Abstract

The classical fiqh clerics, when defining the word “al-rijâlu qawwâm...” in surah al-Nisa’ verses 34-35, interpreted it as “a husband who becomes a family leader”. From this interpretation, a wife is obliged to obey her husband and the nusyûz act applies only for the wives. In contrast, according to feminist fiqh views, such as Muhammad Syahrûr and Musdah Mulia, Nusyûz is an act of defiance of God’s commands. Therefore hurting the heart of a wife or husband, both through speech and deed, is nusyûz (disobedient). This article compares the views of classical scholars with modern thinkers about the problem of nusyûz in the family. This study concludes that modern thinking is more in line with the principles of equality and justice taught in the Qur’an. Thus, nusyûz can not only happen to the wife but also can be applied to the husband.

Abstract

The aims of this research were to describe the plots in Novel Ayahku bukan Pembohong by Tere Liye and explore the implications towards the literature teaching learning in Senior High School. This research was a descriptive-qualitative, which the technique implemented was text analysis. The result of this research showed that the novel plots are divided into 5 stages; descripting has 39 data, showing conflict has 31 data, raising conflict has 19 data, climax has 4 data, and resolution has 7 data. The implication of this research was approppriate in literature teaching learning of senior high school for novel material.Tujuan penelitian ini untuk mendeskripsikan Tahapan Alur dalam novel Ayahku bukan Pembohong karya Tere Liye dan implikasinya dalam pembelajaran sastra di Sekolah Menengah Atas. Metode yang digunakan adalah metode deskriptif kualitatif. Teknik analisis data dalam penelitian ini adalah analisis teks. Hasil analisis secara secara keseluruhan pada Ayahku bukan Pembohong karya Tere Liye terdiri atas alur yang di bagi menjadi lima tahap yaitu, penyituasian 39 data, pemunculan konflik 31 data, peningkatan konflik 19 data, klimaks 4 data, dan penyelesaian 7 data. Hasil penelitian ini dapat diimplikasikan terhadap pembelajaran sastra di Sekolah Menengah Atas kelas XII pada materi novel.Kata kunci: tahapan alur, implikasi, dan novel

Abstract

Female circumcision is a present muslim societies‟tradition since ancient to modern times. Some moslemscholars say women do not need to be circumcised,but many other scholars argue for female circumcisionlaw is mandatory. They argue with hadith narrated byAbu Dawood from Umu Athiyah and narrated byAhmad from Osama. Scientifically studied these haditsis dha‟if can not be used as a basis in determining theproposition or obligation circumcision for girls. If atthe time of the Prophet Muhammad ever set of femalecircumcision, it should be understood only as hisijtihad itself, not as a permanent Sunnah, and justbecause people not be continue it. This is the wisdomof the Prophet who want to make changes to thetradition but performed by gradual and withoutcausing chaos.

Abstract

Abstract: The Dynamics of Sunnah Authority as a Source of Islamic Law. The development of Islamic law to respond to social changes had caused the authority of the Sunnah experience a dynamic evolution. At first, the sole autoritative Sunnah, as the source of law, was the Sunnah of the Prophet. In the era of companions, however, the Sunnah also included behavior and decisions made by the prophet’s companions. In the era of post-Companions, the religious opinions made by judges or the rulings were also considered as Sunnah as they were also based on the Sunnah of the Prophet. Thus, a variety of the Sunnah emerged at the same time in several regions. Facing with this phenomenon, a number of muslim scholars such as: al-Syâfi’i, al-Qarâfi, Yûsuf al-Qaradhâwi, evaluate the authority of the Sunnah and distinguish them to be the one which is still authoritative to be carried out (ma’mûl bih) and the other one which no longer can be carried out (ghair ma’mûl bih). Abstrak: Dinamika Otoritas Sunnah Nabi Sebagai Sumber Hukum Islam. Perkembangan hukum Islam dalam merespon berbagai perubahan sosial menyebabkan otoritas Sunnah Nabi mengalami evolusi yang dinamis. Pada awalnya, Sunnah yang otoritatif sebagai sumber hukum hanyalah Sunnah Nabi. Pada era sahabat, Sunnah juga mencakup perilaku dan putusan-putusan sahabat. Pada era Pasca Sahabat, fatwa ulama atau putusan hakim pengadilan juga diangap sebagai Sunnah karena diyakini masih tetap bersumber dari Sunnah Nabi. Oleh karena itu muncul berbagai sunnah-sunnah lokal yang berbeda. Menghadapi fenomena ini, sejumlah ulama’/intelektual Muslim seperti: al-Syâfi’i, al-Qarâfi, Yûsuf al-Qaradhâwi, memberikan pendapat tentang otoritas Sunnah dan membedakan mana Sunnah yang masih ma’mûl bih atau otoritatif untuk diamalkan dan ada yang sudah ghair ma’mûl bih atau tidak dapat diamalkan lagi.

Abstract

Abstract: This paper examines the theological foundation of conflict resolution from the treasury of the Prophet's Sunnah. This foundation is important to be studied as an epistemology and argument for strengthening conflict resolution in the reconstruction of Islamic science in the modern era. The Sunnah of the Prophet as one of the important sources of Islamic teachings after the Qur'an will strengthen the theological foundation of conflict resolution. This study uses the document study method, with data sources from hadith texts and classical literature to then be processed and analyzed qualitatively using a historical approach. Research findings show that the Sunnah of the Prophet has exemplified the basis and model of conflict resolution or conflict resolution, such as conflict resolution in laying the Hajar Aswad stone, the Medina charter and the Hudaibiyah agreement. The Sunnah of the Prophet as written in the hadith texts is an important source in extracting and determining conflict resolution in society. The Sunnah of the Prophet brings living values in society and is followed by its members. Because Islam is a religion that is embraced by the majority of Indonesian people, the conflict resolution based on the Sunnah of the Prophet provides a better direction. The Sunnah of the Prophet teaches that the model of conflict resolution depends on the type of conflict and the situation and condition of the people who are experiencing conflict. Conflict resolution in the traditions of the Sunnah of the Prophet has developed into the reality of society called local wisdom. Therefore, local wisdom is actually a development of the teachings of the Sunnah of the Prophet who has experienced actualization. The important thing to do is to contextualize and reactivate the values of wisdom in the Sunnah of the Prophet into a model of conflict resolution to remain relevant in the midst of current developments. The various values of conflict resolution or reconciliation in the Sunnah of the Prophet are relevant as approaches to conflict resolution in order to create a harmonious family and a united and peaceful Indonesian state. Abstrak: Tulisan ini mengkaji tentang landasan teologis resolusi konflik dari khazanah Sunnah Nabi. Landasan ini penting dikaji sebagai epistemologi dan argumentasi penguatan resolusi konflik dalam rekonstruksi ilmu keislaman di era moderen. Sunnah Nabi sebagai salah satu sumber penting ajaran Islam setelah al-Qur’an akan memperkuat landasan teologis resolusi konflik. Penelitian ini menggunakan metode studi dokumen, dengan sumber data dari teks-teks hadis dan literatur klasik untuk kemudian diolah dan dianalisis secara kualitatif dengan menggunakan pendekatan historis. Temuan penelitian menunjukkan bahwa dalam Sunnah Nabi telah banyak dicontohkan dasar dan model penyelesaian konflik atau resolusi konflik, seperti penyelesaian konflik dalam peletakkan batu Hajar Aswad, piagam Madinah dan perjanjian Hudaibiyah. Sunnah Nabi sebagai­mana tertulis dalam teks-teks hadis adalah satu sumber penting dalam penggalian dan penentuan resolusi konflik dalam masyarakat. Sunnah Nabi membawa nilai-nilai yang hidup dalam masyarakat dan diikuti oleh anggotanya. Oleh karena Islam merupakan agama yang dipeluk oleh mayoritas masyarakat Indonesia, maka resolusi konflik berbasis Sunnah Nabi memberikan arah lebih baik. Sunnah Nabi mengajarkan bahwa model penyelesaian konflik tergantung kepada jenis konflik serta situasi dan kondisi masyarakat yang mengalami konflik. Resolusi konflik dalam tradisi Sunnah Nabi telah berkembang ke dalam realitas masyarakat yang disebut dengan kearifan lokal. Oleh karena itu maka kearifan lokal sebenarnya merupakan pengembangan dari ajaran Sunnah Nabi yang telah mengalami aktualisasi. Hal yang penting dilakukan adalah melakukan kontekstualisasi dan reaktualisasi nilai-nilai kearifan dalam Sunnah Nabi ke dalam model reolusi konflik agar tetap relevan di tengah perkembangan kekinian. Berbagai nilai-nilai resolusi konflik atau islah dalam Sunnah Nabi tersebut relevan sebagai pendekatan dalam penyelesaian konflik agar terwujud keluarga yang harmoni dan negara Indonesia yang bersatu dan damai.

Abstract

This writing studies Syatibi’s thought on the appropriation of both the Qur’an and Hadith of the makkiyah period as “the root” (usul) and those of the madaniyyah as “the branch” (furu’). Such thought implies the function of the makkiyah texts as “the principle”, and the madaniyah ones as “the implementation”.  This paper then questions the extent to which such thought by Syatibi is relevant with the renewal of Islamic law in contemporary Muslim societies. It uses literary study as its research method, and does its data analysis qualitatively. This research finds out that, Syatibi views the makkiyah texts as an ushul that constitutes a subsistence of maqasid syariah (purposes of the law),  while the madaniyah texts as a furu’, one that forms the implementation of that maqasid syairah. Using his theory of istiqrai makwani, Syatibi views the makkiyah texts as a deductive justification which consists of legal norms between human beings. The teachings of morality and ethics contained in the makkiyah justification are fixed, while those of the madaniyah justification are dynamic and contingent. The consequence is that any form of obligation and prohibition in Islamic law which are derived from the madaniyah justification is dynamic and are changing according to its spatial and historical contexts: hence the compatibility of the texts with the principle of maqasid syariah.

Abstract

Nusyúz is a classical conception codified as a standard law written in Qs. an-Nisáa’ verses 34 and 128. The conventional fiqh perspective of nusyúz connotes the wife’s disobedience to her husband, because it is influenced by the patriarchy of pre-Islamic Arab culture. Presidential Instruction Number 1 of 1991 concerning the Compilation of Islamic Law in Indonesia mentions nusyúz in Articles 80, 84 and 125, only regulates the wife’s nusyúz and its legal sanctions, while the husband’s nusyúz is not mentioned. There is ambivalence, ambiguity and legal injustice for the wife. The focus of this research is the concept of nusyúz in KHI from a gender perspective and its correlation with the development of family law in Indonesia. This type of research is library research with a gender equality analysis approach. The results of this study indicate that it is necessary to rearrange the concept of nusyúz in the KHI, including the modern era understanding of nusyúz and adding the husband's concept of nusyúz and its legal sanctions in KHI.Keywords:     Nusyúz Modern Era, Gender Perspective, Justice.

Abstract

The term Islam Nusantara has sparked and caused polemics, pros, and cons that are quite warm in Indonesia since 2015 until now. As happened in the West Sumatra MUI environment. Islam Nusantara is interpreted as a religious pattern that exists in the archipelago, both at the level of religious practice and how to preach it. The level of amaliyah is interpreted as religious behavior that exists in the archipelago, especially in relation to fiqh which originates from its religious understanding. The problem is: What is the source of knowledge used in formulating Islamic fiqh in Nusantara? What is the validity and method of understanding the sources of knowledge used in formulating Islamic jurisprudence in Nusantara? How is the contribution of Islam Nusantara jurisprudence in reforming family law in Indonesia? This study aims to find answers to the epistemological formulation of Islamic jurisprudence in the archipelago and its contribution to reforming family law in Indonesia. To answer the questions above, the author uses qualitative research methods, types of literature research, the theory of ijtihad with the ushul fiqh approach. This means that the study of the concept of Islam Nusantara is carried out using the framework of ushul fiqh knowledge, especially regarding the concept of ijtihad. At the level of research work, the stretching of thinking to produce fiqh concepts that are unique to the archipelago is seen as part of ijtihad activities. The findings of the research are: (a) The source of knowledge used in formulating Islamic jurisprudence in the archipelago is a source of knowledge commonly known in the study of fiqh and ushul fiqh, both the mujma ’alaih and the mukhtalaf fih, (b) the source of knowledge as said to be valid. By giving a large enough portion to 'urf, and a benefit-oriented understanding, (c) Islam Nusantara’s fiqh can be used as an alternative law in the context of reforming family law in Indonesia.Keywords: Islam Nusantara, Jurisprudence, Epistemology, Legal Reform

Abstract

The meaning of hijrah and jihad has been misunderstood from spiritual meaning to plotical identity among millennial Muslims and students in Indonesia. They start from the desire to change one step to a better or Islamic life in more syar'i terms. However, in the end this understanding led to the emergence of radicalism and intolerance rather than a more contextual and moderate understanding that is relevant to be applied in the life of religion, nation and state. This study uses a qualitative method with the type of library research. The source of the data is obtained through various online media, journals and other literature, and the theory used as an analytical tool is the theory of contextualization. This study finds that the hijrah and jihad movements that are developing among millennials and students in Indonesia originate from a textual understanding of these meanings. The meaning of hijrah and jihad is only understood as a person's change from a bad life to a more syar'i in religion. This phenomenon must be immediately changed towards a textual understanding towards contextual and moderate by using a fast and precise strategy, starting from the teaching system of verses of the Koran and hadiths about Hijrah and Jihad in Higher Education which needs to be contextualized with the current era.
