Abstract

Implementation of diversion by a public prosecutor children, nowadays the mechanism is based on Law of The Republic of Indonesia Number 11 Year 2012 regarding the Juvenile Criminal Justice System. Further provisions concerning the guidelines for the implementation of diversion, ordinances, and coordinate the implementation of diversion stipulated on Indonesian Republic Government Regulation Number 65 in 2015 on the guidelines for the implementation of diversion and treatment of children who are aged 12 years. But the problem until now has not drawn up internal rules to the public prosecutor in the form attorney General of The Republic of Indonesia regulation as the basic for the implementation of the mechanism reffered versioned on Indonesian Republic Government Regulation Number 65 in 2015 on the guidelines for the implementation of diversion and treatment of children who are aged 12 years. The importance of internal rules as the basic for the public prosecutor in the executing diversion, as the uniformity of implementation of the diversion by a public prosecutor children across Indonesia, in order to avoid differences in the implementation mechanisms of diversion, which is still based instruction each child’s direct leadership prosecutor, who do diversion. Further in praction, there are differences in the implementation mechanisms of diversion by a children public prosecutor in Indonesia which resulted in the implementation of the goal of diversion has not been maximally as aspired is to keep children who are dealing with the law, from the adverse effects of the criminal justice system.  Keywords : diversion, juvenile criminal justice system, public prosecutor children

Abstract

This research aims to: (1) Assess and evaluate the pattern containedsystem in the Securing of National Vital Objectsby Vital Object Security Directorate of  Polda Kalimantan Selatan; and (2) Assess and evaluate the obstacles in the Securing of National Vital Objects by Vital Object Security Directorate of  Polda Kalimantan Selatan. It can be concluded that: 1. The system pattern contained in the Securing of National Vital Objects by Vital Object Security Directorate of  Polda Kalimantan Selatan not stated clearly and explicitly in the legislation pam obvitnas, but in the Presidential Decree No. 63 of 2004 on the Securing of National Vital Security Object there is described that pattern Sispamobvitnas, they are: (1) The main executor of the system Securing of National Vital Objek is obvitnas management authority, in this case the Police through Dirpamobvit; (2) Police are obliged to provide security assistance obvitnas; (3) priority preemptive and preventive activities; (4) in an integrated and simultaneous shared obvitnas managers implement security systems obvitnas;  and (5) and against obvitnas is an organic part of or including the military, the security environment remain to be implemented, although the security environment outside Obvitnas or process interruption handling defense and security. 2. The obstacles in the Securing of National Vital Objects by Vital Object Security Directorate of  Polda Kalimantan Selatan, they are: (1) Lack of quality personnel guard PT. Pertamina (Persero) BBM Terminal Banjarmasin due to lack of professional recruitment system; (2) Insufficient number of security officers compared to the vulnerability of the region; (3) Infrastructure security Obvit Of Polda Kalimantan Selatan are limited;(4) The lack of security coordination between Ditpamobvit Polda Kalimantan Selatan with regional security managers of the company, and the company's internal security guard at the Police Post.

Abstract

Criminal act vehicle theft in law areas Polresta Banjarmasin more increasing. This improvement seen by loss reports received  Polresta Banjarmasin. The theft of vehicle in banjarmasin city most happened in residential areas of society, and parking areas. Criminal offender vehicle theft usually done in groups although individually. Unit investigator ranmor Sat Reskrim Polresta Banjarmasin made an efforts versioned in children who did criminal act of theft vehicle. Versioned  child development, coaching and mentoring children, proportionate, deprivation of liberty and punishment as the last effort and avoidance of retaliation juvenile justice law  aims to keep dignity of children, then child entitled get the special protects, especially law protect in system judisial.Unit investigator ranmor Sat Reskrim Polresta Banjarmasin made an versioned effort to child who did criminal act of theft vehicle versioned did because child is still underage and still a  Juvenille criminal justice system that was passed on july 30 th 2012 an effective on 32 st july 2014 legislation is a whole juvenile justice system. The process of resolving casses of children in conflict with the law began with the investigation to the stage of supervision after serving a punishment.Law juvenille justice system give the special protects to child according the principle of protection, fairness, discrininates, the best interest of the child, appreciation for the opinions of children, survival and growth.

Abstract

The purpose of this thesis is to determine and assess the implementation of Principle To recognize the importance of Good Governance in Financial Management System in Indonesia. To know Is General Principles of Local Financial management of the Implementation of Regional Finance can mewujukan Good Governance and How to Achieve Fiscal Management Principles for Being a Good Governance. Research in the writing of this law is to use the method of normative legal writing with properties that provide exposure deskrepsi study or overview of the implementation of Principles of Good Governance in Financial Management System In Indonesia and find How to Achieve Financial Management To Become Principles of Good Governance .. The law Primary use is legal action that the Minister of Home Affairs Number 21 Year 2011 concerning the Second Amendment of the Regulation of the Minister of Home Affairs Number 13 Year 2006 on guidelines for financial management, and secondary legal materials in the form of books and literature. After all the ingredients of the literature and research material collected then the materials are then processed and analyzed.According to this thesis and research results show that: First, the minimal prerequisites for achieving good governance is transparency, accountability, participation, legal empowerment, effectiveness and efficiency, and fairness. Second, implementation has Good Governance in Local Financial Management of renewal has always done.

Abstract

Environmental quality has been threaten the survival decreased humans and other living things, as well as increasing global warming resulting in climate change and this will exacerbate environmental degradation. It is necessary for the protection and environmental management seriously and consistently by all stakeholders. Preventive measures in order to control environmental impacts need to be implemented by utilizing the most of supervision instruments. In carrying out supervision and monitoring of environmental quality in the area, the Government of Indonesia has a Regional Environmental Officer Supervisor (PPLHD). The formulation of the problem in this thesis is how the role PPLHD, the extent of the responsibilities and constraints faced PPLHD in Environmental Protection and Management in North Sumatra. In doing his research, the authors use a method that describes the normative legal principles in environmental monitoring in region conducted by the Regional Environmental Officer Supervisor. From this research can be concluded that the role PPLH/PPLHD still can not be said to run optimally and in principle, very big responsibility PPLH/PPLHD, besides that there are still many constraints faced by the Regional Environmental Supervision Officer in carrying out tasks tasks and functions. The authors suggested that the role should PPLH/PPLHD maximally activated following the laws and regulations applicable environmental by putting his position in a proportional system of local bureaucracy and the constraints that exist must be addressed both internally and externally

Abstract

Arbitrators have very important role in the process of dispute settlement through arbitral institusion. Therefore, Act number 30 of 1999 concerning Arbitration  and Alternative Dispute Resolution regulates the procedure of the appointment of an arbitrators in case of dispute among the parties. The Chairman of District Court is given the authority by the act to resolve the disputes on the appointment of arbitrators, both disputes in as ad hoc arbitration and institusional arbitration. Nonetheles, it is qustionable and the aothority on the settlement of disputes concerning the appointment aof the arbitrators given by the act to the Chairman of district court. Its is also because the spirit which is expented to be built from the disputes settlement is the late process as a result of the procedural and administrative factors can be avoided. Besides, is the authority in accordance with the principle of simple, quick and inexpensie trial. It wil not become simple because the forum must be moved. It will not become quick because it still take time to settle it and it will requires costs for the trial at the court. In addition to, the Chairman of  District Court should have the certain criteria in appointing arbitrators because the requirements stipulated in Article 2 or Act Number 30 of 1999 concerning Arbitration and Alternative Dispute Resolution is not clear on what kind of persons are considered as experts in their field and who has the authority to evaluate that someone is expert in his/her field.

Abstract

Permasalahan di bidang Teknologi Informasi semakin berkembang dan tanpa batas, kejahatan bisa di lakukan oleh warga Negara Asing yang berada di luar Negeri dan merugikan di wilayah Negara Indonesia, dengan adanya Undang-Undang Nomor11 Tahun 2008 diharapkan mampu menjerat pelaku kejahatan yang berstatus warga Negara Asing tersebut. Dan asas hukum pidana yang mengatur adalah asas Nasionalitas Pasif. Tujuan diadakannya penelitian ini guna mengkaji alasan terjadinya perluasan Asas Nasionalitas Pasif dalam Pasal 37 UU ITE serta penerapan asas ini terhadap kejahatan teknologi informasi. Metode penelitian yang digunakan adalah Penelitian ini merupakan normatif, dimana penelitian ini dilakukan dengan menginventarisir peraturan perundang-undangan yang berlaku dan sejauh mana peraturan yang ada mengatur tentang masalah yang diteliti. Dengan pendekatan Asas- asas, Pendekatan PerUndang-Undangan, dan Pendekatan Konsep yakni doktrin atau pendapat para ahli yang bertujuan untuk melihat hukum positif yang berlaku, sehingga dapat memberikan jawaban terhadap permasalahan dalam penelitian ini. Berdasarkan hasil penelitian disimpulkan bahwa alasan perluasan jangkauan Asas Nasionalitas Pasif dalam Pasal 37 UU ITE adalah sebagai acuan dasar dalam menangani permasalahan ini dengan adanya Undang-Undang Nomor11 Tahun 2008 tentang Informasi dan Transaksi Elektronik dapat di terapkan terhadap Tindak Pidana di bidang Teknologi Informasi yang Locus delicti nya diluar wilayah Indonesia, dan berwenangnya Kepolisian Republik Indonesia menyidik perkara tindak pidana di bidang Teknologi Informasi yang terjadi diluar wilayah Indonesia atau berwenangnya aparatur penegak hukum Republik Indonesia seperti kepolisian, kejaksaan,dan  kehakiman dalam penyelesaian tindak pidana ini sekalipun pelaku berada di Luar Negeri dan Warga Negara Asing karena yang diserang adalah kepentingan Indonesia. Konsekuensi hukum berdasarkan perluasan Asas ini adalah dalam tindak pidana di bidang Teknologi Informasi namun penegakan hukum di bidang ini masih memerlukan sarana yang lain untuk dapat tegakkan aturan tersebut khususnya  apabila melibatkan Warga Negara lain, sarana tersebut seperti Perjanjian kerjasama penanganan Perkara Pidana atau Perjanjian Ekstradisi.

Abstract

The purpose of this thesis is to determine and to assess the mechanism of the turnover and / or charging Jakarta governor according to the Law of the Republic of Indonesia Number 29 Year 2007 as well as knowing the turnover the governor of Jakarta with the enactment of the Law of the Republic of Indonesia Number 1 Year 2015. In the writing of this research using normative legal writing with descriptive research . The primary data sources are the Law of the Republic of Indonesia Number 29 Year 2007 , the Law of the Republic of Indonesia Number 23 Year 2014, the Law of the Republic of Indonesia Number 1 Year 2015 and secondary data sources are in the form of books and literature.According to the results of this research shows that , the Law of the Republic of Indonesia Number 29 Year 2007 does not set out clear explanation about the turnover of governorship  of DKI  Jakarta . It only refers to the legislation act about the Regional Administration and Local Elections. After the enactment of the Law of the Republic of Indonesia Number 1 Year 2015, the turnover and / or succession vacuum of power of Jakarta governor refers to this law , meanwhile as a special legal (lex specialis) that the law of Local Government overrides the law of Local Government which are in general (lex generalis). lex specialis derogat legi generali.

Abstract

The purpose of this thesis is to study the rules and legislations related with the implementation of Certificate of Origin (COO) preference as a supporting document which must be complied in export trade and to study the rules and legislations towards the solution to the problems on Certificate of Origin (COO) preference as a document indicating the origin of particular goods. The method of this research is normative legal research by collecting statutory regulations on Certificate of Origin (COO), identifying the problems, and analyzing them qualitatively. The results of this thesis research show that: firstly, with regard to the implementation of Certificate of Origin (COO) preference as a supporting document which must be complied in export trade, it is a fact that there is lack of principle of prudence in the material content of the regulations on Certificate of Origin (COO) of Indonesian export goods. This condition has caused that it is easy to abuse, devert, and falsify the document of Certificate of Origin (COO). More over, the control of the issuing institution of the Certificate of Origin (COO) is very weak and the coordination among the governmental ministries is not well cohesive. The management system of office administration in charge which is not well organized has worsened and added bad cases related with the documents of Certificate of Origin (COO) of Indonesian goods in the export destination countries.

Abstract

Muara dari sebuah proses peradilan adalah putusan. Putusan merupakan sebuah karya penelitian yang dibuat oleh Hakim dengan menggali fakta-fakta persidangan guna memunculkan sebuah fakta hukum yang dapat ditarik simpulan guna mendapatkan pemecahan jawaban atas permasalahan/perkara yang dihadapkan kepadanya.Putusan yang dihasilkan oleh Hakim tentunya diharapkan dapat memberikan rasa keadilan baik kepada para pihak yang berperkara maupun bagi masyarakat pada umumnya.Sebuah putusan yang baik sebagaimana asas dasar sebuah putusan yang tergambar dalam kalimat irah-irah sebuah putusan yakni “Demi Keadilan Berdasarkan Ketuhanan Yang Maha Esa”, dalam artian Hakim memutus sebuah perkara dilandasi atas keadilan yang ia pertanggung jawabkan kepada Tuhan Yang Maha Esa, bukan berlandaskan kepastian maupun kemanfaatan, sehingga Hakim dapat melakukan penemuan hukum dan menyimpangi hukum tertulis apabila itu dilakukan untuk mecapai keadilan.Untuk mencapai keadilan sebuah Putusan dalam bidang hukum perdata haruslah memuat 3 (tiga) kriteria yakni Keadilan Formil Putusan, Keadilan Materiil Putusan dan Keadilan Etika Putusan. Ketiga kriteria ini antara satu dengan lainnya saling mempengaruhi dalam memberikan cita rasa putusan Hakim yang berkeadilan.
