Abstract

Facing the fourth industrial revolution, the state must strengthen its role to protect its citizens as a part of its efforts to provide social security. Indonesia as a nation also have to face this challenge, especially on the ability to provide healthcare and medication for their citizen neither they lived in the country nor stay overseas. This kind of issue has to be our concern because of our current situation in the globalization era force us to eliminate the national border and start to design transnational services to fulfill our basic needs. Therefore, this paper will conduct research that focuses on the healthcare and medication services in the South East Asia, especially a comparison between Malaysia and Indonesia’s government. Furthermore, this study will also give a brief preview of the 4.0 industrial revolution that brings the shifting of a new era for fulfilling a necessary healthcare service by using transnational big data. Through a social justice perspective and sociological law approach, the researcher uses social security theory that will lead us to reach the concept of the welfare state. This comparison will give us a larger image to see Indonesian government legal challenges and opportunities to provide a new form of healthcare services.

Abstract

Penggunaan dan pemanfaatan ruang bawah tanah belum diatur secara nasional, namun setidaknya telah dirumuskan dalam Rancangan Undang-Undang Pertanahan. Artikel ini bertujuan (1) mengkaji konsep dasar kepemilikan ruang bawah tanah serta mencermati perbandingan pengaturan di beberapa negara lain dan (2) menelaah pemberian hak atas ruang bawah tanah sebagaimana dirumuskan dalam Rancangan Undang-Undang Pertanahan dari perspektif prinsip-prinsip hukum agraria nasional, terutama dari Hak Menguasai Negara, sehingga dirumuskan gagasan pemberian hak atas ruang bawah tanah yang sesuai dengan prinsip hukum tanah nasional. Artikel ini merupakan hasil penelitian hukum normatif, di mana disusun dengan menggunakan pendekatan konseptual, pendekatan perundang-undangan, dan pendekatan perbandingan. Hasil penelitian merumuskan bahwa (1) penggunaan dan pemanfaatan ruang bawah tanah perlu diatur dengan regulasi yang memadai guna menjamin kepastian hukum dan (2) mendalilkan kepada prinsip hukum agraria nasional, artikel ini tidak sependapat dengan rumusan di dalam Rancangan Undang-Undang Pertanahan, sehingga pengaturan ruang bawah tanah perlu diatur dengan hak tersendiri atau hak jenis baru yaitu Hak Ruang Bawah Tanah (HRBT).

Abstract

The purpose of this research is to explain and examine the expansion of the absolute competence of the Administrative Court (hereinafter referred to as PTUN) after the Government Administration Law is promulgated and the implications of the application of the Administrative Law on legal certainty to eradicate and enforce corruption in Indonesia. This research uses a normative juridical research method and uses a statutory approach (statute approach). The results showed "that there are several forms of expansion of PTUN competencies, such as the authority that acts factually, the authority, administrative authorization, decide on positive fictitious decisions, and discretionary trials". Meanwhile, the implications of the Government Administration Law on corruption are known as corruption crimes, which are true. So, in this context, there are at least two problems, namely: “1. If the authorized court case is carried out by the state government which is submitted to the court simultaneously, to the State Administrative Court and to the District Court in a corruption case? 2. If at any time a PTUN decision has been issued stating that it is not authorized, but there is also a party who submits the case to the District Court on charges of corruption. What is the attitude of the District Court, whether to accept the PTUN decision on the case or choose to override the PTUN decision”. So the author is of the view that in this case there is concern that it will complicate the prosecution or eradication of criminal acts of corruption in the case of abuse of authority committed by government officials.

Abstract

Penelitian ini bertujuan untuk menganalisis konsolidasi tanah perkotaan dalam rangka penyediaan tanah untuk penataan perumahan dan pemukiman kumuh. Metode yang digunakan adalah metode metode yuridis normatif yang bersifat preskriptif. Hasil penelitian dapat disimpulkan bahwa, pertama Konsolidasi tanah perkotaan untuk pembangunan perumahan berdasarkan UU No. 1 Tahun 2011 dengan cara pelaksanaan konsolidasi tanah bertujuan untuk menyediakan tanah bagi pembangunan rumah, perumahan, dan kawasan permukiman, juga dapat dilaksanakan bagi pembangunan rumah tunggal, rumah deret, atau rumah susun yang meliputi penataan kembali bidang-bidang tanah termasuk hak atas tanah dan/atau penggunaan tanahnya dengan dilengkapi prasarana jalan, irigasi, fasilitas lingkungan dan/atau fasilitas penunjang lainnya yang diperlukan, dengan melibatkan partisipasi para pemilik tanah dan/atau penggarap tanah Kedua konsolidasi tanah bagi penyediaan tanah sebagai kebijakan pembangunan terhadap penataan perumahan di Perkotaan bisa dilakukan dengan melalui penerapan konsep konsolidasi tanah vertikal dan bank tanah.
