Abstract

ABSTRACT Narcotics abuse victims acquire a major concern because the victim is a part that can not be separated from evil. Therefore, the victim has a very important role in victimology that facilitate in finding the response to crime that will affect the decline in the crime rate. This is consistent with the development of victimology in the settings according to the Narcotics Law No. 35 of 2009 on Narcotics.The problemsunder discussioninthis researchare1. How doesthe phenomenon ofcrimedue tomisuseandabuse of narcoticslawcrimesagainstthe victim. 2. Howthe protection ofvictims ofabuseNarcoticsaccording to LawNo. 35 of 2009on Narcotics.This research was conductedatthe National Narcotics AgencyEastKalimantannormative legalresearch methodswhich refers tothe normsandprinciples of the lawcontained in thelegislationas well asthe selectionof therelevantprovisions, namely Law No.35of2009 onNarcotics.The conclusion of this study is that the protection of victims of abuse by Narcotics Law No. 35 of 2009 on Narcotics there is a balance between the perpetrators and victims of abuse Narcotic where criminals got both criminal penalties and fines are heavy and Narcotics abuse victims get rehabilitation protection under Article 54 Narcotics Law No. 35 of 2009.       It is recommendedthatcriminal sanctionsandpenaltiescontained intheNarcoticsActis applicabletoeveryactorinvolvedabuse of narcotics. Abstract

ABSTRACTWith conditions changing strategic environment, and current flight organizer needs, many of which are new policy set within the provisions of the transport number 1 in 2009. Act No. 1 of 2009 governing the flight in Indonesia, in Article (1) number 1 states 'flight is a unified system consisting of the use of airspace, aircraft, and airports, air transport, air navigation, safety and security, the environment and supporting facilities and other facilities. While this paper has theoretical and practical benefits, this paper is expected to be used as the initial information in the field of law for the academic community to know more about the development of air transport law, especially regarding the transport of goods. This paper is practically can provide input for a personal author, community government, and the parties that are directly related to the activity of an air transport, so as to provide air transport services are good and comfortable for passengers.

Abstract

ABSTRACTIn the State of Indonesia marriage is an important issue for human life because it involves the future needs and personal, Religion and State. Regarding personal interests because they want to continue generation (offspring), concerning the interests of religion because marriage is a Worship or the Sunnah of the Prophet Muhammad (Islamic teachings).Marriage Act No. 1 of 1974 is to be thankful for the Indonesian Muslim community, because the Marriage Act is terjaminlah survival of Islamic law in Indonesia. With the Marriage Act of marriage approved by law and in addition it should be noted and registered, so that people do not go around again polygamy, divorce his wife, marry under the hand and so forth.

Abstract

ABSTRACT Implementation of the Suspension of detention of suspects by investigators who dealt with by the Police Samarinda from year to year has decreased, it can be seen from those obtained from registers Police Samarinda. The decrease is due to the hard work of police officers in menangguhan crime, so that people are afraid of making mistakes due to crime or punishment. There are several reasons that caused the suspension of the application letter that the suspect gained Suspension Detention Detention, among others: Suspect will not run away and do not complicate the course of the examination; Guarantee of the family, to attempt Suspension of Detention; Suspect will not cope with his actions again; The suspect has not been convicted; Still undergoing studies in education institutions. Surety is the right suspect before his term ends, whereas the purpose of detention is to give authority to the investigators and prosecutors and judges to hold against those suspected or reasonably suspected to have committed a crime. The purpose of detention is: Keeping in order not to cause concern for the suspect fled .; Keeping the suspect not to damage or destroy evidence; Keeping suspect criminal offense not to repeat again. In the grant application for the suspension of detention, investigators do not just granted suspension of detention, the case investigator will see the weight of the crime have been bdilakukan by the suspect. Considerations an investigator to accept or reject the application for suspension of detention include: Crime of the accused have not disturbing the public; Suspect young age; Still dibangku school or college. The Penolakam surety can also occur if the suspect would be possible: to escape; suspect residence is not fixed; if possible suspect would destroy evidence to obscure the examination both at the level of investigation and other examinations; Not implementing the terms that have been agreed between the investigators to a suspect, for example, must report and others. The obstacles faced by investigators as follows: Suspect did not heed sayarat provisions or conditions in the surety; the identity of the suspect is unclear and there is no surety for accused.

Abstract

ABSTRACT             Mahakam’s bridge was a bridge that connected Samarinda with Samarinda Seberang and other cities like Balikpapan, Kukar and Kubar. Along with the rapid of population growth and economic in Samarinda gave an impact to the user of traffic to the bridge over the Mahakam that connected Samarinda’s city and Samarinda Seberang with the inter-city and other areas. As the reality that happened in Samarinda, in the afternoon and holidays the traffic to Mahakam’s bridge and otherwise always jammed with vehicle till made a severe traffic jammed in the second pathway of Mahakam’s bridge.                According to the problems above, the government of Kalimantan Timur took a wise solution with made an initiative to build a same bridge in the left of Mahakam bridges. With the construction of the twin bridges, the writers interested to know how the responsibility of the government partners in the construction of the twin bridges.            This research method that used in this law script is descriptive design where the writer described the reality of the twin bridges construction and customized with data from Dinas Pekerjaan Umum Bidang Bina Marga Kementerian Pekerjaan Umum.   .            The legal standings that used in construction of  the twins bridges in Samarinda is the governor rule of Kalimantan Timur Nomor 38 Tahun 2012,  from the governor rule of Kalimantan Timur all the rules that became the legal standings in construction of the twins bridges so have a legally enforceable.            Based on the condition of twin’s bridges construction today, the process of building Twins Bridge is foundation construction stage. The foundation of Twins Bridge could be seen by the people when they passed through the twin bridge.            After the writer conducted research in Dinas Pekerjaan Umum Bidang Bina Marga Kementerian Pekerjaan Umum the writer concluded that the responsibility of government partner in twins bridge construction based on the contract between the government of Kalimantan Timur with the government partners is the Contractor, PT. PP Perdana KSO, Consultant Planner is PT. Perencana Jaya and the supervising consultants is PT. Pelaksana Desain Karya Cipta.           Keywords : (The Twins Bridge)

Abstract

ABTRACTIndonesian National Police is one of the law enforcement agency responsible for performing preventive measures against crime and provide protection to the whole community. In the implementation of criminal law and criminal procedure investigations conducted by the police action as a first step in the process of law enforcement. Dikemukan problems in this thesis is how the duties and functions of the Police in law enforcement, irregularities committed by law enforcement officers as well as how Accountability Investigator Police against the occurrence of false arrest or error in persona.The method used is a normative juridical research. Normative juridical research is research using library materials or secondary data obtained from the literature, Legislation and analyzing and interviewing the relevant government agencies that can help solve the problems in this thesis.Investigators as one of the law enforcement officers are given the authority to enforce the law, therefore the duty and authority should be implemented in accordance with the purpose of establishing the law enforcement agencies and is responsible for the implementation does.Based on the research results obtained by the authors in Kutai Police concluded, investigators in performing its duties and authorities sometimes deviations and errors such as abuse of authority or negligence, as in the case of the investigation, may result in a false arrest by the investigator. Perverts and errors or omissions that may occur due to several factors, including the lack of morality and knowledge in law enforcement investigators. In its duties and powers investigators did not investigate professionally and for negligence or breach of which resulted in one arrest and harming a person or victim, the investigator who commits an offense shall be liable in the event of false arrest or error in persona for committing violations of the Code of Professional Ethics of Police, violation of the Code of Professional Ethics of Police shall be penalized in accordance with the violations committed offenders Keywords : Investigator, Investigation, Police

Abstract

ABSTRAKPada umumnya bilyet giro digunakan oleh kalangan bisnis atau para pengusaha, karena lalu lintas pembayaran giral tersebut praktis dan efisien juga lebih aman, karena pada bilyet giro menggunakan cara pemindahbukuan dari rekening penerbit kepada rekening penerima bilyet giro. Sehingga penerbitan bilyet giro ini membawa  serta kewajiban bagi penerbit untuk menyediakan dana dalam bentuk rekening giro. Penerbit mempunyai kewajiban untuk memenuhi dana sedikit-sedikitnya sama dengan perikatan dasarnya. Apabila penerbit ternyata tidak mempunyai dana di bank maka bank akan menolak bilyet giro. Sanksi-sanksi terhadap penerbit bilyet giro kosong antara lain; Untuk pelanggaran pertama penerbitan bilyet giro kosong diberikan surat peringatan pertama, agar supaya yang bersangkutan tidak menerbitkan bilyet giro kosong lagi; Untuk pelanggaran penerbitan bilyet giro kosong yang kedua diberikan surat peringatan kedua dengan ancaman penutupan rekening dan pencantuman namanya dalam daftar hitam; Untuk pelanggaran peneribitan bilyet giro kosong yang ketiga kalinya, kepada nasabah langsung diberitahukan dengan surat bahwa rekening gironya ditutup.Upaya yang ditempuh oleh bank bagi penebit bilyet giro kosong : Membina nasabah; Menolak bilyet giro yang dananya tidak cukup; Dengan mengadakan clearing, hal ini untuk menghindari  adanya kekosongan dana di bank Kata kunci : Bilyet Giro, Bank

Abstract

ABSTRAKPerjanjian Sewa beli merupakan  hukum  kontrak innominaat adalah berbagai kontrak  yang muncul dan berkembang dalam masyarakat , seperti kontrak Sewa Beli , kontrak production sharing, join venture , kontrak karya , leasing , franchise, kontrak kontruksi , kontrak rahim dan lain-lain . Hukum kontrak   innominaat  bersifat  khusus, sedangkan hukum kontrak  atau hukum perdata  merupakan hukum yang bersifat umum . Artinya  bahwa kontrak-kontrak innominaat berlaku terhadap peraturan yang bersifat khusus , sebagaimana yang tercantum dalam berbagai peraturan perundang – perundang yang mengaturnya. Apabila dalam undang – undang khusus tidak teratur  maka kita mengacu pada peraturan yang bersifat umum, sebagaimana yang tercantum dalam Buku III KUH Perdata. Adapun pengaturan Sewa Beli sebagai Hukum Kontrak Innominnat diatur di dalam Buku III KUH Perdata, hanya ada satu pasal yang mengatur tentang kontrak Innominaat, yaitu pasal 1319 KUH Perdata. Jadi Sewa Beli sebagai perjanjian Innominaat bila ditinjau menurut pasal 1319 KUH Perdata adalah sebagai perjanjian yang berada di luar Kitab Undang –undang Hukum Perdata, jadi perjanjian tersebut tunduk pada sebuah aturan umum yang terdapat pada  buku III  Kitab Undang – undang Hukum Perdata, dalam arti boleh saja asal tidak bertentangan dengan Undang-undang, ketertiban umum, kepatutan dan kesusilaan. Berdasarkan hasil penelitian di Kota Samarinda dan beberapa kota besar di Indonesia atas perjanjian Sewa Beli ternyata bahwa semua perjanjian yang menjadi obyek penelitian mencantumkan Klausul tentang jatuh tempo, Klausul ini sehubungan dengan ketidakmampuan pembeli untuk melaksanakan pembayaran angsuran tepat pada waktunya sebagaimana diperjanjikan. Dengan tidak memperhatikan sebab musabab keterlambatan tersebut penjual dengan seketika dapat menyatakan membatalkan perjanjian dan berhak menarik kembali barang yang menjadi obyek perjanjian. Klausul atau syarat menggugurkan ini dianggap merupakan syarat yang tidak seimbang dan keberadaannya hanya menguntungkan penjual dan tidak pada pembeli.

Abstract

ABSTRACT In today's digital age, every day the public is given a wide variety of news information, either by means of electronic media, in print, or online. The types of information that the public absorb are various. Some choose the news content of education, health, lifestyle, celebrities, politics, to law and criminal. Regardless the public's need to absorb latest news information presented by media, there is something overlooked, namely the balance of news. In fact, the balance of news determines the quality and sharpness of the information presented to the public. But the fact is, there are still some media that ignore resource balance in the news production process as set out in the code of ethics of journalists in Indonesia. As a result, the product of information presented is less balanced. In the realm of law, the function of media as a means of social control has been set out in Article 3 paragraph (1) of Law No. 40 of 1999 on Press. In Article 6 (a), this Law defines the role of national press to meet the public's right to know. Elucidation of the article states that the fulfillment of public's right to know will encourage the establishment of truth and justice. Both of the foregoing articles lead to conclusion that the supervision function by the media cannot be separated from its function as a medium of information and its role to meet the public's right to know. Only, it is only by enlightened and conscious community, the power is supervised. On the other hand, the optimal function of the media in enlightening the public thought as well as a means of social control require freedom. Press freedom in certain level and journalists freedom in carrying out their professional using journalism rules will become one of the pillars of the growth of Indonesian democracy.

Abstract

Abstract That according to Article 61 paragraph 3 of Government Regulation No. 24 of 1997 states that: If a person has the right to land had died then right as heir must register their rights within a period of 6 (six) months after the death of the person, not charged pendaftaran.Dari fee provisions of article above that the presence of legal events in the form of inheritance, it can be said that the heir who receives the transfer of property rights as heir must register their rights transition to the Office of National Defence. Within a period of 6 (six) months after the death of the testator must be registered, it is intended that the issuance of new certificates can on behalf of the heirs in question and that the certainty and legal protection for holders of the new property. That the implementation of the registration of transfer of rights because inheritance is done directly by the rights holder / or heirs to the National Land Office, accompanied by the documents that must be satisfied that the respondent completing the registration of property rights for inheritance transition is done through the ravine by 18 respondents or 60% who do request through the intermediary of notary services as much as 7 respondents or 23.334% and the register transfer of rights as an individual inheritance as much as 5% of the respondents, or 16,667.
