Abstract

Workforce diversity is an inevitable phenomenon of the day. Diversity managementis then developed in response to this reality. The discourse has been widelyimplemented in many western countries and some other countries across theworld. Yet, it does not sound loudly in the Muslim countries. The objective of thispaper is to discover Islamic perspective of workforce diversity management. Theresults show that pluralism and multiculturalism values are strongly promoted inIslamic teaching. Although, some conceptual problems regarding conservativeviews on diversity might constrain diversity workforce management, but a strategicsolution to this issue is not impossible. This paper basically favors the idea ofimplementing the Lewin-Schein change model (i.e., unfreezing – change [moving]– refreezing) for managing diversity in the Muslim society context but with amore focus given to the substantive aspects of diversity management (i.e., elaboratingIslamic values on diversity). The role of such qualified Islamic scholars iscrucial in this regard.Keragaman sumber daya manusia di tempat kerja adalah sebuah fenomena yangtidak terhindarkan dewasa ini. Karena itu, mengelola keragaman secara professionaladalah sebuah keniscayaan. Meskipun diskursus tentang pengelolaankeragaman di tempat kerja bukanlah hal yang baru di dunia Barat, namun dinegara-negara berpenduduk mayoritas muslim praktik dan wacana tentang hal tersebut masih kurang mendapatkan perhatian. Paper ini bertujuan untukmenawarkan konsep manajemen keragaman di tempat kerja dalam perspektifIslam. Paper ini menggarisbawahi bahwa multikulturalisme sesungguhnya memilikitempat yang signifikan dala ajaran Islam. Kendati ada ada persoalan konseptualberkaitan pandangan-pandangan konservatif tentang pluralism danmulrikulturalisme, yang nota bene dapat menghambat efektivitas manajemenkeragaman di dunia Islam, namun persoalan ini bukan tidak dapat dipecahkan.Paper ini berpendapat bahwa framework yang ditawarkan oleh Lewin-Scheintentang pengelolaan keragaman dapat diadaptasi dalam konteks dunia Islamdengan mengelaborasi konsep-konsep ajaran Islam tentang keragaman.

Abstract

Artikel ini ditulis untuk menggali paradigma hukum yang menjiwai produk-produk hukum dalam Madhhab Ja’fari. Keberadaan Imam Ja’far al-Ṣādiq dalam kapasitasnya sebagai seorang pendiri Madhhab Ja’fari, akan dikupas secara khusus dalam makalah ini. Selain itu, artikel ini juga mendiskusikan beberapa produk pemikiran fikih Ja’fari yang secara fundamental dianggap berbeda dengan produk fikih kalangan Sunni. Dua produk pemikiran  tersebut adalah tentang khumus dan nikah mut’ah. Artikel ini menyimpulkan bahwa sumber-sumber hukum yang digunakan dalam Madhhab fikih Ja’fari tidak jauh berbeda dengan sumber-sumber hukum yang digunakan dalam Madhhab fikih Sunni, yaitu al-Qur’an, Sunnah, Ijma’, dan Akal. Meskipun terdapat pemahaman definisi yang berbeda mengenai sumber-sumber hukum tersebut, namun hal tersebut tidak menunjukkan bahwa Syi’ah dan Sunni memiliki perbedaan prinsip dalam penentuan hukum. Faktanya, perbedaan penentuan sumber hukum semacam itu juga terdapat dalam diskursus ushul fikih di antara empat Madhhab fikih Sunni.***This article explores the legal paradigm of the Ja’fari school of law. Abstract

This article explores the legal paradigm of the Ja’fari school of law. The article presents the profile of Imam Ja’far, the founder of this school of law. It also discusses some legal thoughts presented by the Ja’fari school of law, which seemed to be fundamentally different from the legal thoughts of the Sunni school of law (e.g., khumus and mut’ah). This article concludes that the legal sources used in the Ja’fari school of law are not fundamentally different from those used in the Sunni school of  law, which include the Quran, the Sunnah, Ijma, and reasoning. Although there might be different approaches among the Ja’fari school of law and the Sunni school of laws in defining these legal sources, this article indicates no principle difference in legal making procedure. Abstract

The era of regional autonomy has increased the number of regulations in Indonesia, including the regulation of zakat. This article peeling relevance zakat regulations in the era of regional autonomy after the enactment of Law No. 23 of 2011 on the Management of Zakat. This article began by discussing various zakat regulations that emerged in Indonesia in the era of regional autonomy, followed by a discussion of the two national regulations on zakat: Law No. 38 of 1999 and Law No. 23 of the year 2011. After that article analyzing the material contained within these two laws Zakat and compared with a charge contained in bylaws zakat alms to evaluate the relevance of regulation after the enactment of Law No. 23, 2011. This article underlines that post Zakat Law, enacted in 2011, local regulations zakat old and new is no longer relevant. Although the issuance of new regulations charity possible, this article suggested that the local government and management to optimize the empowerment of zakat through national legal instruments that already exist.

Abstract

This article discusses two legal cases happened in 2009: the cases of Prita Mulyasari and Bibit-Chandra. These cases are interesting as they involved the use of Internet as a medium for an effective civic engagement in controlling law enforcement. The response of the Indonesian public to the cases of Prita and Bibit-Chandra and their success stories in controlling the authorities indicate a significant existence of the so-called an “online parliament”, which signed an emergence of a new civil society movement in the modern Indonesia. This online parliament is much more inexpensive and independent than the conventional parliament. However, it might only work for political issues that attract much public attention and might be only accessible for those who have the access to the Internet.

Abstract

After the fall of Suharto, the government of Indonesia has started to reform its public sector. The reform began with the introduction of Law 22/1999 on Regional Autonomy and Law 25/1999 on Fiscal Equalization between Center and Regions. The laws have created a huge wave of decentralization in almost all aspects of the management of Indonesia’s public sector. Yet, the future of such a reform is debatable. This article discusses the prospects for public management reforms in Indonesia. This author argues that the government needs clear rules for effective implementation of decentralization. The government also needs to reinforce the role of provincial governments as the agents of the central as well as the coordinator of district governments. Furthermore, the government needs to set standard budgeting, auditing, and reporting procedures for all local budgets, and mechanisms in order to monitor sharing of natural resources revenue and transfers. Last but not least, the role of non-government organizations (NGOs) and mass media is highly significant and required for a successful reform of public management.
