Al Hikmah: Jurnal Studi Keislaman diterbitkan oleh Institut Agama Islam Al-Hikmah Tuban yang terbit sejak tahun 2011. Jurnal ini memuat kajian-kajian keislaman yang meliputi pendidikan Islam, sharî‘ah, pemikiran Islam, ekonomi, dan kajian Islam lainnya. Terbit dua kali setahun, yaitu bulan Maret dan September. Redaksi mengundang para akademisi, dosen, maupun peneliti untuk berkontribusi memasukkan artikel ilmiahnya yang belum pernah diterbitkan oleh jurnal lain. Naskah diketik dengan spasi 1,5 cm pada kertas ukuran A4 dengan panjang tulisan antara 20-25 halaman, 7000-9000 kata. Naskah yang masuk dievaluasi oleh dewan redaksi dan mitra bestari. Redaktur dapat melakukan perubahan pada tulisan yang dimuat untuk keseragaman format, tanpa mengubah substansinya. Alamat Redaksi: Jl. Abstract

Pengaturan pengadaan tanah bagi pembangunan untuk kepentingan umum didasarkan pada prinsip-prinsip yang telah dicantumkan dalam Undang-undang No 2 Tahun 2012 tentang Pengadaan Tanah bagi Pembangunan Untuk Kepentingan Umum. Prinsip yang dimaksud yaitu prinsip kemanusiaan, keadilan, kemanfaatan, kepastian, keterbukaan, kesepakatan, kesejahteraan, keberlanjutan, dan keselarasan. Penormaan dalam peraturan perundang-undangan harus mengacu pada prinsip prinsip yang ada. Namun demikian, berdasarkan kajian yang telah dilakukan penulis terdapat prinsip yang tidak dijabarkan dalam norma hukum, yaitu prinsip kemanusian.

Abstract

Indonesia is a state law. This is clearly contained in the state constitution, namely article 1, paragraph (3) of the Constitution of the Republic of Indonesia Year 1945. Explanation of the Constitution of the Republic of Indonesia Year 1945 further mentioned State Indonesia based on the law (rechstaat), not by power sheer (machtsstaat). As a country which proclaimed itself as a country of law, then all aspects of national life must be based on law. The emergence of dual obligation is related to several articles, namely: (a). Article 2, paragraph (1), which puts the Attorney as government agencies which implies that the prosecutor's office is an agency under the executive, but the authority to implement state power in the prosecution of running the judiciary; and (b). Article 19 paragraph (2) and Article 22 of the Attorney General is appointed, dismissed and responsible to the president, it is structurally under the executive judiciary but functionally is that in carrying out its functions should remain in line with the government-run legal politics.

Abstract

Coates (1996) stated that children learn language by modelling the speech of their community, while simultaneously learning the cultural role that is assigned to them by society depending on their sex. Then, children animated movies as one of modern media became a tool in delivering that kind of message which sometimes contained gender stereotype included in the characters’ speeches. Some linguists belived that men and women have different language features used in their daily conversation. Holmes (1995) stated that the linguistic forms used by women and men contrast - to different degrees – in all speech communities. In his research on Norwich society, he found ut that men mostly used more vernacular language than women. This research aimed to describe the language features used by men and women characters in children animated movies, specifically in Cars and Barbie and 12 Dancing Princesses movies. The research’s results showed that both man and woman characters use language features proposed by Lakoff (1975), such as, empty adjectives, hedge, intensifier, hypercorrect grammar super polite form, tag question, and emphatic stress, even though the characteristics of color words and question intonation have not been found in the characters’ utterances. The difference between men and women’s speeches is shown clearly through the characteristic of hypercorrect grammar in which man used informal speeches in higher frequency than woman. Overall, it can be said that Barbie and 12 Dancing Princesses which was targeted for girls had more formal language variation, while Cars which is targeted for boys had more informal language variation.

Abstract

Education is a conscious and deliberate effort to create an atmosphere of learning and the learning process so that learners are actively developing the potential for him to have the spiritual power of religion, self-control, personality, intelligence, character, and skills needed him, the community, the nation and the State (Law National education No. 20 Th. 2003) on quality improvement is one of the pillars of the development of education in Indonesia. School is a system that has a purpose. In connection with efforts to achieve these goals, seringkalian problems can arise. These problems can be grouped in accordance with the administrative tasks that are the responsibility of the school administrator, so it is the substance of the administrative duties of school heads as the administrator. Among these are tasks grouped into the substance of school supplies. With facilities and infrastructure that meet expected output from there to reach the initial goal of an educational institution itself, but to infrastructure penididikan was adequate and relevant to the needs of the perluhnya Further investigations on the Management of Infrastructures, so that the vision and mission of the school will be achieved in accordance with the initial planning.

Abstract

Approachment of philoshophy or ideology in Islamic Law or philoshophy law use by careful with classical and contemporary religious sholars (‘ulama> ). The word of pholoshophy (falsafah) is not found in sources of Islamic law. Although not found in sources of Islamic law, however  the meaning of pholoshophy (falsafah) in Ulama’s perspective is similar meaning with h}ikmah. Therefore. For understanding and seek the knowledge of Islamic law, someone must need the methodologies to understand it. Al-Qawa>’id al-Fiqhiyyah (legal principles) as deductive reason in legal reasoning through us}u>l al-fiqh approach. This paper seeks to answer a problem of how deductive reson using Al-Qawa>’id al-Fiqhiyyah is regarded as the sourch of Islamic law in the perspective of classical and contemporary religious sholars (‘ulama> ). Basing mainly on the legal approach , this paper argues that not all ulama>  are familiar with, and therefor, employ Al-Qawa>’id al-Fiqhiyyah in the making of Islmaic legal opinion. Permitting the use of legel principle as reference on the condition should be drived from thr primary source of Islamic law (al-Qur’a>n dan Sunnah), not from the legal thought of jurists.

Abstract

Many thinkers Indonesia who had been instrumental in changing the tradition of thought intlektual in Indonesia in this modern era, among them Harun Nasution, Nur Kholis Majid, Shafi'i Maarif, KH. Abdur Rahman Wahid, KH. MA. Sahal Mahfudh, and so forth, of the range that is Munawir Syadzali, where he through his works has been trying to sell the idea of re-actualization of the teachings of Islam and the concept of the State according to Islam in accordance with the social and cultural conditions in Indonesia, his services in the formation of Madrasah Aliyah Special Program (MAPK), sending lecturers IAIN to study in Western countries, a brilliant idea and breakthrough courageous munawir syadzali can be regarded as a solution to the rigidity of Islamic thought and system of Islamic Education, During his time as Minister of Religion, not a policy that has been taken Munawir Syadzali, of which there are three prominent agenda, first, completing Pancasila social organizations and the fundamental pillars of national life, secondly, the improvement of educational institutions, third, strengthening the presence of the Religious Court and Compilation of Islamic Law.

Abstract

In Islamic studies has been known modern terms, modernization, and modernism. For example: "modern streams in Islam" and "Islam and modernization". Modernism in western society implies mind, flow, motion and effort to change the ideology-ideology, customs, old institutions, and so forth, to be adapted to the new atmosphere brought about by advances in science and modern technology. Thoughts and this flow very quickly enter the field of religion, the progress of science and modern technology into the world of Islam, especially after the opening of the nineteenth century, which in the history of Islam is seen as the beginning of the modern period. Further contact with the western world to bring new ideas into the Islamic world, including the idea is democracy. This created problems, which according to Muslim thinkers should be resolved.

Abstract

Jihad and terrorism are two terms that have always been the focus of international attention. There are some mistakes that need to be clarified, especially related to the meaning of jihad in Islam. The international community assumed that both terms-tangible into motion some activist groups that exist in the Islamic-are two sides that can not be separated. Making of war or jihad that many written by Western scholars tend to confuse terrorism with the term jihad. This was done because it may depart from hatred and lack of empathy. Especially after the attacks on the World Trade Centre (WTC) on 9 November 2001 the United States declared war against the terrorists. That term refers to a group of Al-Qaeda leader Osama bin Laden is considered a global terrorist. The issue of an increasingly globalized terrorism in Indonesia after the Bali bombing in October 12, 2012 during the Megawati administration. Map terrorism as being part of the Islamic world.

Abstract

Many people who believe that Islam is a religion that teaches tolerance values to his people. Theological argument which states Islam is a religion that teaches the values of tolerance to their communities they draw from a Quran and al-Hadith. in the Qur'an many verses that invites his people to be tolerant in religious life. There are at least eighteen verses that directly relate to the significance of the values of tolerance for religious life, among the letters terbeut is verse 30 of Surat al-Naml. Paragraph 120 surat al-Baqarah should not in tafsiri with the interpretations are loaded with cargo intolerance. Because, harfiyyah "لن" within the meaning of the verse does not menunjkkan eternally disclaimer. This verse is also derived in special conditions and situations that the war situation. The meaning of this verse is reminding people not to get caught by his own desires, because, man will never ridla before he follows his own lusts and if it follows his own desires, then the question has become people dzalim. With semikian, this verse does not become a threat to the life of religious tolerance. This verse is also not considered as a verse that teaches hatred or intolerance.
