Abstract

Congestion in the capital city of Indonesia, Jakarta, is getting worse and acute. The data of Metro Jaya Police Department shows that the addition number of new cars reaches 250 units per day on average while motorcycle reaches 1.250 units per day. The total number of vehicles until the end of year 2014 di Jakarta is 17.523.967 units dominated by two wheeled vehicles which is up to 13.084.372 units. It was followed by car, 3.226.009 units, goods carrier car 673.661 units, bus 362.066 units, and specific purpose car 137.859 units. Therefore, in order to overcome those problems, Jakarta, the capital city of Indonesia, applied Electronic Road Pricing (ERP) aiming to charge vehicles passing through certain road in certain specific time. The character of this study is normative with constitutional approach and a study of Jakarta Governor Regulation No. 149 Year 2016. The result showed that the substance of Jakarta Governor Regulation No. 149 Year 2016 about electronic road pricing traffic control was qualified as against the principle of act and regulation formation as what has been regulated by act No. 12 Year 2011 especially related to the kind of charging, the amount of the charge, and the penalty of the violation toward the ERP. The legal steps by changing to adapt related regulation about the amount of the charge and the penalty refers to constitution and / or conducting the trial to the Supreme Court to judge the regulation.

Abstract

Ketidakkonsistenan Majelis Hakim dalam menilai kapasitas Forum Warga Kota Jakarta sebagai organisasi non pemerintah (NGO’s Standing) terlihat dalam memberikan putusan sela dan putusan akhir sebagaimana terlihat dalam Putusan No. 403/Pdt.G/2011/PN.JKT.PST. Putusan terebut memperlihatkan ketidakpakaham dengan mencampur adukkan mekanisme Hak Gugat Organisasi Non Pemerintah (NGO’s Standing) dengan Hak Gugat Warga Negara (Citizen Law Suit). Fakta tersebut terlihat dalam putusan sela menerima kapasitas FAKTA, akan tetapi dalam Putusan Akhir menolak gugatan dengan pertimbangan bahwa Ketua dan Sekjen tidak berhak mewakili FAKTA. Permasalahan adalah apakah setiap Organisasi dapat mengajukan gugatan ke Pengadilan dan FAKTA mempunyai legal standing mengajukan  gugatan. Adapun metode penelitian yang digunakan dalam penelitian ini adalah penelitian normatif dengan pendekatan kasus. Hasil penelitian bahwa FAKTA mempunyai hak gugat ke Pengadilan dengan mendasarkan AD/ART dan pengakuan dari putusan pengadilan dan adanya kekeliruan dari Majelis Hakim yang memeriksa dan mengadili perkara tersebut.

Abstract

The implementation of Professional Advocate Certification is deemed to be incompatible with the standards in organizing professional education as regulated by Law no. 20 of 2003 on the National Education System and Law no. 12 of 2012 on Higher Education, causing uncertainty and unscrupulous on the quality of prospective advocates, detrimental to the legal environment in whole. The Profession of Advocates possesses a strategic position in law enforcement to uphold justice, therefore this occupation is known to be a noble profession (offi cium nobile). The problem formulation in this research is to set the framework of implementing Professional Advocate Certifi cation to maintain the professionalism and integrity of advocates and to organize the implementation of Professional Advocate Certifi cation in the coming days. With the use of normative approach as the method of research by utilizing statutory regulations, court decisions, and legal concepts, this study found that Professional Advocate Certifi cation must be carried out in collaboration with universities in accordance with the mandate of the Constitutional Court Decision (MKRI) No. 95/PUU-XIV/2016 date 23rd of May 2017, Decision Number 46 P/HUM/2019, Thursday, 26th of September 2019 and Decision Number 87 P/HUM/2019 on the date 13th of December 2019 and Regulation of the Minister of Research, Technology, and Higher Education Number 5 of 2019. Therefore, it is crucial to accomplish fundamental changes concerning the implementation of advocate professional education by constructing curriculum changes leading up to the integrity and expertise in maintaining the noble reputation of the advocates’ role (officium nobile).

Abstract

The spread of Corona Virus Disease 2019 (Covid-19) in Indonesia is getting wider and results in so many effects. Besides mortality and economy, this country experiences also a lot of problems. To overcome the Covid-19 pandemic, President Joko Widodo had issued various kind of regulations; one of them is the government regulation in lieu of law (Perppu) No. 1 Year 2020 about national financial policy and financial system stability to handle Covid-19 pandemic and/or in order to face the threat that is dangerous for national economy and/or financial system stability. However, a lot of expert and scholars said that Perpu (the government regulation in lieu of law) No. 1 Year 2020 resulted in legal problems. Therefore, the research question of this study is questioning “have the government regulation in lieu of law (Perppu) No. 1 Year 2020 fulfilled the requirement of force majeure condition as what has already been stated in Articel 22 UUD NRI Year 1945? And how is the substance of the regulation of Article 27 point (2) and (3) Perpu No. 1 Year 2020 correlated with immunity rights, and the principles of the establishment of legal regulation in Indonesia? The method used in the study was normative. The approach used was legal regulations and legal principles of the establishment of legal regulations. The result found out that the government regulation in lieu of law Perpu No. 1 Year 2020 published by President Joko Widodo to hold Covid-19 is his right in accordance with the clauses of Article 22 UUD NRI Year 1945, however article 27 point (2) and (3) Perpu No. 1 Year 2020 violate the basic principles of the establishment of legal regulation and it would be potential that the provision of this article lead to uncertainty and injustice.

Abstract

Corona virus disease (Covid-19) pandemic had resulted in a deep anxiety for the whole world, including Indonesia. A number of cross sectorial effort had been conducted to overcome this disaster by the government, including in the low sector by rearranging a lot of regulation to speed up the effort on overcoming the Covid-19 Pandemic. Instead of slowing down, the spread of Covid-19 has been relatively increasing. According to the data per 18 Mei 2020 showed by BBC Indonesia, out of 18.010 cases, it is noted that the addition of the total number of the cases reached 500-600 cases per day; it was a big number compared to what happened on 200-300 cases per day. In addition, the policy of handling Covid-19 pandemic invite a lot of comments because it resulted in some problems due to the weakness of the public leader integrity. The miss-distribution of the aid, the abuses of power among special presidential officer (stafsus), and the corruption of pandemic handling budget were the empiric picture of the problems. The method of this study was juridical and comparative. This study aimed to describe the urgency to realize integrated public leadership in a law state during Covid-19 pandemic. The result of this study was one of the important factors that could influence the handling of non-natural disaster, including Covid-19 pandemic, the integrity of public leader. Public integrity is defined as honest and sincere attitudes to do what is right and fair in every situation so as to sharpen his decisions and actions within the framework of public service.

Abstract

AbstractThe fact of Corona Virus Disease 2019 (Covid-19) pandemics was often made as a reason by a lot of companies to conduct massive layoffs (PHK) in Indonesia. The regulation about force majeure to do massive layoffs (PHK) could only be found in Article 164 Act No. 13 Year 2003 about employment and it is not that specific about what kind of condition which could be categorized as force majeure that enables companies to conduct massive layoffs PHK. The statement of problem of this research is the spread of Covid-19 a condition categorized as force majeure that could become the reason to do a massive layoffs and how is the legal protection of worker toward the layoffs during the Covid-19 pandemics? This is normative research with constitutional and conceptual approach. The result from the observation and analysis indicated that the Covid-19 pandemics could be qualified as a force majeure but to conduct massive layoffs the companies need to experience loss or disadvantage and already closed permanently or massive layoffs is conducted for efficiency as what has been regulated by Article 164 point (1) and (3) Act No. 13 Year 2003 about employment by doing some steps in advance as stated in Minister Hand-outs  No. SE-907/MEN/PHI-PPHI/X/2004, 28th October 2004 and the decision of the Supreme Court No. 19/PUU-IX/2011, 20th June 2012.  Keywords: Work relationship, massive layoffs, Covid-19 ABSTRAKFakta penyebaran Corona Virus Disease 2019 (Covid-19) banyak dijadikan alasan bagi perusahaan-perusahaan untuk melakukan pemutusan hubungan kerja (PHK) d Indonesia. Pengaturan mengenai alasan force majeure dalam melakukan PHK hanya terdapat dalam Pasal 164 Undang-Undang No. 13 Tahun 2003 Tentang Ketenagakerjaan dan tidak terlalu rinci bagaimana kondisi yang dapat dikualifikasi sebagai force majeure sehingga perusahaan dapat melakukan PHK. Rumusan masalah penelitian ini adalah apakah penyebaran Covid-19 merupakan kondisi yang dikualifikasi force majeure sehingga dapat dijadikan alasan untuk melakukan pemutusan hubungan kerja dan bagaimana perlindungan hukum pekerja atas pemutusan hubungan kerja yang terjadi pada masa penyebaran Covid-19 ? Penelitian ini menggunakan metode penelitian normatif dengan pendekatan perundang-undangan dan konsep. Dari hasil penelusuran dan analisis dapat ditegaskan penyebaran Covid-19 dapat dikualifikasi sebagai keadaan memaksa namun untuk melakukan PHK perusahaan harus mengalami kerugian dan telah tutup secara permanen  atau PHK dilakukan dengan alasan efisiensi sebagaimana diatur Pasal 164 ayat (1) dan (3) Undang-Undang No. 13 Taun 2003 Tentang Ketenagakerjaan  dengan terlebih dahulu  melakukan langkah-langkah dalam Surat Edaran Menteri Nomor SE-907/MEN/PHI-PPHI/X/2004, tertanggal 28 Oktober 2004 dan Putusan Mahkamah Konstitusi Nomor 19/PUU-IX/2011, tertanggal 20 Juni 2012. Kata kunci : Hubungan Kerja, Pemutusan Hubungan Kerja, Covid-19

Abstract

Ketentuan Pasal 90 ayat (1) UU Nomor 13 Tahun 2003 Tentang Ketenagakerjaan yang telah melarang atau mewajibkan pengusaha untuk membayuar upah tidak lebih rendah di bawah upah minimum menyebabkan timbulnya masalah yang tidak hanya dari aspek filosofis, yuridis dan sosiologis yang berujung pada ketidakpastian dan ketidakadilan tidak hanya dari Pekerja tetapi juga Pengusaha atau Perusahaan, dikarenakan ditemukan fakta bahwa tidak semua pengusaha mempunyai kemampuan untuk membayar upah minimum dan adanya ketidakpastian dan ketidakjelasan mengenai definisi Pengusaha (Pasal 1 angka 5) dan Pengusaha (Pasal 1 angka 6)  UU No. 13 Tahun 2003 Tentang Ketenagakerjaan. Masalah dalam penelitian ini adalah apa implikasi hukum Pasal 90 ayat (1) UU No. 13 Tahun 2003 yang menimbulkan ketidakpastian dan ketidakadilan bagi pekerja dan Pengusaha dan bagaimana mereformulasi ketentuan Pasal 90 ayat (1) UU No. 13 Tahun 2003 Tentang Ketenagakerjaan yang melarang bagi pengusaha membayar upah lebih rendah dari upah minimum, sehingga dapat memberikan kepastian dan keadilan bagi pekerja dan pengusaha dalam menjalin hubungan kerja? Tipe penelitian ini adalah penelitian normatif dengan pendekatan filosofis dan perundang-undangan. Hasil penelitian ditemukan bahwa norma hukum larangan pengusaha membayar upah dibawah upah minimum perlu direformulasi dengan memberikan ketentuan minimal bagi pengusaha yang diberikan kewajiban membayar upah minimum.

Abstract

Peniadaan Peninjauan Kembali sebagai upaya hukum luar biasa dalam penyelesaian perselisihan hubungan industrial berdampak pada rasa keadilan para pihak. Terbukti adanya pengujian terhadap norma hukum dalam Undang-Undang No. 2 Tahun 2004 Tentang Penyelesaian Perselisihan Hubungan Industrial yang dianggap sebagai landasan peniadaan upaya hukum peninjauan kembali dengan munculnya Putusan Mahkamah Konstitusi Republik Indonesia dengan Nomor 34/PUU-XVII/2019, Nomor 46/PUU-XVII/2019 dan Nomor 89/PUU-XVIII/2020. Masalah penelitian ini adalah apakah peniadaan peninjauan kembali sebagai upaya hukum luar biasa dalam penyelesaian perselisihan hubungan industrial dapat memberikan keadilan dan bagaimana pengaturan upaya hukum peninjauan kembali dalam penyelesaian perselisihan hubungan industrial berbasis kepastian dan keadilan. Metode penelitian menggunakan penelitian normatif dengan pendekatan peraturan perundang-undangan, konsep dan putusan pengadilan. Hasil penelitian ditemukan bahwa peniadaan peninjauan kembali dalam perkara perselisihan hubungan industrial justru menghilangkan keadilan yang terdapat dalam asas sederhana, cepat, adil dan murah, karenanya perlu pengaturan upaya peninjauan kembali sebanyak dua kali dengan beberapa alasan yang diperketat sehingga memberikan kepastian dan keadilan bagi masyarakat pencari keadilan dalam menyelesaikan perselisihan hubungan industrial.

Abstract

The fact that the legal aid provision has not reached all the Indonesian citizens forces the Ministry of Law and Human right to establish the ministerial regulation of the Ministry of Law and Human Right No. 1 year 2018 about Paralegal on legal aid provision which is effectively applied on the 26th January 2018 as the implementation of Act No. 16 year 2011 about Legal Aid. The regulation that gives the Paralegals a spacious room to lawyer in the court resulted in pros and cons if it is contrasted to the position of an advocate within the act No. 18 year 2003 about lawyer, legal aid quality, and monitoring on the provision of legal aid. The statement of the problem is how the legal standing of Paralegal in lawyering in the court as what has already been regulated by the regulation of the Ministry of Law and Human Right No. 1 year 2018. This is a normative research with legislation approach and concept approach. The result of this research found out that there are Paralegal regulations that need to be adjusted with the regulation about legal aid provision such as age limit, qualifi ed educational curriculum, and the need of ethical code that ties up the Paralegal joining law aid organization, so the objective of this constitutional nation to admit, to protect, and to guarantee the human right of the citizens about the access to justice and equality before the law as what has been explained in Article 28 D, article 4 point (1) Constitution of Indonesian Republic Year 1945 could be implemented.

Abstract

Tulisan ini bertujuan untuk menjelaskan bagaimana kedudukan hukum internasional di dalam Pembukaan UUD NRI 1945. Metode penelitian yang digunakan adalah metode penelitian hukum normatif, dengan menggunakan pendekatan perundang-undangan (statute approach), konseptual (conceptual approach) dan pendekatan historis (historical approach) yang kemudian diolah dan dianalisis secara kualitatif. Kajian ini menyimpulkan bahwa Pembukaan UUD NRI 1945 sebagai rechtside Indonesia nyatanya memuat secara implisit keinginan konstitusi untuk melegitimasi hukum internasional dalam sistem hukum Indonesia di mana di dalamnya mengandung nilai-nilai: pertama Pembukaan UUD NRI 1945 memuat perintah menjunjung tinggi norma-norma internasional melalui pengakuan, penghormatan dan jaminan terhadap perikemanusiaan dan perikeadilan sehingga menolak segala bentuk penjajahan di atas dunia. Dan kedua, Pembukaan UUD NRI 1945 telah memberi arah guna turut mewujudkan ketertiban dunia berdasarkan kemerdekaan, perdamaian abadi, dan keadilan sosial sebagai salah satu tujuan bernegara selaku tujuan tertinggi.
