Abstract

Critical studies of hadîth do not always aim at arguing against the legitimacy of hadîth as one of the sources of Islamic Law. Nor do it doubt –like many orientalist would do- the authenticity of the hadîth as a source of Islamic teaching. Critical studies of hadîth are about investigating the accuracy and validity of the narration chain. Considering that many hadîths take a long period of time before they are being narrated, inaccuracy might have taken place in that process. Therefore a critique is needed. In the context of contemporary life, a critique is even more needed especially that which looks at hadîth in terms of its relation with modern science, technology, gender issues, human rights, freedom of expression, and so on. This paper discusses the notion of the critical studies of hadîth in contemporary life by focusing on four issues (1) the cognitive foundation of the studies, (2) the objects of the critique, (3) the necessity of the critique, and (4) the normative standards of the critique.

Abstract

This paper basically argues that the many social problems that we are now faced are in fact product of the system of our religious education. The educational system of our Madrasas has not thus far shown its ability to address the spiritual needs of our students. This resulted in students absorbing the physical and at best the intellectual dimension of education by ignoring the moral and behavioral aspects of it. On this ground –the paper argues- the system of our religious education must be revisited and reevaluated. Such system must not only indoctrinate students to learn about heaven, hell, what is lawful and lawful, belief and infidelity and the like, but must also teach them about tolerance, understanding and other social values. Our religious education must teach students conceptual knowledge but also educate them about how to respect others and live in a plural society. It is about these that this paper is concerned with. It is about the scheme of religious education for pluralism or multiculturalism.

Abstract

Many High Schools (Aliyah) in Indonesia are faced with one of the following problems: low operational expenditure, poor human resources, unsettled contract with the teachers, small number of the teachers, and poor facilities. This paper tries to speak of the practical ways to come to terms with such problems. These practical ways -some of which are related to money- are in fact ideals. These ideals in one way or another are the foundations for the practical problems that our schools face. By ideals we mean such values as determination, discipline, and right vision for the school. The paper argues that money is not a magic stick that may solve all problems. he key is that all elements of school must use the best they have to realize the best they want to achieve. Practical problems may be solved by ideals, obsessions and dreams. In a country where money is rare, the vision and orientation of our education should change the character of the educated from being money-oriented to ideals-oriented.

Abstract

This study focuses on Hasyim Asy’ari’s religious thinking. It particularly examines three key issues, Hasyim’s responses to religious dynamics in the early twentieth century, the correlation between his ideas and the religious tradition or thinking of the ulama’ in the medieval period, and the extent to which he presented the originality, trend, and uniqueness of his ideas on the discourse of Ahl al-Sunnah wa al-Jamâ‘ah. Basing its analysis on the historical understanding of religion and philosophy, the study also makes use of hermeneutics, and seeks to grasp the deep meaning of the text by considering carefully its horizons. The findings of this study imply that Hasyim crafted a new concept of Sunnism, which can be particularly called “particular Sunnism”. By this we mean a discursive understanding of the concept of Ahl al-Sunnah wa al-Jamâ‘ah according to the context of locality, the religious dynamics that shape it as well as the existing interpretation on it that has been taken by the likes of the modernists and traditionalists in Indonesia in the early twentieth century.

Abstract

This paper examines the notion of state and leadership according to the contemporary Islamic thought. To be more precise, the paper asks whether it is possible for a non-Muslim to be the president of the majority Muslim country. To answer this, the paper will dwell into the problem of citizenship both in classical and modern Islamic thought by taking into account the political and social situation that shapes this thought. The paper maintains that many Muslims—both in the past and at the present—fail to offer a proper discourse on statehood and leadership in Islamic perspective. The mainstream discourse on this issue—the paper argues—is that which keeps in a good balance the notion of religiosity and citizenship. The rightwing Muslims will provide a textual understanding of the problem, while the left-wing will otherwise offer a secular interpretation of it. This paper will try to keep the two in a balance, and present a fair understanding of what the Quran and the Sunnah say about the problem at hand.

Abstract

The subject of this paper is the orthodox nature of KH Shalih Darat’s Sufism. He is an Indonesian Muslim thinker of the 19th century. The paper argues that the man is behind the dissemination of not only Islam but also of Sufism on the Javanese island. Despite his high standing knowledge and piety however, the man is not yet known especially in the academic circle in Indonesia. It is this reason that the paper is interested in exploring his ideas and intellectual biography. The paper tries to show that Muslim community during his lifetime was polarized into the elites and the laymen. K.H. Shalih Darat targeted the latter while not forgetting the former. But the most striking question would be how does his orthodox religiosity fit into the laymen and work for the elites? The paper will try to answer this question by emphasizing first that for the man, orthodoxy is a must for people of the Javanese outlook. And second, it will try show that while orthodoxy and heterodoxy are always at odds with one another, the tension between the two does bring a good implication for the course of dakwah on the island.

Abstract

The main problem that this paper is interested in dealing with is the notion of taqlid, the English translation of which being a blind acceptance. Taqlid is the opposite of Ijtihad, the intellectual exercise to draw certain legal rules from their sources. Muslims over centuries believed that taqlid in legal matters is not allowed, and that the door of Ijtihad has never been closed, as some Western scholars would emphatically argue. The paper nonetheless maintains that taqlid does take place in a major part of Islamic legal history. It has become unavoidable for Muslims to accept blindly –due to some reasons- the legal views of the earlier scholars and jurists. But the paper also argues that to accept without question the views of the authoritative scholars in legal matters is not always bad. The paper tries to show that there are –due to some conditions- positive things in committing Taqlid. To show this, the paper would attempt to scrutinize the historical facts in which Muslims do benefit from doing Taqlid. It means also that, Ijtihad is not always good for Muslims. By presenting some findings -the paper will argue- that in some cases, Muslims should abandon independent intellectual exercise and resort to blind acceptance if in doing so would bring benefit for them.

Abstract

Theories of Islamic economics have formed part and parcel of the global study on economy. Practically on the other hand, Islamic economics have shown its competing ability andreceived in turn a cheerful welcome from the business community as well as from the masses at the global stage. This paper is an attempt to make a contribution in the field of what we may call the scientific construction of Islamic economics. The paper proposes that this science consists of two aspects, namely value and knowledge. With regards to the latter, on which this paper will pay its major attention, the role of methodology is crucial. This paper will therefore touch on this issue and the role of methodology in inventing knowledge and in the analysis of economic datum. Here by methodology we mean particularly fiqh. We contend that fiqh is in itself methodology. It is rich with methodological tools such as the concept of maqashid al-syariah (the purpose of divine law) which may be used not only to analyze economic datum but also to provide a schemata in resolving some economic problems. By speaking of fiqh as a science of economics we hope to pave the way for the possible invention of the science of economics based on fiqh and its philosophy.

Abstract

Al-Shatibi is known in the history of Islam as a prioner in the theory of Syari’ah. He wrote al-Muwafaqat, his magnum opus. This paper deals with this historic figure by referring to his theory concerning rukhsah; an exemption given to Muslim in performing the rites for certain and acceptable reason. The paper will look at this concept by considering the background in which it is propounded. We believe that his theory is not conceptualised out of the blue. Two key words will be used to embark on this task, namely ‘adamu al-Haraj and (tatbîq). The former is about the removing the difficulty from man, and the latter is about the application of the Syari’ah in the live of individual. By using the first concept, the paper will try to reconstruct the fact that in propounding his theory of rukhsan, al-Syatibi always keeps in mind the fact that Islam is revealed mainly to make life easy, and not vice versa. By using the second concept in the meantime, we try to show that the Syari’ah laws—rukhsah included—are revealed to apply (the application Syari’ah is not always in political context).

Abstract

This paper is aimed at describing the history and the social dynamics of the reformist and traditionalist fiqh in Indonesia. It first tries to show that since the 13th century Islam in Indonesia has largely been Sufi-oriented. It was only fairly recently that Islam in this country came into contact with figh especially after the return of Indonesian students from the Middle East toward the end of the 19th century. The puritan and reformist movements that prevailed in the Middle East at the time especially those under the patronage of Muhammad Abdul Wahhab and Jamaluddin al-Afghani inspired Muslims of this country to launch a similar reform in Indonesia. This reform movement received a somewhat strong opposition from the traditionalists since the beginning of the 20th century, hence the tension between the two currents of thought. This paper pays particular attention to this dynamic tension in the context of the contemporary historical and legal development in Indonesia.
