamakan dengan pekerja di wilayah publik.

Abstract

Surrogate Mother is a method used by infertility couples to have offspring who still have a genetic relationship. This method is usually carried out by married couples who cannot have offspring through the IVF method. The implementation of Surrogate Mother is generally based on agreement. This agreement is an agreement that grows and develops in the community so that it is not yet known in the Penal Code. So this agreement is included in the new innominaat agreement. In Indonesia, until now there has been no legal umbrella related to Surrogate Mother. The existence of this agreement is inseparable from the principle of freedom of contract which gives freedom for everyone to make any agreement and with anyone. With the Surrogate Mother agreement, the right to continue descendants which are human rights (civil and political rights) which cannot be reduced under any circumstances can be fulfilled. In the implementation of Surrogate Mother, we also pay attention to certain restrictions as regulated in IVF regulation, including those conducted by a legitimate married couple and in a state of infertility. Therefore, the type of Surrogate Mother that can be done is Gestational Surrogate or Intrafamillie Surrogate by implanting the results of fertilization of a legitimate husband and wife into the womb of a Surrogate Mother.

Abstract

AbstractThe aim of this research is to explore the influence of the competence and commitment of an investigators or an assistant investigator in the investigation process. The result shows that both of competence and commitment of an investigator or an assistant investigator have a significant relationship with the settlement of complaints. Competence has a strong enough influence with the resolution of complaints while the family has committed a weak influence on the family settlement of complaints/victims. Research findings indicate that the resolution of victim complaints will be good if the competence and commitment of investigators increased.

Abstract

AbstractMutation arrangement of functional official to occupy structural position did not arrange specifically in legal authority, but by applying law no 5 years 2014 about apparatus civil of country so in region refer to article 68 paragraph 4 that goverment employee can move inter and between high leadership position, administration position, and functional position in central institute and regional based on qualification, competency, and job scorring. Research result shown that arrangememnt, procedure, and mekanism of mutation to funtional official to occupy structural position which done in region is by corporation of position judgment and promotion that has duty to give judgment to region head but didn’t give full care of qualification, competency, and assessment of goverment employee’s job so didn’t create the principle of appointment.                                                                                                                                                                                 AbstrakPengaturan mutasi pejabat fungsional untuk menduduki jabatan struktural belum diatur secara khusus dalam ketentuan perundang-undangan, namun dengan berlakunya Undang-undang Nomor 5 Tahun 2014 tentang Aparatur Sipil Negara, maka di daerah mengacu pada Pasal 68 ayat ( 4 ) bahwa PNS dapat berpindah antar dan antara Jabatan Pimpinan Tinggi, Jabatan Administrasi, dan Jabatan Fungsional di Instansi Pusat dan Daerah berdasarkan kualifikasi, kompetensi, dan penilaian kinerja. Hasil penelitian menunjukan bahwa prosedur dan mekanisme mutasi pejabat fungsional untuk menduduki jabatan struktural yang dilakukan di daerah adalah melalui Badan Pertimbangan Jabatan dan Kepangkatan atau Baperjakat yang tugasnya memberikan pertimbangan kepada Kepala daerah namun tidak sepenuhnya memperhatikan kulifikasi, kompetensi dan penilaian kinerja Pegawai Negeri Sipil sehingga belum terciptanya asas penempatan.
