Abstract

The writing of this thesis examines the resolution of consumer disputes through the establishment of the Consumer Dispute Resolution Agency (BPSK) in the city of Jambi. The purpose of writing, knowing and analyzing consumer dispute resolution through BPSK so that it becomes urgent in the city of Jambi. Formulation of the problem regarding the form of consumer dispute resolution in the city of Jambi and the importance of non-litigation resolution, namely through BPSK so that it becomes urgent in the city of Jambi. The research method used is empirical research with descriptive qualitative analysis research specifications. The findings in this thesis, first of the twenty-two consumer complaints to the Indonesian Consumers Foundation (YLKI), ten cases of consumer disputes that entered the BPSK district / city of Bungo, five cases of consumer disputes that were submitted to the BPSK regency / city of Sarolangun. It appears that consumer complaint disputes will continue because the relationship between business actors and consumers is intertwined with one another. Second, the process of consumer dispute resolution assisted by YLKI is limited and does not have the final power as BPSK. Then, the government's attention is needed as an effort to improve the welfare of the community in helping people resolve consumer disputes by facilitating BPSK as a special body based on the mandate of consumer protection law. Abstrak Penulisan skripsi ini mengkaji mengenai penyelesaian sengketa konsumen melalui pembentukan Badan Penyelesaian Sengketa Konsumen (BPSK) di kota jambi. Tujuan penulisan, mengetahui dan menganalisis penyelesaian sengketa konsumen melalui BPSK sehingga menjadi urgen di kota jambi. Rumusan masalah mengenai bentuk penyelesaian sengketa konsumen di kota jambi dan pentingnya penyelesaian non litigasi yaitu melalui BPSK sehingga menjadi urgen di kota jambi. Metode penelitian yang digunakan penelitian empiris dengan spesifikasi penelitian deskriptif analisis kualitatif. Temuan dalam skripsi ini, pertama dari dua puluh dua pengaduan konsumen kepada Yayasan Lembaga Konsumen Indonesia (YLKI), sepuluh kasus sengketa konsumen yang masuk ke BPSK kabupaten/kota bungo, lima kasus sengketa konsumen yang masuk ke BPSK kabupaten/kota sarolangun. Terlihat bahwa sengketa pengaduan konsumen akan terus berlangsung karena hubungan antara pelaku usaha dan konsumen yang saling terikat satu sama lain. Kedua, adapun proses penyelesaian sengketa konsumen yang dibantu oleh YLKI terbatas dan tidak mempunyai kekuatan final seperti halnya BPSK. Kemudian, diperlukan perhatian dari pemerintah sebagai upaya mensejahterakan masyarakat dalam membantu masyarakat menyelesaikan sengketa konsumen dengan memfasilitasi BPSK sebagai badan khusus berdasarkan amanat undang – undang perlindungan konsumen.

Abstract

The purposes of this study are: 1) To find out and analyze the form of seller's good faith in buying and selling online through social media. 2) To find out and analyze the legal consequences of sellers who do not have good intentions in online buying and selling transactions through social media. Problem formulation: 1). What is the form of seller's good faith in online buying and selling transactions through social media. 2). What are the legal consequences for sellers who do not have good intentions in online buying and selling transactions through social media. Research method: the research method used is normative juridical law research. The results of the study are: 1) Good intentions in starting activities, namely delivering goods according to the agreement, providing correct information on the conditions and guarantees of goods or services. 2). As a result of the law against sellers who do not have good intentions in online buying and selling transactions through social media, the seller has an obligation to provide compensation, or replace goods that are not in accordance with the agreement as the buyer's rights. ABSTRAK Tujuan dari penelitian ini adalah: 1)Untuk mengetahui dan menganalisis bentuk iktikad baik penjual dalam transaksi jual beli secara online melalui media sosial. 2)Untuk mengetahui dan menganalisis akibat hukum terhadap penjual yang tidak beriktikad baik dalam dalam transaksi jual beli secara online melalui media sosial. Rumusan masalah: 1).Bagaimana bentuk iktikad baik penjual dalam transaksi jual beli secara online melalui media sosial. 2).Bagaimana akibat hukum terhadap penjual yang tidak beriktikad baik dalam dalam transaksi jual beli secara online melalui media sosial. Metode penelitian: metode penelitian yang digunakan penelitian hukum yuridis normatif. Hasil penelitian adalah: 1) Niat baik dalam kegiatan usahanya yaitu melakukan pengiriman barang sesuai dengan kesepakatan, memberitahukan informasi secara benar adanya mengenai kondisi dan jaminan barang atau jasa. 2).Akibat hukum terhadap penjual yang tidak beriktikad baik dalam dalam transaksi jual beli secara online melalui media sosial penjual mempunyai kewajiban untuk memberikan kompensasi, atau penggantian barang yang tidak sesuai kesepakatan sebagai hak pembeli.

Abstract

Abstract This study aims to determine and analyze: 1) why there is a land dispute between the corporation and the community in Muaro Jambi Regency; 2) how is the settlement of land disputes between corporations and communities related to legal certainty in Muaro Jambi Regency. This research is empirical legal research with data collection techniques through interviews and documentation studies. The results showed that 1) land disputes between corporations and communities in some cases in Muaro Jambi Regency were caused by a not good faith of land sale and purchase agreements, land tenure was not based on clear rights and sales and purchases that were not carried out by the legal owner. 2) Settlement of land disputes between corporations and community in Muaro Jambi Regency based on the provisions of Article 37 and Article 46 (Regulation of the Minister of Agrarian and Spatial Planning / Head of the National Land Agency Number 11 of 2016 concerning Settlement of Land Cases). Abstrak Penelitian ini bertujuan untuk mengetahui dan menganalisis: 1) mengapa terjadi sengketa tanah antara korporasi dengan masyarakat di Kabupaten Muaro Jambi; 2) bagaimana penyelesaian sengketa tanah antara korporasi dengan masyarakat kaitannya dengan kepastian hukum di Kabupaten Muaro Jambi. Penelitian ini adalah penelitian hukum empiris dengan tehnik pengumpulan data, wawancara dan studi dokumentasi. Hasil penelitian menunjukkan bahwa 1) penyebab terjadinya sengketa tanah antara korporasi dengan masyarakat di Kabupaten Muaro Jambi pada beberapa kasus disebabkan karena perjanjian jual beli tanah yang tidak dilandasi itikad baik, penguasaan tanah tanpa dilandasi alas hak yang jelas danjual beli yang tidak dilakukan oleh pemilik yang sah. 2) Penyelesaian sengketa tanah antara korporasi dengan masyarakat di Kabupaten Muaro Jambi ditelusuri dengan ketentuan yakni: ketentuan Pasal 37 dan Pasal 46 Peraturan Menteri Agraria Dan Tata Ruang/Kepala Badan Pertanahan Nasional (Permen Agraria) Nomor 11 Tahun 2016 tentang Penyelesaian Kasus Pertanahan.

Abstract

This study aims to determine and analyze the form of legal protection for recipients of blank bilyet giro based on Decision Number 2470 K / Pdt / 2014 and Decision Number 423 / PDT / 2018 / PT DKI. Furthermore, to find out and analyze the publisher's responsibility regarding blank bilyet giro based on Decision Number 2470 K / Pdt / 2014 and Decision Number 423 / PDT / 2018 / PT DKI. The formulation of the problems in this study are 1) What is the form of legal protection for recipients of empty bilyet giro related to Decision Number 2470 K / Pdt / 2014 and Decision Number 423 / PDT / 2018 / PT DKI? 2) What is the publisher's responsibility regarding Decision Number 2470 K / Pdt / 2014 and Decision Number 423 / PDT / 2018 / PT DKI? This research method is normative legal research and uses a statutory approach, a case approach, and a conceptual approach. The result of this research is the legal protection provided to recipients of empty bilyet giro in the form of repressive legal protection in the form of regressive rights and claiming compensation and payment, by filing a lawsuit to the Court. The publisher's responsibility for issuing blank bilyet giro is to provide compensation and provide an object of guarantee to the recipient based on a court decision.  Abstrak Penelitian ini bertujuan untuk mengetahui dan menganalisis bentuk perlindungan hukum bagi penerima bilyet giro kosong berdasarkan Putusan Nomor 2470 K/Pdt/2014 dan Putusan Nomor 423/PDT/2018/PT DKI. Selanjutnya untuk mengetahui dan menganalisis tanggung jawab penerbit terkait bilyet giro kosong berdasarkan Putusan Nomor 2470 K/Pdt/2014 dan Putusan Nomor 423/PDT/2018/PT DKI. Adapun rumusan masalah dalam penelitian ini adalah 1)Bagaimanakah bentuk perlindungan hukum bagi penerima bilyet giro kosong terkait dengan Putusan Nomor 2470 K/Pdt/2014 dan Putusan Nomor 423/PDT/2018/PT DKI? 2)Bagaimanakah tanggungjawat penerbit terkait Putusan Nomor 2470 K/Pdt/2014 dan Putusan Nomor 423/PDT/2018/PT DKI? Metode penelitian ini adalah penelitian hukum normatif dan menggunakan pendekatan peraturan perundang-udangan, pendekatan kasus, serta pendekatan konseptual. Hasil dari penelitian ini adalah perlindungan hukum yang diberikan bagi penerima bilyet giro kosong berupa perlindungan hukum represif berupa hak regres dan menuntut ganti rugi serta pembayaran, dengan mengajukan gugatan ke Pengadilan.  Bentuk pertanggungjawaban penerbit terhadap penerbitan bilyet giro kosong yaitu memberikan ganti rugi serta memberikan objek jaminan kepada penerima berdasarkan putusan pengadilan.

Abstract

This study aims to determine the responsibilities of the Provider/PT.Gunung Reduk to workers who experience work accidents who have not been registered in the BPJS Employment program, as well as to find out the constraints that the Provider/PT.Gunung Reduk have in giving responsibility to workers who experience work accidents. . The research method used is empirical juridical, namely researching in terms of labor protection in terms of social security which should be based on applicable laws and regulations and how it is implemented at PT.Gunung Reduk. Based on the results of the research and discussion, it was found that, in carrying out the responsibility of Provider/PT. Gunung Reduk to workers who had work accidents, they had carried out their responsibilities, namely by providing treatment and care costs and transportation costs to the hospital when an accident occurred, but this is not in accordance with the applicable law, because the provider does not register its workers in the BPJS Employment program. The provider/PT.Gunung Reduk should immediately register their workers into the BPJS Employment program, because workers have the right to get protection in the form of Social Security provided by the Social Security Administering Body (BPJS) which has been stipulated by Law Number 24 of 2011. The obstacles The provider/PT.Gunung Reduk in giving responsibility to workers who experience work accidents in the form of administrative obstacles, namely BPJS registration which is considered so complicated, workers who are only contracted for 3 months, BPJS is considered not so important, and the provider's lack of legal awareness of how important it is. BPJS of Employment. ABSTRAK Penelitian ini bertujuan untuk mengetahui tanggung jawab Penyedia/PT.Gunung Reduk terhadap pekerja yang mengalami kecelakaan kerja yang belum terdaftar dalam program BPJS Ketenagakerjaan, serta untuk mengetahui kendala-kendala Penyedia/PT.Gunung Reduk tersebut dalam memberi tanggung jawab terhadap pekerja yang mengalami kecelakaan kerja. Metode penelitian yang digunakan bersifat yuridis empiris, yaitu meneliti dalam hal perlindungan tenaga kerja dari segi jaminan sosial yang seharusnya berdasarkan peraturan perundang-undangan yang berlaku dan bagaimana pelaksanaannya pada PT.Gunung Reduk. Berdasarkan hasil penelitian dan pembahasan didapatkan hasil bahwa, pada pelaksanaan tanggung jawab Penyedia/PT.Gunung Reduk terhadap tenaga kerja yang mengalami kecelakaan kerja sudah melaksanakan tanggung jawab yaitu dengan memberikan biaya pengobatan dan perawatan serta biaya angkut ke Rumah Sakit pada saat terjadi kecelakaan saja, namun hal ini belum sesuai dengan undang-undang yang berlaku, karena penyedia tidak mendaftarkan pekerjanya  dalam program BPJS Ketenagakerjaan. Hendaknya pihak Penyedia/PT.Gunung Reduk segera mendaftarkan pekerjanya ke dalam program BPJS Ketenagakerjaan, karena pekerja mempunyai hak untuk mendapatkan perlindungan berupa Jaminan Sosial yang diberikan oleh Badan Penyelenggara Jaminan Sosial (BPJS) yang telah ditetapkan Undang-Undang Nomor 24 Tahun 2011. Adapun kendala Penyedia/PT.Gunung Reduk tersebut dalam memberi tanggung jawab terhadap pekerja yang mengalami kecelakaan kerja berupa kendala administrasi yaitu pendaftaran BPJS yang dinilai begitu rumit, pekerja yang hanya dikontrak 3 bulan saja, BPJS dinilai tidak begitu penting, dan kurangnya kesadaran hukum penyedia terhadap betapa pentingnya BPJS Ketenagakerjaan.   Kata Kunci :Perlindungan Hukum, Tenaga Kerja, Kecelakaan Kerja

Abstract

Corporate Social Responsibility (CSR) is one of the obligations that must be carried out by companies in accordance with the contents of article 74 of Law Number 40 of 2007 concerning Perseroan Terbatas. The purpose of this study is to find out about the ideal management of CSR for limited liability companies. This research is a normative study, using a conceptual approach and legislative approach. Based on the results of the study found that the CSR obligation norms for the company seem indecisive, because Social Responsibility has not been explicitly set about CSR mechanisms specifically in regulations, standards "propriety” and “reasonableness” in CSR budgeting, the form of implementation and who is competent in assessing the reasonableness and propriety must be clearly regulated in government regulations so that CSR management is directed and measurable.

Abstract

This article is the result of research with the aim of analyzing and examining the principles in the implementation of the National Social Security System by BPJS Kesehatan in Jambi City. Then it aims to study and analyze the problems and efforts to overcome the problems. The research carried out is a type of empirical research, which concentrates on the main data from the field. The sampling method is through the 'accidental sampling' technique. The result of the research states that the humanitarian principle and the principle of benefit have mostly been implemented in BPJS services at the Hospital in Jambi City. Only the principle of social justice for all Indonesian people is still obscured and its implementation has not yet been seen in the implementation of health services by BPJS at Jambi City Hospital. Furthermore, there are still problems in the implementation of the BPJS in Jambi City, namely some of the losses in the implementation of the National Health Insurance, the unfairness of claims by participants in certain groups, unequal facilities and health workers in Hospitals.
