Abstract

Shariah governance is concatenation of two concepts, these are the concept of good corporate governance and shariah compliance. The governance of banks applies the principle of transparency, accountability, responsibility, professionalism and fairness whereas shariah compliance is the duty of Islamic bank to meet compliance with Islamic principles. The operation of Islamic banks must strictly adhere to the provisions of shariah. The application of shariah governance is the implementation of good corporate governance principles and shariah compliance. The implementation of shariah governance in Islamic banks relies on surveillance covering all research activities, observation and measurement on the course of operations, both internally and externally. Based on the above background, author makes formulations of the problem; (a) how is the implementation of Shariah governance in Islamic bank?; (b) How is the supervision of the application of Shariah governance in Islamic bank?.  The purpose of this paper is to know the implementation of Shariah governance in Islamic banks and to know the supervision of the implementation of Shari'a governance in Islamic bank. The implementation of GCG in Islamic banking creates transparency to prevent fraud, conduct accountability with the system that controls the relationship between the organs of company, do responsibility, keep independence, and keep in touch with fairness. The application of sharia compliance at Islamic banks without riba in bank transactions, no vagueness (gharar) in bank transactions, there is no gambling (maisir) in bank transactions. Bank conducts business on the basis of allowed (halal) profits. Banks manage zakat, sadaqah, and infaq according to the shariah provisions. The implementation of sharia governance in Islamic banks relies on surveillance covering all research activities, observation and measurement on the course of the operation by using elements of the AGM, Board of Commissioner, Board of Auditor, Shariah Supervisory Board (DPS), Director of Compliance, Internal Audit, Internal Shari'a Reviewers of SKAI and external monitoring system consists of elements of the Financial Services Authority (OJK), Public Accountant, National Sharia Council (DSN) and Stakeholders.Keywords: Corporate, syariah, Governance

Abstract

To assess and find a sharia law on contemporary issues, including economic activity, it is absolutely required ushul fiqh. Supposing, ushul fiqh is the production process to produce a product of jurisprudence by means of operational standards qawa'id fiqhiyyah. A law of fiqih can not be removed from the proposition/source (the text of the al-Quran and Hadith) without going through the ushul fiqh and qawa'id fiqhiyyah. Not all qawa'id fiqhiyyah can accommodate interests in activities mu'amalah instead. Only a few of qawa'id is associated with transactions of mu'amalah instead. Thus, as the increased complexity of a trade and needs, it is of course necessary to study qa'idah even more, with reference to the methods outlined in ushul fiqh. Keywords: Qawa’id al-Fiqh, Principles of Sharia Economics

Abstract

The discourse on waqf recently appears the back to the surface. It not only discusses about the opinion of the fiqh scholars who have no uniform about understanding and nature waqf  itself, but also to reform and optimize waqf  in order to do more, namely to superintend the social problems of society, related to the prosperity of the economy of the people. Therefore, contextualization and repositioning of waqf institutions becomes a necessiry for immediate implementation. The function and role of waqf is very large in supporting the development and progress of the muslims. Therefore the management of waqf must be able to be optimized. Tragically the management of waqf in Indonesia is still not maximized, so there are some waqf property abandoned in its management, some even missing. This is due to the waqf management still uses traditional-consumptive management pattern. Efforts to develop waqf to be productive and productive, there are four things to note; Institutional aspect, accounting aspect, auditing aspect and aspect of nadhir. If these four aspects can be met, then the utilization of waqf will be more efficient. There are several forms of models that can be run by the manager of waqf, such as by holding Sharia banks as a partner with schema of murabahah, istisna’, ijarah muntahiyah bi al-tamlik (financial leasing with purchase option), muzara’ah, qard al-hasan, musharakah (partnership) and mudarabah muqayyadah. Keywords: Contextualization, Repositioning of Waqf, Prosperity of the People

Abstract

Profit and loss sharing system applied in the Islamic bank as an alternative substitute for the application of the interest system is deemed to successfully avoid the negative impacts of the interest application. It is also considered to be able to allocate resources and fund sources efficiently. The solution is briefly mentioned by holding the financing transactions based on three models, namely mudlarabah, musharakah dan murabahah. In this study, there are several methods used to collect the data. It includes methods of observation, interviews and documentation. The data is then analyzed using descriptive analysis and qualitative approach. The research findings figure out that the realization of profit and loss sharing system based on mudlarabah financing applied in the Branch Office of Syariah Mandiri Bank in Lumajang, in terms of Islamic Law, is valid since it already fulfills the validity requisites of mudlarabah. There is only such dilemmatic consideration relates to the issue of assurance because of the difference opinion among Islamic scholars (Ulama) about the license of assurance itself aside of the emergency or in case that the suspicion toward mudlarib emerged. The financing of mudlarabah in Syariah Banking, particularly in terms of the application of financing calculation in the Branch Office of Syariah Mandiri Bank in Lumajang is completely appropriate since it already fulfills the requisites obtained in all Syariah Bankings and the Fatwa of National Syariah Council. The application of profit and loss sharing calculation in the Branch Office of Syariah Mandiri Bank in Lumajang is valid and appropriate since its realization is in accordance with Islamic and Banking Law. The profit-sharing ratio provided by the bank are 95.10%: 4.9%, 90, 69%: 9.31% and 87.10%: 12.9%. Abstract

The emergence of new Islamic banks creates healthy competition among Islamic banks both in terms of improving services, as well as improving the performance of the banks themselves. As one of the institutions that has an important role in the country's economy, banking regulators need to conduct controlled and comprehensive performance monitoring to improve the performance of Islamic banking so that the bank remains healthy and efficient. Profitability is the most important indicator to measure the performance of a bank. Return on assets (ROA) focuses on the company's ability to earn earnings in the company's operations by utilizing its assets. The purpose of this study is to analyze the influence of the non performing financing factor (NPF), the ratio of operating costs to operating income (BOPO), and financing to deposit ratio (FDR) on profitability in Islamic banking in Indonesia as measured by return on assets. The analytical method used in this study is multiple linear regression. The results of this study indicate that the simultaneous non performing financing (NPF), the ratio of operating costs to operating income (BOPO), and financing to deposit ratio (FDR) affect the return on assets on Islamic banking in Indonesia, while partially non performing financing (NPF) has no effect. The ratio of operating costs to operating income (BOPO) has a negative effect, and financing to deposit ratio (FDR) has a positive effect on profitability in Islamic banking in Indonesia as measured by return on assets. Keywords: Profitability, Non performing financing factor, The ratio of operating costs to operating income, Financing to deposit ratio

Abstract

The study aims to analyze the effect of CAR, NPF, FDR to mura>bah}ah financing on Islamic commercial banks simultaneously and partially. The dependent variable in this study is mura>bah}ah financing. The independent variables are CAR, NPF, FDR. The research of mura>bah}ah financing using a quantitative approach. The research population includes all registered Islamic banking in the Bank Indonesia period 2015-2019. The sample was determined by purposive sampling technique. The data used in this study are quarterly financial statement data three Islamic banks in Indonesia period 2015-2019. The method of analyzing data used multiple linear regression. The results of this study indicate that the partially capital adequacy ratio (CAR) variable significantly negative effect on mura>bah}ah financing with value sig. 0,0000 < 0,05. Non performing financing (NPF) variable significant negative effect on mura>bah}ah financing with value sig. 0,003 < 0,05. Financing deposit ratio (FDR) variable significant negative effect on mura>bah}ah financing with value sig. 0,0000 < 0,05. The results of this study indicate that capital adequacy ratio (CAR), non performing financing (NPF), and financing deposit ratio (FDR) variable effect simultaneously to  mura>bah}ah financing variable with value sig. 0,0000 < 0,05. Keywords: capital adequacy ratio; non performing financing; financing deposit ratio; mura>bah}ah financing

Abstract

The theory of Karl Marx’s Historical Materialism states that system of ownership is a necessity in the social system. Marx declares the social system development takes place in five stages. The first stage is primitive-communal society has have not recognized the system of ownership. The second stage is the stage of division of labor and the emergence of ownership. The third stage is formation of feudal society. The fourth stage is development of a capitalist community. The final stage is stage of development of the social system which is the formation of a socialist-communist society. If seen from ownership, the social-communal system is divided into three sections; the stage of primitive-communal society, the division of labor and the stages of ownership, and phase of the ownership elimination. According to Marx, the ownership of proletariat workers system suffers exploitation and alienation. Both of these things can only be solved by removing the ownership system which is replaced by the role of collective ownership. For Islamic economics, exploitation and alienation experienced by the proletariat workers are the result of inconsistencies in wealth management and distribution system in the capitalist system, not proprietary. Abstract

Islamic economic view on demand and consumption is relatively equal with conventional economics, but there are limits for individual to behave economically in accordance with the rules of sharia. In Islamic economics, Islamic norms and morals, which are Islamic principles in conducting economic activities, are factors that determine an individual or society in conducting economic activities, so that Islamic economic theory is different from the theory of conventional economics. Demand is from the consumer and supply is from producer. Both of these are central to an economic problem because these two things make market work. Therefore, before looking at whether policy or event is capable of affecting the economy, we must first see the effect on demand and supply, including The object of discussion is the issue of inter-temporal consumption, that is consumption executed in two times, namely the present (first period) and the future (second period). Instruments that may affect the volume of money are allocated for consumption in either the first or second period includ: First, Zakah; the imposition of zakat in the first period 1 (Z1)) will reduce m1 allocated to C1. If there is no savings or lending in the first period, then final spending (m1 = FS = C1 +Z1) is same with m1. Second, Infaq or shadaqah; the expenditure of infaq or shadaqah in the first period will reduce the m1 allocated to C1. There is no savings or lending in the first period, then final spending equals m1. Third, rate of profit or profit sharing (rp); if in the first period there is a portion of m1 allocated in the form of savings and is invested, then the final spending the second period (FS2) equals m2 the number of m1 saved is added with the rate of profit (rp) (FS2 = m2 + (1 + rp) m1 ). Keywords: Inter-temporal, Consumption, Demand, Islam, Conventional

Abstract

In muamalah activity, Islam has provided a clear line of wisdom. Business or trade transactions are things that are highly regarded and glorified in Islamic teachings, whether done individually or in groups. The attention of Islam towards trading transactions has recently been responded positively by Muslims in the world, particularly in Indonesia. Sharia institutions have shown fast development marked by the growing number and variety of Sharia-labeled businesses. Multi-level marketing has also been affected by Muslims’ awareness of sharia-based behaviors in their daily lives. This has also been supported by the issuance of the fatwa from DSN MUI (Sharia National Council – Indonesian Ulama Council) No. 75/DSN-MUI/VII/2009 concerning Sharia multi-level direct selling (PLBS). This phenomenon has urged Tiens Indonesia to adjust their network system to the stipulations in the fatwa. This study aimed to analyze and describe as well as evaluate the network system applied by Tiens Syariah. Using the descriptive qualitative field study, the research is conducted in Yogyakarta Special Province. Data is gathered from observation, interview, and documentation. The obtained data was then analyzed qualitatively and explained descriptively. The result of research shows that based on Point 12 of the fatwa from DSN-MUI No. 75 Year 2009 concerning Sharia multi-level direct selling, the multi-level marketing company Tiens Syariah has fulfilled all the standards in Point 12. Abstract

Financial report is data which can provide an illustration and information. The information that is given is a description of enterprise at some point or another certain or at a particular period. Financial report is an analysis used to know the meaning of set forth in the number that such financial statement so that beneficial for the users. In addition, by analyzing the influence of an financial report can be seen divorce or funding murabahah and musharakah in effecting company profitability. This research attempts to answer the question of how the influence of murabahah financing to profitability in BPRS Madinah Lamongan, how the influence of musharakah financing to profitability in BPRS Madinah Lamongan, and how the influence of murabahah financing and musharakah simultaneously on the profitability in BPRS Madinah Lamongan. This research is quantitative model which describes the phenomena of objects research and take conclusions  based on figures the statistical analysis. Data collection is carried out by interviews from employees of BPRS Madinah Lamongan and documentation with the methods for data collection of financial report BPRS Madinah Lamongan 2014-2017 Period. The results of research shows that first, murabahah financing has an influence on the profitability in BPRS Madinah Lamongan 2014-2017 period. It is otherwise based on the partial test. Second, musha>rakah financing has no influence to profitability in BPRS Madinah Lamongan 2014-2017 period. It is otherwise based on the partial test. And third, murabahah financing and musharakah together fit to influence to profitability in BPRS Madinah Lamongan 2014-2017 period.
