Abstract

One of the objectives of the Basic Agrarian Law (UUPA) is to provide legal certainty for all people and enable the functioning of earth, air, and space, as well as natural wealth that aspired. However, the Basic Agrarian Law (UUPA) has not provided legal certainty over land, one of which is a plot of land with more than one certificate with the same object. The factors causing the occurrence of multiple certificates are caused by the community and the government from the National Land Agency, which does not have a valid database as referred to by Supreme Court Decision Number 976 K/PDT/2015. The formulation of the problem in this research is how efforts to prevent the occurrence of multiple certificates (overlapping) and what are the obstacles in preventing their occurrence double certificate (overlapping). This research aims to determine and analyze the prevention efforts and constraints in preventing the occurrence of double certificates (overlapping). The problems in this study were studied using a normative juridical method using a statutory approach and a conceptual approach—data collection techniques using studies bibliography and assistance and defense of legal facts. According to the research findings, efforts to prevent the occurrence of double certificates (overlapping), specifically by optimizing administration land use and creating land registration maps, so that if there are indications of the occurrence of double certificates, they can be canceled as soon as possible, as well as obstacles in preventing double certificates (Overlapping), specifically the lack of understanding and enthusiasm from the community in applying for their land in Complete Systematic Land Registration (Pendaftaran Tanah Sistematis Lengkap, PTSL), are shown.Keywords: Double certificate; legal certainty; overlapping.

Abstract

The increase in online book sales without permission and copyright violations in Indonesia poses a major threat to written works. This problem requires normative legal and moral studies to find solutions that complement previous research. This article aims to analyze and describe the legal regulations for buying and selling pirated books online and explain that the act of pirating books for sale is a moral crime. Normative legal research was used, which produced prescriptive conclusions. The data in this article consists of the Copyright Law, Information and Electronic Transactions Law, and other technical regulations. These regulations are equipped with various supporting references that discuss copyright issues, moral rights, and integrative legal theory, which describes a comprehensive legal system for responding to regulatory violations. This article reveals that national legal policies are not sufficient to guarantee protection for authors and publishers against book piracy and even make it difficult to report this crime to the police so that the use of the criminal justice system becomes ineffective. Indonesian society's perception of book piracy must be improved from previously being a common practice to a moral crime that is financially detrimental, and to the good name of authors and publishers. This article suggests several changes to the regulatory structure. First, we determine the authenticity verification scheme for books sold in bookstores and on marketplace platforms. Second, eliminating the concept of Klach Delict in criminal provisions so that reporting the crime of book piracy can be done by anyone, especially publishers and the public, who observe copyright.

Abstract

Buying and selling land has become a natural thing in Indonesia. The need for land is increasing daily along with the increase in the human population. In buying and selling land, one must pay attention to the ownership of the land, one of which is inheritance land. This study aims to determine the juridical review and legal consequences of the sale and purchase of disputed inheritance land without going through the Land Deed Maker Official (PPAT). The method used in this research is normative juridical employing library research and analyzing the applicable laws and regulations related to the legal issues under study. Before the sale and purchase transaction, the land was divided among each heir under the deed of distribution of inheritance must be ensured. Then to ensure legal certainty, the sale and purchase of the inherited land must be carried out before the PPAT. Buyers must also be careful in buying and selling inherited land by checking the juridical truth of the land data and checking directly to find out the history of land ownership from the party closest to the land's location.Keywords: Buy and Sell; Inherited Land; Land Deed Maker Official.

Abstract

By examining the current state of customary land control and the judge's factors in granting the petition in Constitutional Court Decision Number 35/PUU-X/2012, this research seeks to identify and analyse customary land in Kampar Regency, Riau Province. This study employs a normative juridical approach, which examines the features of legal rules with a particular emphasis on the language used to describe socially occurring facts. The research findings were thoroughly examined and debated in order to shed light on the customary control situation in Kampar Regency, Riau Province, and the factors that the judge took into account when granting a request for judicial review in the 2012 Constitutional Court decision (No. 35/PUU-X). Along with the research's findings, the authors offer suggestions for future studies. Keywords: mastery, traditional land, position   Dengan mengkaji keadaan penguasaan tanah adat saat ini dan faktor hakim dalam mengabulkan permohonan Putusan Mahkamah Konstitusi Nomor 35/PUU-X/2012, maka penelitian ini berupaya untuk mengidentifikasi dan menganalisis tanah adat di Kabupaten Kampar, Provinsi Riau. Penelitian ini menggunakan pendekatan yuridis normatif, yang mengkaji ciri-ciri aturan hukum dengan penekanan khusus pada bahasa yang digunakan untuk menggambarkan fakta-fakta yang terjadi dalam masyarakat. Temuan penelitian ini dikaji dan diperdebatkan secara mendalam untuk menjelaskan situasi penguasaan adat di Kabupaten Kampar, Provinsi Riau, dan faktor-faktor yang menjadi pertimbangan hakim dalam mengabulkan permohonan uji materiil dalam putusan Mahkamah Konstitusi tahun 2012 (No. 35/PUU-X). Seiring dengan temuan penelitian, penulis menawarkan saran untuk penelitian selanjutnya. Kata kunci: penguasaan, tanah adat, kedudukan
