ISSN : 26846853     EISSN : 2684883X     DOI : -
Core Subject : Economy,
In various literatures on the economy is divided into two sectors: the real sector which includes the service market and the market for goods, and the monetary sector which consists of the money market and the capital market (wealth). In some economic systems, the monetary (financial) flowing in a country will affect the rate of the economy. Monetary economy can be applied in a policy called monetary policy. In a conventional discussion, a monetary policy is implemented to achieve an increase in national income, to stabilize market prices, and to control the inflation rate. To achieve these macroeconomic goals, interest rates are used which is a weakness of the conventional monetary system. The subsequent use of interest rates has led to an economic crisis, even a global financial crisis, therefore there is monetary policy in the Islamic economy to reduce interest rates. It can be concluded that the influence of the financial system and monetary policy in the perspective of Islamic economics in the New Order era and Islam has its own monetary policy that is different from other economic systems. In the aspect of the goal of Islam, it does not only emphasize equilibrium between the demand and supply of money but also strives for equality with the principles of justice and brotherhood, so as to create a fair distribution of wealth and income as well. In connection with the needs of a new economic system, the Islamic monetary system offers a solution to overcome the financial crisis.

Abstract

Several factors influence the recurrent purchase attitude of organic food customers in Jabodetabek (the cities of Jakarta, Bogor, Depok, Tangerang, and Bekasi). Under the theories of Consumer Behavior or Perceived Behavior Control and Theory of Planned Behavior, there are 5 endogenous variables that enter into the implications of consumer behavior towards organic food and four exogenous variables on this attitude. Environmental issues, food safety concerns, health consciousness, organic food knowledge, and subjective norms are the five. The remaining four factors are attitude toward organic food, intention to recommend, price barrier, and intention to repurchase organic food. SmartPLS 3.0, based on the PLS SEM formulation, became a tool for calculating the value of 84 respondents in a cross-sectional study. Finally, environmental concerns do not apply to the most recent models. Meanwhile, health concerns, food safety concerns, and price barriers remain minor. There are three constructs that merit additional investigation, in addition to their managerial implications. First, other variables other than this journal must be added for future creation from the producer's standpoint. Second, it is prudent to conduct research for the next development of a certain brand. Third, the following structure can be analyzed over time.
Tumpang Tindih (Overlapping) Wanprestasi dan Penipuan Pidana dalam Penyelesaian Masalah Kontrak Komersial Suwarti Suwarti; Wahda Z. Imam

Abstract

This research aims to analyze fraud in depth based on Article 1328 of the Civil Code in agreements that may result in breach of contract, as well as to examine the legal implications of commercial contracts containing elements of fraud based on Article 1328 of the Civil Code, where fraud can be annulled or declared void ab initio. The method used in this research is normative research on legal principles contained in Article 1328 of the Civil Code. The data used in this research are secondary data. The secondary data used in this research consist of primary legal materials that are authoritative, meaning they have authority, secondary legal materials, and tertiary legal materials. The research results show that fraud based on Article 1328 of the Civil Code in agreements does not result in breach of contract. This is because breach of contract and fraud in civil law have different elements. Breach of contract is regulated in Article 1243 of the Civil Code, while fraud in civil law is regulated in Article 1328 of the Civil Code. Breach of contract (negligence or inadvertence) by a party can take four forms: First, not doing what was promised to be done; Second, performing what was promised but not as promised; Third, performing what was promised but late; Fourth, doing something that, according to the agreement, should not be done. Meanwhile, fraud, as referred to in this research, consists of the concept of fraud found in Article 1328 of the Civil Code, namely, the presence of defects in will. Defects in will are caused by: mistake or negligence, coercion, and fraud. Therefore, to determine when breach of contract occurs and when fraud occurs depends on a person's intention. If there was already a malicious intent before the contract was closed/signed, then this constitutes an act of fraud. If a person's malicious intent arises after the contract is closed/signed, then this is an act of breach of contract.

Abstract

This research aims to analyze the legal aspects in the implementation of inheritance case decisions involving disputed properties that already have a property ownership certificate. The main focus of this research is to identify challenges and obstacles that may arise in the implementation of such decisions. The research method used is a normative analysis approach, which involves examining relevant laws and regulations, related jurisprudence, as well as relevant documents. The research findings indicate that the implementation of inheritance case decisions involving disputed properties with existing property ownership certificates involves a series of complex legal processes. The main challenge lies in harmonizing the court's decision with the validity of the previously issued property ownership certificate. Additionally, it is important to consider the rights of the parties involved that are protected by the law. This research also highlights the need for practical guidance or guidelines for parties involved in the implementation of such decisions, including judges, lawyers, and other relevant parties. These recommendations are expected to make a positive contribution to improving justice and effectiveness in resolving inheritance disputes involving properties with ownership certificates in the future.
