Abstract

Warisan adalah berpindahnya harta seseorang kepada seseorang setelah meninggal dunia. Sistem pembagian warisan dalam hukum adat Gayo, didasarkan pada sistem keturunan yang ditarik menurut garis bapak sistem pewarisan (patrilineal) yang mana kedudukan anak laki-laki mendapat lebih banyak bagiannya dari kedudukan anak wanita didalam pewarisan, tetapi pada kenyataannya sebagian masyarakat Gayo mengenal istilah patah titti (tidak ada pergantian tempat) yaitu ahli waris meninggal terlebih dahulu dari pada pewaris, maka harta warisan pewaris tersebut yang seharusnya jatuh kepada cucu sebagai penganti bapaknya yang penerima warisan, tetapi hal tersebut tidak terjadi karena dianggap telah putus hubungan. Permasalahan yang akan dibahas dalam skripsi ini yaitu bagaimana pelaksanaan pembagian warisan di daerah masyarakat Gayo menurut hukum islam dan hukum adat dan berapa bagian yang akan diperoleh oleh ahli waris dalam sistem waris masyarakat Gayo. Hasil penelitian ini, bahwa pada penerapan hukum waris terhadap masyarakat Gayo khususnya patah titti sangat bertentangan dengan hukum islam dan belum diatur secara tegas didalam suatu peraturan perundang-undangan. Hal ini mengakibatkan perselisihan antara hukum islam dan hukum adat. Didalam hukum islam tata cara pembagian warisan telah secara jelas di atur dan ditegaskan setiap bagian yang diperoleh oleh ahli waris, dan pada hukum islam adanya pergantian tempat ahli waris, lain halnya dengan hukum adat Gayo Patah Titti. Seperti pada contoh kasus yang penulis teliti tersebut, merupakan contoh konkrit dimana patah titti mengakibatkan terputusnya hubungan silahturahmi dari dampak tidak di aturnya pembagian warisan hukum islam di masyarakat Gayo sehingga hak masyarakat Gayo sebagai Mukmin (orang Islam) tidak mendapatkan haknya berdasarkan hukum Islam.

Abstract

Dalam rangka memberikan jaminan perlindungan terhadap anak yang bekerja (child labor), Pemerintah telah menerbitkan Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagarkerjaan dan peraturan perundang-undangan lainnya. Namun pada kenyataannya, banyak sekali peristiwa yang terjadi di perusahaan pertanian tembakau yang mana para pengusaha mempekerjakan anak tanpa memperhatikan ketentuan-ketentuan yang termuat dalam ketentuan Pasal 69 Undang-Undang Nomor 13 Tahun 2003 tersebut. Dengan menggunakan metode yuridis normatif dapat disimpulkan bahwa implementasi Pasal 69 Undang-Undang Nomor 13 Tahun 2003 dalam prakteknya banyak mengalami permasalahan dan hambatan, diantaranya faktor ekonomi yang justru menjadi pendorong mengapa anak harus bekerja, faktor budaya, faktor peran serta masyarakat, serta lemahnya koordinasi dan kerjasama, keterbatasan aparatur pemerintah yang bertugas melakukan pengawasan, serta faktor lain baik langsung maupun tidak langsung, sehingga sampai saat ini fenomena anak yang bekerja hampir selalu dapat ditemukan di seluruh wilayah Indonesia.

Abstract

The Covid-19 pandemic is a pandemic that has hit the world, include Indonesia. With this pandemic, Indonesia has experienced an emergency status. Through Presidential Decree No.11 of 2020, Indonesia has announced a health emergency status. With the COVID-19 pandemic, the government has stepped in to make various efforts in order to overcome the impact of the Covid-19 pandemic. The government's effort in overcoming the pandemic is by giving vaccinations to the community in stages. However, in the implementation of the vaccine, the community has not yet understood the benefits of the vaccine, especially considering that the Indonesian people are diverse in culture, various ethnicities, so that in its implementation there are those who are contra but some are pros. Therefore, the existence of this article is one of which is to explain the existence of vaccination in the community which is a right or obligation for society and whether vaccine refusal can be subject to criminal sanctions. This research is a research in the field of law with a research approach that provides a systematic exposure to regulations that regulate certain categories of laws, analyze relationships between regulations, describe areas experiencing obstacles, and even predict future developments with a conceptual approach. The results showed that vaccination was originally the right of everyone. And it also shows that people in society seem to be carried away with emotions to carry out their obligations as citizens who contribute to health for the Indonesian people themselves considering the emergencies in Indonesia today, because people can predict that if they do not participate in vaccination it has the potential to infect and even kill other people. As for punishment, this should be an ultimum remedium, if other institutions such as persuasive methods, socialization and even administrative sanctions related to vaccination are no longer functioning while health emergencies in Indonesia are getting worse

Abstract

Legal protection for victims of human trafficking has become a serious concern for the international community because human trafficking does not only occur in one area but has developed into an organized transnational crime. But what happens if the victims are illegal migrant workers who incidentally do not have official documents, considering that the number of illegal migrant workers who are victims of human trafficking abroad is currently increasingly dominating. The purpose of this study is to determine legal protection for illegal Indonesian migrant workers who are victims of trafficking in persons in connection with Law Number 21 of 2007. The author uses a normative juridical research method that uses secondary data and uses primary data only as support for secondary data. The results of this study indicate that Law Number 21 of 2007 concerning the Crime of Trafficking in Persons, hereinafter referred to as the TPPO Law, provides legal protection to illegal Indonesian migrant workers who are victims of human trafficking in the form of fulfilling their rights, including the right to rehabilitation, the right to integrated services, the right to be returned to Indonesia based on state costs, the right not to be arbitrarily deported, the right to assistance when dealing with laws in the destination country, the right to restitution, and other rights.

Abstract

The Job Creation Law is one of the structural reform policies that have been implemented by the Indonesian government with the aim of improving the investment climate and expanding employment opportunities. Despite its positive aims, the law has also generated debate and controversy regarding the resulting implications for labor rights. This study aims to analyze the impact that the Job Creation Law has had on the protection of labor rights in Indonesia. This research uses a normative juridical method with a statutory approach. In addition, this research also includes monitoring changes in policies, company practices, and workers' attitudes towards the implementation of the Job Creation Law. The results of the research show that the work copyright law has been rejected by various community clusters with the view that it does not provide adequate benefits and protection for Indonesian workers or laborers. Some of the implications of this law for the protection of workers' rights in Indonesia based on Article 81 chapter IV of the Job Copyright Law which discusses employment are the abolition of several provisions regarding severance pay, ease of entry of foreign workers, abolition of the maximum limit for contract workers, and abolition of the system City/District Minimum Wage.

Abstract

Food is a food product that is widely and freely circulated in the community, food that will be consumed so as not to harm consumers must provide adequate, correct, honest and responsible information. Over time, there have been many violations committed by business actors related to food circulating in the market and it is very risky when consumed by consumers. In food trading activities, it shows that there are still many business actors who sell dangerous food products, this can be detrimental to consumers because it can endanger the health and safety of consumers. The purpose of this study is to determine legal protection for consumers against trading that does not follow halal production in terms of Law Number 8 of 1999 concerning Consumer Protection. Meanwhile, the method used in this study is descriptive analytical method with a normative juridical approach. Data, namely secondary data collected by way of literature study or document study, then analysed qualitatively normative. Based on the results of the research that the consumer's position is strictly regulated in Law Number 8 of 1999 concerning Consumer Protection. In article 1, paragraph 1, it is explained that consumer protection is all efforts that guarantee legal certainty to provide protection to consumers in order to protect consumer rights so that consumers do not suffer losses committed by business actors, especially in the formalin food sector, These regulations are useful for consumers to know the limits or requirements for good food and what actions are prohibited by business actors.

Abstract

Data dari BPS Kota Bandung tercatat 11% anak kota Bandung yang belum memiliki akte kelahiran dari Kantor Catatan Sipil, sebagai pemenuhan tertib administrasi penduduk. Terlebih lagi dengan terjadinya pergeseran fungsi dan tugas negara dari fungsi negara yang hanya sebagai penjaga malam ke fungsi mewujudkan kesejahteraan warga negara . Campur tangan negara yang terbuka luas tersebut mengharuskan adanya sejenis tertib peraturan hukum untuk melindungi perlakuan sewenang-wenag negara terhadap warga negara. Tertib peraturan tersebut tertuang pada kebijakan yang diambil oleh pemerintah dalam Undang-Undang Nomor 24 Tahun 2013 tentang Perubahan Atas Undang-Undang Nomor 23 Tahun 2006 tentang Administrasi Kependudukan, yang selanjutnya disingkat menjadi UU Administrasi Kependudukan. UU Administrasi Kependudukan mewajibkan setiap penduduk Indonesia untuk melaporkan peristiwa kependudukan dan peristiwa penting yang dialaminya kepada instansi pelaksana dengan memenuhi persyaratan yang diperlukan dalam pendaftaran penduduk dan pencatatan sipil, sebagaimana yang tertuang dalam Pasal 3 UU administrasi kependudukan agar terpebuhinya tertib administrasi. Tertib administrasi dimaksudkan untuk memberikan perlindungan, pengakuan, penentuan status pribadi dan status hukum setiap peristiwa kependudukan dan peristiwa penting yang dialami oleh penduduk Indonesia dan Warga Negara Indonesia yang berada di luar wilayah Negara Kesatuan Republik Indonesia. Beberapa keluarga pemulung Kota Bandung yang sebelumnya telah difasilitasi oleh tim pengabdian masyarakat Universitas Langlangbuana untuk menikah secara resmi dan mendapatkan beberapa hak-hak sipilnya berupa pendaftaran kependudukan guna mendapatkan Kartu Tanda Penduduk elektronik (e-KTP) dan Kartu Keluarga (KK). Namun kegiatan perlu ditindaklanjuti dengan memberikan legalisasi anak-anaknya untuk mendapatkan nomor Induk Anak dan Akta kelahiran terutama anak di luar perkawinan yang sah dari Dinas catatan Sipil. Metode dalam memfasilitasi kegiatan tersebut dengan melakukan advocacy keluarga pemulung untuk mendapatkan hak identitas kependudukan, pendampingan dan edukasi. Dari hasil PKM penerbitan dan pengakuan anak yang di luar nikah, anak yang sah dan keluarga yang sampai saat ini belum terfasilitasi e-KTP padahal suket KTP sudah diterima sejak lama.

Abstract

The problem of food safety in Indonesia already has a legal basis that regulates it, namely Law Number 18 of 2012 concerning Food, and Law Number 8 of 1999 concerning Consumer Protection, which requires businesses to ensure food safety so as not to cause harm to consumers. The purpose of this research is to find out and analyse the obligation to provide food safety guarantees by business actors to consumers. This study uses normative legal research, because it is carried out by examining secondary data, so that the specification of the research used is analytical descriptive, with a normative juridical approach, namely research conducted by examining secondary data. The secondary data was obtained by means of a literature study, then to draw conclusions from the results of the research, a qualitative juridical analysis was used. Based on the results of the study, the obligation to provide food safety guarantees by business actors to consumers based on Law Number 18 of 2012 concerning Food in conjunction with Law Number 8 of 1999 concerning Consumer Protection has not been implemented optimally by business actors, so that it has not provided enough protection for consumers, due to the fact that there are still cases of distribution of food that does not meet food safety standards, thus harming consumers.

Abstract

This research examines the complex interactions between professional ethics, legal perspectives, and developments in medical technology in medical practice. Conflicts often occur when the ethical principles underlying medical practice conflict with existing legal constraints, especially as technological advances accelerate. Through in-depth analysis of complex clinical situations and recent legal regulatory developments, this research aims to understand how physicians navigate the moral challenges that arise from the use of advanced technologies in healthcare while considering the existing legal framework. The results illustrate the need for a careful balance between technological innovation, ethical principles, and compliance with legal regulations to ensure responsible and quality medical practice
