Abstract

This paper aims at responding a critical accusation of qital concept in the Qur’an and hadith and providing analyses by using historical and practical approach. It can be argued, then, that the purposes of qital can be explained correctly as directed by both sources. At the very practical of interpretative approach, this study employs the historical, eidetic, and practical criticism. The research argues that qital or war can be applied with some criterias and ethics based on the Qur’an and hadith instruction. These criteria are (1) The nature of qital should be directed into God (fi sabiillah); (2) The qital should be first caused by the war of the enemy, (3) The qital is not permitted in the sacred worship places, (4) It aims to relieve the slander, (5) It is not allowed to sacrifice of other Muslims. The ethics of qital are: (1) It is not permitted to overreach, (2) Moslems must end the war if the enemy are surrender, (3) it is obliged to do based on the regulations and the aggrement, (4) it is not permitted to destroy.

Abstract

Tulisan ini bertujuan untuk memetakan konsep, gagasan dan pola pendidikan Islam dalam masyarakat madani di Indonesia, dengan berpijak pada konsep pendidikan dan masyarakat madani dari aspek kesejarahan dan kenabian untuk memetakan konsep pendidikan Islam pada masyarakat madani Indonesia pada konteks kekinian dan masa yang akan datang. Penelitian ini menggunakan metode diskriptif analitis dengan mengkaji referensi yang bersumber dari perpustakaan. Dalam penelitian ini didapatkan kesimpulan bahwa masyarakat madani Indonesia mengacu kepada konsep masyarakat madaniyah yang dikembangkan oleh Rasulullah, yakni masyarakat yang memiliki keadaban demokrasi, bertakwa kepada Allah SWT, yang seimbang antara dimensi fikir (iptek) dan dimensi dzikir (imtaq),  dan mampu menyelaraskan dimensi Abdun, sebagai makhluk Allah yang tanpa daya dan dimensi Khalifah, sebagai pemimpin di muka bumi. Sehingga melahirkan sosok manusia yang dalam istilah al-Quran disebut sebagai Ulul Albab. Berangkat dari terbentuknya pribadi-pribadi yang Ulul Albab tersebut maka akan terbentuk sebuah komunitas yang dikenal dengan masyarakat madani Indonesia. This paper aims to map concepts, ideas and patterns of Islamic education in civil society in Indonesia, with rests on the concept of education and civil society from the historical aspect and the prophetic to map the concept of Islamic education in Indonesia's civil society in the context of the present and future. This research uses descriptive analytical method to assess references source from the library. It was concluded Indonesian civil society refers to the concept of Madaniyah society developed by the Prophet, the people who have the civility of democracy, fear Allah SWT, which is balanced between the fikr dimension (Science and Technology) and the dhikr dimension (imtaq), and able to harmonize the abdun dimension, as a creature of God is without power and the dimensions of the Caliph, as a leader on earth. It will create the human figure in terms of the Koran referred to as Ulul Albab. Departing from the formation of Ulul Albab, it will form a community known by the Indonesian civil society. Abstract

This paper aims to understand the meaning of jihad in the present context by re-reading the hadith about “the command to fight against human until they say there is no god but Allah." The re-reading to this hadith need to do continuously, because in present context, there are a lot of violences on behalf of religious texts both derived from Qur'an and hadith. Theory used to understand the hadith is hermeneutical theory by Nasr Hamid Abu Zaid. The hermeneutic of Nasr Hamid Abu Zaid consists of three main pillars, namely finding the dalalah (meaning), magza (significance) and maskut anhu (unspoken dimensions) of the text. Based on the application of the hermeneutic, it is obtained the results that dalalah of jihad implied in Hadith is that jihad in peace way is more emphasized; while magza (significance) of the hadith is instructing that Jihad in Islamic view is only in decent way and maskut anhu (unspoken dimensions) of the Hadith is that violent jihad is prohibited.

Abstract

The position and function of the Prophet Muhammad (pbuh) in Islamic law is viewed differently among hadith scholars. The modern group of hadith experts see that there are two dimensions in the Prophet Muhammad (pbuh): the dimension as an apostle and the dimension as an ordinary human being. Meanwhile, the group of classical hadith experts believes that the Prophet Muhammad (pbuh) only has one dimension, namely, as an apostle. Classical hadith scholars argue that the Prophet Muhammad (pbuh) was a reflection of revelation, whether it was related to matters of sharia or related to humanity. The group of modern hadith experts made the concept of a prophet sunnah divided into sunnah tasri’iyyah and sunnah gairu tasyri’iyyah. Meanwhile, the group of classical hadith experts emphasizes that all of the Prophet’s sunnah are tasyri’iyah in nature. This paper aims to bridge the two groups of hadith experts by offering the terminology sunnah sābitah and sunnah mutaghaiyyirāh as an alternative typology of sunnah in the contemporary era. This paper is a descriptive-historical-reconstructive literature research using a history of ideas approach. The findings in this article are sunnah ṡābitah is a sunnah that must be implemented permanently regardless of time and place. In contrast, sunnah mutaghaiyyirāh is a sunnah of the Prophet whose implementation changes according to time and place. Sunnah ṡābitah is related to aqidah, worship, halal and haram, and general rules of muamalah. In addition to the four categories above, it is included in the sunnah mutaghaiyyirāh
