Abstract

Legal Aspects of Sharia Banking Legislation, Law Number 21 of 2008, in terms of judicial philosophy and Sociological basically a sense of Justice has addressed the needs of the Islamic Ummah as a consequence of legal pluralism live and grow in the dynamics of Indonesian society. While from the juridical formalistic approach through the legal umbrella Act No.3 of 2006 and Act No. 4 of 2004 its implementation requires a judge in creating and upholding justice, should know and understand the aspirations and values of living in society and orientation, which should put forward justice together with the orientation of legal certainty and expediency. Abstract

Regional Head in a direct election indicates not yielded Regional Head of an ideal, in this case is suspected that some Regional Head who stumble legal cases of corruption. Such things can happen because of the democratic process in elections beginning with the starting pull of interest between the prospective head region with political parties on the one hand, and between candidates for the head area with his constituents on the other side. The implications of these conditions cause the cost of direct elections is quite expensive. With the number of political parties is quite large and there is no consciousness of the voters make choices based on conscience cannot be avoided in the elections always bring money politics (politics of money) / political horse-trading, and will bring leaders think moral hazard. These conditions are still just always happens in local elections democratic party directly. Such a case will be examined from a sociological aspect to bring up three issues, namely: the proliferation of political parties, money politics (money politics) / political horse-trading and the nature of moral hazard. Keywords: direct election problems, sociological perspectives

Abstract

In essence, globalization is the best means for Muslims to introduce the culture and the teachings of Islam to all corners of the world. Abstract

Fairness in taxation policy can be viewed from: first, the equilibrium relationship between tax authorities and taxpayers,  secondly, equitable allocation of the tax burden on various segments of society according to his ability. Corporate income tax collection system did not reflect the sense of justice because the application of the single rate system of corporation tax burden caused injustice, and the authority of the tax authorities are still too broad. It needs political reconstruction based corporate income tax law of justice based on Pancasila, through structuring and strengthening aspects of philosophy, the subtance and structure of tax law. Progressive tax law by using a new paradigm is expected to display the figure of taxation more equitable and humane, so as to promote awareness of voluntary compliance from tax payer, followed by transparency and responsibility of countries to achieve people’s welfare. Keywords: Reconstruction, Corporate Income Taxes, Juctice

Abstract

Regulations governing the crime of corruption has changed several times. This is done to reach a modus operandi of various criminal acts of corruption and minimize the legal gaps that can be used as an excuse for the perpetrators of corruption to be able to detach himself from the shackles of law. Investigation, prosecution and examination before the court in a corruption case precedence over any other case to completion as soon as possible. In the Law of Criminal Acts of Corruption, the loss state is enough to capture perpetrators of corruption. Perpetrators of corruption have the right to prove that he did not commit corruption. Even so, the prosecutor still must prove the charges. Greater accountability of corruption, namely the possibility of imposition of penalty in absentia, the possibility of seizure of goods that had been seized for a defendant who has died before a verdict can not be changed again, the formulation of a broad scope of the offense, the expansion of the interpretation of the word "embezzle "the offense of embezzlement. Keyword : corruption, financial state, criminal responsibility

Abstract

West Legal System follow the philosophy of legal positivism values conflict with the noble values of the Indonesian nation, so there Gab between the law and people of Indonesia are regulated, System of Customary Law in the values of certain indigenous communities whose territory reached 350 indigenous territories, and can only be believed by public socialized habits, and can not be validated as a national law, and Islam as the Legal System is based on the attributes of God as "Asmaul Husna" and diamalkan believed by the majority of individuals nationwide Indonesian society and tolerance of permanent values believed by minority groups in Indonesia, therefore the system of Islamic law that allows a system of national law in accordance with the personality of the Indonesian nation and not betentangan with the values of Pancasila. Keywords   :  Western Legal System, system of customary law, islamic legal system, the national legal system, perspective of legal philosophy, harmony.

Intellectual Property Rights’ issues are growing problems in accordance with the development of science and technology. As examples of developments in biotechnology with the technology of genetic engineering led to the birth of the need to protect the results of biotechnology engineering. In developed countries Intellectual Property Rights has become part of everyday society, so that science and technology development in the country are always oriented to the protection of Intellectual Property Rights. Abstract

Indonesia's national legal system based on modern law with a philosophy liberalism, individualism and rationalisme background of the nineteenth century in Europe (Penal Code), that contains the class characteristics. The characteristics of the national law classes imply of the Court as a judicial dictatorship. The existence of three different decision in terms of budget corruption committed by members of parliament, namely decision-free, loose and criminal verdict in the same case is proof of the dictatorship of the Court. To prevent the necessary expansion of the meaning of a judicial dictatorship legality principle, from the formal justice-procedural justice toward substantial material with 3-integral approach, the approach of juridical science religious, juridical contextual, and insightful approach to comparative/global recall the problem of corruption is an issue international. In addition it needs to be revisited Constitutional Court Decision No. 003/PUU-IV/2006 to be replaced with understanding the material unlawfully receiving AVAW as set forth in Supreme Court Jurisprudence No. 42 K/Kr/1965 and also article 2 and article 5 of Law. 48 of 2009 and the possible penal settlement by mediation. Keywords   : modern law, judicial dictatorship, reconstruction of criminal responsibility, criminal acts of corruption.

Abstract

Partial understanding about children and their rights according to Law No. 1 of 1974 and Law no. 23 of 2002, become confusing. If the concept of "every child" has the right to know his parents, raised and nurtured by the parents themselves are connected with the concept of illegitimate children, there will arise the question of whether an illegitimate child ("child adultery"), may file a lawsuit to the Court, in case the biological father has been married to another woman. The result of systematic interpretation in the application of Article 7 paragraph (1) Act No. 23 of 2002 based on the principles and specific legal principles in family law and marriage, the recognition of children can not be applied to "every child" and it only works for children out of wedlock with her biological father is not bound by the terms of marriage with another woman.  The expected contribution is the implementation of human rights in every national legal product should consider the principle of legal certainty, usefulness and fairness, and not just create new problems in society. Abstract

The implementation of the concept on freedom of rights for association of trade union is facing the phenomenon of liberal capitalistic global economic trends characterized by conflicting industrial relations. The problems  in this research, What are the impacts of the implementation of the concept on freedom  for association in trade unions to industrial relations which is capitalistic to the workers’ welfare?. To answer these three problems, the writer used qualitative analysis with constructivism paradigm. This study draws some conclusions as follows, the implementation of the concept on freedom for association in trade unions, which is capitalistic, affects the following: (1) the high rates on labor strike, (2) the increasing number of disputes on industrial relations between the entrepreneurs and the workers. Keywords: impact, industrial relations, capitalism
