Jurnal Hukum dan Peradilan (JHP) is published by the Research Center for Law and Judiciary of the Supreme Court of the Republic of Indonesia. JHP aimed to be a peer-reviewed platform and an authoritative source of information on legal and judiciary studies. The scope of JHP is analytical, objective, empirical, and contributive literature on the dynamics and development of legal studies, specifically in Indonesia. JHP welcomes scientific papers on a range of topics from research studies, judicial decisions, theoretical studies, literature reviews, philosophical and critical consultations that are analytical, objective, and systematic. However, from a wide range of topics that researchers can choose from, JHP puts more attention to the papers focusing on the sociology of law, living law, legal philosophy, history of national law, customary law, literature studies, international law, interdisciplinary, and empirical studies. Jurnal Hukum dan Peradilan (JHP) is a media dedicated to judicial personnel, academician, practitioners, and law expertise in actualizing the idea of research, development, and analysis of law and judiciary. Jurnal Hukum dan Peradilan comes out three times a year in March, July, and November.

Abstract

Based on Indonesian Constitution 1945 the existence of quasi-judicial institution as a part of judicial power.Article 24 subsection (3 ) of the constitution of the republic of indonesia 1945 and the law number 48 / 2009 about judicial power admitting quasi-yudicial institutionshas judicial powers. For maximalize exercising of the quasi-judicial institutions are needed legal policy for supporting functional-constitusional relations between Commison for Supervion of Bussiness Competition and Supreme Court as top judicial power organization. Besides that needs to be done an effort to control the behavior commissioner of Commison For Supervion of Business Competition in avoiding abuse of power and moral hazard. Abstract

Indonesian administrative courts’ absolute jurisdiction are limited to the administrative decisions. It leads the courts as a special administrative court, even a “very special court”, because such definition of administrative decisions laid down on Law on Administrative Court is more narrow compared to the definition of administrative decision as laid down on the General Administrative Law Act of the Netherlands as it source. Most court decisions on the courts’ absolute jurisdiction vary in interpretations that make them unpredictable. They cause uncertainty and inconsistency in the application of administrative courts’ absolute jurisdiction. Furthermore, they create confusion to the society looking for appropriate forum dealing with administrative acts and bafflement to the administrations executing courts’ decisions. The concept offered to the expansion of Indonesian administrative courts’ absolute jurisdiction are based on the method and determination of administrative disputes. Method used is general method, while determination used is subjective and objective determinations. Subjective determination includes external and internal disputes, while objective determination includes all administrative acts in the field of public laws covered the legal and factual acts causing material or immaterial damages. Abstract

Since the verdict of the Constitutional Court (MK) Number 93/PUU-X/2012 pronounced on Thursday, August 29, 2013, concerning the judicial review of Law No. 21 of 2008 on Islamic Banking, it is no longer dualism dispute resolution. The verdict as well as strengthen the jurisdiction of Religious Court to resolve Islamic banking disputes. In consideration of the judges, judges agreed stating that Article 55 paragraph (2) and (3) of Law No. 21 of 2008 which is an ideal norm, contains no constitutional problems. The problem is the explanation of the constitutional article 55 paragraph (2) of the Act. The emergence of the Constitutional Court verdict No. 93/PUU-X/2012 which substantially states that the explanation of Article 55 paragraph (2) of Law No. 21 of 2008 does not have binding force, basically does not violate the principle of freedom of contract which is common in contract law. The parties are allowed to make a dispute resolution agreement out of religious court based on provisions as Act No. 30 of 1999 on Arbitration and Alternative Dispute Resolution.
