<![CDATA[ABSTRAKOptimalisasi peran aktif warga negara dalam sistem demokrasi sejalan dengan ketentuan Pasal 1 ayat (2) UUD 1945 yang menempatkan kedaulatan berada di tangan rakyat dan dilaksanakan menurut UUD 1945. Konsep demokrasi langsung ini dipandang sebagai konsep paling ideal. Hanya saja dalam pelaksanaan di lapangan, peran aktif warga negara dalam setiap perhelatan demokrasi justru terbentur dalam sejumlah regulasi teknis. Salah satu regulasi yang menjadi penghambat adalah ketentuan Pasal 69 ayat (1) Undang-Undang Nomor 32 Tahun 2004 Tentang Pemerintahan Daerah yang mensyaratkan bahwa untuk dapat menggunakan hak memilih, harus terdaftar sebagai pemilih. Ketentuan ini kemudian dinyatakan Mahkamah Konstitusi (MK) bertentangan dengan UUD 1945 melalui putusan Nomor 85/PUU-X/2012. Dalam putusannya MK memutuskan bahwa untuk dapat menggunakan hak pilih, maka warga negara cukup hanya menunjukkan Kartu Tanda Penduduk dan Kartu Keluarga di lingkungan setempat. Putusan ini patut diapresiasi dalam upaya melindungi dan menjamin hak memilih sebagai hak konstitusional sekaligus hak asasi warga negara. The concept of direct democracy is seen as the most ideal concept. It’s just in the field, the active role of citizens in a democracy every event just hit the number of technical regulations. One of the regulations that a barrier is the provision of Article 69 paragraph (1) of Law No. 32 Year 2004 on Regional Government which requires that to be able to exercise their right to vote, must be registered as a voter. This provision was later declared the Constitutional Court (MK) contrary to the 1945 Constitution through verdict No. 85/PUU-X/2012. In its decision the Court decided that in order to be able to vote, then the citizens enough to show identity cards and family cards in the local environment. This decision should be appreciated in the effort to protect and guarantee the right to vote as well as the constitutional rights of citizens rights.
