Abstract

This study aimed at exploring the concept and the typology of ijtihād according to Muḥammad Sayyid Ṭanṭāwī. The concept was descriptively expressed while analyzing it using content analysis techniques with a comparative approach. Meanwhile, in scrutinizing the biography and ideas of Ṭanṭāwī, this study utilizes inductive methods and a socio-historical approach to look at his social and political circumstances that the interaction of a mujtahid with his socio-cultural or socio-political environments. The results of the study showed that ijtihād according to Ṭanṭāwī, is an outpouring of the maximum ability of a mujtahid to arrive at the sharī‘ah law by means of istinbāṭ of the sharī‘ah propositions. The area of ​​ijtihād according to Ṭanṭāwī is on the ẓanniyyāt al-thubūt texts such as the Ḥadīth which is a lot of discussion of the Ḥadīth experts about its sanad, validity, weakness and so forth, or ẓanniyyāt al-dilālah, such as the Ḥadīth or the Qur’ān which includes more than one meaning based on the meaning of lughawī or fairness of sharī‘ah. In addition, the Ṭanṭāwī’s typology of ijtihād covers the moderate and middle ground group that pay much attention to maqāṣid sharī‘ah, naṣṣ, and human interests as long as it does not conflict with naṣṣ.

Abstract

This article examines the integration-intercon-nection of sciences in Tārīkh al-Rusul wa al-Mulūk. It argues that the integration-interconnection has been an integral part of early Islamic historiographical works. Hence there were no historical problems related to the integration-interconnection in the treasures of Islamic sciences. This research employs the integration-inter-connection and the functional theory as a conceptual framework. This research also uses the historical method, comprising heuristic, data verification, interpretation, and historiography. To further examine the issues, it also employs the intertextual approach. The results of this study showed that the integration interconnection in Tārīkh al-Ṭabarī is correlated to scientific and metho-dological aspects. The scientific element referred to here is the coherence and interrelation among the subjects of history, literature, ‘Ulūm al-Qur’ān, and ‘Ulūm al-Ḥa-dīth in Tārīkh al-Ṭabarī. At the same time, the methodolo-gical aspect referred to the meaning, function and implication of the integration-interconnection, either in the study of Islamic history or Islam in general.

Abstract

The notion of womanhood has become a serious concern of most cultures, religions and states. As such can be seen in written documents they have produced to educate and discipline their female subjects. However, most of the documents are produced by male authority within their respective fields; and many propagated for submissive womanhood. Why these male authors do so? Why they tend to discipline women? Where are the voices of women? These are the questions that attracted me to do research. To start with, I do research on Aisyiyah’s ideas on womanhood, because it is an Islamic organization for women that has survived more than a century. This is qualitative research with mixed methods in the data collection. The primary data comes from published documents and interviews. The research finds that these Aisyiyah women are strategic in developing their idea of womanhood; they take up the opportunity from learning to reclaim the right to self-identification as progressive woman, not submissive and inactive women as proposed in other books. Aisyiyah build its argumentation based on theological, scientific as well as cultural considerations. They also collaborate with other partners of similar minds to sustain their vision on womanhood.

Abstract

This article attempts to describe the role of ulama (Islamic Scholars) of Darul Uloom Deoband in India and those of Pesantren Tebuireng Jombang in Indonesia, who are categorized as traditionalist, in the independence movement against the invaders. The ulama of Darul Uloom Deoband opposed to the British rule, while the ulama of Tebuireng struggled against the Dutch colonialism and Japanese occupation. Using a historical approach, this article reveals that traditionalist scholars in both institutions had a significant role in the independence movement, even though Islam is minority in India and majority in Indonesia. They fostered anti-colonial attitudes against the invaders in order to defend their homeland and fight for their country’s independence.

Abstract

This article examines the Christian-Muslim relations in the third/ninth century through the al-Mutawakkil’s edict on Christianity issued in 235/850. Historically, al-Mutawakkil’s rule in 232-247/847-861 was marked by three significant events: the ending of the Inquisition in 234/849, the declaration of an edict against Christianity in 235/850, and the lifting of the tomb of Imam Ḥusayn b. Abī Ṭālib in 236/851. Particularly, the second event highlighted the complex relations between Christians and Muslims in early Islam, and accordingly raised such a question as why the Caliph al-Mutawakkil only targeted Christians in his edict even though Muslims had encountered many religious groups (ahl al-dhimmah). Examining the classical and modern resources of Islamic history on this account, this article traces theological, social, and political factors in the Christian-Muslim encounters surrounding al-Mutawakkil’s edict. Even though al-Mutawakkil failed to fully implement the edict on Christians, he demonstrated that he was a tactician ruler who could win over his Muslim subjects and control non-Muslim citizens, bureaucrats, and soldiers.

Abstract

This article seeks to explore the importance of maqāṣid al-sharī‘ah as a theory to address the develop-ment of Islamic law in the contemporary world. Following the need to respond to modern challenges in Muslim society, the theory of maqāṣid al-sharī‘ah needs to be worked out optimally so that the results of legal provisions do not shift from the primary objectives of the state and government formation. The fundamental goal is to create benefits for the nation and state. The trend of the emergence of nation-states with multi-ethnic, multi-racial, multi-cultural, even multi-religious populations demands the need for tools for sophisticated religious analysis such as the theory of maqāṣid al-sharī‘ah. In the context of a nation-state like Indonesia, maqāṣid al-sharī‘ah can be used as a theoretical perspective to determine the legal standing of the debate about Pancasila and transnational ideology, which has recently been widely discussed in the community. Pancasila is an agreement of the Indonesian founding fathers to maintain the unity and integrity of the nation amidst the diversities. This article describes the role of maqāṣid al-sharī‘ah in the study of the Islamic constitutional law, the dynamics of Islamic law, and the Pancasila as ideology of the state.

Abstract

This article discusses the controversy on the Sufi metaphysics contained in a treatise called al-Durr al-Nafīs written by Muhammad Nafis al-Banjari, and the interest of the public in it. This study analyses a number of studies of this treatise, and it is enriched by interviews with some relevant Islamic scholars. Some Islamic scholars reject the Sufi doctrines of Muhammad Nafis on the ground that they are not in line with Islamic orthodox teachings. There are some Islamic scholars who simply say that the doctrines of the treatise are not included in the Ahl al-Sunnah camp, while others say that they are misguided and misleading. On the other hand, there are some Islamic scholars who say that the doctrines are actually orthodox, but they are only for intellectually and spiritually gifted people. Although most of the scholars suggest that the treatise should not be freely taught to, or circulated among, common people, thanks to print technology and the rise of interest in Sufism, this treatise has been more widely read in religious gatherings and circulated not only in different parts of Indonesia but also in Southeast Asia.

Abstract

Tolerance is an important issue in the life of the nation and state, and is related to religiosity and multiculturalism. Theoretically, an open religious attitude tends to make people tolerant and a closed religious attitude tends to make people intolerant. This study uses a quantitative research design, and data collection technique employs a questionnaire with google form. The analysis used is descriptive and inferential. The results of the study concluded that the tolerant attitude of students in the high category is 80.9%. The level of religiosity of students in the high category is 75.5%, while the level of religiosity of students in the high category is 57.7% of the number of respondents as many as 503. The relationship between religiosity and multiculturalism with tolerance is in the high category. with r=0.773 with p. 0.00. Those who are obedient to worship, understand religion correctly and respect differences in culture, religion, and customs, apparently tend to be more tolerant.

Abstract

Tablighi Jama’at is a da‘wah movement that seeks to invite Muslims to return to the pure practice of Islam, with the primary goal being to awaken the spiritual spirit in every Muslim, personally and collectively. Since its presence on the Indian mainland a few decades ago, the Tablighi Jama’at has become the world’s most influential global da‘wah movement. Indonesia, the largest Muslim-majority country in the world, is one of the bases of this movement. This article examines how the Tablighi Jama’at wins huge and loyal followers among the Muslim community in Indonesia. This study focus on revealing a character-building model carried out by the movement in Lombok Island, Indonesia, through one of its essential activities called khurūj fī sabīl Allāh. The author has conducted field research and collected data through participant observation, interviews, and documentation. This study finds that the character-building model performed in khurūj consists of four components: literature or teaching materials, practices, a conducive environment, and evaluations through deliberation. This study argues that khurūj can change people’s character in a relatively short time.

Abstract

This article provides an alternative solution in terms of environmental protection in Islamic law, namely a study of the description of the potential development of waqf law, in this case, forest waqf, as an alternative solution to environmental protection on the island of Kalimantan. The method used in this paper is normative juridical, which examines the law of ecological protection theoretically from the perspective of Islamic law and describes the possibility of new alternatives from the study of empowerment of waqf and its potential on the island of Kalimantan. The results show that waqf for the environment can balance development and environ-mental sustainability, as well as have an impact on sustainable environmental preservation, where future generations will have a level of utilization of the environment and natural resources that are at least equal to the level of utilization of the current generation, both in terms of the diversity of choices for natural resources, the quality of the environment and natural resources, and access to the environment and natural resources on the island of Kalimantan as the island where the capital city of Indonesia Archipelago is located.
