MIQOT: Jurnal Ilmu-Ilmu Keislaman is a peer reviewed academic journal, established in 1976 as part of the State Islamic University of North Sumatra Medan (see: video), dedicated to the publication of scholarly articles in various branches of Islamic Studies, by which exchanges of ideas as research findings and contemporary issues are facilitated. Abstract

Abstrak: Peralihan status beberapa Institut Agama Islam Negeri (IAIN) menjadi Universitas Islam Negeri (UIN) di antaranya berimplikasi pada eksistensi kajian dakwah merupakan fakultas ilmu agama tersendiri dan berbeda dengan ilmu komunikasi atau kajian dakwah terintegrasi dengan studi ilmu komunikasi. Tulisan ini berupaya menjelaskan bagaimana integrasi dakwah Islam dengan ilmu komunikasi ditinjau dari perspektif interpretatif menjadi ilmu komunikasi Islam. Penulis mengemukakan bahwa dakwah Islam secara akademis dapat diintegrasikan dengan ilmu komunikasi menjadi ilmu komunikasi Islam. Komunikasi Islam dalam pengertian sebagai proses merupakan penyampaian pesan ajaran Islam melalui berbagai media, dimana karakteristik dasarnya bersifat persuasif dan rasional mengajak manusia untuk kembali kepada fitrah dan potensinya. Dengan demikian sarjana Dakwah Islam pada akhirnya memiliki status sama dengan Sarjana Ilmu Komunikasi.Abstract: The Integration of Islamic Propagation with the Science of Communication. The Transformation of a number of the State Institute for Islamic Studies (IAIN) into Islamic State Universities has resulted in some implications for propagation studies as a separate religious science faculty being distinct from communication science or alternatively it is integrated with the study of communication science. This essay tries to explain how to integrate Islamic propagation with communication science viewed from interpretative perspective to become the science of Islamic communication. The author contends that academically, Islamic propagation can be integrated with communication science as Islamic communication. Islamic communication as a process signifies as delivering the message of Islamic tenets through various media, the main characters of which are persuasive and rational calling peoples to return to their nature and potential. Thus, the alumni of the Islamic propagation then may gain the same status as communication science alumni.Kata Kunci: komunikasi, dakwah, IAIN, UIN

Abstract

Abstrak: Manakala membicarakan tentang proses islamisasi di Indonesia, para ahli akan fokus pada pembahasan tentang Aceh. Pada hal di Sumatera Utara, khususnya di sekitar kota Medan dan Barus banyak  dijumpai situs makam kuno yang membuktikan agama Islam sudah lama bertapak di daerah ini. Dengan menganalisis tipologi dan kronologi nisan Aceh dan inskripsi yang terdapat pada batu nisan di Kota Rantang dan Barus, Sumatera Utara diketahui bahwa proses islamisasi di Sumatera Utara sudah terjadi sejak abad ke-13 M. Proses islamisasi itu akhirnya membentuk sebuah komunitas politik bercorak Islam pada abad ke-13 M yakni munculnya Kerajaan Haru di Kota Rantang, Hamparan Perak.Abstract: Islamization in North Sumatra: A Study of Gravestone in Rantang and Barus Cities. When talking about the process of islamization in Indonesia, many an expert will focus on discussing Aceh. Where as in North Sumatra, especially around the city of Medan and Barus many ancient gravestones found that proves the Islamic religion has long foothold in this area. By analyzing the typology and chronology of Aceh tombstones and inscriptions found in gravestones in the cities of Rantang and Barus, North Sumatra Province is known that the process of islamization in North Sumatra have occurred since the 13th century AD. The process of islamization was eventually formed a political community of Islam in the design of the 13th century AD ie the emergence of the Kingdom of Haru in the Kota Rantang, Hamparan Perak.Kata Kunci: Islamisasi, tipologi, batu nisan, Kota Rantang, Barus, Kerajaan Aru

Abstract

Abstrak: Cepatnya perubahan yang terjadi di tengah kehidupan sosial kemasyarakatan di era globalisasi ini seringkali tidak seimbang dengan upaya pembaharuan pemikiran di kalangan umat Islam. Tampaknya, hal ini disebabkan oleh keyakinan bahwa karya- karya pemikiran ulama masa lalu dianggap sakral, sudah menjawab setiap tantangan yang ada sepanjang sejarah umat Islam dan karena itu dianggap final. Karenanya, setiap upaya untuk mengkritisinya dianggap sebagai “makar akademis” dan pelakunya bahkan dapat dituduh murtad. Akhirnya, timbul kekhawatiran di kalangan praktisi akademis untuk melakukan pembaharuan yang berakibat pada stagnasi pemikiran. Tulisan ini adalah sebuah upaya untuk mendiskusikan problem-problem pembaruan pemikiran Islam di Indonesia lebih detail dan upaya-upaya solutif terhadap problem- problem tersebut.Abstract: Islamic Thought Reform Movement in Indonesia: From Part of Problem to be Part of Solution. The rapid development of social life in the era of globalization has often been run unparallel with the effort for thinking reform within the Muslim community. It appears that this may have arisen from the belief that the works of the past scholars of Islam are regarded to be sacred, capable of responding to any challenges in the span of the history of Muslim community and thus regarded final. Similarly, any attempt to criticize such views is seen as an academic assault the actor of whom may be accused of doing an act of apostasy. At the end, this lead to anxiety within the academicians to carry out reform that would have a logical consequence of thinking to be stagnant. This essay is an attemp to discuss the problems of Islamic thought reform in Indonesia in details as well as find solution to such problems.Kata Kunci: pembaharuan pemikiran Islam, Indonesia

Abstract

Abstrak: Penanganan terhadap persoalan korupsi merupakan tugas berat di setiap negara dalam mencapai good governance. Di Indonesia, sejak bergulirnya reformasi, terjadi peningkatan tindak pidana korupsi dan penyebaran pelakunya semakin meluas. Tulisan ini mencoba memberikan solusi tentang sanksi hukum pemiskinan koruptor, baik dari perspektif hukum pidana positif maupun hukum Islam. Menurut penulis, pemiskinan koruptor yang berarti sebuah hukuman untuk membuat tersangka menjadi miskin akibat aset dan harta benda yang dimilikinya sebenarnya mendapat preseden dari putusan-putusan hakim yang menyita harta koruptor. Dalam hukum pidana Islam, pemiskinan koruptor sebenarnya tidak sejalan dengan konsep ‘uqûbah atau penjatuhan sanksi bagi seorang terdakwa. Namun demikian, sebagai sebuah bentuk hukuman takzir berupa denda sejumlah uang yang dituntut oleh Jaksa Penuntut Umum terhadap seorang terpidana kasus korupsi, tampaknya boleh dilakukan.Abstract: Impoverishment of Corruption Crime in the Perspective of Positive Criminal Law and Islamic Law. Dealing with corruption issue is a tough task of any country in achieving good governance. In Indonesia since reformation era began, there was an increase in the number of corruption crime This paper attempts to provide solution pertaining to sanctions to impoverish corruption crime, both in the perspectives of Islamic positive criminal law and Islamic penal law. According to the author, the impoverishment of corruption crime in the sense of sanction that causes the suspect in the state of poverty due to the fact that their property and asset prescribed in the precedent of the decisions of judges who confiscate criminals. In the Islamic perspective, the impoverishment of the corruption crime as punishment is not in line with a form of punishment named ‘uqûbah or impose sanctions for a defendant. Nevertheless, as a form of punishment in the form of fines as ta’zîr, an amount of money demanded by the public prosecutor against a convicted cases of corruption, perceived to be feaseable to be applied.Kata Kunci: korupsi, koruptor, pemiskinan, jinâyah, hukum pidana

Abstract

Abstrak: Artikel ini akan menjawab pertanyaan bagaiaman pemerintahan Islam mendapatkan kewenangan dalam pendistribusian dan pemanfaatan tanah Negara, begitu juga dengan pelbagai prasyarat perkembangan ekonomi. Dengan merujuk kepada karya genre fikih, penulis mengemukakan bahwa Nabi Muhammad Saw. dan para khalifah mendapatkan kewenangan mereka berdasarkan ketentuan  hukum Islam untuk menjalankan roda pemerintahan, memimpin rakyat dan menegakkan hak-hak sipil termasuk hak untuk memiliki tanah pertanian dan perumahan dalam rangka memenuhi kebutuhan rakyat. Lebih lanjut menurut penulis, pemerintah berkewajiban untuk mengatur pengalokasian hak, distribusi dan pemanfaatan tanah yang lebih intensif untuk memaksimalkan fungsi tanah sebagai asset negara dan rakyat sehingga kebutuhan pemakai bisa terpenuhi. Dengan demikian, kebijakan pemerintahan Islam tidak hanya tertuju pada kesejahteraan ekonomi tetapi juga dalam pembangunan pemukiman rakyat. Abstract: The Government Authority in the Distribution and Utilization of State Land in Islam. This article will answer how the Islamic government gains the authority in the distribution and utilization of state land as well as the requirements for the economic development. By delving into the works in Islamic jurisprudence genre, the author maintains that the Prophet Muhammad and the caliphs received the legality from the Islamic law to rule the country and the people, and to preserve civil rights including the right to own agricultural land and housing in order to meet people’s needs. Furthermore, he asserts that the government is obliged to regulate the allocation of rights, distribution and intensive use of land in order to empower land as asset of the state and the society and thus the consumer needs are fulfilled. Thus, the Islamic government policy is not only confined in providing economic welfare but also in land and housing.Kata Kunci: hukum Perdata Islam, pemerintah, tanah negara

Abstract

Abstrak: Metode Penerjemahan al-Qur’an ke dalam Bahasa Indonesia: Suatu Studi Perbandingan. Urgensi pengalihbahasaan Kitab Suci al-Qur’an meru­pakan hal yang tidak dapat dipungkiri dalam penyampaian pesan yang dikandung­nya agar tepat pada audiens yang dihadapi. Perkembangan penerjemahan al-Qur’an di Indonesia memiliki kekhasan gaya dan metode. Di antara karya penting terlihat seperti dalam karya Mahmud Yunus, HAMKA, dan Departemen Agama Republik Indonesia. Penerjemahan di dalam ketiga kitab tersebut telah mengakomodasi istilah Arab yang ditemukan baik secara lafal maupun makna. Dalam tulisan ini diketengahkan perbandingan penerjemahan menggunakan tiga metode yang berbeda dari masing-masih penerjemah tersebut. Berdasarkan hasil analisis penulis, dipahami bahwa kosakata yang berkaitan dengan masalah keagamaan memiliki pengaruh besar dalam penulisan penerjemahan. Abstract: The Qur’an Translation Method into Indonesian Language: A Comparative Study. The importance of the translation of the Qur’an is undeniable in order that its message can be properly conveyed to its audience faced. The development of Qur’anic translation in Indonesia has its distinct style and method. Amongst the most important ones are such works as Mahmud Yunus, HAMKA, and Departemen Agama Republik Indonesia (Department of Religious Affairs Ministry of the Republic of Indonesia). The translations of these works have accommodated Arabic expression both in verbal and meaning. This essay tries to compare the method of translation employed in those three works of translation. Abstract

Abstract: This study examines the relationship between the introduction of the Compilation of Islamic Law (KHI) in 1991 and the shift of the attitudes Islamic court judges taking inheritance as a case in point. Prior to the introduction of KHI the judges are urged to refer to the classical works of Islamic jurisprudents in giving their judgment, the consequence of which gives the impression that there is no legal certainty in the decision of Islamic courts. The author argues that in post-introduction of KHI there has been a shift in the attitude of judges in determining biological status of an heir who had died prior to the predecessor. The author concludes that the emergence of the compilation has significant impact in improving the position of the Islamic court judges administratively, and that they were responsive to maintaining social equalities.Kata Kunci: KHI, sikap hakim, Peradilan Agama, ahli waris pengganti

Abstract

Abstrak: Palestina pada mulanya adalah bagian dari Daulah Islamiyah di bawah Turki ‘Utsmani. Tetapi dengan dikuasai wilayah ini oleh Inggris (1917), seterusnya dicaplok sebagian besar (48 %) oleh Yahudi, Palestina yang mayoritas penduduknya Muslim menjadi tidak merdeka. Tulisan ini bertujuan mengungkapkan perlawanan Muslim-Palestina terhadap Yahudi-Israel. Untuk maksud tersebut dimanfaatkan pendekatan dan analisis historis dengan library research dalam pengumpulan data. Dari studi ini ditemukan bahwa Zionis Israel menguasai Palestina karena mendapat sokongan dari sekutu utamanya yaitu Amerika Serikat, Inggris dan Prancis. Sementara Palestina berjuang sendiri, karena negara-negara Islam sekitarnya sudah pernah ingin membantu pada tahun 1968, tetapi mengalami kekalahan dalam peperangan enam hari. Akibatnya, Mesir, Suriah, Yordania dan Palestina lepas sebagian wilayahnya. Terakhir, Palestina semakin terpuruk, dan jika disahkan RUU Yahudi yang diajukan oleh Benyamin Netanyahu ke Parlemen Israel, Palestina dan Arab Islam akan semakin terdesak.Abstract: Palestine and Israel: History, Conflict and the Future. At the beginning Palestine was a part of Daulah Islamiyah under the Turki Usmani, but because this area was dominated by England in 1917, then about 48 percent of it was annexed by Jews, Palestine with the Muslim majority became not independent. This writing aims at exploring the struggle Muslim-Palestine toward Jews-Israel. For this purpose, the use of historical analysis and library research approaches in collecting data were used. The findings from this research are that Zionist Israel dominated Palestine because of being supported by its main allies: America, English and France while Palestine struggle alone because the surrounding Islamic countries had ever wanted to help in 1968 but they were lost in a six-day war. Therefore, Egypt, Syria and Jordan and Palestine released a part of their area. Lately Palestine becomes worse and if the Jews constitution proposed by Benyamin Netayahu to the Israel Parliament, Palestine and Arab Islam will be strongly insisted.Kata Kunci:Muslim, Palestina, Yahudi, Israel

Abstract

Abstrak: Fokus tulisan ini mengkaji sejauhmana nilai filosofis tentang konsep rumusan norma pertanggungjawaban hukum memiliki kesamaan antara hukum Islam dengan nilai-nilai yang dicita-citakan pembangunan hukum nasional, yaitu terwujudnya nilai keadilan, kemanfaatan dan kemaslahatan hukum bagi manusia. Akan tetapi dalam hal rumusan batasan usia atau dewasa bagi seseorang untuk dapat memikul pertanggungjawaban hukum, terdapat beberapa perbedaan prinsip antara rumusan ‘âqil bâligh dalam hukum Islam dengan peraturan perundangan di Indonesia. Batasan usia dalam peraturan perundangan Indonesia perlu disesuaikan dengan kondisi sosial masyarakat dewasa ini. Ketercukupan asupan gizi, perkem- bangan teknologi rekayasa pangan, dan perkembangan teknologi informatika ber- pengaruh kuat terhadap kecenderungan lebih cepat dewasa bagi seseorang. Diharap- kan kajian ini dapat mengisi atau memberikan sumbangan konsep atau wawasan baru bagi tersusunnya ilmu hukum Indonesia atau pembangunan hukum nasional Indonesia.Abstract: The Essence Legal Development and its Accountability under the Banner of Pancasila in Islamic Perspective. The focus of this paper is to examine the the extent to which philosophical formulation of the concept of legal accountability norms are similar between Islamic law with the values   aspired development of national laws, the final objective of which spins around the realization of the value of justice and for the interest of humans. However, in terms of the formulation of age limit for a person to be able to bear the legal liability, there are some differences between the formulation of the principle of legal capacity with the laws and regulations of Islamic law in Indonesia. The legal capacity in Indonesian laws needs to be formulated according to the social conditions of today’s society. Adequacy of nutrient intake, the development in food engineering technology, as well as information technology have relatively contributed to the process of maturity of a person become faster. Abstract

Abstrak: Tulisan ini hendak membongkar mitos Islam moderat Indonesia melalui pengamatan terhadap dua organisasi keagamaan yang selama ini dikenal sebagai “juara” Islam moderat yaitu Nahdlatul Ulama (NU) dan Muhammadiyah. Pertanyaan yang mengemuka adalah, pertama, apakah benar bahwa pandangan-pandangan keagamaan kedua organisasi ini moderat; kedua, apakah ada Islam moderat yang khas Indonesia, dan ketiga, bagaimana—setelah membongkar mitos—membangun sebuah cetak-biru Islam Indonesia yang aplikatif dan adaptif. Dalam tulisan ini ditemukan bahwa teologi moderat kedua organisasi ini tidak cukup lagi untuk mengakomodasi tantangan era modern. Sekalipun pencapaian kedua organisasi ini patut diapresiasi sebagai pelopor dalam merumuskan Islam moderat di Indonesia yang visible secara rinci, mereka perlu membangun argumen yang lebih mapan untuk visi moderat “dari dalam.”Abstract: Quo-vadis Moderate Islam Indonesia? Reconsidering the NU and Muhammadiyah Modernism. This paper tries to unravel the “myth” of Indonesia’s moderate Islam by analyzing two mainstream religious organizations which have long enjoyed their reputation as the champion of moderate Islam: Nahdlatul Ulama (NU) and Muhammadiyah. The questions put forward are: first, whether the religious worldviews of the two organizations are moderate in nature; second, whether there is such thing as typically Indonesian moderate Islam; and third, how to construct a viable and workable blue-print of Indonesia’s moderate Islam. This paper reveals that the moderate theology of both organizations is no longer sufficient in accommodating the challenges of this modern era. Although the achievement of both organizations deserve appreciation as a pioneering attempt at making a more detailed but visible formulation of Islamic moderatism in Indonesia, they need to construct a more established argument for moderate vision “from within.”Kata Kunci: modernisme Islam, Nahdlatul Ulama, Muhammadiyah
