Abstract

This study departs from the hajj bailout financing facility which is a booming product because of the customer's interest, but in this case there is a difference in the target achievement between Bank Syariah Mandiri (BSM) Ujungberung KCP which is less successful in improving the hajj bailout products while the Rancaekek KCP is very superior in one consolidation Ahmad Yani Branch Office Bandung. This is what is interesting for researchers to carry out this research, the difference constraints include service quality and promotion factors. This phenomenon raises problems that must be examined, namely how the influence of service quality and promotion of market share expansion products hajj bailouts at Bank Syariah Mandiri KCP Ujungberung and KCP Rancaekek Bandung. This study aims academically to contribute in the study of Islamic economics in worksheets, especially the quality of service and promotion of market share expansion and practically expected to be able to provide input to all employees of BSM KCP Ujungberung regarding the quality of service and promotion of market expansion of bailout products. Hajj that has been successfully carried out by BSM KCP Rancaekek.The conclusion of this study is that there is a significant influence of service quality on the expansion of market share by 53.3% with a strong correlation of 0.730 and through t test, where t counts at 8.245 (> t table), then H_0 is rejected and H_i is accepted. Furthermore, there is a significant influence of promotion on the expansion of market share by 30.3% with a moderate / sufficient correlation of 0.550 through t test, where t counts is 4.219 (> t table), then H_ (0) is rejected and H_i is accepted. Then there is a significant influence of service quality and promotion simultaneously to the expansion of market share by 60.6% and a strong correlation of 0.784 and through Test F, where F count is 67.023 (> F table), then 〖H〗 _ ( 0) rejected and H_i accepted.

Abstract

This study aims to examine the effect of Economic Value Added and Market Value Added on stock prices in companies listed on the Jakarta Islamic Index (JII). The type of data used is quantitative data sourced from the official website of the Indonesia Stock Exchange (IDX). The number of samples of 16 companies that meet the research criteria using purposive sampling method. Data collection uses non-participant observation method for documents in the form of company annual financial reports. The data analysis technique used is multiple linear regression analysis. The results showed that simultaneously EVA and MVA had significant effect on stock prices. Then, partially, both the EVA and MVA variables have effect on stock prices.

Abstract

Abstract. Waqf is a legal act of a person, group of people or legal entity that separates part of his property and institutionalizes it forever for the benefit of worship or other public purposes in accordance with Islamic teachings. Therefore, someone who is waqf must do the recording and registration of waqf assets. This study aims to find answers to the main problem, namely, how to review Islamic law and Law No. 41 of 2004 concerning Waqf on the Recording of Waqf Assets at Ponpes Al-Asyiqien 2 Bandung. In this study, the author uses a qualitative research method with a normative juridical approach, the data source is obtained from the rules of Islamic law and national law, data collection techniques using interviews, documentation and literature study. The framework used is the theory legal protection, legal certainty and rules of benefit. The results of the research from the waqf, there is no record of waqf assets due to many disputes between nazhir, therefore that the waqf does not have authentic evidence, indeed in Islamic law that recording of assets is not required but in the context of benefit, has the benefit of avoiding disputes in the future and getting strong legal protection. Abstrak. Wakaf adalah perbuatan hukum seseorang, sekelompok orang atau badan hukum yang memisahkan sebagian dari benda miliknya dan melembagakannya untuk selama-lamanya guna kepentingan ibadah atau keperluan umum lainnya sesuai dengan ajaran Islam. Maka daripada itu seseorang yang mewakafkan harus melakukan pencatatan dan pendaftaran aset wakaf. Penelitian ini bertujuan untuk mencari jawaban dari pokok permasalahan yaitu, bagaimana tinjauan hukum Islam dan UU No.41 Tahun 2004 Tentang Wakaf terhadap Pencatatan Aset Wakaf di Ponpes Al-Asyiqien 2 Bandung. Dalam penelitian ini penulis menggunakan metode penelitian kualitiatif dengan pendekatan yuridis normatif, sumber data di dapatkan dari aturan-aturan hukum Islam dan hukum Nasional, teknik pengumpulan data menggunakan wawancara, dokumentasi dan studi literatur. Kerangka pemikiran yang dipakai yaitu teori perlindungan hukum, kepastian hukum dan kaidah maslahat. Hasil penelitian dari wakaf tersebut, belum adanya pencatatan aset wakaf dikarenakan banyak perselisihan antara pihak nazhir, maka daripada itu bahwasannya wakaf tersebut tidak mempunyai bukti autentik, memang dalam hukum Islam bahwasannya pencatatan aset tersebut tidak diharuskan tetapi dalam konteks kemaslahatan, memiliki manfaat yaitu agar terhindar dari persengketaan dikemudian hari dan mendapatkan payung hukum yang sangat kuat.

Abstract

Abstract. Gojek is a technological innovation engaged in transportation, PT Gojek Indonesia is an online transportation service that can be ordered online to meet the needs of Indonesian people who live far from public transportation, the purpose of this research is to find out about renting a Gojek account that occurs in the field and to knowing the review of Islamic business ethics on leasing a gojek account in the city of Bandung. The research methodology uses a qualitative approach, the data collection techniques used are interviews, observations, documentation, and literature studies. The results of this study are based on the practice of leasing carried out by both parties between the owner and the tenant there is a negotiation in it which automatically results in an agreement between the two parties from the owner and the tenant, then seen from the ijarah contract and a review of Islamic business ethics explains that the rental account This gojek is in accordance with the ijarah agreement then the object is a gojek account which brings benefits to both parties to the contract. However, it is not in accordance with the principles of Islamic business ethics because it contains elements of gharar, so from an Islamic business ethics point of view, renting a Gojek account is not allowed. Abstrak. Gojek merupakan inovasi teknologi yang bergerak dibidang transportasi, PT Gojek Indonesia merupakan layanan transportasi online yang bisa dipesan secara online untuk memenuhi kebutuhan masyarakat Indonesia yang bertempat tinggal jauh dari transportasi umum, tujuan dilakukannya penelitian ini untuk mengetahui tentang sewa menyewa akun gojek yang terjadi dilapangan dan untuk mengetahui tinjauan etika bisnis Islam terhadap sewa menyewa akun gojek kota Bandung. Metodologi penelitian menggunakan pendekatan kualitatif, teknik pengumpulan data yang digunakan yaitu wawancara, observasi, dokumentasi, dan studi pustaka. Hasil dari penelitian ini berdasarkan praktik sewa menyewa yang dilakukan oleh kedua belah pihak antara pemilik dan penyewa ada negosiasi didalamnya yang secara otomatis terjadinya kesepakatan antara kedua belah pihak dari pemilik dan penyewa, lalu dilihat dari akad ijarah dan tinjauan etika bisnis Islam menjelaskan bahwa sewa menyewa akun gojek ini sesuai dengan akad ijarah kemudian dari objek nya berupa akun gojek yang mendatangkan manfaat bagi kedua belah pihak yang ber akad. akan tetapi tidak sesuai dengan prinsip prinsip etika bisnis Islam karena mengandung unsur gharar, sehingga ditinjau dari etika bisnis Islam sewa menyewa akun gojek ini tidak boleh.

Abstract

Abstract. Arisanlogy.id is a social gathering system where each member pays a different deposit amount, the top one pays the largest deposit amount, and the last member pays the smallest deposit amount and even less than the get he receives. This thesis aims to find out the practice and review of fiqh muamalah social gathering in a declining system on the Arisanlogy.id Instagram account. This research method is qualitative and the type of research is field research. The data collection technique used is interviews with the admin and members of the Arisanlogy.id. The data sources used are primary and secondary data sources and then analyzed using a sociological juridical analysis approach. The object of this research is about the practice of social gathering on a declining system on social media. The results of this study indicate that the practice of social gathering systems is decreasing on the Arisanlogy.id Instagram account based on the implementation system not in accordance with the principles of fiqh muamalah because there are differences in the amount of deposits between members, there is injustice between members in paying wages and the practice of fines and the inaccuracy of penalty fees. taken due to the negligence of members in paying the arisan deposit. So, the practice of Arisanlogy.id's declining system of arisan has an element of usury because debts drag on to profits. Abstrak. Arisanlogy.id ialah arisan menurun dimana yang menempati urutan teratas membayar jumlah setoran paling besar, dan anggota yang menempati urutan terakhir membayar jumlah setoran paling kecil dan bahkan lebih kecil dari get yang dia terima. Penelitian ini bertujuan untuk mengetahui praktik dan tinjauan fikih muamalah arisan menurun pada akun instagram Arisanlogy.id. Penelitian ini menggunakan metode kualitatif dan jenis penelitiannya penelitian lapangan. Teknik pengumpulan data yang digunakan yaitu wawancara terhadap admin dan anggota Arisanlogy.id. sumber data yang digunakan berasal dari sumber data primer dan sekunder kemudian dianalisis menggunakan pendekatan analisis yuridis sosiologis. Adapun yang menjadi objek dalam penelitian ini adalah tentang praktik arisan sistem menurun pada media sosial. Hasil penelitian ini menunjukkan praktik arisan sistem menurun pada akun instagram Arisanlogy.id berdasarkan sistem pelaksanaannya belum sesuai dengan prinsip fikih muamalah karena terdapat perbedaan jumlah setoran antar anggota, terdapat ketidak adilan antar anggota dalam pembayaran upah dan adanya praktik denda serta belum tepatnya biaya penalti yang diambil akibat lalainya anggota dalam membayar setoran arisan. Sehingga, praktik arisan sistem menurun Arisanlogy.id terdapat unsur riba karena utang-piutang yang menyeret pada keuntungan.

Abstract

Abstract. Buying and selling game accounts is rife on social media, this is used by game account sellers in the Rising Force Remastered buying and selling forum. The purpose of this study was to analyze Islamic business ethics and the Consumer Protection Law No. 8/1999 on buying and selling game accounts at the Rising Force Remastered buying and selling forum. The research method used is qualitative, with a normative juridical approach, the type of research data is library research, the source of research data comes from secondary data, data collection techniques use interviews and literature studies, data analysis techniques use descriptive qualitative. The results of this study are the practice of buying and selling game accounts is not in accordance with Islamic business ethics because the seller violates the provisions made by the game publisher, then buying and selling game accounts contains gharar related to the existence of the object, if the game service is closed then the game account buyer will lose so can eliminate the principle of willingness (an taradhin). The practice of buying and selling game accounts violates Article 4 letter c and Article 7 letter b in the Consumer Protection Law No. 8/1999. Abstrak. Jual beli Account game marak terjadi di media sosial, hal ini dimanfaatkan oleh penjual Account game di forum jual beli barang Rising Force Remastered. Tujuan penelitian ini adalah untuk menganalisis etika bisnis Islam dan UU Perlindungan Konsumen No.8/1999 terhadap jual beli Account game pada forum jual beli barang Rising Force Remastered. Metode penelitian yang digunakan adalah kualitatif, dengan pendekatan yuridis normatif, jenis data penelitian adalah penelitian kepustakaan (library research), sumber data penelitian berasal dari data sekunder, teknik pengumpulan data menggunakan wawancara dan studi pustaka, teknik analisis data menggunakan kualitatif deskriptif. Hasil penelitian ini adalah praktik jual beli Account game tidak sesuai dengan etika bisnis Islam karena penjual melanggar ketentuan yang telah dibuat oleh publisher game, kemudian jual beli Account game tersebut mengandung gharar terkait eksistensi objeknya, jika layanan game kelak ditutup maka pembeli Account game akan merugi sehingga dapat menghilangkan prinsip kerelaan (an taradhin). Praktik jual beli Account game tersebut melanggar Pasal 4 huruf c dan Pasal 7 huruf b dalam UU Perlindungan Konsumen No.8/1999.

Abstract

Abstract. Jual kaid is the name of a gold pawn in Tasikmalaya Regency which is one of the traditions of the Tawangbanteng Village community. The Mas Tasik Sari 1 store is one of the places that provides this product jual kaid. The jual kaid financing system carried out at Toko Mas Tasik Sari 1, in practice the cost of storage and maintenance (ujrah) depends on the amount of money borrowed. The purpose of this study was to determine the determination of ujrah and the review of fiqh muamalah on the practice of jual kaid carried out at the Mas Tasik Sari Store 1. The research method used in this study was qualitative with a sociological juridical approach. The data collection technique uses descriptive, namely the preparation of the results of the data obtained from the field which includes observation, interviews, documentation and literature study. Then it is processed based on written sources to become an accurate answer. The results of the study indicate that the practice of jual kaid at Toko Mas Tasik Sari 1 is not in accordance with the fatwa of DSN MUI No. 25/DSN-MUI/III/2002 which states that the amount of storage and maintenance costs for marhun should not be based on the size of the loan. Abstrak. Jual kaid merupakan sebutan gadai emas di Kabupaten Tasikmalaya yang menjadi salah satu tradisi masyarakat Desa Tawangbanteng. Toko Mas Tasik Sari 1 merupakan salah satu tempat yang menyediakan produk jual kaid ini. Sistem pembiayaan jual kaid yang dilakukan di Toko Mas Tasik Sari 1 ini, pada praktiknya biaya penyimpanan dan pemeliharaan (ujrah) tergantung pada besarnya jumlah uang pinjaman. Tujuan penelitian ini untuk mengetahui penentuan ujrah dan tinjauan fikih muamalah terhadap praktik jual kaid yang dilakukan di Toko Mas Tasik Sari 1. Metode penelitian yang digunakan dalam penelitian ini adalah kualitatif dengan pendekatan yuridis sosiologis. Teknik pengumpulan datanya menggunakan deskriptif, yaitu penyusunan hasil data-data diperoleh dari lapangan yang mencakup observasi, wawancara, dokumentasi dan studi kepustakaan. Kemudian diolah berdasarkan sumber-sumber tertulis untuk menjadi suatu jawaban yang akurat. Hasil dari penelitian menunjukkan bahwa dalam praktik jual kaid di Toko Mas Tasik Sari 1 belum sesuai dengan fatwa DSN MUI No. 25/DSN-MUI/III/2002 yang menyebutkan bahwa besar biaya penyimpanan dan pemeliharaan marhun tidak boleh berdasarkan jumlah besar pinjaman.

Abstract

Abstract. Mojiso is a soju drink that is labeled halal. This drink is adapted from the original soju from South Korea which is not labeled halal. The majority of Indonesians who are Muslim have made owner shop create this drink idea so they can feel the sensation of drinking soju. But unfortunately, this drink is still a problem in society because the bottle resembles real soju. Based on this phenomenon, the problems in this research are formulated as follows: (1) How is the practice of using used alcohol bottles on halal soju products at Mojiso.id Stores? (2) How is the use of used alcohol bottles in terms of Islamic Law at Mojiso.id Shop? The researcher used a qualitative descriptive method. The samples selected in this study were the owners and buyers of Mojiso.id Stores, employees of the Health Service, and 6 scholars. Data collection techniques used in this study were interviews, observation, and documentation. The data analysis technique used in this research is interactive analysis. The results of this study indicate that the practice of using used alcohol bottles at the Mojiso shop has several stages in the manufacturing process. These stages start from the process of searching, sorting, washing, drying, giving liquids, giving name labels, sealing bottle caps, and packing the product. Meanwhile, according to a review of Islamic law, the use of used alcohol bottles in halal soju products at the Mojiso Shop is allowed to be reused according to Islamic law on the condition that the bottles are completely clean of the alcohol contained in them. Abstrak. Mojiso merupakan minuman Soju yang berlabel halal. Minuman ini diadaptasi dari Soju asli asal Korea Selatan yang tidak berlabel halal. Mayoritas penduduk Indonesia yang beragama Islam membuat pemilik toko menciptakan ide minuman ini agar mereka dapat merasakan sensasi meminum Soju. Namun sayangnya, minuman ini masih menjadi problematika di masyarakat karena botolnya yang menyerupai Soju asli. Berdasarkan fenomena tersebut, maka permasalahan dalam penelitian ini dirumuskan sebagai berikut: (1) Bagaimana praktik penggunaan botol bekas khamr pada produk Soju halal di Toko Mojiso.id? (2) Bagaimana penggunaan botol bekas khamr yang ditinjau dari Hukum Islam di Toko Mojiso.id? Peneliti menggunakan metode deskriptif kualitatif. Sampel yang dipilih dalam penelitian ini adalah pemilik dan pembeli dari Toko Mojiso.id, pegawai Dinas Kesehatan, dan ahli ulama yang berjumlah 6 orang. Teknik pengumpulan data yang digunakan dalam penelitian ini adalah wawancara, observasi, dan dokumentasi. Adapun teknik analisis data yang digunakan dalam penelitian ini adalah analisis interaktif. Hasil dari penelitian ini menunjukkan bahwa praktik penggunaan botol bekas khamr di toko Mojiso memiliki beberapa tahapan dalam proses pembuatannya. Tahapan-tahapan tersebut mulai dari proses pencarian, penyortiran, pencucian, penjemuran, pemberian cairan, memberikan label nama, penyegelan tutup botol, dan pengepakan pada produk tersebut. Sedangkan menurut tinjauan hukum Islam, penggunaan botol bekas khamr pada produk soju halal di Toko Mojiso diperbolehkan untuk digunakan kembali menurut hukum Islam dengan syarat botol tersebut sudah benar-benar bersih dari zat alkohol yang terkandung didalamnya.

Abstract

Abstract. Toserba Selamat Cipanas Cianjur is a retail business that provides products for people's needs ranging from fashion, food, and furniture. Located in Cipanas, Cianjur. At the beginning of 2020 there was a Covid-19 pandemic that affected Toserba Selamat Cipanas, namely a decrease in income of around 40% due to limited public space and limited store operating hours. The purpose of this study was to analyze the sharia marketing strategy used by the Toserba Selamat Cipanas.The method used in this study uses a SWOT analysis method and a qualitative descriptive research. Data techniques with interviews and questionnaires to the head of the shop and some of his employees. The result of the research is that the Toserba Selamat Cipanas is also in the IIA quadrant position with a stability strategy, (Aggressive maintenance stability strategy) in that quadrant the existence of Toserba Selamat Cipanas shows that it has great opportunities but still has weaknesses that are greater than its strengths, therefore Cipanas's safety department stores must take advantage of opportunities so that it can become a strength so that it can minimize weaknesses and even avoid all forms of threats that can be predicted or unexpected. Abstrak. Toserba Selamat Cipanas Cianjur merupakan sebuah usaha Bisnis Ritail yang menyediakan produk kebutuhan masyarakat mulai dari sandang, pangan, dan papan. Terletak di daerah yang sangat strategis ditengah kota wisata yaitu di Cipanas Kabupaten Cianjur.Pada awal tahun 2020 terjadi pandemi Covid-19 yang mempengaruhi Toserba Selamat yaitu terjadinya penurunan pendapatan sekitar 40% karena dibatasinya ruang gerak masyarakat serta dibatasinya jam operasional toko . Tujuan penelitian ini adalah untuk menganalisis strategi marketing syariah yang digunakan oleh Toserba Selamat Cipanas Cianjur dan strategi apa yang dapat digunakan oleh Toserba Selamat Cipanas. Metode yang digunakan pada penelitian ini menggunakan Metode analisis SWOT dan pendekatan penelitian deskriptif kualitatif. Teknik pegumpulan data dengan wawancara dan kuesioner kepada kepala toko dan beberapa karyawannya. Hasil penelitiannya adalah Toserba Selamat ada di posisi kuadran IIA dengan strategi stabilitas, (Aggressive maintenance stability strategy) pada kuadran tersebut keberadaan Toserba Selamat menunjukan mempunyai peluang yang besar namun masih memiliki kelemahan yang ternyata lebih besar dari pada kekuatanya, maka dari itu toserba selamat Cipanas harus memanfaatkan peluang agar bisa menjadi kekuatan supaya bisa meminilmalisir kelemahan dan mewaspadai bahkan menghindari dari segala bentuk ancaman yang dapat diduga maupun tidak terduga

Abstract

Abstract. Agricultural zakat is one of the zakat maal which has its own rules regarding nishab and the type of agriculture according to Islamic law and Law Number 23 of 2011 concerning Zakat Management, especially Article 4. In this regard, farmers in Ciranggon Village, Karawang Regency carry out agricultural zakat without knowledge of the rules. nishab and zakat management mechanisms that are not in accordance with applicable legislation. Based on these problems, the focus of this study aims to determine the analysis of Islamic law on the implementation of agricultural zakat in Ciranggon Village, Karawang Regency, and to determine the analysis of Article 4 of the Zakat Management Act No. 23 of 2011 on the implementation of agricultural zakat in Ciranggon Village, Karawang Regency. The research method used is descriptive analysis with a normative juridical approach, namely analyzing the level of conformity of the implementation of agricultural zakat in Ciranggon Village with Islamic Law and Article 4 zakat management of Law no. 23 of 2011. The results show that the analysis of Islamic legal views on the practice of agricultural zakat in Ciranggon Village, Karawang Regency is not fully in accordance with the provisions of Islamic Law, especially related to nishab and the implementation of agricultural zakat practices in Ciranggon Village, Karawang Regency also not fully in accordance with the provisions of Article 4 of the Law. zakat management no. 23 of 2011 especially in the care of zakat that is not through an official amilin agency or institution. Abstrak. Zakat pertanian merupakan salah satu zakat maal yang memiliki aturan tersendiri terkait nishab dan jenis pertaniannya menurut Hukum Islam maupun UU Nomor 23 Tahun 2011 Tentang Pengelolaan Zakat khususnya Pasal 4. Terkait hal tersebut, para petani di Desa Ciranggon Kabupaten Karawang melaksanakan zakat pertaniannya tanpa pengetahuan mengenai aturan nishab dan mekanisme pengelolaaan zakatnya yang tidak sesuai perudang-undangan yang berlaku. Berdasarkan permasalahan tersebut, maka fokus penelitian ini memiliki tujuan agar bisa diketahui Analisis Hukum Islam Pada pelaksanaan zakat pertanian di Desa Ciranggon Kabupaten Karawang, dan untuk mengetahui analisis Pasal 4 UU pengelolaan zakat No. 23 Tahun 2011 terhadap pelaksanaan zakat pertanian di Desa Ciranggon Kabupaten Karawang. Penelitian ini memiliki metode yakni analisis deskriptif, sedangkan penelitian memiliki pendekatan yakni analisis deskriptif dengan pendekatan yuridis normatif yaitu menganalisis tingkat kesesuaian pelaksanaan zakat pertanian di Desa Ciranggon dengan Hukum Islam dan pasal 4 pengelolaan zakat UU No. 23 tahun 2011. Dimana penelitian ini memiliki hasil jika pandangan hukum Islam terhadap praktik zakat pertanian di Desa Ciranggon Kabupaten Karawang belum sepenuhnya selaras pada ketentuan Hukum Islam khususnya terkait nishab dan pelaksanaan praktik zakat pertanian di Desa Ciranggon Kabupaten Karawang juga belum sepenuhnya sesuai dengan ketentuan Pasal 4 UU pengelolaan zakat No. 23 Tahun 2011 khususnya dalam penitipan zakat yang tidak dengan melewati Badan atau Lembaga amilin resmi.
