Abstract

AbstractThe issuance of Law No. 18/2001 gave the authority for the Aceh Regional Government to exercise special autonomy. The presence of this law also confirms the authority of the Aceh Regional Government to make regional regulations, establish policies, conduct supervision, and foster the administration of governance in Aceh based on Islamic law. However, the administration of government in Aceh as a special autonomy from special regions does not always work well. One that still reaps the pros and cons is the issue of sharia-based regional regulations made and enforced in Aceh. The various regional regulations that have sprung up in Aceh are seen as not paying enough attention to aspects of human rights. Some of them include regional regulations on prohibition of piggybacking between men and women, restrictions on curfew hours, separation of public space between men and women. The latest is the emergence of a circular in the form of an appeal about the standardization of coffee shops, cafes, and restaurants that must be in accordance with Islamic law. This study uses a descriptive qualitative analysis method with a literature review approach. The results of the study stated that the application of regional regulations in Aceh is still a polemic and is reaping the pros and cons in the community.Keywords: Sharia, Local Regulations, Human Rights, Aceh, Discrimination

Abstract

Abstract:Presidential elections are part of the democratic party event. However, the presidential elections in 2014 and 2019 were unique elections and took a lot of public attention. In addition to only being followed by two candidates, they also formed two big camps of supporters who shared high fanatics with each candidate. In this study, the extent to which political communication theory was built by the two candidates was examined, so as to convince potential voters. In various ways carried out to attract public sympathy for the feasibility of each candidate to become the leader of the country. Some people provide positive perceptions by giving appreciation, but others provide negative perceptions and consider their acts of political communication to be limited to mere imaging. Therefore, this study wants to answer these problems.Keywords: Political Communication, Public Perception, Presidential Election Abstrak:Pemilihan umum presiden merupakan bagian dari ajang pesta demokrasi. Akan tetapi pemilihan umum presiden di tahun 2014 dan 2019 merupakan ajang pemilu yang unik dan menyita banyak perhatian publik. Selain hanya diikuti oleh dua kandidat, juga membentuk dua kubu besar pendukung yang sama-sama memiliki fanatik yang tinggi kepada masing-masing kandidat. Dalam penelitian ini, dikaji sejauhmana teori komunikasi politik dibangun oleh kedua kandidat, sehingga dapat meyakinkan calon pemilihnya. Dengan berbagai cara dilakukan guna menarik simpati publik akan kelayakan masing-masing kandidat untuk menjadi pemimpin negeri. Sebagian masyarakat memberikan persepsi positif dengan memberikan apresiasi, akan tetapi sebagian lain memberikan persepsi negatif dan menganggap tindakan komunikasi politiknya hanya sebatas pencitraan belaka. Oleh karena itu, penelitian ini ingin menjawab permasalahan tersebut.Kata Kunci: Komunikasi Politik, Persepsi public, Pemilu Presiden

Abstract

AbstractThe philosophy of Value-Added Tax (VAT) is a tax on consumption which is severely influenced by the development of business transaction and consumption pattern of society. In order to be the tool of social engineering and give legality of justice, Law Number 42 of 2009 should give certainty of law related to VAT imposition on transaction influenced intensely by business model growing in line with social development. Information technology development endorses the digital economy. Despite the fast growth of the digital economy in Indonesia, in line with the consistent growth of public and government consumption, the VAT revenue does not grow for consecutive three years. Law Number 42of 2009 does not prescribe explicit imposition VAT. Provision of VAT imposition on the digital economy makes VAT Law does not give justice legality and does not function as a tool of social engineering.Keywords: Value-Added Tax (VAT), Digital Economy, Justice Legality.

Abstract

AbstractThe purpose of this article is to discuss legal protection for migrant workers. However, there is a difference between the legal and cultural systems of the sending country and the recipient country, thus causing many problems. To anticipate such problems, both sending and receiving countries are required to take legal protection measures, so that they can avoid being the object of arbitrariness/lawlessness. Therefore, to avoid things that are not desirable, one of the efforts that need to be done is to make bilateral agreements in the form of legal documents in a model that is not too formal, but quite effective with the recipient country. In addition, the commitment of the Indonesian government is shown by its active participation in the discussion of various international legal instruments related to the rights of migrant workers.Keywords: Migrant Workers, Memorandum of Understanding, Constitutional Rights AbstrakTujuan artikel ini adalah untuk membahas perlindungan hukum bagi pekerja migran. Namun, ada perbedaan antara sistem hukum dan budaya negara pengirim dan negara penerima, sehingga menimbulkan banyak permasalahan. Untuk mengantisipasi masalah seperti itu, baik negara pengirim dan negara penerima diwajibkan untuk melakukan tindakan perlindungan hukum, sehingga mereka dapat menghindari menjadi objek kesewenang-wenangan/pelanggaran hukum. Oleh karena itu, untuk menghindari hal-hal yang tidak diinginkan, maka salah satu upaya yang perlu dilakukan adalah membuat perjanjian bilateral dalam bentuk dokumen hukum dalam model Nota Kesepahaman (MoU) yang tidak terlalu formal, tetapi cukup efektif dengan negara penerima. Selain itu, komitmen pemerintah Indonesia ditunjukkan dengan partisipasi aktifnya dalam diskusi berbagai instrumen hukum internasional terkait dengan hak-hak pekerja migran.Kata Kunci: Buruh Migran, Nota Kesepahaman, Hak Konstitusional

Abstract

AbstractLand is one of the important elements of national development program, where each infrastructure development activity initiated by the government in the sector will always relate to land and land acquisition, for entities that can’t be ignored. The arrangement of land forms has also been accommodated in the form of laws and implementing regulations. However, in general, there’re no problems with the same problems from eviction and seizure, but conflicts between government and society are unavoidable. This paper presents a systematic analysis using the normative-empirical method for various cases of land acquisition by reviewing it based on a conceptual approach, which is seen from the viewpoint of the Law Number 5 Year 1960 and of the concept of The Theory of Justice from Rawls. The results of the research analysis lead researchers to Compulsory Rehabilitation and Resettlement as a solution that is considered to be able to realize justice as fairness in the concept of humanitarian and equitable land acquisition, so it can be a concrete effort to realize social welfare for all Indonesian people.Keywords: Land Acquisition, National Development, Justice AbstrakTanah merupakan salah satu elemen terpenting dalam rencana pembangunan nasional. Setiap kegiatan pembangunan infrastruktur yang digagas oleh pemerintah dalam sektor rill selalu berkaitan dengan tanah dan pengadaan tanah, sebagai suatu entitas yang tidak dapat dipisahkan. Regulasi mekanisme pengadaan tanah pun telah diakomodir dalam bentuk undang-undang dan peraturan pelaksananya. Akan tetapi secara implementatif, mekanisme pengadaan tanah di Indonesia tak terlepas dari problematika pelik yang berakar dari ketidakadilan pemerintah yang identik dengan penggusuran dan perampasan, sehingga konflik antara pemerintah dan masyarakat merupakan hal yang tidak bisa dihindari. Tulisan ini memaparkan analisis secara sistematis menggunakan metode normatif-empiris terhadap berbagai kasus pengadaan tanah dengan dikaji berdasakan pendekatan perundang-undangan dan pendekatan konseptual, yaitu dilihat dari sudut pandang Undang-Undang No. 5 Tahun 1960 Tentang Pokok-Pokok Agraria dan konsep Teori Keadilan dari Rawls. Hasil analisis penelitian mengarahkan peneliti kepada Compulsory Rehabilitation and Resettlement sebagai sebuah solusi yang dinilai dapat mewujudkan justice as fairness dalam konsep pengadaan tanah yang humanis dan berkeadilan, sehingga dapat menjadi upaya kongkrit dalam mewujudkan kesejahteraan sosial bagi seluruh rakyat Indonesia.Kata Kunci: Pengadaan Tanah, Pembangunan Nasional, Keadilan

Abstract

Abstract.Problems in dismissing board members by their supporting political parties are still a polemic in the constitutional system of the Republic of Indonesia. The presumption of council members as an extension of the party is still a heated debate. So that a council member who should be a representative of the people seems to be a party representative. The regulation of dismissal of members of political parties is contained in article 16 of Act No. 2 of 2011 concerning Political Parties which explains that dismissal of party members is based on several factors, such as death, resignation in writing, becoming a member of another political party and violating code of ethics for Political Parties. This discussion uses qualitative research methods with a literature review approach.Keywords: Dismissal, Board Members, Political Parties Abstrak.Problematika pemberhentikan anggota dewan oleh partai politik pengusungnya masih menjadi polemik dalam sistem ketatanegaraan Republik Indonesia. Adanya anggapan anggota dewan sebagai kepanjangan tangan partai, masih menjadi perdebatan yang sengit. Sehingga seorang anggota dewan yang seharusnya menjadi wakil rakyat seolah menjadi wakil partai. Akan halnya pengaturan pemberhentian terhadap anggota partai politik tertuang dalam pasal 16 Undang-Undang Nomor 2 tahun 2011 tentang Partai Politik yang menjelaskan bahwa pemberhentian terhadap anggota partai didasari oleh beberapa faktor, seperti meninggal dunia, mengundurkan diri secara tertulis, menjadi anggota partai politik lain dan melanggar kode etik Partai Politik. Pembahasan ini menggunakan metode penelitian kualitatif dengan pendekatan literatur review.Kata Kunci: Pemberhentian, Anggota Dewan, Partai Politik

Abstract

 AbstractGeneral elections are held with the aim of electing people's representatives, as well as to form a government that is democratic, strong, and obtains popular support. Besides aiming to realize national goals as the 1945 Constitution. In general elections there are candidates who are not proposed by political parties or a combination of political parties called individual candidates or independent candidates. This research uses normative juridical and library research by evaluating the laws and regulations, books, journals, and related internet sources. The results of the study showed that there were still no legitimate or independent candidates being approved, thus indicating the blockage of citizens' constitutional rights to be elected in a general election.Keywords: General Election, Presidential and Vice-Presidential Candidates, Individual or Independent Candidates

Abstract

AbstractViolence against women is an act that is contrary to human rights. That is why the act of violence against women is one of the acts that violates human rights, so we need a national legal instrument regarding the elimination of violence against women in Indonesia. The purpose of this research is to find out what are the factors of women becoming victims of domestic violence, and to find out legal protection efforts for women victims of domestic violence. The analysis used in this research is descriptive which uses qualitative research types with the aim of revealing facts, circumstances, phenomena and circumstances when researching. The results of this study indicate factors that cause women to become victims of domestic violence, such as individual factors, partner factors, socio-cultural factors, and economic factors, and efforts to protect the law of women victims of domestic violence are regulated in the Criminal Code, Law Number 23 of 2004 concerning Elimination of Domestic Violence. Forms of legal protection directly through institutions such as Integrated Service Centers and Legal Aid Institutions.Keywords: Violence, Household, Legal Protection

Abstract

AbstractCorruption is an extraordinary and difficult problem to eradicate so that one of the responsibilities in the Corruption Criminal Court is needed to resolve other corruption cases. The witness of the offender or known as the Justice Collaborator is a secret leaker who works with Law Enforcement Officials to dismantle another crime by giving information or testimony to the crime he has committed with his colleagues. A person who is a witness or a criminal is very much getting threats from outside parties, both for himself and for his family. Therefore, legal protection is needed that guarantees the safety of the witnesses given. Legal protection is the protection given to every citizen is no exception, because Indonesia is a legal state that upholds the values of justice and law enforcement and human rights. Protection of Justice Collaborator has been regulated in Law Number 31 of 2014 as regards Protection of Witnesses and/or Victims. In the Law, a Justice Collaborator has the right to get protection for his personal, family and property security, and is free from Threats relating to the testimony that he will, is or has given. Witness Actors have the right to obtain protection, this is in accordance with the LPSK and the 1945 Constitution regulations, so that the state is obliged to respect, protect and fulfill human rights, even though the Justice Collaborator is someone who has committed a crime.Keywords: Legal Protection, Justice Collaborator, Corruption.

Abstract

Abstract.Every citizen has the right to get the same opportunity in government. Therefore, the state must facilitate the rights of its citizens, because it is regulated in the constitution. This study uses normative legal research methods and literature studies. The results showed that the existence of individual candidates in the political and democratic system occurred because Law No. 32/2004 on Regional Government only limited and facilitated candidates for regional heads who came from political parties only. Individual candidates in the post-conflict local election in Indonesia are insignificant because one of them is the regulation governing individual candidates considered burdensome for individual candidates, even though the individual candidates have been regulated in the 1945 Constitution and strengthened by the Constitutional Court Decision Number 5/PUU-V/2007 which is the political right of the community to be chosen as a form of democracy and human rights. Deparpolization is caused by a decrease in public trust in political parties, so that people look for other political channels and provide space for people who do not have political vehicles, which are expected to be able to answer the deadlock of political parties so that their political rights can run well.Keywords: Individual Candidates, Democracy, Political Parties, General Election.
