Abstract

The constitutional mandate of Article 33 Constitution - the welfare of the people and the community needs to establish the state-owned does not seem to be carried to the maximum so bergulirlah privatization policy. Strengthening this policy led to the privatization provisions in Act Number 19 of 2003 about Corporate Government . In connection with the birth of the concept of privatization which is the concept of capitalism, the author felt the need to analyze the law on the privatization of state-owned enterprises in Indonesia in the perspective of Constitution Article 33 paragraph (4). This study shows that the policy direction expected Privatization is a system of management of state enterprises more efficient and productive and achieve good corporate governance principles. To achieve that goal setting is certainly Corporate Government privatization in the Act should remain in line with the spirit of the economic constitution contained in Constitution Article 33 paragraph (4) because the state continues to run control function through the sectors regulation privatized state enterprises carry out its activities.

Abstract

The land is one of the most valuable items because it is a source of life and livelihood for humans. The land has economic value and spiritual value for the owner. However, as the community's need for land increases, so does the legal problem in acquiring land. Everyone will disagree with one another in defending their land rights. One of them is ownership disputes that occur in inherited land which are the object of the transfer of land rights to other parties, for example through buying and selling. There are several phenomena of legal problems due to the sale and purchase of inherited land which is carried out unilaterally by one of the heirs and / or several heirs. Therefore, in this paper, we will discuss some problem formulations, namely: (1) What is the position of the sale and purchase of land over inherited land without the consent of all heirs? (2) What are the legal consequences of buying and selling land on inherited land without the consent of all heirs? Through normative juridical study, the following results are obtained. First, the legal act of buying and selling inherited land without the consent of all heirs is an illegal act before the law. Secondly, the legal consequences of buying and selling land on inherited land without the approval of all heirs are null and void.

Abstract

The presence of a notary in the Association of legal Communities is significant. Nevertheless, in carrying out its role and function, the Notary is very vulnerable in the vortex of deed against the law. Although in many instances, the public Notary can not be held accountable for the unlawful acts, in some cases, the Notary is unable to circumvent his involvement. This article presents two issues related to notary involvement in unlawful acts, especially the criminal offense. Each of these is: first, how is the form of notary involvement in criminal acts of document falsification? Secondly, can the public Notary be held accountable for his involvement in criminal acts of document falsification? This research was conducted through normative legal research. The results show that there are many forms of notary involvement in criminal acts of document counterfeiting. Secondly, the Notary may be held accountable and may be asked for criminal liability because of his involvement in criminal acts of document falsification.

Abstract

Era industri 4.0 mendukung perkembangan sistem bekerja secara Remote Working. Dengan berbagai sistem yang ada, hubungan kerja yang timbul antara Pemberi kerja dan Pekerja dimulai dengan adanya Perjanjian Kerja. Secara fakta, Perjanjian kerja yang seringkali memgalami permasalahan di Indonesia adalah PKWT. Remote working dalam PKWT yang dilakukan melalui media elektronik tentunya harus dilihat dari berbagai aspek hukum, yaitu: KUHPerdata, UU Ketenagakerjaan dan UU Cipta Kerja sebagai pembaharuannya, serta UU ITE. Oleh karena itu, penulisan ini akan menguraikan beberapa hal yaitu: Pertama, bagaimana pola PKWTdengan konsep Remote Working dalam prespektif UU Cipta Kerja?; Kedua, bagaimana keabsahan PKWTdengan konsep remote working dalam prespektif UU Cipta Kerja?. Dengan menggunakan metode penelitian yuridis normatif dapat diuraikan bahwa PKWT dengan konsep remote working pada prinsipnya jg harus tunduk pada UU Ketenagakerjaan dan UU Cipta Kerja. Selain itu, terdapat beberapa aspek hukum yang harus diperhatikan oleh para pihak dalam perjanjian kerja sehingga keabsahan perjanjian kerja dapat terpenuhi dan dapat melindungi hak dan kewajiban masing-masing pihak.

Abstract

Abstract Conflict over land in Batam occurred in some areas of Batam which initially not identified as forest land by forest SK.463/Menhut-II/2013, such as: Cape kitbag, Cape Gudap, Batuampar, Batam Center, and Batuaji. With the conflict over land that describes the land sector by setting asynchronization SK.463/Menhut-II/2013, which resulted in the status of management rights. Therefore, the authors conducted research related to the legal effect of setting asynchronization land sector with the publication of case studies SK.463/Menhut-II/2013 in the city of Batam. This study aims to describe and analyze the cause and effect of law asynchronization land sector settings with SK.463/Menhut-II/2013, as well as formulate legal solutions to these problems to achieve legal certainty the status of land in Batam. The method of this research using this type of juridical-empirical research with research sites in Batam. The analysis technique used is descriptive qualitative analysis Teknisk. Furthermore, the author obtained the result that the cause of the land sector by setting asynchronization SK.463/Menhut-II/2013. This is the dispute BP Batam authority and the Ministry of Forestry of the existence of the forest area in Batam which occurred in 1985 and eventually led to the publication of  SK.463/Menhut-II/2013. In fact the field, the legal consequences that arise are: Management Rights owned by BP Batam be no binding legal effect, the legal uncertainty arising Land Management Rights BP Batam which the certificate has been issued by the Land Office, and the banks are still hesitant to accept the security certificate land rights that are in the forest location. The existence SK.463/Menhut-II/2013 based on the principle of lex superior and inferior derogat legi principle Lex specialis legi generali derogat not appropriate as opposed to a special arrangement in the formation of Batam Industrial Region. Key words: asynchronization arrangement, management rights, land rights  Abstrak Konflik pertanahan di Kota Batam terjadi di beberapa wilayah Kota Batam yang pada awalnya bukan kawasan hutan diindentifikasi sebagai kawasan hutan oleh SK.463/Menhut-II/2013, seperti: Tanjung Uncang, Tanjung Gudap, Batuampar, Batam Center, dan Batuaji. Dengan adanya konflik pertanahan tersebut menggambarkan adanya insinkronisasi pengaturan bidang pertanahan dengan SK.463/Menhut-II/2013 yang berakibat pada status Hak Pengelolaan. Oleh karena itu, Penulis melakukan penelitian terkait akibat hukum insinkronisasi pengaturan bidang pertanahan dengan studi kasus penerbitan SK.463/Menhut-II/2013 di Kota Batam. Penelitian ini bertujuan untuk mendeskripsikan dan menganalisis penyebab dan akibat hukum insinkronisasi pengaturan bidang pertanahan dengan SK.463/Menhut-II/2013, serta merumuskan solusi hukum dari permasalahan tersebut untuk mewujudkan kepastian hukum status tanah di Batam. Adapun metode penelitian ini menggunakan jenis penelitian yuridis-empiris dengan lokasi penelitian di Kota Batam. Teknik analisis yang digunakan yaitu teknisk analisis deskriptif kualitatif. Selanjutnya, Penulis memperoleh hasil bahwa penyebab insinkronisasi pengaturan bidang pertanahan dengan SK.463/Menhut-II/2013 ini adalah adanya perselisihan kewenangan BP Batam dan Kementrian Kehutanan tentang keberadaan kawasan hutan di Batam yang terjadi pada tahun 1985 dan pada akhirnya berujung pada penerbitan SK.463/Menhut-II/2013. Secara fakta lapangan, akibat hukum yang timbul yaitu: Hak Pengelolaan yang dimiliki BP Batam menjadi tidak mempunyai kekuatan hukum mengikat, timbul ketidakpastian hukum Hak Pengelolaan Lahan BP Batam yang sertifikatnya telah diterbitkan oleh Kantor Pertanahan, dan pihak perbankan masih ragu-ragu untuk menerima jaminan sertipikat hak atas tanah yang berada di lokasi kawasan hutan. Keberadaan SK.463/Menhut-II/2013 berdasarkan asas Lex superior derogat legi inferior dan asas Lex specialis derogat legi generali tidaklah tepat karena bertentangan dengan pengaturan khusus dalam pembentukan Daerah Industri Kota Batam. Abstract

Sharia-based financing institutions are currently experiencing developments in the financial industry. Sharia financing provided by the BPRS is one of the ways that can be used by the community to meet their daily needs or manage their business. The use of financing certainly has the risk of default and execution of collateral which of course will be detrimental to the creditors (BPRS). Various financing problems are generally caused by the financing process that does not pay attention to legal provisions, especially sharia contract law and guarantee law. Taking the theme: "Issues on the Legality of the Financing Contract at BPRS and its solution in the Perspective of Agreement Law", this paper will examine two problems, namely: First, reviewing the validity of the Sharia financing contract at BPRS based on the Sharia Economic Law Compilation; and second, reviewing and finding the efforts that should be made by the BPRS so that the sharia financing contract meets the pillars and conditions of the contract in the Sharia Economic Law Compilation. This study uses a normative juridical research method with a statutory approach method, concepts, and cases. Through this method, the following findings were obtained: First, the problem of sharia financing in BPRS Syariah lies in the non-fulfillment of the Rukun and the terms of the sharia contract in some of its financing contracts which are dominated by carelessness in applying the legal principles of financing and SOPs that have been made. Second, the BPRS and its Customers must pay attention to and understand the elements of the fulfillment of the pillars and terms of the contract in the financing contract against the rules contained in the Sharia Economic Law Compilation.

Abstract

The issue of the position of power over movable property often raises the question of whether the party in control is the owner. This is very important in the realm of law, especially if an object that is controlled by one party will be made the object of a transaction with another person. Therefore, it is necessary to carry out further legal identification and analysis related to the concept of the position of control of the movable property, both in the perspective of civil law and criminal law so that in the end it can find differences and similarities in the concept of the position of control of the movable property so that it can create legal certainty and protection for the public. parties involved in an engagement or legal relationship. Therefore, the implementation of control of objects in civil law cannot be separated from the provisions in criminal law which ultimately require pawnshops to apply the principle of prudence in control of objects.

Abstract

Seringkali bisnis yang telah didasari oleh Kontrak Bisnis menimbulkan sengketa oleh para pihak. Sengketa hukum bisnis tidak hanya mencakup sengketa keperdataan namun dapat beralih pada hukum pidana. Hal ini pula yang dikeluhkan dan dialami oleh beberapa Pengusaha yang tergabung dalam Rumah Pengusaha Malang Raya (RPMR). Oleh karena itu, sangatlah penting masyarakat yang bergelut di dunia bisnis memahami konsep hukum perjanjian dan penyelesaian sengketa hukum kontrak bisnis. Metode yang dilakukan oleh Tim Pengabdi yaitu: 1) pengidentidfikasian permasalahan anggota RPMR terkait sengketa bisnis, 2) Penyuluhan Hukum yang dilakukan dengan tatap muka dan melalui siaran radio; 3) Pendampingan Hukum dengan cara membuka posko konsultasi hukum dan kunjungan langsung ke beberapa anggota UMKM; dan 4) evaluasi Kegiatan Pengabdian. Pelaksanaan kegiatan pengabdian ini menunjukan bahwa terdapat peningkatan keilmuwan dan keterampilan dari para peserta dalam menganalisis permasalahan sengketa kontrak bisnis, menyelesaikan sengketa yang sedang dihadapi, dan menghadapi dan/atau mencegah perbuatan/hal-hal yang memiliki potensi menimbulkan sengketa bisnis.
