The fact that there are some state institutions that are regulated in the Constitution of the Republic of Indonesia year 1945 while some others are not, causes horizontal problems among those institutions. The authority of the institutions is regulated in the Constitution and in other laws. The authority to investigate a criminal act is owned by the Police, Attorney, and Corruption Eradication Commission (KPK). The authority of the Police is stated in the Law number 8 of 1981 on Criminal Code Procedure and in the Law number 2 of 2002 on Indonesian National Police (Polri). The Attorney’s authority is stated in Law number 16 of 2004 on Indonesian Attorney and KPK’s authority is stated in the law number 30 of 2002 on KPK. This research was normatively conducted through normative jurisdictional study with systematic and descriptive data analyses. These analyses were conducted based on the Law number 8 of 1981 about Criminal Code Procedure, the Law number 2 of 2002 on Polri, the Law number 16 of 2004 on Indonesian Attorney and the Law number 30 of 2002 on KPK. The research showed that Polri, Indonesian Attorney, and KPK have the authority to conduct investigation of criminal act of corruption. The investigation is a political will of the current government. The author concluded that Polri, Indonesian Attorney, and KPK were given the authority to conduct investigation of criminal act of corruption based on the Law number 2 of 2002 on Polri, the Law number 16 of 2004 on Indonesian Attorney and the Law number 30 of 2002 on KPK. KPK has full authority to conduct investigation of criminal act of corruption. This is based on the principle lex specialis deroga te lex generalis and the Law number 30 of 2002. Keberadaan lembaga negara yang terdapat dalam Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 maupun yang tidak, dampak horizontal antar lembaga negara. Kewenangan lembaga negara tersebut yang telah diatur dalam konstitusi/UUD 1945 maupun yang diatur dalam Undang-Undang. Kewenangan penyidikan tindak pidana korupsi saat ini dilakukan Polri, Kejaksaan RI maupun KPK. Ketiga institusi Negara tersebut melaksanakan penyidikan, memiliki dasar hukumnya masing-masing. Polri didasarkan pada UU No. 8 Tahun 1981 tentang KUHAP dan UU No. 2 Tahun 2002 tentang Polri, UU No. 16 Tahun 2004 tentang Kejaksaan RI, sedangkan KPK didasarkan oleh UU No. 30 Tahun 2002 tentang KPK. Penelitian ini dilakukan secara normatif, yaitu dengan melakukan kajian yuridis normative, dengan analisis data diskripsi, sistematisasi dan eksplanasi, sesuai dengan UU No. 8 Tahun 1981 tentang KUHAP dan UU No. 2 Tahun 2002 tentang Polri, UU No. 16 Tahun 2004 tentang Kejaksaan RI, sedangkan KPK didasarkan oleh UU No. 30 Tahun 2002 tentang Komisi Pemberantasan Tindak Pidana Korupsi. Hasil penelitian ini menunjukkan bahwa Polri, Kejaksaan RI dan KPK berwenang untuk melakukan penyidikan tindak pidana korupsi. Penyidikan merupakan political will dari pemerintahan saat ini. Kesimpulan dari penelitian ini bahwa Polri, Kejaksaan RI dan KPK diberikan kewenangan untuk melakukan penyidikan tindak pidana korupsi, sesuai UU No.2 Tahun 2002, UU No. 16 Tahun 2004 tentang Kejaksaan RI UU No. 30 Tahun 2002, tentang KPK. KPK berwenang penuh melakukan penyidikan tindak pidana korupsi, sesuai dengan asas lex specialis derogate lex generalis.karena kewenangan khusus oleh UU 30 tahun 2002.
