Abstract

Marriage Dispensation is an attempt by the prospective bride and groom to obtain a decision from the court to enter into a marriage for underage couples. Applications for marriage dispensation have increased since the COVID-19 pandemic hit Indonesia. This research focuses on analysing the factors behind the increase in requests for marriage dispensation and seeking efforts to overcome the increase in requests for dispensation. The research method used is field research with a qualitative approach. Data collection techniques were collected through observation and interviews with judges from the Padangsidimpuan Religious Court and the Pengabungan Religious Court. Interviews were also conducted with the Padangsidimpuan and Mandailing Natal Women's Empowerment and Child Protection Services and the people of Padangsidimpuan and Mandailing Natal, who submitted requests for dispensation from marriage. The results of this study indicate that the reasons for the prospective bride and groom applying for dispensation include juvenile delinquency (free sex), pregnancy out of wedlock, arranged marriages, low economy, and encouragement of traditional traditions (marlojong). Efforts were made to address the increase in requests for marital dispensation by strengthening the role and cooperation between the Religious Courts, the Women's Empowerment and Child Protection Service (DP3A), and the community (family)..

Abstract

The expectation of reform for the bureaucracy remains neutral in elections and still encounters structural conflicts inherent in the bureaucracy as an agency. In the context of local politics, the government bureaucracy plays a crucial role in influencing the results of the regional elections. This article employs Anthony Giddens' theory of structuration to examine the strategic behaviour of the Indonesian government bureaucracy in regional elections. The data collection method used in this study was literature research, which aimed to gather data and information using various materials available in the library. The results of this study found that the bureaucracy involved in regional elections is at the level of discursive and practical consciousness, which originates from the bureaucracy's ability to reflect on itself and monitor similar practices in broader space and time. Integrating space and time in social practices is fundamental in observing agents' actions in interacting with the structure. The room and time of the regional elections are closely related to the space and time of governance.

Abstract

AbstractThe impact of environmental damage caused by mining activities, especially nickel mining, is still a common problem. There is no shared awareness to protect the environment so that it remains balanced from various parties, namely companies that carry out mining production, the government as a regulatory policy, and the community as the party that operates environmental damage due to mining production activities. This study uses an environmental and political approach to describe the problems of environmental damage. The method used in this research is qualitative research. Data and information sources were obtained from observations, discussions, and references to literature documents from books, journals, and electronic information media. The results of this study found environmental damage due to nickel mining due to several things, namely mining production activities in forest areas, problem permissions of mining and the dynamics between profit interests and environmental damage resulting from mining activities. Abstract

Circular Letter of the Covid-19 Handling Task Force Number 11 of 2022 concerning Provisions for the Travel of Domestic Persons During the Covid-19 Pandemic Period is the basis for revoking the obligation for Rapid antigen tests for people who have received full doses of vaccines and booster vaccines, but are required to comply with health protocols. People who receive the first dose of the vaccine and who have not received the vaccine for reasons of special health conditions must show negative results from the RT-PCR test or rapid antigen test. This regulation also applies to travellers who are fasting. One prohibition that must be avoided while fasting is putting something into the body. In response, the Indonesian Ulama Council issued fatwa number 23 of 2021 concerning the Swab Test to Detect Covid-19 While Fasting, which states that the swab test does not break fast. So it is necessary to study how the views of the Ulama on this fatwa and its relevance to the situation when this fatwa was decided. This study uses the method of literature review. The approach used is the ushul fiqh approach, and the theory used is istihsan. The primary legal material used is the MUI Fatwa Number 23 of 2021, and the secondary legal material used is books and journal articles. The purpose of this study was to find out the views of the Ulama on the results of the MUI's Ijtihad in establishing Fatwa Number 23 of 2021 so that there is no doubt when carrying out a swab test while fasting and whether this MUI fatwa is relevant to the situation at the time this fatwa was decided. The study's results show that Ulama's views on the results of the MUI's Ijtihad in establishing Fatwa Number 23 of 2021 are divided into two opinions. Most contemporary scholars say that the law on swab testing during fasting does not break the fast. According to the classical ulama, the Hambali and Shafi'i ulama declared it null and void. The Maliki school of thought believes there is a gap for the swab not to break the fast because it is a dry and solid object that does not reach the stomach. The Hanafi school believes that the swab is not invalidated because it does not enter the body perfectly. MUI's decision-making in establishing Fatwa No. 23 of 2021 is considered relevant to the situation when this fatwa was issued. This fatwa is an effort to emphasize the spread of Covid-19.

Abstract

The progress of the digital world influences the structure of religious discourse. The development of religious discourse in digital space, especially social media, has run wild without control. One-sided truth claims are getting stronger. So Khaled Abou el-Fadl's offer deserves consideration, namely the morality of discourse as the authority for religious discourse on social media. This research focuses on how the morality of discourse can be used as a basis for the power of religious discourse on social media. This research is descriptive-qualitative, which is a conceptual study using library data. Through a holistic approach, the reference data is analyzed through data reduction and data presentation. The data presented are adapted to relevant perspectives, interpreted based on theories, classified into concepts, and narrated in a new understanding of the phenomenon under study. As a result, discourse morality procedures in the authority structure of religious discourse on social media need to be upheld so that belief in God as the highest authority is not replaced by unilateral claims. In addition, the morality of discourse can also be the basis for government policies to regulate and limit religious discourse discussed on social media.

Abstract

Social conflict in Mamasa was a crucial issue. The conflict which initially had a political dimension has led to ethnic and religious conflicts. Various efforts to rebuild the social integration of the community continue to be carried out. This study aims to examine the role of religious identity representation as media of conflict resolution in building social reintegration. The author analyzes the electoral arena in Mamasa which always provides space for religious representation in contesting. The research used an ethnographic approach to explain this phenomenon. Data collection techniques were carried out by observation, interviews and documentation. This study found that religious representation in the regional head election has a significant role in the process of social reintegration of the community in Mamasa district, West Sulawesi. In the process, the community does not rely on extreme identity politics (ethnic and religious) but rather builds moderate political awareness. These political choices contribute to the development of social integration in society.

Abstract

The purpose of this research is to analyze the implementation of religious moderation in SMP Negeri 3 Mengkendek, Tana Toraja Regency. This type of qualitative research with a pedagogic approach. Primary data sources come from interviews, while secondary data are taken from documents related to research. The results of the study show that the implementation of religious moderation in SMP Negeri 3 Mengkendek Tana Toraja Regency has indirectly been formed, this is evidenced by the absence of coercion (respect for individual rights) in religion and tolerance built by all groups starting from family, school , and society. Teachers on the subject matter of Islamic Religious Education (PAI) at State Junior High School 3 Mengkendek provide reinforcement of religious education in the learning process, namely through providing information and sources related to morals, as well as providing lesson assignments that aim to train students' responsibilities . In addition, strengthening the implementation of religious moderation in Islamic education learning at SMP Negeri 3 Mengkendek, namely the existence of local community wisdom that is so strong that it has an impact on the curriculum in educational institutions in Kab. Abstract

This research aims to determine the strategies by Islamic Religious Counselors in reducing the number of early marriages in the Wara district. The author chooses qualitative research with an empirical approach to Islamic law to analyze social reality in depth. This approach was chosen because the authors wanted to explain an in-depth analysisof Islamic religious extension officers' role in carrying out informative, educative, consultative, and advocative functions in early marriage cases. The subjects in this study were two functional Islamic religious instructors, five non-civil servant Islamic religious instructors, and one BP4 mediator. The object of this study is the role of religious instructors in carrying out professional functions in cases of early marriage. The study results showed that the Islamic Extension Counselors in Wara District performed well because they carried out informative and educative roles and functions, consular and advocative functions as extension agents consistently by conducting direct counselling to the community. The strategies undertaken to reduce the number of early marriages arecounsellingto prevent underage marriages, rejecting underage brides, socializing the importance of formal education to adolescents, and approaching parents to maximize their role in educating children.
