Abstract

Rental agreements are usually made in writing in a standardized form, namely the content, form and closing have been standardized unilaterally by the business actor. This agreement is coercive and causes losses for the lessee and even an imbalance in the position between consumers and producers. This study aims to: (1) determine the contents of the standard clauses in the car rental agreement at Komando Rent a Car whether or not they are in accordance with the principle of good faith (2) to determine the legal consequences of including the standard clause in the car rental agreement at Komando Rent a car. The type of research used in this study is empirical juridical by using data collection techniques through interviews and literature studies. The results of the study show that: (1) the car rental agreement at Komando Rent a Car is not in accordance with the principle of good faith because there is a standard clause in the form of delegation of responsibility for business actors to the detriment of one of the parties, does not reflect a sense of justice and violates the law (2 ) the legal consequence of the inclusion of a standard clause which contains the transfer of responsibility for this business actor is that the agreement is null and void and can be subject to imprisonment and fines. Abstrak Perjanjian sewa biasanya dilakukan secara tertulis yang sudah dalam bentuk baku yaitu isi, bentuk serta penutupannya telah dibakukan secara sepihak oleh pelaku usaha. Perjanjian ini bersifat memaksa dan menimbulkan kerugian bagi pihak penyewa bahkan terdapat ketidakseimbangan posisi antara konsumen dan produsen. Penelitian ini bertujuan untuk: (1) mengetahui isi klausula baku pada perjanjian sewa menyewa mobil di Komando Rent a Car telah sesuai atau tidak dengan asas itikad baik (2) untuk mengetahui akibat hukum dari pencantuman klausula baku pada perjanjian sewa menyewa mobil di Komando Rent a Car. Jenis penelitian yang digunakan dalam penelitian ini adalah yuridis empiris dengan menggunakan teknik pengumpulan data melalui wawancara dan studi kepustakaan. Hasil penelitian menunjukkan bahwa: (1) perjanjian sewa menyewa mobil di Komando Rent a Car tidak sesuai dengan asas itikad baik karena terdapat klausula baku berupa pelimpahan tanggung jawab pelaku usaha sehingga merugikan salah satu pihaknya, tidak mencerminkan rasa keadilan dan melanggar Undang-Undang (2) akibat hukum dari pencantuman klausula baku yang memuat pengalihan tanggung jawab pelaku usaha ini adalah perjanjian tersebut batal demi hukum dan dapat dikenai sanksi penjara dan denda.

Abstract

A system can be declared successful if its application in the field has achieved predetermined objectives. The Supreme Court as the highest agency in the judicial sphere has issued a system to register cases and trials in court electronically, one of which is the Bangil Religious Court. The purpose of the study was to determine the application of the e-court system in the examination of cases at the Bangil Religious Court and to determine the effectiveness of the e-court system at the Bangil Religious Court. Research methods used by researchers are sociological empirical research methods that describe the actual environmental conditions of society supported by data and facts obtained by conducting interviews and observations. The results showed that: 1) The examination of cases at the Bangil Religious Court has not fully implemented the examination of cases using the e-court system because one of the agendas for examining cases in the trial, namely the agenda of evidence, is still carried out manually. 2) Effectiveness of e-court  system implementation The Bangil Religious Court cannot run effectively because 4 factors of legal effectiveness cannot be met, namely Law Enforcement Factors there are obstacles experienced by judges in the verification process in  the e-court system, Facilities and Infrastructure Factors related to network system constraints from the center and facilities that are less attractive to the community, Community Factors that do not understand technological developments, Cultural Factors The difficulty of transitioning people's way of life from conventional to electronic. The factor that is fulfilled is Law Enforcement Factors evidenced by the issuance of PERMA Number 1 of 2019. Suggestion that the Supreme Court improve network repair and maintenance on the e-court system to avoid system errors at certain times and often conduct socialization related to e-court renewal.

Abstract

The development of the times facilitates the dissemination of information and culture to various parts of the world. The law is one of the things that also developed. The law cannot be separated from the regulation regarding intellectual property rights that participate in developing as technology and globalization develop. As regulations in Indonesia, one type of intellectual property rights is copyright. In digital development, technology is also developed, one of which is artificial intelligence. In its development Artificial Intelligence is developing very rapidly even today Artificial Intelligence can make artwork in the form of digital photos that can be protected by copyright. This study was compiled through a conceptual approach and using normative legal research methods, doctrinal, and comparative studies, as well as using quality analysis techniques. This study argues that Indonesia has not accommodated the arrangement of artificial intelligence results so that the arrangement is needed so as to create a law that is able to follow the flow of times and create protection against artificial intelligence creations. Abstrak Perkembangan zaman mempermudah penyebaran informasi mupun budaya ke berbagai penjuru dunia. Hukum menjadi salah satu hal yang ikut berkembang pula. Hukum tidak mungkin terlepas dari pengaturan mengenai Hak Kekayaan Intelektual yang ikuts mengalami perkembangan seiring berkembang teknologi dan globalisasi. Sebagaimana pengaturan di Indonesia, salah satu jenis Hak Kekayaan Intelektual adalah Hak Cipta. Dalam perkembangan digital, berkembang pula teknologi salah satunya Artificial Intellengence. Dalam perkembangannya Artificial Intellegence berkembang sangat pesat bahkan dewasa ini Artificial Intellegence dapat membuat karya seni berupa foto digital yang bisa dilindungi Hak Cipta. Penelitian ini dibuat melalui pendekatan konseptual dan menggunakan metode penelitian hukum normatif, doktrinal, dan studi perbandingan, serta menggunakan teknik analisis kualitas. Penelitian ini berpendapat bahwa Indonesia belum mengakomodir pengaturan mengenai karya seni hasil Artificial Intelligence sehingga dibutuhkan pengaturan tersebut sehingga tercipta hukum yang mampu mengikuti arus zaman dan tercipta perlindungan terhadap karya kreasi Artificial Intelligence.

Abstract

Copyright holders have exclusive rights to their creations or work. Illegal downloading and streaming of movies can be detrimental to copyright holders and countries. Therefore, perpetrators can be subject to criminal and civil sanctions. This study aims to: (1) determine the protection for the Moral Rights and Economic Rights of film creators or Copyright Holders from illegal downloading and streaming of films on the Internet and (2) determine how the law should regulate the rights of creators from illegal downloading and streaming activities to provide legal protection. The type of research used in this study is normative juridical by using data collection techniques through literature studies. The results show that: (1) the protection of Economic Rights and Moral Rights of film copyright is still lacking in providing legal protection because sanctions for violators of Moral Rights have not been regulated in the Copyright Law (2) the Copyright Law has regulated legal steps that Copyright Holders can take to obtain legal protection in the field of Copyright through mediation, criminal complaints, claims for compensation, and reports on the closure of content and access rights

Abstract

Along with the times, Balinese traditional architecture is increasingly being eroded by modern architectural art and also by the occurrence of damages. The purpose of this paper is to analyze the protection of traditional architectural buildings in the modern Balinese era  and problems related to the preservation of traditional architecture in the modern Balinese era. This research adopts the doctrinal research and uses primary, secondary and tertiary legal materials. These legal materials were collected using a card system with a statute approach, a fact approach, and an analytical conceptual approach. Findings of the study show that: first, according to national law, Balinese traditional architecture is a cultural heritage and is regulated in Indonesian Law Number 5 of 1992 concerning Cultural Heritage Objects. Meanwhile, in the Province of Bali, Balinese traditional architecture is regulated in the Regional Regulation of the Province of Bali Number 5 of 2005 concerning Architectural Requirements for Buildings; secondly, one of the ways taken by the Government of Bali Province to preserve Balinese traditional architecture is to apply it to buildings. Balinese architecture, besides being used in the physical form of buildings, is also applied to the design of fences and gates along the main roads and streets in the environment. Balinese architecture is also required to be applied to government-owned houses or buildings, and official residences.   Abstrak Arsitektur tradisional Bali seiring perkembangan jaman semakin tergerus oleh seni arsitektur modern dan juga terjadinya kerusakan-kerusakan. Tujuan penulisan ini adalah menganalisis perlindungan bangunan arsitektur tradisional di era Bali modern dan permasalahan terkait pelestarian arsitektur tradisional di era Bali modern. Penelitian ini merupakan Doctrinal Research dengan menggunakan bahan hukum primer, sekunder dan tersier. Teknik pengumpulan bahan hukum dilakukan dengan sistem kartu dengan pendekatan perundang-undangan, pendekatan fakta, dan pendekatan analisis konseptual. Hasil dari penelitian ini yaitu: Pertama, Secara hukum nasional, arsitektur tradisional Bali merupakan salah satu cagar budaya dan diatur di dalam Undang-Undang Nomor 5 Tahun 1992 tentang Benda Cagar Budaya. Sedangkan di Provinsi Bali, arsitektur tradisional Bali telah diatur di dalam Peraturan Daerah Provinsi Bali Nomor 5 Tahun 2005 tentang Persyaratan Arsitektur Bangunan Gedung; kedua, Salah satu cara yang dilakukan oleh Pemerintah Provinsi Bali untuk pelestarian arsitektur tradisional Bali adalah dengan mengaplikasikannya pada bangunan gedung. Arsitektur Bali selain digunakan dalam bentuk fisik dari bangunan gedung, juga diberlakukan untuk desain pagar dan gerbang disepanjang jalan raya dan jalan lingkungan. Arsitektur Bali juga diwajibkan untuk digunakan terhadap bangunan atau gedung milik pemerintah, rumah dinas maupun rumah jabatan.

Abstract

In handling cases of sexual violence experienced by persons with intellectual disabilities,  the Public Prosecutor must have  great skills in  understanding the laws and regulations that will be used in drafting charges in court. The purpose of this study is to examine the  consideration of the Public Prosecutor in filing  charges and charges in case number PDM– 020/Eku.2/BTM/01/2022. The research method used is a  normative legal research method with a statutory approach and a conceptual approach. The results  of the study show that First, the Public Prosecutor uses/determines the charges against the maker/sexual violence for persons with intellectual disabilities in case Number: PDM– 020/Eku.2/BTM/01/2022, based on objective factors and subjective factors. Objective factors refer to factors that relate to the rules of laws and regulations. Subjective  factors are  factors that are related or related to the perpetrator and criminal responsibility which he has carried out. Criminal liability. Second,  the  Public Prosecutor's claim in case Number PDM– 020/Eku.2/BTM/01/2022 is in accordance with the principle of legal certainty. However, the legal certainty provided by the Public Prosecutor does not necessarily provide benefits for victims with intellectual disabilities.
