Abstract

ABSTRAKMasyarakat Indonesia mayoritas beragama Islam, pada dasarnya memperjuangkan syariat Islam bagi umat Islam merupakan suatu  keharusan baginya. Salah satunya bentuknya dengan berupaya memberlakukan hukum pidana Islam sebagai salah satu solusi kebuntuan hukum yang dianggap pada saat sekarang ini. Upaya awal di dalam memperjuangkan formalisasi syariat Islam adalah kodifikasi ketentuan hukum perdata Islam, seperti perkawinan dan kewarisan, dalam sistem perundang-undangan nasional. Langkah selanjutnya untuk memberlakukan hukum pidana Islam hingga sekarang belum terwujud. Berbagai upaya sudah dilakukan demi terwujudnya hukum pidana nasional yang dapat mengakomodasi aspirasi umat Islam yang menjadi penduduk mayoritas di negeri ini. Pemerintah sudah mengajukan draf yang berisi RUU KUHP nasional. Draf ini sudah bertahun-tahun dibahas oleh para ahli dan praktisi hukum kita, namun hingga sekarang belum mencapai kata sepakat. Yang menjadi pembahasan utama RUU KUHP tersebut adalah pasal-pasal baru yang memuat ketentuan hukum pidana Islam (HPI). Sebagian masyarakat kita masih keberatan untuk memberlakukan ketentuan HPI di negara kita. Berbagai argumen diajukan agar HPI tidak dapat diberlakukan di tengah-tengah masyarakat kita. Hingga akhir ini belum ada kepastian tentang pemberlakuan RUU KUHP nasional yang memuat ketentuan HPI tersebut.Kata Kunci : Pidana Islam, Hukum, BerlakuABSTRACTThe majority of Indonesian people are Muslim, basically fighting for Islamic law for Muslims is a must for him. One of the forms is by trying to impose Islamic criminal law as a solution to the legal impasse that is considered at the present time. The initial effort in fighting for the formalization of Islamic law was a codification of the provisions of Islamic civil law, such as marriage and inheritance, in the system of national legislation. The next step to enforce Islamic criminal law has yet to materialize. Various efforts have been made to realize the national criminal law that can accommodate the aspirations of Muslims who are the majority population in this country. The government has submitted a draft containing the national Criminal Code Bill. This draft has been discussed for years by experts and our legal practitioners, but until now has not reached an agreement. The main discussion of the Criminal Code Bill is the new articles which contain provisions on Islamic criminal law (HPI). Some of our people still object to enforce HPI provisions in our country. Various arguments were put forward so that HPI could not be applied in the midst of our society. Until now, there has been no certainty regarding the enactment of the national Criminal Code Bill which contains the provisions of the HPI.Keywords: Islamic Crime, Law, Applies

Abstract

AbstrakSecara hakiki segala yang diam dan bergerak di muka bumi baik daratan maupun lautan memang milik Allah. Kalau secara hakiki ini diterapkan dalam keseharian, kehidupan mendadak chaos karena siapa saja merasa khalifatullah. Namun, secara majazi hak milik Allah bisa diidhofahkan kepada siapa saja agar kehidupan jadi terang dan terus berjalan. Hak atas Kekayaan Intelektual (HKI) merupakan salah satu hak yang telah mendapatkan perlindungan secara hukum di Indonesia, ada beberapa peraturan perundang-undangan yang mengatur tentang hak-hak yang termasuk dalam ruang lingkup kekayan intelektual seperti hak cipta, hak paten, hak merek, hak rahasia dagang dan sebagainya. Yang perlu diketahui lebih mendalam adalah bagaimana hak cipta dalam perspektif hukum Pidana Islam karena Indonesia sebagai negara terbesar menganut agama Islam akan sangat mempengaruhi pemahaman dan kesadaran penduduk Indonesia akan pentingnya perlindungan terhadap hak atas kekayaan intelektual.Kata kunci: Hak Cipta, Hukum, Pidana IslamAbstractBasically everything that is stationary and moves on the face of the earth, both land and sea, indeed belongs to God. If it is essentially applied in daily life, life suddenly chaos because anyone feels khalifatullah. However, by virtue of God's property can be transferred to anyone so that life will be bright and keep going. Intellectual Property Rights (IPR) is one of the rights that has been legally protected in Indonesia, there are several laws and regulations governing rights that are included in the scope of intellectual property such as copyright, patent rights, trademark rights, rights trade secrets and so on. What needs to be known more deeply is how copyright in the perspective of Islamic Criminal law because Indonesia as the largest country adheres to Islam will greatly affect the understanding and awareness of the Indonesian population on the importance of protecting intellectual property rights.Keywords: Copyright, Law, Islamic Criminal

Abstract

Family resilience is a family condition that has tenacity and toughness and contains physical and material abilities in order to live independently and develop themselves and their families to live harmoniously in increasing physical and spiritual well-being and happiness. To deal with this cultural attack of globalization coupled with the COVID-19 pandemic crisis which resulted in many impacts on divorce, it is necessary to have good family resilience and the quality of religious education applied in social life. Family resilience is the key to successful development in a country that will have an impact on national resilience and the sustainability of a nation. The formulation of the problem is summarized in the objectives of this study, namely; To know the concept of family resilience according to Indonesian law and Maqashid Syari'ah, as well as to find the right solution and form of family resilience during the COVID-19 pandemic to avoid division and divorce. From this research, the long-term goal is to be able to regenerate the spirit of maintaining family resilience in an increasingly massive era of globalization, with the support of the government and religious education, it is hoped that the quality of family resilience will be better. The research methodology used is a qualitative research method through literature study, with normative juridical research and secondary data sources collected by documentary and interview methods and then analyzed descriptively qualitatively so that the level of synchronization, appropriateness of norms, and so on are known.

Abstract

ABSTRACTIn Indonesia, provisions regarding criminal acts are regulated by Law Number 35 of 2009 concerning Narcotics and Law Number 5 of 1997 concerning Psychotropics. In this Law, there are several criminal sanctions for criminals, such as imprisonment, fines and capital punishment. Regarding criminal sanctions (one of which is in Number 35 of 2009 concerning Narcotics) there are pros and cons from experts regarding this matter. One of the most severe forms of death penalty and has been debated for hundreds of years by criminal law and criminology experts. Narcotics in the context of Islamic law is a matter of ijtihâdî, because drugs do not enter directly into their prohibition by the texts of either the Al-Qur'an or al-Sunnah, and were not known at the time of the Prophet Muhammad at that time who were in the community from khamr drinkers. The research objective is to find out about the sanctions for the perpetrators of drug crime from the perspective of positive law and Islamic criminal law. The research methodology used is qualitative research through literature study, with the type of juridical normative research. The application of criminal sanctions given to manufacturers, dealers and dealers in accordance with Law No.35 of 2009 on Narcotics. The law on narcotics is haram as well as related to the haram of khamr, one of the penal sanctions is the death penalty using the hirabah approach because of the effects of narcotics from all aspects. Keywords: Drugs, Criminal Death, Islamic Criminal

Abstract

Abstrak: Pornography and pornoaction happen because of modernization and globalization influence on sosiety lives. Without consciousness from society to solve the above problems which considering Islamic community public interest, pornography and pornoaction always emerge. Islam as doctrine early presents to solve the problems, so there are many Quranic verses and prophet traditions regulate the dress, communication between man and woman, including the publications that appear moral decadence.Kata kunci: pornografi, pornoaksi, Islam.

Abstract

Abstract. The impact of divorce will certainly be very large for a child. Moreover, if the child is still under age, of course he really needs attention, affection and supervision from both parents. The purpose of this study is to find out about child custody to the father according to the compilation of Islamic law. This study uses a literature study by searching for related materials and information in books, journals, and the internet. The results of this study indicate that in the Compilation of Islamic Law the custody of children who have not been mumayyiz belongs to their mother. However, if the child is categorized as mumayyiz, then the child has the right to choose the holder of custody. Abstrak. Dampak perceraian tentu akan sangat besar terhadap seorang anak. Terlebih lagi jika anak tersebut masih dibawah umur yang tentunya sangat memerlukan perhatian, kasih sayang dan juga pengawasan dari kedua orangtuanya. Tujuan dilakukan penelitian ini yaitu untuk mengetahui mengenai hak asuh anak kepada ayah menurut kompilasi hukum islam. Penelitian ini menggunakan study literatur dengan mencari materi dan informasi terkait di buku, jurnal, maupun internet. Hasil dari penelitian ini menunjukan bahwa dalam Kompilasi Hukum Islam hak asuh anak yang belum mumayyiz adalah milik ibunya. Akan tetapi jika anak tersebut dikategorikan sudah mumayyiz maka anak tersebut berhak memilih pemegang hak asuhnya.

Abstract. The practice of pawning has long been practiced by the people of Pasir Jambu Village, Kec. Sukaraja Kab. Bogor conducted in CV. Eka Dewi Tri Pratama. The practice of pawning cars that occurred in Pasir Jambu Village is that there is a first party (Rahin) and a second party (Murtahin) in which the contract in the transaction is defective (unclear) because the first party is not honest and there are still documents in the contract. not explained by the rahin. Based on this phenomenon, the problems in this study are as follows: (1) How is the practice of mortgaged car loans in Pasir Jambu Village, Kec. Sukaraja Kab. Bogor? (2) How is fiqh muamalah on the use of mortgaged car loans in Pasir Jambu Village, Kec. Sukaraja Kab. Bogor? The research conducted by the researcher is field research, namely research that is directly carried out in the place where the phenomenon occurs, namely in Pasir Jambu Village about the practice of pawning a credit car and the benefits of pawning a credit car. Researchers used primary data and secondary data. Data was collected through interview and documentation methods and in data analysis using qualitative descriptive methods. Based on the results of the study, that the implementation of the practice of car pawning is still in installments carried out by the community in an agreement and carried out by both parties written in the agreement letter, with proof of receipt and bringing in witnesses. There is the use of pawned goods without rahin's permission in the previous contract, as well as inconsistent terms and conditions because the pawned goods are not fully owned by rahin and murtahin uses marhun. Abstrak. Praktik gadai telah lama dipraktikkan oleh masyarakat Desa Pasir Jambu Kec. Sukaraja Kab. Bogor yang dilakukan di CV. Eka Dewi Tri Pratama. Praktik gadai mobil yang terjadi di Desa Pasir Jambu yaitu adanya pihak pertama (Rahin) dan pihak kedua (Murtahin) yang dimana akad dalam transaksi tersebut cacat (tidak jelas) karena pihak pertama tidak terus terang dan masih ada dokumen-dokumen yang dalam akad tersebut masih tidak dijelaskan oleh pihak rahin. Berdasarkan fenomena tersebut maka permasalahan dalam penelitian ini adalah sebagai berikut: (1) Bagaimana praktik barang gadai mobil kredit di Desa Pasir Jambu Kec. Sukaraja Kab. Bogor? (2) Bagaimana fikih muamalah terhadap pemanfaatan barang gadai mobil kredit di Desa Pasir Jambu Kec. Sukaraja Kab. Bogor? Penelitian yang dilakukan oleh peneliti adalah penelitian lapangan, yaitu penelitian yang langsung dilakukan di tempat di mana fenomena tersebut terjadi yaitu di Desa Pasir Jambu tentang praktik gada mobil kredit dan manfaat barang gadai mobil kredit. Peneliti menggunakan data primer dan data sekunder. Pengumpulan data dilakukan melalui metode wawancara dan dokumentasi dan dalam analisis data menggunakan metode deskriptif kualitatif. Berdasarkan hasil penelitian ,bahwa pelaksanaan praktik gadai mobil masih dalam cicilan dilakukan oleh masyarakat dalam kesepakatan dan dilakukan oleh kedua belah pihak dituliskan didalam surat perjanjian, dengan bukti kwitansi dan mendatangkan saksi. Adanya penggunaan barang gadai tanpa izin rahin dalam akad sebelumnya, serta rukun dan syarat yang tidak sesuai karena barang yang digadaikan sepenuhnya belum milik rahin dan murtahin manfaatkan marhun.

Abstract

Abstract. The responsibility of the husband and wife is not only to nurture and educate the child but also to participate in providing guidance on learning. But unlike the community in Ciburial Village many parents are busy working so that the time for the family is reduced especially in terms of the education of their children. In this study, to find out the responsibility of husband and wife to the education of children according to the Marriage Act and Compilation of Islamic Law. And the responsibility of the husband and wife to the education of children in the village ciburial associated with the Law of Marriage and Compilation of Islamic Law. The method used by the author is qualitative descriptive method, this method to understand what phenomena experienced by the study subjects in the form of speech from observed behavior so that this study is correct in accordance with the facts of the field, by interviewing directly with the source. The results of this study showed that the husband and wife's responsibility for children's education in Ciburial Village does not play an active role in carrying out their responsibilities to guide children in learning, because the parents there are busy working, so to guide the child in learning is done by his own child without any guidance. But in Islamic education the parents there have given it well such as telling to pray, recitation and fasting. Abstrak. Tanggung jawab suami istri tidak hanya memelihara dan mendidik anak namun juga harus berperan serta dalam memberikan bimbingan belajar. Tetapi berbeda dengan masyarakat di Desa Ciburial banyak orang tua yang sibuk bekerja sehingga waktu untuk keluarga berkurang terutama dalam hal pendidikan anak-anaknya. Pada penelitian ini, untuk mengetahui tanggung jawab suami istri terhadap pendidikan anak menurut Undang-Undang Perkawinan dan Kompilasi Hukum Islam. Dan tanggung jawab suami istri terhadap pendidikan anak di Desa Ciburial yang dihubungkan dengan Undang-Undang Perkawinan dan Kompilasi Hukum Islam. Metode yang digunakan penulis yaitu metode deskriptif kualitatif, metode ini untuk memahami fenomena apa yang dialami oleh subjek penelitian dalam bentuk ucapan dari perilaku yang diamati sehingga penelitian ini benar sesuai dengan fakta lapangan, dengan mewawancarai langsung dengan narasumber. Hasil penelitian ini menunjukkan bahwa tanggung jawab suami istri terhadap pendidikan anak di Desa Ciburial kurang berperan aktif dalam melakukan tanggung jawabnya untuk membimbing anak dalam belajar, karena orang tua disana sibuk bekerja, sehingga untuk membimbing anak dalam belajar dilakukan oleh anaknya sendiri tanpa ada bimbingan. Tetapi dalam pendidikan agama Islam orang tua disana sudah memberikannya dengan baik seperti menyuruh shalat, mengaji dan berpuasa.

Abstract

Abstract. Marriage is a very sacred legal act in which in marriage there is a great agreement with Allah SWT between a man and a woman to build a sakinah, mawaddah, warahmah household, and between the two there is no lineage or mahram relationship. In Islamic law, marriage is declared valid if it is carried out according to religious teachings and the marriage contract complies with sharia. The purpose of the study was to find out how the law of marriage online according to the Shafi'iyah and Hanafi'iyah schools of thought. In this study, the research method used a qualitative approach and data collection was carried out by means of a literature study. The conclusion according to Islamic law is that marriage will be declared valid if the pillars of marriage and the conditions of marriage are met. According to the Syafi'iyah school, the marriage contract must be carried out continuously, which is after the marriage guardian pronounces the consent and the prospective husband pronounces Kabul and must be in one assembly while the Hanafi'iyah school allows for different places or majlis. Abstrak. Pernikahan merupakan suatu perbuatan hukum yang sangat sakral yang mana dalam pernikahan terdapat perjanjian yang agung terhadap Allah SWT antara laki-laki dan perempuan untuk membina rumah tangga yang sakinah mawadah warahmah.dan di antara keduanya tidak memliki nasab atau hubungan mahram. Dalam syartiat islam pernikahan dinyatakan sah apabila dilaksanak menurut ajaran agama dan akad nikahnya memnuhi syara. Tujuan penelitian untuk mengetahui bagaimana hukum pernikahan secara daring menurut mazhab syafi’iyah dan mazhab hanafi’iyah . dalam penelitian ini metedo penelitian menggunakan pendekatan kualitatif dan pengumpulan data di lakukan dengan studi pustaka. Hasil kesimpulan menurut hukum islam bahwa pernikahan akan di nyatakan sah apabila rukun nikah dan syarat nikah nya terpenuhi. Menurut mazhab Syafi’iyah akad nikah harus dilakukan secara kesinambungan yang mana setelah wali nikah mengucapkan ijab dan calon suami mengucapkan Kabul dan harus dalam satu majelis sedangkan mazhab Hanafi’iyah memperbolehkan adanya perbedaan tempat atau majlis.

Abstract

Abstract. The Supreme Court (MA) through the Supreme Court Regulation (PERMA) Number 1 of 2019 concerning the Administration of Cases and Trials in Electronic Courts which has been selected by PERMA No. 3 of 2018 concerning Electronic Court Case Administration, issued an e-court system. Registration of cases to the Religious Courts before the PERMA No. 1 of 2019 regarding the e-court system, is carried out conventionally, namely parties seeking justice must come directly to the Religious Court itself. The purpose of this study is also to find out how the process of resolving divorce cases through the e-court of the Supreme Court by looking at the simple, fast, and low-cost courts, and how to apply PERMA Number 1 of 2019 concerning online case administration. By using empirical juridical research methods, these observations made direct observations by means of document studies, and it can be said that: the application of the e-court application at the Sumedang Religious Court has been implemented, according to a simple, fast, and low-cost court. However, there are still several obstacles that hinder the maximal factor of this kind of implementation, the main obstacle is from the litigants themselves. Abstrak. Mahkamah Agung (MA) melalui Peraturan Mahkamah Agung (PERMA) Nomor 1 Tahun 2019 tentang Administrasi Perkara dan Persidangan di PengadilannSecara Elektronik yang menggantikan PERMA No. 3 Tahun 2018 tentang Administrasi Perkara di Pengadilan secara Elektronik mengeluarkan sistem e-court. Pendaftaran perkara ke Pengadilan Agama sebelum adanya PERMA No. 1 Tahun 2019 mengenai sistem e-court, dilaksanakan secara konvensional, yaitu pihak yang mencari keadilan harus datang secara langsung ke Pengadilan Agama itu sendiri. Tujuan dilakukannya penelitian ini adalah juga untuk mengetahui bagaimana proses penyelesaian perkara perceraian melalui e-court Mahkamah Agung dengan melihat pada asas peradilan sederhana, cepat, dan biaya ringan, serta bagaimana penerapan PERMA Nomor 1 Tahun 2019 Tentang Administrasi perkara secara online. Dengan menggunakan metode penelitian yuridis empiris, pengamatan ini dilakukan pengamatan langsung dengan cara study document, dan dapat disimpulkan bahwa: implementasi aplikasi e-court di Pengadilan Agama Sumedang sudah sangat maksimal diterapkan, sesuai dengan asas peradilan sederhana, cepat, dan biaya ringan. Akan tetapi masih ada beberapa kendala yang menghambat kurang maksimalnya penerapan asas ini, faktor utama kendalanya yaitu dari para pihak yang berperkara itu sendiri.
