Abstract

This research focuses on analyzing the empowerment of social institutions as village government partners in the participatory development process. The location is in Percut Village, Percutseituan District, Deliserdang Regency. The background that is used as a reference for this research begins with the understanding that the urgency of villages in development in Indonesia is so urgent. The village is given authoritative to grow and develop in line with the development of its own community. Furthermore, the village holds millions of pieces of knowledge of the virtues of life and harmony of local wisdom that should be maintained, can be recognized from the mantra of three orders, namely; ordinances, manners, and manners (Zamroni, 2017). This kind of thinking construction is important to restate in order to examine the current relationship between the village government and the community (social institutions). Social institutions as partners of the Village Government have a very strategic role; start to formulate participatory development plans, implement, control, utilize, maintain and develop participatory development, mobilize and develop participation, mutual cooperation and community self-help, and foster dynamic development of the community in the context of community empowerment. Seeing the huge role that village community institutions have, it is important and interesting that this research is carried out to see the existence of community institutions as village government partners in the participatory development process. With this research, it will provide reference data for stakeholders related to community institution empowerment. In addition, it is an academic study in public policy and provides input to the village government regarding the reference to the model of community institution empowerment as a partner of the village government in order to work together to manage development in a participatory village. As for answering the problem of this study using qualitative methods and types of research with a descriptive approach. The targeted research output is a journal article and as a follow up will create a model in the institutionalization of village community organizations.

Abstract

Indonesia is an archipelagic country that is vulnerable to natural and non-natural disasters. The trend of natural disasters that occur in Indonesia itself tends to increase from year to year as well as what happened in Karo Regency. According to BPS data from 2015-2020 there was an increase in natural disasters, especially those caused by the eruption of Mount Sinabung.The problem that occurs is that Sukatendel Village is located in Tiganderket District, Karo Regency which has an altitude of 500 meters above sea level. This certainly increases the risk of disaster. The purpose of this study was to determine the effectiveness of implementing the Sukatendel Village Regulation No. 01 of 2019 regarding the Disaster Resilient Village program. With qualitative research methods. The results showed thatImplementation of Village Regulation No. 1 of 2018 concerning the disaster-resilient village program which includes 4 (four) factors, namely: The communication factor has not been carried out properly, due to the irregularity of socialization activities and the limitations of information communication tools to the surrounding community. The human resource factor is adequate in the implementation of DESTANA with the establishment of a village management and DRR Forum, but has limited budget and facilities in disaster management. The disposition factor or commitment owned by the implementor is good in carrying out its responsibilities as the implementer of the policy. The bureaucratic structure factor in the implementation of DESTANA has been directed and clear with the creation of a disaster management mechanism, the division and role of each team, but this is of course with the approval of the Karo Regency Government.

Abstract

Abstrak To maintain the sustainability of all habitats in the forest of the Gunung Leuser National Park, it has been fully regulated in Law no. 5 of 1990 concerning Conservation of Biological Natural Resources and Their Ecosystems. The formulation of the problem in this research is how the implementation of Law no. 5 of 1990 in TNGL and what are the obstacles to the Gunung Leuser National Park Center. The research method in data collection is used by the method of literature study and field study. The data that has been collected was analyzed qualitatively. Based on the results of the study found the implementation of Law no. 5 of 1990 concerning the Conservation of Biological Natural Resources and Their Ecosystems is carried out by means of pre-emptive, preventive to repressive activities. The obstacle experienced by the Gunung Leuser National Park Center is the lack of joint forestry police personnel and the weapons used are only long-barreled weapons that are very old, so that it is possible for crimes in the Gunung Leuser national forest area to be repeated. AbstractUntuk menjaga kelestarian dan seluruh habitat yang berada di hutan Kawasan Taman Nasional Gunung Leuser sepenuhnya telah di atur di dalam Undang-Undang No. 5 tahun 1990 tentang Konservasi Sumber Daya Alam Hayati dan Ekosistemnya. Adapun rumusan masalah dalam penelitian tersebut adalah Bagaimana implementasi Undang-Undang No. 5 Tahun 1990 di TNGL dan apa saja hambatan Balai Besar Taman Nasional Gunung Leuser. Metode penelitian dalam pengumpulan data yaitu digunakan dengan metode studi pustaka dan studi lapangan. Data yang telah dikumpulkan dianalisa secara kualitatif. Berdasarkan hasil penelitian ditemukan implementasi Undang-Undang No. 5 tahun 1990 tentang Konservasi  Sumber Daya Alam Hayati Dan Ekosistemnya dilakukan dengan cara kegiatan preemtif, preventif sampai dengan represif. Hambatan yan dialami oleh Balai Besar Taman Nasional Gunung Leuser adalah kurangnya personel gabungan polisi kehutanan dan senjatan yang digunakan hanya menggunakan senjata laras panjang yang sudah berusia sangat tua, sehingga dapat memungkinkan kejahatan di kawasan hutan nasional Gunung Leuser akan tetap terulang.

Abstract

AbstractThe Constitutional Court is an important institution in the Indonesian state administration. The Constitutional Court acts as a balanced institution according to the principle of mutual control, because the 1945 Constitution provides the authority to resolve power disputes between state institutions. In addition, through its authority to review laws that violate the 1945 Constitution, the Constitutional Court guarantees the fulfillment of citizens' constitutional rights and protects them from laws that may cause constitutional harm. Several community groups and individuals submitted judicial reviews to the Constitutional Court regarding the constitutional losses caused by the Job Creation Law Number 11 of 2020. the problem that will be discussed is the legal considerations of the Constitutional Court Decision Number: 91/PUU-XVIII/2020. It is hoped that this research will be useful as a reference in the advancement of legal science in Indonesia, especially in the field of Constitutional Law related to the legal analysis of the Constitutional Court Decision Number: 91/PUU-XVIII/2020 in the Case of the Formil Test of Law Number 11 of 2020 concerning Job Creation against the 1945 Constitution in Review of the Principles of Legal Certainty in Indonesia. It is hoped that this writing will also be useful for the community and legal practitioners and theorists.This research uses normative juridical, or library law research, as a methodology. Normative legal research is based on primary and secondary legal materials, namely research that refers to the norms found in laws and regulations, or the law is considered as what is written in law books. Constitutional Court Decision No. 91 / PUU-XVIII / 2020 is a decision that granted the formal examiner's request for Law Number 11 of 2020 concerning Job Creation with the verdict that Law Number 11 of 2020 concerning Job Creation does not have conditionally binding legal force and is contrary to the 1945 Constitution of the Republic of Indonesia because it is not intended not to be revised within 2 (two) years from the date of this decision. In terms of the legal certainty of Law Number 11 of 2020 concerning Job Creation after Constitutional Court Decision Number 91 / PUU-XVIII / 2020, this decision is the current law (ius constitutum). This is because the decision of the Constitutional Court cannot be compared or complained about. AbstrakMahkamah Konstitusi (MK) merupakan lembaga penting dalam ketatanegaraan Indonesia. Mahkamah Konstitusi berperan sebagai lembaga yang berimbang menurut asas saling mengontrol, karena UUD 1945 memberikan kewenangan untuk menyelesaikan sengketa kekuasaan antar lembaga negara. Selain itu, melalui kewenangannya untuk menguji undang-undang yang melanggar UUD 1945, MK menjamin terpenuhinya hak konstitusional warga negara dan melindunginya dari undang-undang yang dapat menimbulkan kerugian konstitusional. Beberapa kelompok masyarakat dan individu mengajukan judicial review ke Mahkamah Konstitusi terkait kerugian konstitusional yang ditimbulkan oleh UU Cipta Kerja Nomor 11 Tahun 2020. permasalahan yang akan dibahas mengenai pertimbangan hukum Putusan Mahkamah Konstitusi Nomor: 91/PUU-XVIII/2020. Diharapkan penelitian ini bermanfaat menjadi rujukan dalam kemajuan ilmu hukum di Indonesia, khususnya dalam bidang Hukum Tata Negara terkait dengan analisis hukum Putusan Mahkamah Konstitusi Nomor: 91/PUU-XVIII/2020 Dalam Perkara Uji Formil Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja Terhadap UUD 1945 Ditinjau dari Asas Kepastian Hukum di Indonesia. Diharapkan penulisan ini juga akan bermanfaat bagi masyarakat dan praktisi dan teoritisi hukum.Penelitian ini menggunakan yuridis normatif, atau penelitian hukum kepustakaan, sebagai metodologi. Penelitian hukum normatif didasarkan pada bahan hukum primer dan sekunder, yaitu penelitian yang mengacu pada norma-norma yang ditemukan dalam peraturan perundang-undangan, atau hukum dianggap sebagai apa yang tertulis dalam buku hukum. Putusan MK No. 91/PUU-XVIII/2020 merupakan putusan yang mengabulkan permohonan pengujin formil atas Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja dengan amar putusan Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja tidak mempunyai kekuatan hukum mengikat secara bersyarat dan bertentangan dengan Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 karena tidak dimaksudkan untuk tidak dilakukan perbaikan dalam waktu 2 (dua) tahun sejak putusan ini diucapkandalam hal kepastian hukum dari Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja setelah Putusan Mahkamah Konstitusi Nomor 91/PUU-XVIII/2020, putusan ini merupakan hukum yang berlaku saat ini (ius constitutum). Ini karena putusan Mahkamah Konstitusi tidak dapat dibandingkan atau dimintai komplain atasnya.

Abstract

Flooding is a natural phenomenon caused in areas where many rivers flow. This research intends to describe, analyze and reveal the flash flood disaster in Ladang Rimba in 2023. In its development, this method uses environmental history by utilizing sources obtained, both written and oral, which are related to the topic of discussion. The results of this research show that after the 2023 Ladang Rimba flash flood disaster, it was a sad story for all the people living in the flood area. Severe damage due to flash floods in Gampong Ladang Rimba in Central Trumon District still leaves mud sediment with a thickness of up to 120 cm. still covering residential areas, residents' houses and various infrastructure. The impacts of flash floods in Ladang Rimba include: experiencing levels of damage to infrastructure, including housing, roads, bridges and utilities, loss of livelihoods, business closures, and impacts on local industry, social and psychological impacts on individuals and communities, including trauma, problems mental health, and community cohesion, the level of community involvement in the recovery process and empowerment of local residents. For this reason, a comprehensive review is needed that involves collaboration between various stakeholders, including government agencies, non-government organizations, community representatives and academic researchers.
