Abstract

This paper will discuss how the Qanun Jinayah differentiate the concept of private and public space in the implementation of sharia in Aceh. This paper will particularly discuss how private and public space being defined in the Qanun and how broad the scope of this Qanun is. This paper finds that there is no private space in Qanun Jinayah. There are only two conditions that listed in Qanun Jinayah, first, when at the work place, second evidence by the family card. A person who committed to criminal Act (Jarimah) in private and public space, he or she will be punished by Qanun Jinayah. Because of that Government in this case Wilyatul Hisbah and investigator has right to enter a person’s private space if that person is suspected to Jarimah crime. This paper sees that the authority has changed to violate the human right.

Abstract

This research was conducted to search the meaning of traditional Islamic boarding schools in Seberang Kota Jambi as an existence legacy of religious traditional institutions in Jambi Malay modern world. The boarding school were slow adapt the modern developments and considered as an educational institution “conservative” who only teach “sky” science by forgetting his footing on the earth. The author tries to conduct a research to determine how the response of a salafiyah Islamic boarding school named al-Mubarok al-Islam toward social change, and how its success. Through a field research and descriptive qualitative method, data were collected through observation, interviews and documentation. The results of research include: First, al-Mubarok al-Islam salafiyah Islamic boarding schools has been growing and has a formal structure that can accommodate all aspects of the pesantren. Second, al-Mubarok al-Islam salafiyah Islamic boarding schools began to provide an opportunity for its students to be able to follow modern world by facilitating them in the national exam and have a certificate in general that can be used in the workplace in general. Third, al-Mubarok al-Islam salafiyah Islamic boarding schools provides the opportunity for students to be able to learn information communication technology nowadays.

Abstract

This article aims to study and analyze the Islamic spiritual sides of the deconstruction in Kanjeng Ratu Kidul belief from the perspective of Kiai Ibnu Hajar. Kanjeng Ratu Kidul is a very popular myth among people in the southern part of Java Island. Most of them hold annual ceremonies as a way to express their request for having the blessing and being avoided from disasters. The data of this research were collected through in-depth interviews and participatory observations. Derrida’s deconstruction theory was applied to analyze the spirituality aspects. There are three deconstruction processes: (1) logocentric identification; (2) internal contradiction return; (3) difference or building new construction. This research found that Kiai Ibnu Hajar’s deconstruction spirituality was performed in three stages: (1) visual identification stage, which is done through eliciting the discourse of Kanjeng Ratu Kidul by her pictures or photos; (2) returning stage, which is done through mind-verbal activities, i.e. by understanding the nature and existence of human being through religious teachings and informal chats; (3) building new concept, which is actualized through the use of new terms among the members of Jamaah Aolia Panggang Mosque.

Abstract

One of the problems that often arise after the divorce is the ownership of assets acquired during marriage, whether it belongs to the husband, wife, or both of them. According to the Compilation of Islamic Law or the fiqh of the results of ijtihad fuqaha Nusantara, the assets obtained in marriage, except those obtained through inheritance or grants from parents/family, are joint property of husband and wife (gono gini). One party may not use it except getting agreement from the other parties. And if marriage breaks, either because of divorce or death, then it must be divided into two. In the books of Arabic Fiqh, there is no joint property because marriage does not cause a mixture of wealth. Nonetheless, in the books of fiqh provides the possession of wife's assets, such as dowry, livelihood, mut'ah, iwadl and tirkah. If the provision of fiqh is carried out consistently, then when a divorce occurs, the husband must leave the house, because all the property has become the property of his wife through a way of life. But this is certainly not fair. Therefore the determination of the existence of joint property in marriage is a moderate opinion and a benefit.

Abstract

Religious conflict is not only a matter of religion, but also a matter of human life who wants peace in life. By understanding the Islamic strategy in building peace in Indonesia, we can find conflict resolution that must be developed in life. This study argues that conflict and Islam’s strategy in building peace is a study of conflict resolution in overcoming violence and truth claims in religion. Thus, this study formulates the question of how religious conflict and Islamic strategies of peace building in Indonesia are? This study uses the library research to find sources of conflict and Islamic strategies in building peace in Indonesia. The results of this study indicate that conflict and Islamic strategies in building peace provide an overview: (1) the conflict has become a public debate about truth claims and religious violence; (2) religious culture and moderation are the strategy of Islam in building peace in Indonesia. The findings of this study indicate that conflict and Islamic strategies in building peace as conflict resolution exist in Indonesia.

Abstract

This article aims to analyze Ab Hasan al-Nadwī’s thoughts on tazkiyah al-nafs. Then, the character values in tazkiyah al-nafs are integrated into the concept of character formulated by the Ministry of Education.The concept of character by the Ministry of Education has a clear nationalism vision but has no technical direction. Then it can be filled with tazkiyah al-nafs by Abū Hasan al-Nadwī who has technical directions. The integration of the concept of character by the Ministry of Education and tazkiyah al-nafs by Abū Hasan al-Nadwī is useful for producing a character concept that has technical direction and has a nationalism vision. The research method used is integration-interconnection. Eighteen character values by the Ministry of Education are filled with tazkiyah al-nafs by Abū Hasan al-Nadwī which includes fiqh dhahir and fiqh bathin. The research findings produce tazkiyah al-nafs which includes shalat, fasting, zakat, sunnah worship, ‘ibadah bathin integrative with eighteen character concepts which include religious, honest, tolerant, discipline, active, creative, independent, democratic, curios, nationalist, patriotic, appreciative, friendship, peaceful, literative, environmentalist, humanist, and responsibilities.

Abstract

The characteristics of fiqh with its local wisdom in the Pengajian Pitulasan are based on the charismatic authority approach of Sunan and Kiai figures who gave a philosophical view named Gusjigang. Gusjigang is a dialectic reflection between fiqh and local wisdom in Kudus city. This philosophy is applied in daily life which leads to being a completely human character. The form of responsiveness fiqh found in the Pengajian Pitulasan Yayasan Menara Kudus is to use the method and approach of qauli by involving dialogical elements that reflect the public mind even though it is still at a small level. This research is a type of field research based on literature review as know as library research with the documentary-historical method. The data also shows that the form of fiqh responsiveness in the Pengajian Pitulasan has absorbed various dimensions of life such as the economic, social, health, and other fields. Among the forms of fiqh that represent the dialectic between fiqh and its local wisdom in the Pengajian Pitulasan are: the role of the Kiai is clearly seem in preserving the local culture of Pengajian Pitulasan Yayasan Menara Kudus and avoiding sacrifices with the cow for the Kudus Kulon community.

Abstract

This paper describes the thoughts of Nasr Hamid Abu Zaid on the theory of Al-Qur’an interpretation, with a descriptive-analytic analysis. The data were collected from various sources from Nasr’s writings, books, and journals that wrote about Nasr and his thoughts, as well as other sources that had relevance for analysis purposes. Abu Zaid tries to reveal the meaning and significance (magza) which then brings out the meaning of “the ineffable”. In this case, the meaning is represented by the text or in the sense that it lets the text speak about itself. Then, from that meaning, there is a dialogue with the conditions or contexts that surround a reader. Therefore, the meaning is static because it contains historical meaning, and the significance is dynamic in accordance with the horizon of each reader.
