Abstract

The results of the medical examination are proof of the doctor-patient relationship, which is documented in a record containing an explanation of the patient's health condition based on the results of the examination that has been carried out. Although the recording process is an obligation, there are several cases where medical records are not filled in correctly and some are not even filled in by officers. Therefore, this research is designed to find out the urgency of electronic medical records as evidence of therapeutic transactions. The problems studied in this article are: First, the juridical consequences of health workers and hospitals in making and keeping RM or RME confidential; Second, the position and strength of RM or RME as evidence according to the law of evidence. The results show that health workers or hospitals are obliged to make Medical Records or Electronic Medical Records correctly and responsibly. Regulation of the Minister of Health Number 749a/MENKES/Per/XII/1989 concerning Medical Records is the basis for the obligation to procure Medical Records, therefore it must be adhered to for every health service.Keywords: Medical Records, Electronic Medical Records, Evidence

Abstract

The title of this research is taking over consumptive loans without collateral; (research study on Bank Syariah Mandiri Lhokseumawe). The approach method used is a qualitative descriptive approach. The results of the study, the implementation of the takeover of Multipurpose Micro credit of Bank Mandiri to Multipurpose financing of Bank Syariah Mandiri (BSM) by using a murabahah financing contract carried out by BSM Lhokseumawe Branch did not meet the pillars and contract requirements stipulated in the Sharia Economic Law Compilation. In the credit conversion process, it prioritizes the benefit aspect, namely leaving the disadvantages of the interest-based banking system towards the benefit of financing in Islamic banks in accordance with sharia principles. Expecting the importance of fulfilling sharia principles in the process of taking over credit without collateral from conventional banking into sharia banking products, the DSN-MUI needs to issue a fatwa to regulate the conversion of credit without collateral from conventional banking into sharia banking products.Keywords: consumer credit; financing; Islamic law, murabahah; sharia financial institution qanun.

Abstract

The discussion on the Indonesian Criminal Code continues and cannot be separated from criticism by various parties. One of the arrangements that has received criticism is regarding living law in society (living law). On the one hand, this regulation emphasizes the existence of living law which is the character of the multi-cultural Indonesian nation. On the other hand, this arrangement is considered to have no legal certainty. This research examines in depth how the urgency of setting living law in the Indonesian criminal law code, as well as examines the existence of this living law in the perspective of progressive law. The research was designed with a normative juridical method. The approach used is a statutory approach and a conceptual approach. The results of the study show that living law arrangements in the criminal law code are very important to provide legal certainty for the existence of indigenous and tribal peoples in Indonesia. Living law arrangements are also in line with the spirit of progressive law enforcement. For law enforcers, especially judges, this arrangement reinforces the provisions of Article 5 paragraph 1 which requires judges to explore, follow and understand legal values and a sense of justice that lives in society.Keywords: Living Law, Progressive Law, Criminal Code

Abstract

This study aims to analyze the maladministration of land acquisition for the public interest (Case study: Solo-Yogyakarta Toll Road). This type of research is juridical-normative. The nature of the research: descriptive-qualitative, meaning that it provides an overview of the problem/object being studied. The data studied were limited to secondary data. Sources of data: documents, archives, previous research results, and other validated sources. Data analysis was carried out through the following stages: data reduction, data display, data processing, and data meaning. Conclusions are drawn inductively. The results of the study show: (1). It is true that there has been maladministration in land acquisition. The committee has carried out deceitful practice, namely the practice of lying or being dishonest to the public regarding the contents of the regulation, as well as the assessment of compensation; (2). In the practice of providing compensation for non-physical components, it is not discussed, and is not taken into account, so that the amount of compensation is low; (3). The former holders of land rights feel very disadvantaged because non-physical compensation which includes: moving costs, solatium, PPAT fees, BPHTB fees, and waiting interest expenses, are not taken into account. In fact, these costs are the rights of the people affected by the land acquisition. In order to buy replacement land or move, they had to pay for it themselves.Keywords: Maladministration, compensation, land acquisition

Abstract

Abstract The emergence of tourism as a major industry is one of the most remarkable changes that have occurred in global economic activity. Over the last three decades, issues related to the environment and sustainable development related to tourism, especially in Bali, have developed from a marginal topic into a focus of consideration and research. The purpose of this research is to find a novelty in the use of the concept of green tourism as a method that is seen as capable of supporting sustainable tourism development based on local wisdom, especially in Bali. The research used is normative legal research on Law no. 10 of 200b concerning Tourism with a statutory and conceptual approach. This study found that various statutory regulations, including Law no. 10 of 2009 concerning Tourism, namely through sustainable tourism all resources can be managed so as to meet needs and maintain cultural integrity, ecological dimension biodiversity, and system life.Keywords: Bali; Green Tourism; Sustainable Tourism; Local Wisdom.

Abstract

Tujuan nasional tersebut tertuang dalam pembukaan UUD 1945, yang bertujuan untuk melindungi bangsa dan tanah air Indonesia, termasuk keamanan nasional. Kebijakan hukum pertahanan dan militer dalam bentuk diplomasi menjadi sangat penting untuk menghindari konflik antar negara. Khususnya di kawasan ASEAN, Indonesia semakin tidak memiliki relevansi strategis untuk keamanan kawasan, yang terlihat dari berbagai permasalahan hukum terkait kedaulatan Indonesia. Pelanggaran kedaulatan sama sekali bukan ancaman. Selain itu, semua aturan internasional dimaksudkan untuk saling melindungi dan menghindari konflik negara. Oleh karena itu sangat penting untuk menelaah militer Indonesia secara terlama sebagai alat diplomasi beserta kebijakan hukum strategis melalui beberapa perjanjian dengan negara lain untuk memperkuat militer Indonesia. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan dan konseptual. Hasil penelitian ini menyimpulkan bahwa Indonesia telah menempuh diplomasi berupa perjanjian dan kerjasama dengan negara lain untuk saling menguntungkan. Sedangkan. Perjanjian kerjasama antar negara di kawasan ASEAN telah dilakukan dengan menggunakan seluruh peraturan perundang-undangan nasional dan internasional. Hasil penelitian ini menyimpulkan bahwa Indonesia telah menempuh diplomasi berupa perjanjian dan kerjasama dengan negara lain untuk saling menguntungkan. Perjanjian kerjasama antar negara di kawasan ASEAN telah dilakukan dengan menggunakan seluruh peraturan perundang-undangan nasional dan internasional. Abstract

The right to health for all Indonesian people is guaranteed in Article 28H of the 1945 Constitution. Doctors and dentists are the main professions in the field of health, as stated in Law No. 29 of 2004 concerning Medical Practice. After the Covid 19 Pandemic ended, there has been a significant shift, with the rise of health services through digital and application media, ease of access to health, and online sick notes. This facility can be misused for work purposes etc. Moreover, a defendant can avoid the investigation process by easily obtaining a sick note online; this service cannot optimize patient examinations because it's not done face-to-face. Therefore it is important to examine the making of online sick notes, which have the potential to become a form of crime and be reviewed from the perspective of a criminological approach. This study aims to examine online sick notes as a crime and whether this activity is by Law No. 29 of 2004 reviewed in criminology. The research method used is normative legal research with statutory and conceptual approaches. The results of this study conclude that making sick notes online is not by Law No. 29 of 2004 and violates Article 7 KODEKI so that it can be considered a form of crime. In contrast, from a criminological point of view, through communication and convenience, this makes the perpetrator according to the science of criminology as contained in the differential theory association.Keywords: Criminology, Medical Practice, Online Sick Letter

Abstract

The revelation of the engineering handling of the death case of Police Brigadier Nofriansyah Yosua Hutabarat has had an impact on raising other issues related to unprofessionalism within the Indonesian National Police such as the issue of the 303 gambling consortium, drugs, promotions associated with factions within the POLRI, luxury lifestyle, case transactions and so on The public considers that unprofessionalism within the Indonesian National Police does not only occur with individual members of the police but is already "institutionalized", the slow handling of the murder case of Police Brigadier Nofriansyah Yosua Hutabarat is suspected of having a tug-of-war of interests is an example of "institutionalized" unprofessionalism, even though this case has received attention from the President and Menkopolhukam. The regulation of some of Kompolnas' repressive powers in Presidential Regulation Number 17 of 2011 gave rise to new legal norms that increase Kompolnas' authority, this becomes out of sync and harmony with Kompolnas'.Reform of the external oversight system at the Indonesian National Police is a must by rearranging the system of recruitment, education and career paths for Polri members and officials as well as strengthening the existence of external oversight institutions (both preventive and repressive in nature) and their authority attached to Kompolnas as The National Police Agency through the revision of Law Number 2 of 2002 concerning the Indonesian National Police

Abstract

The Job Creation Law which has been approved and ratified becomes Law Number 11 of 2020, cannot be separated from the taxation cluster. As it is known that taxes have a budgetary function as state revenue and regulating function as a reflection of the country's economic policy. This study aims to examine the priority of the regularend function of taxes in the taxation cluster in Law Number 11 of 2020 concerning Job Creation. The results of the study indicate that the regularend function of taxes accommodated in the Job Creation Law and Perppu Number  1 year 2020 Jo. Law Number 2 of 2020 as well as Law Number 7 of 2021 concerning Tax Harmonization can work in several ways, namely: in the context of funding investment in Indonesia, tax incentives on dividends from within the country are intended to reduce the tax burden that must be borne by taxpayers, differences in interpretation in determining the status of tax subjects affect the country or jurisdiction that has the right to impose, relaxation of provisions for crediting Input Tax, which is deemed unfair for business actors, Arrangements on the amount of administrative sanctions of interest and interest compensation which are applied by taking into account market interest rates; and Taxation of digital transactions carried out by foreign sellers or marketplaces.

Abstract

Purbalingga Regency is famous for its artificial eyelash industry and is the second largest in the world after Goangzu, China. The company cooperates with Plasma (intermediary) to work on part of its production to replace overhead costs associated with the use of standard labor and meet fluctuating demand. The purpose of this study is to determine the construction of legal relationships between intermediaries (plasma) as employers and female workers in the false eyelash industry sector in Purbalingga Regency and to determine whether female workers in the industry have received preventive protection due to the formation of legal relationships between employers and workers through intermediaries (plasma). This research uses normative-empirical research methodology. This research focuses more on normative research supported by field data or empirical research. Based on the results of the research, the formation of legal relationships between women workers and the Plasma (company branch) is carried out through piecework agreements, but there are still restrictions that must be followed, such as the requirement that factory workers and employees have the status of casual daily laborers. Female plasma workers who work in the informal industry do not receive social protection as they should. The Social Protection System for all levels of society stipulates that the government must provide social insurance, and this is where the welfare of plasma workers becomes the responsibility of the government.Keywords: Construction of legal relations, Plasma, female workers
