Abstract

The philosophical values  contained in the  building of the  traditional marriage of the  Malay community of the City of Bengkulu are a reflection of the socio-cultural relations of Malayness with Islamic values. Historically, Beng- kulu Malay Islam  was an incarnation of acculturation and  assimilation between Muslims who came  to Bengkulu. The position of the process of acculturation of Islam  in Bengkulu Malay society,  became very significant as the basis of the cultural process of Bengkulu society until now. Acculturation of values and internalization of Islamic values is very func- tional in shaping philosophical values in the custom of marriage of the Bengkulu community. This is expressed in every stage of the traditional marriage, there are ritual processions that are inter-related with local wisdom, Islamic values and other Islamic philosophical meanings.

Abstract

This research raises  about Had for Lesbians, Gay, Bisexual, Transgender (LGBT) Perspective of Imam Shafi’i, Islamic Law and Positive Law. This research method is library research. The results of this study indicate that Had Lesbi- an, Gay, Bisexual, Transgender (LGBT) according to Imam Syafii Imam Syafii’s opinion about LGBT is considered a very damned act and  is considered as jarimah regardless of the perpetrators, whether done by unmarried people or people those who are married, it is referred to as fahisyah and is regarded as against the law. It also does not reduce its criminal value, even though it is done voluntarily or like it. Although no one feels aggrieved, it is still seen as a very despicable sexual violation, without knowing priorities. Had in the Islamic law perspective on Lesbians, Gay, Bisexual, Transgender (LGBT) that LGBT punished this behavior seen from the side where he channeled his lust for the same sex. So, if he were a man, when he channeled lust desires to fellow men, then the law was included in the category of gay (liwath) and if he was a woman, when channeling his lust for others, then the law was included in the category of lesbian . the scholars also agreed that the clerics forbid transgender behavior

Abstract

This paper aims  to explore how the concept of multiculturalism in the Medina Charter as an initial  concept applied by the  Prophet to realize multiculturalism in the  practice of pluralist shared life, Affirmation of the  Medina Charter as a preliminary check  in multiculturalism, because the  verses  of the  Koran  at the  time  of the  emergence of the Medina Charter not finished yet. Furthermore, it is explored how then the Koran responds to the Prophet’s politi- cal and  humanist policy steps  in a normative-historical manner in developing multiculturalism as an offer of Islamic concepts for the formation of multiculturalist instruments. The research used is library research (library reseach), which examines the content of the Medina Charter, related verses of the Koran and reading books related to the subject matter. While the  approach used  in this study  is historical-philosophical. The method for analyzing the  data  that  I use is de- scriptive analysis method. The basic assumption is that the policies and strategies developed in the Medina Charter and the response of the verses of the Koran are part of Islamic Education. In developing multiculturalism-based PAI, it is not enough just to normalize the basics, but it needs to be done in a community effort in the Learning Plan. The paradigm of multiculturalism that must be built is how the multicultural theology itself and what are the main principles that can be developed from the reading of the Medina Charter and the verses of the Quran relating to multiculturalism

Abstract

The purpose of this study is to find out how the role of women’s women’s crisis center Bengkulu in handling cases of domestic violence in the perspective of Islamic Law and  Law Number twenty  three Year two four About Aboli- tion of Domestic Violence. This type of research is field research (field research) supported by library  research (library research). From  the  result  of this research, it is concluded that  the  role of women’s crisis center Bengkulu women in handling cases  of domestic violence in collaboration with legal aid institutions, medical, police,  and  courts, this  co- operation is called  case-handling network in an effort to reach cases  of domestic violence and  sexual  violence can be handled and  facilitated by victims  such  as safe houses, counseling rooms, to share stories and  facilities  in the form of legal assistance and handling in a familial manner while reducing the number of sexual violence handled by prevention programs. Analysis of Islamic law against domestic violence that in Al-Qur’an Surah  An-Nisa ‘verse thirty-four explains that a husband should not immediately hurt  his wife with a painful blow. Since Islam does not teach such a thing, there have been good and  right rules when the husband is facing such  problems. Although beating the wife is justified in Is- lam, it is hitting that does not hurt the wife and with educational intentions. Analysis of Law Number Twenty-three Years Two Thousand Four  About Abolition of Domestic Violence  is able  to avoid  family violence, when disharmony occurs between husband and wife. More broadly, it is necessary to have fundamental changes in women’s status and attitudes toward both women and men  in society,  the need for continuous and strategic efforts to deconstruct traditional power structures that have been considered legitimate and deconstruct cultural assumptions and religions that strengthen and legitimize violence

Abstract

This study  aims  to: first, to find and  analyze the correlation and  effect of ethnic background of the selecting preferences in the  mayor  election of Bengkulu City in 2012. Second, to find and  analyze whether there was a shift or change in preferences based on ethnic backgrounds in the elections of the Mayor of Bengkulu City between 2007 and2012.This study applied a quantitative approach that classified as causal explanatory descriptive and comparative study. This research is located in the  Bengkulu City by taking  a sample of 100 respondents by simple random sampling method. To answer the  first research objective, statistical analysis is used  multinomial logistic  regression analysis, whereas to answer the second research purposes used  non-parametric statistical analysis of the Mc Nemar test.The results of the  data  analysis shows  there are significance correlation and  influence of the  ethnic background with preference vote in the election of Mayor and  Deputy Mayor of Bengkulu City in 2012. Specifically,  ethnic background influence someone to choose candidate for Mayor and  Deputy Mayor from ethnic Serawai  - Minang, Serawai  - Beng- kulu City, and Serawai - Palembang. Then, there was a preference change to choose based on ethnic background in the elections of the city of Bengkulu in 2007 with the election in 2012. Voter preferences based on ethnicity has declined in2012 compared to 2007

The main ideas as an excellence book entitled The Venture of Islam Conscience and History in a World Civili- zation were prepared by Marshall GS Hodgson with a critical historical study. The book which consists of three volumes is interesting to review. Although other than the author is not a follower of Islam,  the objective in analyzing the data  in his study  needs to be reviewed. The writing in the form of this review aims; 1) reviewing the aspects in which  the work has strength both in terms of methodology, objectivity of data  studies on Islamic history  and  2) examining the  weak- nesses of the analyst

Abstract

In this discussion the development of inheritance law was stated, from the time before  colonialism until  the time of independence. In the development of inheritance law before  the colonial period, the empire and  the sultanate applied inheritance law as a living law in the  community as well as a culture of Indonesian law in its time.  When  the Dutch East Indies government arrived, Indonesia had  implemented Islamic religious law, which  then continued and recognized its legal authority, Van den Berg conceptualized Staatsblat 1882 Number 152 which contained provisions for indigenous people or colonized people, religious laws must be applied in his environment. Snouck Hoergronje, advisor to the  Dutch East Indies Government, initiated the  receptie theory of Islamic issues  and  domestic children who pro- posed “Islam  can apply if it has been perceived by customary law”, so adat  is what determines the existence or absence of Islamic law. Furthermore, at the  time  of independence Indonesian Islamic law experts tried  to make  Islamic law a national law, with the effort of national seminars in the formation of law, Islamic law was made as one of the sources in addition to European law and Customary law

Abstract

If the nature of the horizon above  is observed, which  also shows the sun, moon, stars and  so on, so does the earth with all its contents in the  form of humans, animals, plants and  solid objects, there is a close relationship with the complicated balance that smoothes the arrangement between the various colors of nature and that strengthen each other’s circumstances. Everything is a sign and proof of the form of Allah Almighty. In addition to showing the existence of the Substance of Allah SWT also proves the oneness and to His Almighty created it. It seems not to be imagined at all in anyone’s mind that these objects occur  without anyone creating as well as it is impossible to imagine that something created no one made it.
