Abstract

Following the commencement of democratic and decentralized era in Indonesia, both political and socio-economic climate has tented to be more dynamic in the grassroots level. ‘Change’ is the most prominent term found in local politics, covering three fundamental aspects, i.e. political, public administration, and constitutional law. Such changes bring about the conscience to recognize their implication and the needs to readjust the current system in line with the spirit of reform. This paper analyses five essential issues faced by local government and local people, i.e. direct election of Local Government Head, institutional arrangement, development planning system and documents, evaluation of inappropriate regional regulations, and perplexing issue on legal hierarchy. It also provides some recommendations could be taken in dealing with those issues.

Abstract

The enactment of Law No. 33 and 34 (2004) may only achieve decentralization’s purposes if accompanied by suitable preparation from local government agencies. In this case, financial independency can be fortified by optimizing potential resources, particularly self-local revenues (pendapatan asli daerah) such as local taxes and levies. Effort to improve financial capacity, however, should also deeply consider its impacts on investment and people’s purchasing power. This paper tries to elaborate the strategy of Barjarmasin City Government in strengthening its financial capacity.

Abstract

The north side of East Kalimantan Province is characterized by harsh bordering areas, both land and sea. There are 386 islands in East Kalimantan territory; and 138 of those are unanimous. Such condition requires suitable policy to manage and optimize natural resources as well as to accelerate socio economic development and people’s prosperity. It also aims at protecting environmental quality and preventing from alien’s threat and intervention. This paper elucidates the implementation of East Kalimantan Provincial Government’s territorial policy based on the strategic study (SWOT Analysis). It also explicates the principles and procedures of giving names to unanimous islands.

Abstract

The issue on the development of border areas is becoming much more significant in the current decade. Tension between Indonesia and Malaysia on the Ambalat block reminds Central and Provincial Government on the importance of border areas in terms of political (i.e. sovereignty) and economic (i.e. prosperity) development. As a result, the preceding paradigm treating border-areas as ‘backyard’ of the country has been noticeably altered. In order to realize the new paradigm, (border-areas as ‘front yard’), policy readjustments are truly required. In that purpose, this paper tries to explore potential strategies of developing border-areas, particularly through authority and institutional rearrangements as well as action plan implementation.

Abstract

Since the last two months, two extraordinary issues in home country have shaken the political world. Alas, both issues concerns the most-hated moral patoplogy: corruption! The first issue relates to the case of bribery by an eminent member of General Election Comission (KPU), and the second is the case of corruption indication by the Chief Director of Bank Mandiri. The new lesson of both cases is hopefully that our government has entered a new era of corruption abolition: enforcing law and order fairly to any citizens without considering their status. A condition that hardly happened during the previous governments! Such high spirit of abolishing corruption seems triggered by the President Yudoyono’s commitment to make 2005 as the Year of Corruption Abolition. The commitment was then strengthened by the launching of several steps on abolsihing corruption last month, following the Presidential Instruction Number No. 5/2004 on the Alleviation of Corruption Abolition.

Abstract

The enactment of new decentralization framework has been unwisely implemented in many regions. Districts/city governments tend to promulgate new local taxes and levies result in high cost economy for regional business activities. The principle of delivering administrative approval (perijinan) is also misgiving as it is deployed for all people’s economic facets. Philosophically, not everysingle economic activity requires such kind of permission. This situation leads to the deprivation of public service quality. In order to restore government performance in delivering public services, this paper tries to offer a solution from the perspective of constitutional / public administration law (hukum administrasi negara), i.e. providing new mechanism of administratief beroep or administrative legal efforts (upaya hukum secara administratif).

Abstract

During New Order epoch, Indonesia’s governmental system was very centralized. Consequently, local governments’ dependency on central government budget and policies is remarkably apparent. The genesis of 1999 extended-decentralization framework aims not only to reduce the fiscal dependency, but also to alter the development paradigm from growth-oriented to distribution and equity-oriented strategies. In other words, the purpose of regional autonomy is actually to strengthen the economic basis of local development. In order to attain such idea, this paper highlights the importance to reform the existing budgeting system and cycles.

Abstract

The position of sub-district government in the decentralization era has been essentially altered. Previously it was central government’s agents in charge of deconcentration functions. Since the ‘big bang’ decentralization of 1999, however, it was incorporated to be a part of local government’s bodies. The new pattern of sub-district, certainly, will lead to the needs to rearrange its organizational design and authority. Unfortunately, there is insufficient regulation from central government providing comprehensive guidance and methods on how to revitalize the role, structure and authority of sub-district government. Considering the situation, this paper proposes some alternative options which might be well implemented for creating new configuration of sub-district government.

Abstract

The global issue on environmental degradation is becoming solemn concern among national and local governments. One of strategies in overcoming environmental problems, particularly in the shielding / caring areas (kawasan lindung), is to promote special institution in charge of composing plan, implementing programs, controlling and evaluating performance, as well as building strategic alliances among stakeholders to protect and improve the quality of shielding areas. This paper tries to analyze the probability of making new institutions based on “collaborative management” principles. In brief, it offers two models of such institution, namely, upstream – downstream solidarity; and central – regional solidarity.

Abstract

Dispute between Central and Local Government on seaport management tends to be more frequent since the implementation of regional autonomy laws of 1999. The focal point of such conflict rests on how to evenly distribute the power and authority of seaport management among different level of government. From the perspective of public administration, this situation will lead not only to the fading of seaport services, it also leads to the creation of unconducive economic atmosphere in the whole country. Learning from Canada’s experience, this paper offers legal interpretation and possible actions to solve either existing or prospective conflicts.
