Abstract

Law enforcement officers often consider that torture is best and easiest way to be able to extract information from a suspects. In fact, we often find media reports about the violence committed by the investigator in the investigation process to get confession from someone who allegedly committing a crime.As for the purpose of writing this thesis is to determine arrangements of legal protection to suspects who experienced crimes of violence in the investigation process and criminal accountability of violence committed by investigators associated with efforts to protect the human rights of suspects.In writing this thesis, the author use the normative research methods, which in this study by a literature review. To draw a conclusion from the collected data, the authors using data analysis techniques deductive, by draw a conclusion from general to specific conclusion.The conclusion that can be derived from this research are: First, the setting about law protection of abused suspects in the investigation process does not have special regulations, so there are still many loopholes for law enforcement officials committing acts of violence in the investigation process. Second, the criminal liability of the investigator who do violence to the suspect did not go as mandated by chapter 422 of KUHP, where there are many investigators who commit acts of violence in performing its duties escape from legal responsibility. As well as ineffective oversight of the process of investigations conducted by the superior based on rules of Criminal Investigation about supervisory investigation and the need for revision of these regulations in order to optimize the process of monitoring the investigation.Keywords: Regulation - Legal Protection - Suspect

Abstract

Health services was one of the main factors affected the health status of the community. The organization of health care providers such as community health centers was aform of health resources provider have quality service in appropriate with community expectations. The aim of this research was to known the correlation between the indicators quality of service (technical competence, access to service, human intercourse, security, convenience, continuity of service, efficiency and effectiveness) with the patient health maternity and child health (KIA) level at community health center Plus Perbaungan. The type of research use was quantitative research with cross sectional design. The number of samples of 48 respondents conducted by using accidental sampling technique. The data collection used questionnaires. Data were analyzed quantitatively with Chi-Square test with 95% α=0,05 and logistic regression p=0,25. Data analysis showed 5 service quality indicator that related to patient satisfaction of KIA that is technical competence (p = 0,024), relation between man (p = 0,020), comfort (p = 0,024), service continuity (p = 0.027), efficiency (p = 0.003). From 7 variables that enter into logistic regression test there was 1 variable have p value ≤ (0,05) that was efficiency variable with value (p = 0,003, B = 1,732) concluded that there is effect of efficiency to satisfaction of patient KIA with big influence 1,732 meaning Efficiency variables 1,732 times affect patient satisfaction KIA. It was expected that the Plus Plus Community Health Center improves the quality of service in order to maintain patient satisfaction especially pay more attention to efficiency services.

Abstract

Mahkamah Konstitusi melalui putusan No.14/PUU-XII/2014 menyatakan menolak permohonan gugatan sejumlah dokter yang mempersoalkan ketentuan pidana dan proses hukum dalam pasal 66 ayat (3) UU No.29 Tahun 2004 tentang praktik kedokteran. Pemberlakuan pasal 66 ayat(3) aquo menimbulkan ketidakpastian hukum, hilangnya hak konstitusional dokter, reputasi, dan rasa aman, serta timbul rasa takut dalam menjalankan praktik kedokteran karena setiap orang dimungkinkan mengadukan dokter secara pidana maupun perdata tanpa melalui MKDKI. Tujuan penelitian: memahami perlindungan hukum terhadap dokter atas dugaan melakukan tindak pidana medik pasca putusan Mahkamah Konstitusi No.14/PUU-XII/2014 dihubungkan dengan sifat melawan hukum materiil dan memahami implikasi mengabaikan ajaran sifat melawan hukum materiil dalam penentuan terhadap terjadinya tindak pidana medik bagi dokter yang diduga melakukan tindak pidana medik. Penelitian ini menggunakan pendekatan yuridis normatif bersifat deskriptif analitik dengan data sekunder dari studi pustaka melalui bahan hukum primer, sekunder maupun tersier yang berkaitan dengan tindak pidana medik, sifat melawan hukum dan perlindungan hukum dalam hukum pidana Indonesia. Data dianalisa menggunakan analisa kualitatif. Kesimpulan: dengan ditolaknya gugatan terhadap uji materiil pasal 66 ayat (3) melalui putusan Mahkamah Konstitusi No.14/PUU-XII/2014 hak dokter dan dokter gigi untuk memperoleh perlindungan hukum atas dugaan tindak pidana medik berdasarkan peraturan perundang – undangan Indonesia yang berkeadilan belum terwujud memberikan keadilan, ketertiban dan kepastian. Saran: aparat penegak hukum agar mempunyai persepsi yang sama dalam menerapkan perbuatan melawan hukum atas dugaan melakukan tindak pidana medik baik secara formal maupun materiil, pemerintah agar membuat pedoman peraturan pemerintah dan pembentukan suatu lembaga penyelesaian sengketa medik, sarana pelayanan kesehatan agar membuat standar pelayanan medik perlindungan dokter sesuai undang-undang, dan masyarakat agar memahami dan mengerti perbedaan antara tindak pidana medik dan risiko medik.

Abstract

ABSTRAKKeberhasilan pelayanan gizi di rumah sakit dalam mendukung proses penyembuhan penyakit pada pasien, sangat ditentukan oleh proses pengolahan makanan mulai dari bahan makanan sampai menjadi makanan jadi yang siap dikonsumsi oleh pasien. Pelayanan gizi dapat terlaksana dengan baik apabila didukung oleh manajemen penyelenggaraan makanan yang baik. Manajemen penyelenggaraan makanan merupakan serangkaian kegiatan yang dilakukan mulai dari perencanaan makanan sampai dengan distribusi makanan kepada pasien/konsumen yang berfungsi sebagai sistem dengan tujuan untuk menghasilkan makanan dengan kualitas yang baikJenis penelitian ini menggunakan Kualitatif Fenomenologi dengan menggunakan deskriptif Informan penelitian berjumlah  22 orang. Informan Penelitian ini dikelompokkan menjadi dua yaitu informan utama dan informan pendukung. Adapun informan utama berjumlah 17 informan yaitu kepala instalasi gizi dan tenaga di instalasi gizi. Sedangkan informan pendukung berjumlah 5 informan yaitu pasien rawat inap.Berdasarkan hasil secara kualitatif berdasarkan wawancara mendalam terhadap informan didapatkan  bahwa perlu evaluasi mulai dari input, proses sampai output gizi harus diperbaiki, penambahan tenaga gizi, sarana dan prasarana, proses perencanaan di instalasi gizi serta hasil masakan yg disajikan sering mengalami keterlambatan juga dari segi variasi maupun cita rasa makanan      harus di kaji ulang, sehingga manajemen penyelenggaraan makanan menjadi lebih baik lagi.Kesimpulan dalam penelitian ini tenaga gizi masih kurang, sarana dan prasarana tergolong kurang memadai, dan biaya opersaional sangat minim berasal dari APBD. Selain itu, proses yang meliputi kegiatan penyelenggaraan makanan juga tidak seluruhnya dilakukan. Saran diharapkan Seluruh petugas di Instalasi Gizi RSUD Dr. R.M. Djoelham Binjai diharapkan melaksanakan seluruh kegiatan penyelenggaraan makanan sesuai langkah-langkah dan memenuhi persyaratan yang telah ditentukan dalam pedoman PGRS. Kata Kunci    :           Evaluasi, manajemen penyelenggaraan gizi.

Abstract

The legal research method is a scientific activity based on certain methods, systematics, and thoughts, which aims to study one or several certain legal phenomena by analyzing them, except that, an in-depth examination of the legal facts is also held to then seek a solution. on the problems that arise in the symptoms in question. For this reason, research is carried out which includes methods. This research is a descriptive analysis which aims to describe in detail, systematically and thoroughly related to the problem. In this study, the data collection technique used is a library study. The literature study is carried out through secondary data sources, namely data that includes official documents, books,Malpractice in Article 11 paragraph (1) letter b in Law Number 6 of 1963 concerning Health Workers, which has been declared abolished by Law Number 23 of 1992 concerning Health. Based on the provisions of Article 11 paragraph (1) letter b of Law Number 6 of 1963, it can be used as a reference regarding malpractice, in the fields of administration, civil law, and criminal law. In medical malpractice which becomes an act against the law because of its nature, the will is often directed at the form of the act and not at the result. Culpa is usually only focused on the result. The adverse effects on the patient are not desired. In medical malpractice the form of action must be inconsistent with medical professional standards and standard operating procedures or at least contrary to normal general practice in the medical world.

Abstract

The main problem in this research is a policy problem, namely the problem of legal policy in regulating the rules of legal certainty for health facilities. Therefore the approach to this problem is a policy-oriented approach. However, considering that the main target of this research is legislative policy in formulating legal certainty for health facilities in carrying out their duties and functions, the approach is mainly taken with a juridical-normative approach. This research was conducted at the Blangkejeren Public Health Center, Lhoksukon City, Central Aceh, with literature studies at the Panca Budi University Library and internet searches. The data sources of a research are primary data and secondary data. Because this research is a normative legal research, the sources studied are secondary data sources. Legal certainty of payment for health services has provided legal certainty to Health Service Providers (PPK) as regulated in Presidential Regulation Number 19 of 2016 concerning the Second Amendment to Presidential Regulation Number 12 of 2013 concerning National Health Insurance (JKN). However, this change still does not provide legal certainty for BPJS patients when problems occur related to the amount of payments that must be paid by BPJS to Health Service Providers, if there are patients who experience/require to be treated with costs that exceed the rates determined by BPJS. Abstract

The purpose of this study is to determine the effect of evaluation by the head of the room on the performance of nurses in the inpatient room of RSU Hajj Medan in 2020. This study used a quantitative method with a cross sectional design. The results of the study found that the effect of behavior evaluation on nurse performance showed a significance value of 0.000 (p <0.05). The effect of the evaluation of professional abilities on the performance of nurses shows a significance value of 0.417 (p> 0.05). The effect of the evaluation of the nursing process on the performance of nurses shows a significance value of 0.006 (p <0.05). The conclusion of this study is that there is an effect of behavior evaluation and nursing process by the head of the room on the performance of nurses in the inpatient room of RSU Hajj Medan in 2020. Evaluation of professional abilities does not have a significant effect on the performance of nurses. The most influential variable is the behavior with the highest coefficient value, amounting to 0.512 with a positive value. The head of the room is expected to optimize his role in evaluating programmed, scheduled, and in accordance with the standards and principles of implementation.

Abstract

The legal relationship between doctors and patients is essentially a relationship that needs each other and is based on trust, but along the way, it is not impossible to end up in a medical dispute. The emergence of disputes that occur between doctors and patients is more often due to weaknesses in building effective communication which results in conflict between doctors and patients. The emergence of a conflict that leads to a dispute does not need to occur if both parties understand their position and position both from a medical and legal perspective through a good communication network, mutual respect and mutual trust. And if finally there is a medical dispute between the two parties, both doctors and patients, legal communication should be put forward such as mediation to resolve medical disputes that occur. Thus, mediation as legal communication in the resolution of medical disputes requires effective communication efforts by optimizing the value of a win-win solution between the disputing parties, both from the doctor and the patient, in achieving the goal of resolving medical disputes, especially outside the court (non-litigation mediation).

Abstract

ABSTRAKRSUD Dr. R.M. Djoelham Binjai merupakan rumah sakit provider BPJS, di mana pada implementasi kebijakan JKN masih terdapat masalah-masalah terutama terkait pending klaim seperti adanya miss komunikasi, kurangnya kerja sama/komitmen (disposisi) petugas dalam menjalankan peraturan sehingga berdampak pada kelancaran klaim/besaran klaim yang dapat merugikan rumah sakit.Penelitian ini bertujuan untuk mengetahui Mengapa terjadi pending klaim BPJS kesehatan pasien rawat inap di RSUD DR.RM Djoelham Binjai. Jenis penelitian ini adalah penelitian kualitatif dengan pendekatan fenomenologi dengan menggunakan wawancara mendalam sebagai cara untuk mengumpulkan data. Informan penelitian ini sebanyak 7 informan terdiri dari 1 informan utama dan 6 informan pendukung.Hasil  penelitian menunjukkan Pengembalian berkas klaim pasien rawat inap  BPJS Kesehatan di RSUD Dr. R.M. Djoelham Binjai terjadi karena ketidak sesuaian atau tidak lengkapnya pengisian item-item di dalam pengisian rekam medis, kesalahan petugas dalam proses penginputan, selain itu perbedaan pemahaman mengenai kelengkapan berkas klaim antara pihak Verifikator internal rumah sakit dengan pihak verifikator BPJS Kesehatan.            Berdasarkan  penelitian  ini, diharapkan kepada RSUD Dr. R.M. Djoelham Binjai untuk meningkatkan kinerja dengan melakukan Pelatihan, Pengawasan dan evaluasi kepatuhan petugas secara berkala dalam pengisian lembar syarat yang diajukan pada pihak verifikator BPJS. Abstract

Currently the demand for automation and intelligence systems is very high. That's why people are showing interest in smart devices. For example, people can control or monitor their household appliances via the web or applications via mobile phones. Internet of Things (IoT), which can make these devices or hardware devices communicate, exchange data, and control each other via the web or smartphone applications. Temperature and humidity in the environment can also be monitored via the web and smartphones using (IoT) so that the air in the environment remains healthy and awake. In this study, the ESP8266 MCU Node and the DHT11 sensor were used which can measure temperature and relative humidity. The IoT platform used is Blynk which is connected to a smart phone. The results of this study are temperature and relative humidity readings that can be monitored in real time via a smart phone, making it very easy for our efforts to monitor temperature and humidity in a place
