Abstract

Sharia audits at Zakat Institutions in Indonesia are an obligation through Law Number 23 of 2011 concerning Zakat Management, that all management of zakat funds, infaq, alms, and other religious social funds (ZIS and DSKL) are audited by the Ministry of Religion in accordance with sharia principles. . This study aims to explain and analyze the practice of sharia auditing in zakat institutions in Indonesia which has been effective since 2020 and a study of the use of positive law and sharia in the implementation of sharia audits. This study uses a descriptive method with a qualitative approach through content analysis on regulations, data, documents. The results of the study indicate that the practice of sharia auditing covers the entire management of ZIS and DSKL funds starting from planning, implementing, coordinating, and reporting by measuring: 1) sharia compliance in management and governance, collection of funds, distribution of funds, and implementation of zakat regulations, and 2 ) transparency which includes financial transparency, management transparency, and program transparency. The use of positive law is an obligation that must be carried out in the implementation of sharia audits . The problem of managing funds that there are no provisions in positive legal regulations and fiqh literature, then the process of priority legal and fiqh instinbath with a set of rules is appropriate to function as a reference in the determination of Islamic law (ijtihâd al-ahhkâm) by sharia auditors. The contribution of novelty in this research is the first research on the journey of implementing sharia audits by the Ministry of Religion at zakat institutions in Indonesia, as well as a study of the use of positive law and syar'i in the implementation of the audit. The results of this study are expected to provide a conceptual contribution and increase knowledge related to the implementation of sharia audits in zakat institutions.

Abstract

The objective of this study is to design a cash waqf management framework for financing infrastructure in Indonesia's new capital, Nusantara. The scoping review methodology is used in this study to accomplish both research goals. The Publish or Perish application is used to collect scientific journal articles as part of the data collection process. A constructivist scoping review analysis procedure was used as the data analysis technique. The waqf program can be used to fund capital city infrastructure development projects, according to the study's findings. Our findings offer a cash waqf model that is linked to the mudharabah contract to pay for the state capital's relocation. The government can utilize this information as a springboard for developing financing regulations based on Islamic finance. By integrating pertinent stakeholders, further studies can employ the model created through the use of grounded theory. By conceiving of a cash Waqf system for funding the development of public infrastructure, our article advances Islamic finance literature.

Abstract

Abstract This study aims to identify the most influential strategies in increasing the accountability aspects of maqoshid sharia CWLS transactions by Nazir by first identifying the problems that exist in each element of maqoshid sharia, the solutions that have been carried out by nazir, and some future strategies. The method used is the Analytical Network Process qualitative approach. The data collected comes from informants from BWI, regulators, government, Nazirs, and Islamic financial institutions collecting cash waqf funds (LKSPWU). The results of the research show several identified strategies. Development and dissemination of the first competencies for sustainable waqf managers and communities related to the CWLS program, professional management, accounting and reporting, and technology. The second strategy is determining what information rules are presented to individual and non-individual wakif parties, such as regulators, the government, and LKSPWU.

Abstract

This study aims to identify and analyze the legal constructions of capital guarantees in the AAOIFI Sharia Standards and the DSN-MUI Fatwas, also to analyze the legal provisions of both. The research method uses a qualitative method and legal comparative approach, and the nature of the research is normative juridical. The results of the research show that the rulings of the AAOIFI Sharia Standards are more reassuring and prioritize the principle of ihtiyâth (precaution). Meanwhile, the legal provision of the DSN-MUI fatwas in which the capital manager is allowed to guarantee a return on business capital, is a commitment in the form of tabarru from the fund manager and must be fulfilled since the commitment is a wa’ad mulzim (binding promise). This legal provision of the DSN-MUI Fatwas is a form of an innovative ijtihad (effort) that seems different with the opinions of the majority of scholars which are the legal basis of the AAOIFI. However, the fatwa of the DSN-MUI is supported by various arguments and is more applicative, especially when it is used as a product in Islamic financial institutions.

Abstract

This article discusses organizational commitment in the context of Islamic banking. Specifically, we explored whether organizational commitment relates to its human resource management practices. In addition, it will also examine the role of perceived organizational support in this relationship. To achieve this goal, we conducted an online survey at one of the branches of the largest Islamic bank in Indonesia. Data were analyzed using structural equation modeling-partial least squares (SEM-PLS). The results showed that there were problems with human resources management (HRM) practices, perceived organizational support, and organizational commitment from Islamic banks, resulting in high turnover potential. Specifically, HRM practices and perceived organizational support were positively and significantly related to organizational commitment. However, perceived organizational support only mediated the relationship between HRM practices and normative and affective commitment, but not for the relationship between HRM practices and continuance commitment.

Abstract

This study explores the role of spiritual leadership in enhancing the spiritual and economic motivation and the performance of employees of sharia-compliant hotels in Banda Aceh, Indonesia. A number of 330 employees of the selected sharia-compliant hotels were selected as the study’s sample using a purposive sampling technique. Utilizing a structural equation modelling technique, the study found the important role of spiritual leadership in enhancing spiritual and economic motivation and employee performance. Additionally, spiritual leadership affected employees’ performance indirectly through motivation. Thus, hotel management could improve employee performance by enhancing spiritual and economic motivation and spiritual leadership.

Abstract

Shari'ah audit, a monitoring tool for ensuring Shari'ah compliance, is an important component in the operations of Islamic financial institutions.  However, this study aims to discuss Shariah's audit framework and explore the potential challenges involved in the Shariah audit. The study employed 40 practitioners from several Islamic financial institutions engaged in the audit services of Shari'ah through a purposive sampling procedure. The data was generated using a questionnaire tool. The data have been analysed with descriptive statistical tools including frequency, percentage, averages and standard differences because of the descriptive character of the study. The study findings demonstrate that the awareness of the Shariah audit is satisfactory since most of them have learned about the Shari'ah audit by way of a job training programme, which enabled them to say what Shari'ah audit practice should be. Likewise, the findings indicate that the practice has a lack of an independent audit report, an independent audit framework for the Shari'ah audit as well as inadequate competent Shari'ah auditors. In addition, the findings show that Shari'ah's audit has a strong potential in the near future to become a marketable career. Eventually, the results suggest that Shari'ah auditor should be integrated into the accounting of higher learning institutions; a comprehensive Shari'ah audit framework and standards; a new regulatory/professional body with a mandate to supervise Islamic Financial Institutions; and a professional certification in the Shari'ah audit. The study is hopeful to contribute to the development of the desired auditing practices for Shari'ah audit in Malaysia.

Abstract

Abstract: The primary objectives of this article are: (1) to elaborate the responses of Islamic bank executives in Indonesia on the issue of the constraints that preclude the Shariah-compliant Asset-backed Securities (SABS) issuance especially from shariah and legal perspectives, and (2) to formulate solutions to the constraints under the discussion. This research used a qualitative descriptive model with socio-juridical and inductive approaches. The research data were acquired from nine delegations of different Islamic banks through interviews and questionnaires, as well as literature reviews regarding fiqh al-muamalat, fatwah, and legislation. The data were analyzed using content analysis method by examining the constraints encountered by the Islamic banks involved in this research prior to SABS issuance. The research findings suggest that: first, despite offering benefits and being a necessity in balancing the liquidity mismatch of source of funding for Islamic banks, the SABS concept brings about risks and constraints in its implementation; second, the constraints to SABS issuance include the difficulties in procuring assets on which the SABS issuance is based; third, the constraints in the legal aspect include the basis of bank authority to sell assets to SABS issuers, the types of assets on which SABS issuance are based, the process of asset transfer to special purpose vehicles (SPV), the dubiety in the clauses that manage bankruptcy remoteness and perfection of security interest, as well as the problems concerning the accounting, asset bookkeeping, and taxation issues.

Abstract

Since the inauguration of the stock waqf by the Indonesia Stock Exchange in 2019 and along with the large number of sharia investors reaching 117,942 investors in 2022, it has considerable potential in stock endowments. The purpose of this study is to determine the development of stock endowments for Muslim investors. Using qualitative research methods using normative juridical approaches, collection techniques: primary data comes from literature studies and secondary data comes from distributing questionnaires to stock investors. The results of this discussion can be concluded that the existence of stock waqf is a description of money waqf that has been practiced by the public before the MUI fatwa in 2002 concerning money endowments, then stock endowments were officially launched by IDX in 2019. Based on the questionnaire distributed to investors, investors more dominantly answered that they already knew the stock endowments, then the existence of Law No. 41 of 2004 had been recognized but the distribution was more dominant assuming it was not distributed properly. And there is only 1 person who has ever endowd shares.

Abstract

Along with the widespread application of Islamic law, the Government of Aceh implemented an exclusive zone for the application of sharia economics. The issuance of Qanun No. 11/2018 concerning Islamic Financial Institutions emphasizes the exclusivity of the Islamic economy in Aceh. This paper aims to discuss the implementation of the Qanun of Islamic Financial Institutions from a public policy perspective. Data was collected through interviews with the heads of the Islamic Sharia Office, academics, non government activist, and stakeholders of Islamic financial institutions in Aceh. The data is then analyzed using an interpretive policy analysis approach. The results of the study found that the sharia economic exclusivity in Aceh was a public policy that began with the appearance of inputs in society in the form of demands and support that entered the political system. This is based on the fading of sharia values in the practice of the people of Aceh, giving rise to demands to restore Islamic identity within the local government framework. Through the conversion process, this demand produces output in the form of an exclusive public policy in implementing Islamic finance in Aceh. This policy has implications for people's difficulties in accessing inclusive finance, which can have an impact on the welfare of the people of Aceh.
