Abstract

The development of information and communication technology has had a significant impact on various sectors of life, including the banking sector. The legal system has made essential safeguards to protect bank and customer data security. The latest information regarding developments in the Indonesian Kapital data leak case must be sought through trusted news sources or contacting authorities such as the OJK or Bank Indonesia to obtain accurate and up-to-date information. The Consumer Protection Law seeks to protect bank customers by limiting standard clauses that cannot be avoided in today's banking business world. The method in this research uses normative legal research. Issues that occur in the banking world relate to the legal position of banking in cases of leakage of Indonesian Sharia Bank customer data and banking legal protection efforts that have been carried out by the legal system to protect the security of bank data and customer data. There are two factors that cause leaks of customer personal data, namely internal and external factors. Cases of customer data leakage are serious violations of privacy and information security. Banks, including Islamic banks, have a big responsibility in maintaining the confidentiality of customer data and protecting their personal information. If a data leak occurs, the bank could face legal and regulatory consequences, and could potentially harm their reputation. The method in this research uses normative legal research.

Abstract

Perkembangan pesat teknologi digital telah mengubah lanskap industri perbankan, memberikan manfaat yang signifikan, tetapi juga menimbulkan tantangan hukum yang kompleks. Artikel ini bertujuan untuk menganalisis peran regulasi terkini dalam mengatasi tantangan hukum yang dihadapi oleh perbankan di era digital. Artikel ini akan mempelajari tantangan utama yang dihadapi oleh perbankan dalam mengelola keamanan data, perlindungan konsumen, dan integritas transaksi keuangan dalam lingkungan digital yang terus berkembang. Tantangan ini meliputi risiko keamanan siber, pelanggaran privasi, penipuan elektronik, dan kompleksitas regulasi yang beragam di berbagai yurisdiksi. Metodologi yang digunakan dalam artikel ini adalah analisis deskriptif dan kualitatif, yang melibatkan pengumpulan data dari berbagai sumber, seperti peraturan perbankan, laporan riset, studi kasus, dan panduan praktik terbaik yang diterbitkan oleh otoritas terkait. Data ini akan dianalisis secara komprehensif untuk mengidentifikasi kelemahan dan kekurangan dalam regulasi yang ada, serta mengusulkan langkah-langkah perbaikan yang dapat diambil. Hasil dari artikel ini diharapkan dapat memberikan kontribusi dalam mengembangkan regulasi perbankan yang lebih baik di era digital. Selain itu, artikel ini juga memberikan wawasan kepada praktisi perbankan, otoritas pengawas, dan peneliti hukum untuk memahami tantangan hukum yang dihadapi oleh industri perbankan dan merancang solusi yang efektif dalam mengatasi masalah ini.

Abstract

A brand is an identifying mark used specifically to distinguish one product from another.With the advancement of technology and information, many trademark disputes arise. Such as the litigation between MS GLOW and PS GLOW, these brands are also involved in trademark plagiarism lawsuits. So, how is the trademark dispute resolution between MS GLOW and PS GLOW carried out, and what legal protection efforts exist for the registered trademarks MS GLOW and PS GLOW concerning trade of goods in Indonesia. The method used in this research is a legal and regulatory approach, a case approach, and then a conceptual approach. The results of this research indicate that dispute resolution takes place in two commercial courts. The trial in the Medan Commercial Court ruled in favor of MS GLOW, whereas the trial in the Surabaya Commercial Court ruled in favor of PS GLOW. The verdict of the Surabaya Commercial Court concluded that the use of the MS GLOW brand did not align with the registered trademark group. The 'first to file' system is a preventive legal protection effort, while repressive legal efforts are carried out through the imposition of criminal sanctions.
