Abstract

This research studied the status of political promises declared by Mayor candidates of Surabaya election 2020 during their campaigns started from September 26, 2020. It was field-library research with qualitative analysis. Data were collected by observing online media that particularly reports the election's campaign activities. They were then analyzed by using Islamic theology and jurisprudence approaches combined with structural-functionalism, symbolic interactionism, and social contract theories. It found four main remarks: first, Quranic verses and Prophetic traditions as theological underpinnings have definitely guided moral standards of Islamic politics, especially how to make such political promises. Secondly, the political realism of promises is a language of transactional politics and communication practice. Thirdly, political promises could only be legitimated by fulfilling strike pre-requirements and within very urgent conditions. Finally, the legal status of political promises must be contextual and conditional.

Abstract

This study examines the Fatwās issued by the Indonesian Ulama Council (Majelis Ulama Indonesia/MUI) on Indonesian Muslim attitudes and practical procedures towards their religious behaviors and public demands on the government appreciation and recognition. The fatwās present logical reasoning which has attracted the government’s attention to adopting them and issue legal products based on them. With a normative legal research approach, this study is considered as qualitative research which using critical legal theory to analyze the important points in the Fatwās. As a result, this study finds four important cases in the fatwā on religious attitudes and behaviors during the COVID-19 pandemic: first, the fatwa on COVID-19 has logical reasoning which is in line with paramedical advice; second, the fatwa on COVID-19 is consistent with the government political interests concerning physical and social restrictions; third, the fatwa on COVID-19 ends the negative stigma on the political role of religious actors; and fourth, the fatwa shows the increasing role of Kiai (religious figures) from cultural brokers to actors of Islamic legal scientism.     AbstrakPenelitian ini menguji fatwā hukum yang dikeluarkan oleh Majelis Ulama Indonesia (MUI) tentang sikap dan prosedur praktis umat Islam Indonesia dalam beragama serta tuntutan publik atas penghargaan dan pengakuan pemerintah. Fatwā tersebut menghadirkan nalar logis sehingga menarik perhatian pemerintah untuk mengadopsi dan mengeluarkan produk hukum yang didasarkan pada fatwā tersebut. Dengan pendekatan penelitian hukum normatif, penelitian kualitatif ini menggunakan teori hukum kritis untuk menganalisis poin-poin penting dalam fatwā. Hasilnya, studi ini menemukan empat kasus penting dalam fatwā tentang sikap dan perilaku beragama selama pandemi COVID-19. Pertama, fatwā hukum tentang COVID-19 memiliki penalaran logis yang sejalan dengan nasihat paramedis; kedua, fatwā hukum tentang COVID-19 sejalan dengan kepentingan politik pemerintah mengenai pembatasan fisik dan sosial; ketiga, fatwā hukum tentang COVID-19 mengakhiri stigma negatif terhadap peran politik aktor agama; dan keempat, fatwā hukum menunjukkan semakin meningkatnya peran kiai dari calo budaya menjadi pelaku ilmu hukum Islam.

Abstract

Abstract: The MUI Fatwa about Female Circumcision. The issue of female circumcision has become a public issue following research, either independent or sponsored, repeatedly finding there to be a number of negative effects arising from allowing the enforcement of female circumcision in a number of countries. The issue of children’s and women’s protection are also often connected to the issue of the implementation of circumcision, especially in relation to children’s rights and women’s reproductive rights. This study finds that provisions targeting female circumcision do so in an effort to protect women’s rights. This article finds that the MUI fatwa, as well as ulamas’ views on madzhab and fiqh, which regulates procedures pertaining to the implementation of female circumcision, serves to strengthen the protection of children’s rights, that is, protection from negative effects which is caused by extreme actions in the dangerous practice of circumcision.Keywords: female circumcision, MUI, fatwa, fiqh, children’s protection.Abstrak: Fatwa MUI tentang Khitan Perempuan. Masalah khitan terhadap perempuan menjadi isu publik setelah adanya pelbagai penelitian, baik yang dilakukan secara independen maupun karena ada sponsor, yang menemukan adanya pelbagai dampak negatif yang ditimbulkan dari penyimpangan pelaksanaan khitan terhadap perempuan di beberapa negara. Isu perlindungan anak dan perempuan juga sering kali dikaitkan dalam masalah pelaksanaan khitan, khususnya terkait hak anak dan hak reproduksi perempuan. Studi ini menemukan bahwa ketentuan mengenai khitan perempuan sejalan dengan upaya perlindungan terhadap hak perempuan. Fatwa MUI, sebagaimana juga pandangan ulama mazhab fikih yang mengatur tata cara pelaksanaan khitan perempuan, justru meneguhkan perlindungan terhadap hak anak, yakni perlindungan dari dampak negatif yang ditimbulkan akibat tindakan berlebihan dalam praktik khitan yang menyebabkan bahaya.Kata Kunci: khitan, perempuan, fatwa MUI, fikih, perlindungan anakDOI: 10.15408/ajis.v12i1.964

Abstract

Public leaders in practice often make political promises and it is not uncommon for these promises to come without a realization. Promises without realization often cause problems both philosophically, juridically, and sociologically. Philosophically, it will injure the existence that all promises must be kept. In practice, the promises of leaders and future leaders take many forms when it comes to the perspective of Islamic law. The perspective of jumhur Fuqaha states that keeping promises is impossible and breaking the law is makruh. The Qoidah is a public leader who break their promises are included in the category of sinful leaders (fasiq), this simultaneously impacts that the level of the leader's wickedness will affect the level of people's obedience to him. This research aims to describe the position of promises given by public dreamers to society from an Islamic perspective. The results of this study explain that leaders often give promises that are limited to commitments and leaders should not break promises because the law is haram and promises are a debt that must be paid.Keywords: Promise; Leader; Political Abstrak: Pemimpin publik dalam praktiknya sering kali memberikan janji politik dan tidak jarang janji tersebut hadir tanpa sebuah realisasi. Janji tanpa realisasi sering kali menimbulkan problematika baik secara filosofis, yuridis maupun sosiologis. Secara filosofis hal tersebut akan menciderai eksistensi bahwa semua janji pada hakikatnya harus ditepati. Dalam praktiknya, janji-janji pemimpin dan calon pemimpin mengambil banyak ragam jika dikaitkan dengan perspektif hukum Islam. Dalam perspektif jumhur Fuqaha menyatakan bahwa menepati janji itu mustahab dan mengingkarinya hukumnya makruh. Kaidaahnya pemimpin publik yang ingkar janji termasuk kategori pemimpin yang berdosa (fasiq). Hal ini secara simultan berdampak bahwa dari kadar kefasikan pemimpin akan mempengaruhi kadar ketaaatan rakyat kepadanya. Penelitian ini bertujuan untuk mendeksripsikan kedudukan atas janji yang diberikan oleh pemimpin publik kepada masyarakat dalam perspektif Islam. Hasil penelitian ini menjelaskan bahwa pemimpin sering memberikan janji yang sebatas komitmen dan pemimpin tidak boleh mengingkari janji karena hukumnya haram dan janji adalah sebuah hutang yang harus dibayar.Kata Kunci: Janji; Pemimpin; Politik

Abstract

This article examines the shift of contract objectives from what originally set for non-profit objectives to business ones. Such shift is found in the three contracts; wakalah (power of attorney), hawalah (underground banking), and kafalah (guarantee). Referring to their uses in several Islamic financial products in Indonesia and comparing to the sharia resolution of Sharia Authority Council Malaysia and Islamic law (fiqh), the majority of these contracts is proven to apply fees (ujrah) and used both independently and in combination with other contracts. Here, the fees are mostly applied in the Islamic financial institutions, but unfortunately the customers who are involved in the contracts get less. This, in turn, affects and changes the contract classification which originally included the three in the non-profit contract and eventually turns them into the business contract. If the contracts are set for business objectives, they are then considered as service/lease based contracts (ijarah). In the construction of a real agreement (contract), this shift has implications on changes in the rights and responsibilities of the parties involved and can raise a dispute cause of misunderstanding of the status of the contract as voluntary (tabarru’) or business (tijari).

Abstract

As a global pandemic which has led to economic and mental health crises, Covid-19 demands resilience in every scope of social systems. This article attempts to examine the resilience of family as the smallest social system and assess the impacts of Islamic law awareness and other factors in family resilience and parenting quality. This article is based on a quantitative and cross-sectional study which involved 296 young people and families as respondents from all-over Indonesia. The study reveals that family resilience is influenced by parenting quality, awareness of Islamic law, and personal financial management. The parenting quality is affected by psychological maturity and personal financial management. In addition, raising awareness of Islamic law among young people and families may strengthen family resilience during the Covid-19 crisis. The capability of parents, especially fathers, as family leaders to transform spiritual-religious activities to enhance family resilience is a strategic issue.

Abstract

Cryptocurrency is a result of recent development of digitalization in the financial transaction. OneGram is a part of it that uses gold instruments to back up and maintain its value stable. The purpose of this study is to explore how Islamic law and MUI & NU, through their fatwa, percieve the OneGram. This research uses a qualitative approach to gain a deep understanding of the OneGram by using secondary data collected from the Quran, hadith, relevant academic journals according to Islamic law and fatwas from both organization. The results of this study state that OneGram is allowed by Islamic law and the fatwa to be used as digital payment system. OneGram is furthermore supervised by shariah supervisory board to avoid gharar (uncertainty) and maysir (gambling) in maintaining its value. The unique fact from this digital currency is that the use of gold in transaction had been applied in the time of Prophet Muhammad SAW. From this digital development, OneGram as a gold-backed cryptocurrency can revive the function of dinar as currency. OneGram transforms the gold value in dinar coin which physically has no flexibility in today transaction to the gold value in digital platform which has flexibility in digital transaction with broad accesability.
