Abstract

Program dalam kegiatan ini berupa Penyuluhan Hukum Adat dengan topik “Optimalisasi Pemahaman Hukum Adat Masyarakat Pesisir Guna Membangun Kesadaran Hukum Adat di Daerah Gorontalo”. Tujuan lain kegiatan pengabdian adalah agar masyarakat mengetahui dan memahami regulasi berkaitan dengan keberadaan hukum adat serta potensi di Desa Botubolu’o. Pengetahuan diberikan khususnya bagi masyarakat dan generasi muda dalam memahami kedudukan serta pentingnya hukum adat ditengah masyarakat. Selain memberikan manfaat dalam pengembangan kehidupan sosial budaya masyarakat, program yang dilaksanakan juga untuk meningkatkan partisipasi desa dalam menjaga adat serta budaya Gorontalo sebagai bagian dari usaha mendukung Gorontalo sebagai salah satu daerah adat di Indonesia. Kegiatan lain yang dilaksanakan adalah pelatihan tarian adat bagi siswa-siswi baik SD, SMP maupun SMA, serta Pembentukan Kelompok Pemuda Pencinta Budaya Desa Botubolu’o. Kegiatan ini dilakukan sebagai bekal untuk menguasai tarian adat bagi generasi mendatang di desa Botu Bolu’o. Selain kesadaran hokum masyarakat, tujuan lain pelaksanaan kegiatan pengabdian ialah membangun kesadaran masyarakat dalam mengelola potensi khususnya kawasan pesisir laut guna pengembangan desa ke depan, serta terjalinya kemitraan Desa dengan Perguruan Tinggi khususnya Fakultas Hukum UNG.

Abstract

The problem faced in Indonesia is that there need to be supporting devices in implementing the regulations in article 16 paragraph (3), such as the procedures for implementing it, assessing the economic value of Copyright, and how to disburse from Copyright. The research method used in the framework of this research is the normative legal research method. Although Copyright can be used as collateral as stipulated in law No. 28 of 2014, It still needs to be implemented in its practice. Copyright has economic value and can be transferred either in whole or part due to inheritance, grants, wills, written agreements or other causes justified by laws and regulations. In addition, Copyright has qualified as an object of fiduciary guarantee, among others. It belongs to the category of things and has economic value, so Copyright allows it to be used as an object of debt guarantee. The Copyright that will be used as the object of debt guarantee must be registered in the general register of works as proof of ownership of a Copyright. However, in its laws, Copyright does not have to be registered. Another condition is that the validity period of copyright protection has not expired, this is important in terms of the economic value of the Copyright because it can still be maintained against anyone.

Abstract

The purpose of this study is to find out and analyze how the role of the religious affairs office in dealing with Siri marriages in the North City District. The method used in this research is an interviews, observation, and documentation. This type of research is descriptive and qualitative. The qualitative descriptive analysis approach emphasizes research that aims to obtain legal knowledge empirically by going directly to the object or field. The types of data used in this study are primary and secondary data. The results of the study indicate that the role of the religious affairs office in tackling Siri marriages in the District of North City includes providing counseling on marriage registration and happy families to prospective brides and guardians, conducting socialization about the impact of unregistered marriages, and also the importance of registering marriages carried out in every time he fills an event, either a recitation or an event that involves the head of the religious affairs office. Factors that hinder the religious affairs office in dealing with unregistered marriages in the North City sub-district include Lack of competent human resources, low awareness of the law in society, and inadequate facilities and infrastructure.

Abstract

The purpose of this study is to find out and analyze the role of the village head as a mediator in resolving land title disputes in Tongo Village, Bonepantai District, and Bonebolango Regency. This research uses a type of empirical legal research, with a qualitative research approach that uses facts in the field as the main data source. The data sources used are the results ofobservation, interviews in the field, and documentation. The population and samples used are village heads and communities in dispute in Tongo Village. The results showed that (1) the settlement of land disputes in Tongo Village through the mediation of the Village Head is quite effective because it always strives to obtain mutual benefits and does not require a lot of costs, is more efficient, and still maintains good relations between the community; (2) while the factors causing land disputes in Tongo Village are the use of land without permission from the landowner, unclear division of inheritance, uncertified land, and land boundary disputes.

Abstract

This research focuses on the role and responsibility of the state in controlling and regulating electronic information resources, especially in the scope of e-commerce in Indonesia. In the digital era, the rapid development of e-commerce requires effective and comprehensive regulation to ensure the integrity, security, and growth of this industry. This research discusses several necessary regulations adopted by the Indonesian government, including Law Number 11 of 2008, which was changed to Law Number 19 of 2016 concerning Information and Electronic Transactions, Government Regulation No. 82 of 2012 concerning the Implementation of Electronic Systems and Transactions, Law Number 7 of 2016 concerning Trade, and Bank Indonesia Regulation No.11/12/PBI/2009 concerning Electronic Money. This research shows that these regulations and policies have established a Solid legal framework for e-commerce in Indonesia. However, given the rapidly changing technology and industry dynamics, these regulations and policies must be continuously updated and adapted to new needs. Therefore, the state's role in monitoring industrial developments, adjusting regulations, and educating the public is essential in establishing a fair, safe, and sustainable e-commerce ecosystem. Overall, this research shows that balancing consumer protection and industry growth is critical for the future of e-commerce in Indonesia.

Abstract

Program dalam kegiatan ini berupa Pemetaan Sumber Daya Karang Taruna Desa Buhu. Tujuannya adalah memberikan manfaat khususnya terhadap aparat pemerintah desa beserta organisasi pemuda karang taruna desa agar lebih produktif dalam pengembangan desa. Adapun manfaat dalam pengembangan kehidupan perekonomian masyarakat ke arah yang lebih baik, melalui pemetaan potensi yang ada di desa, serta terjalinya kemitraan Desa dengan Perguruan Tinggi khususnya Fakultas Hukum Universitas Negeri Gorontalo. Hasil dari pengabdian ini adalah berdasarkan RPJM Desa Buhu menunjukkan bahwa terdapat beberapa potensi desa disektor Pertanian, Perikanan, dan Peternakan. Menjadi suatu persoalan dewasa ini, pemuda Karang Taruna Desa Buhu belum bisa menangkap peluang bisnis dan usaha kreatif dan pengelolaan potensi desa Buhu. Sehingga melalui program pengabdian pemetaan sumber daya Karang Taruna Desa Buhu ini diharapkan mampu memberikan edukasi yang dapat menciptakan dan memotivasi pemuda karang taruna untuk lebih produktif dalam pengelolaan potensi desa yang dikemas dalam usaha ekonomi produktif. The program in this activity is in the form of Mapping coral resources of Buhu Village Cadets. The goal is to provide benefits, especially to village government officials and village cadet coral youth organizations, to be more productive in village development. The benefits in developing the community's economic life in a better direction through mapping the potential in the village, as well as establishing village partnerships with universities, especially the Faculty of Law, Gorontalo State University. The result of this service is based on the Buhu Village Medium-Term Development Plan, and it shows several potential villages in the Agriculture, Fisheries, and Animal Husbandry sectors. It is a problem today, the youth of Karang Taruna Buhu Village have not been able to grasp business opportunities and creative efforts and manage the potential of Buhu Village. So that through the Buhu village coral cadet resource mapping service program, it is hoped that it will be able to provide education that can create and motivate coral cadet youth to be more productive in managing the potential of the village packaged in productive economic efforts.

Abstract

The purpose of this study is to find out the PPAT's responsibility in making the deed of sale and purchase of jointly owned land rights (boedel) which is in dispute and to find out the efforts of PPAT in completing the deed of sale and purchase of land which is still in the status of joint property rights (boedel). The research method used is sociological juridical, research based on a principle of law or regulation that applies to the reality that occurs in society or in practice as it is. The results of the study found that the PPAT's responsibility was in making the deed of sale and purchase of landShared Property Rights (Boedel) Those Who Are Still Disputingwill not continue in making the deed of sale and purchase when one of them still objected or is still in dispute because it is already contained in the laws and regulations but in other studies will still accept the disputed on the condition that mediation must be carried out so that the problem can be solved and PPAT's efforts in completing the deed of sale and purchase of land common property rights, namely by conducting deliberation.

The purpose of this research is to know and analyze about iThe legal implication is that there is a difference in the price tag of goods on the window display and the shop cashier for entrepreneurs, which has implications for the provisions of the Consumer Protection Act and Permendag No. 35 of 2013 which can result in criminal sanctions and administrative sanctions as well as payment based on the lowest price tag. Abstract

Waqf is a waqif legal act to separate and or give part of one's property to be used forever or for a certain period of time in accordance with the interests of worship and or general welfare according to sharia. In order to avoid disputes and problems related to waqf goods or land and to clarify their legal status, waqf goods must be registered and certified. Waqf Land Certification is the process by which the National Land Agency issues Waqf Land Certificates after Nazhir submits a Waqf Land Registration. Article 39 of Government Regulation Number 42 of 2006 concerning Implementation of Law Number 41 of 2004 concerning Waqf contains provisions concerning registration of land ownership certificates, and Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency of the Republic of Indonesia Number 2 of 2017 concerning Procedures for Land Registration Waqf at the Ministry of Agrarian Affairs and Spatial Planning. Related to the importance of the legitimacy of a land, it often triggers legal problems, namely that land owned by the community has not been registered as a result of a lack of understanding of the importance of waqf land certification. Taking into account the legal issues above, the Community Service Team at the Faculty of Law, State University of Gorontalo carried out this community service activity as an effort to increase Community Legal Awareness Regarding Waqf Land Certification to Guarantee Legal Certainty..

Abstract

Indonesia and Singapore were the founding members of an economic and geopolitical organization of countries in the Southeast Asian region called the Association of Southeast Asian Nations (ASEAN). ASEAN mandates each member country to create regulations and policies related to e-commerce transactions through the 1999 ASEAN Summit. This paper is a normative study and aims to analyse the development of e-commerce regulations in Indonesia and Singapore by utilizing comparative and statute approaches. The result of the study finds out that Singapore has designed its e-commerce master plan since 1998, meanwhile, Indonesia started to develop the master plan related to e-commerce a decade late than Singapore through the Acceleration and Expansion of Indonesian Economic Development program (MP3EI), which launched in 2011. Indonesia has regulated a few components related to e-commerce, but some are still partial and spread in a few regulations. This paper recommends governments unify all e-commerce components regulations into one act that can cover legal protection and become the basis of procedure regulation related to e-commerce in Indonesia. The usage of the Trustmark stamp and online registration procedure for the e-commerce activities required by Singapore can be enforced in Indonesia as a solution to problems that occur in e-commerce activity in Indonesia.
