Abstract

Tujuan penelitian menganalisis efektivitas pelaksanaan mediasi dalam penyelesaian sengketa kewarisan di Pengadilan Agama Barru Kelas II pasca PERMA No. 1 Tahun 2016 dan faktor-faktor yang mempengaruhinya. Penelitian menggunakan metode penelitian hukum empiris. Faktor-faktor yang mempengaruhi efektivitasnya pelaksanaan mediasi terdiri atas faktor internal dan faktor eksternal. Faktor internal yaitu: Kehadiran para pihak, tempat dan waktu, Komunikasi, Pemahaman mengenai hukum waris Islam, Iktikad para pihak, Psikologis, dan Kemampuan mediator sedangkan faktor eksternal yaitu: Aturan hukum mediasi, Harta warisan telah lama tidak dibagi hingga beberapa generasi, Peran kuasa hukum, Mediator hakim, Sarana dan prasarana mediasi di pengadilan, serta Sosial budaya masyarakat dalam hal waris. The research objective was to analyze the effectiveness of the implementation of mediation in the settlement of inheritance disputes at the Barru Class II Religious Court after PERMA No. 1 of 2016 and the factors that influence it. This research uses empirical legal research methods. The factors that influence the effectiveness of the implementation of mediation consist of internal factors and external factors. Internal factors, namely: presence of parties, place and time, communication, understanding of Islamic inheritance law, intention of the parties, psychology, and the ability of the mediator, while external factors are: legal rules of mediation, inheritance has not been shared for several generations, the role of power law, judge mediator, mediation facilities and infrastructure in court, as well as social culture of the community in terms of inheritance.
