Abstract

The implementation of declarative principles in copyright registration still faces confusion, as the government has granted authority to the Sub-Field of Intellectual Property in the service of recording creations. This contradicts the declarative principle and Law Number 28 of 2014 concerning Copyright. This study employs a socio-legal approach with primary and secondary data through stages of Editing, Classifying, Verification, Analysis, and Conclusion. The research findings indicate that declarative copyright registration is only obtained automatically after the creation is completed and takes on a tangible form. Registration serves as a legal assumption that the work is finished. The process begins with tracking following a report of copyright infringement by the creator. After verification, the file is sent to East Java Regional Police for investigation, and the results are relayed to the Sub-Field of Intellectual Property of the Ministry of Law and Human Rights in East Java. However, the implementation of declarative principles should be adjusted to avoid confusion and ensure compliance with applicable copyright laws.
