Abstract

Mudharabah (Profit Share) finance is one of Islamic Banking products which characteristically different and has higher risk compared to other finances. At this point, the Islamic Banking has resolved to provide an assurance for their Mudharabah customers as stated in the Act No. 21 year 2008, and also Fatwa of The National Sharia Committee No. 07/DSN-MUI/IV/2000 regarding basic foundation of Islamic Banking. However, this foundation in contrast, rejects the application of the assurance into the Mudharabah Finance.The idea of the application of this assurance in the Mudharabah Finance is taken to make protection from the existence of Moral Hazard and Asymmetric Information, and to achieve the humanity values for all the humankind as the customers. Moreover, for the Islamic Banking themselves, this application is necessarily a part of their concerns to anticipate the Moral Hazard and Asymmetric Information, assess the liquidity, and secure from the breach of the contract. On the other hand, due to the assurance, the customers without restraint tend to feel safe and work normally keeping on the contract given by the banks. In fact, since the variation of multiple finances today, most of the society needs to have the assurance to assure their investment, and in a wider effect, to create kindness for the human beings.

Abstract

Settlement of sharia economic disputes on Islamic financial institutions can be done through the judiciary (litigation) or outside the judiciary (non-litigation). With the new authority, the religious courts are required to prepare the facilitiy and infrastructure, and Human Resources in order to handle Islamic economic disputes, which is submitted to the religious courts. Islamic economics in the settlement of disputes in religious courts, legal culture also affect the judges decision as well. for example, Islamic religion become a foothold in solving all the problems posed to the religious court. In connection with this, this paper will describe how the legal culture, in this case religion and education, gives effect to the settlement of Islamic economics disputes in the religious  court.

Abstract

Urban development in Indonesia raises some urban problems. One of them is the switch function of agricultural land to residential and industrial. Meanwhile, the food needs of communities dependent on agricultural commodities which in fact require land as a place of production. The concept of urban agriculture emerged as an answer to deal with the problem of urban land and the sustainable development efforts. According to the Farm Bill and Trade Act of 1990, meaning the practice of sustainable agriculture crop production and livestock production systems integrated with certain rules so that it can continue in the long term. Sustainable Agriculture-System (SAc-S) is a proposed solution to address the sustainability of land and food in urban areas as well as a form of sustainable development by looking at the social, economic and environmental. Our idea to realize the urban farm located in one-story building that do not spend the urban land. In addition, the building will be surrounded by several other concepts, namely livestock, fisheries, horticulture and agroforestry. This concept can be applied in the city center to achieve food self-sufficient green city.Keywords: urban land issues, sustainable development, green city
