PERLINDUNGAN HUKUM TERHADAP KORBAN EKSPLOITASI SEKSUAL ANAK

Abstract

Anak kerap menjadi korban eksploitasi sesksual yang bukan hanya datang dari lingkungan sekolah atau lingkungan pertemanannya tapi yang paling buruk adalah berasal dari lingkungan keluarganya, dimana anak diperjualbelikan untuk kepentingan ekonomi keluarga. Penelitian ini bertujuan untuk mengetahui sejauh mana perlindungan hukum yang di dapatkan oleh korban eksploitasi seksual pada anak. Metode yang digunakan adalah metode penelitian Jenis penelitian yang digunakan dalam adalah penelitian kepustakaan (Library Research) yakni hasil penelitian yang didapatkan dari sumber-sumber tertulis sehingga diketahui sejauh mana peran pemerintah, masyarakat, keluarga dan orang tua melindungi korban  eksploitasi seksual pada anak. Hasil penelitian menunjukkan bahwa perlindungan hukum bagi anak korban eksploitasi seksual adalah kewajiban dan tanggung jawab Negara, Pemerintah Daerah, Masyarakat, Keluarga, dan Orang tua atau Wali. Mendampingi dan melindungi selama proses penyembuhan trauma psikis dan emosional agar korban tidak pernah merasa sendiri. Pemerintah juga wajib memberikan perlindungan kepada korban, keluarga, dan masyarakat disekitarnya agar ancaman terhadap keselamatan mereka tetap terjagat terutama pada proses peradilan. Kemudian dengan adanya aturan tentang perlindungan anak serta undang-undang yang mengatur perlindungan saksi dan korban diharapkan dapat memberikan pemahaman kepada semua pihak untuk memberikan peranannya ketika mendapati langsung dilingkungan sekitar tindakan kejahatan terutama kejahatan eksploitasi seksual pada anak. Children are often victims of sexual exploitation which not only comes from the school environment or their friendship environment but the worst is from their family environment, where children are traded for the economic benefit of the family. This study aims to determine the extent of legal protection that is obtained by victims of sexual exploitation of children. The method used is a research method. The type of research used is library research, namely research results obtained from written sources so that it is known to what extent the role of government, society, families and parents in protecting victims of sexual exploitation of children. The results of the study indicate that legal protection for child victims of sexual exploitation is the obligation and responsibility of the State, Local Government, Community, Family, and Parents or Guardians. Accompany and protect during the healing process of psychological and emotional trauma so that the victim never feels alone. The government is also obliged to provide protection to victims, their families, and the surrounding community so that threats to their safety are maintained, especially in the judicial process. Then with the rules on child protection as well as laws governing the protection of witnesses and victims, it is hoped that it can provide an understanding to all parties to give their role when they find out directly in the environment around crimes, especially crimes of sexual exploitation of children.
