Abstract

The purpose of this research is the legal protection for Termination of Employment in the era of the COVID-19 pandemic according to Islamic law and Indonesian positive law as well as the similarities and differences between the two. The research method used in this research is comparative descriptive, with a content analysis approach. This approach used an in-depth discussion of the contents of written information, systematically and objectively analyzed the facts, characteristics, and the relationship between existing elements or certain phenomena and can then be compared to theory. According to Islamic law, legal protection for workers against layoffs is part of the purpose of Islamic law. Namely to maintain life and property to achieve happiness in the world through a good and honorable life (hayyah thayyibah). Therefore, it must be carried out with principles such as human freedom, human dignity, justice, and anti-discrimination, as well as fair wages. In contrast, according to positive law, workers' legal protection for termination of employment can occur because the company is closed due to force majeure, and the entrepreneur is obliged to pay severance pay, long service pay and compensation rights pay that must be received by the worker. The difference is that Islamic law is not regulated in detail regarding the provision of severance pay, long service pay, and compensation rights pay that should be received as in positive law. However, in Islamic law, it is carried out following the agreement (akad) that has been made and agreed to. Therefore, there is no dispute due to injustice committed by one of the parties.Keywords: Legal Protection, Layoffs, Covid-19 Pandemic, Islamic Law, Positive Law

Abstract

The existence of street children, homeless people and beggars using the road is not in accordance with the function of the road because it can interfere with safety, security and smooth traffic. Along with the implementation of regional autonomy policies, the regions must play an active role in carrying out efforts to handle these social problems through the role of the Social Service. The research method using field research is carried out by reviewing data sourced from the research location or field. Based on its nature, this research is a descriptive study, namely a study to describe certain phenomena or symptoms. Based on the results of the research, the role of the Bandar Lampung City Social Service is in accordance with the principles of Islamic law, namely having a role to handle street children, namely by controlling the streets, which is handed over to the POL-PP for later coaching at the Bandar Lampung City Social Service. deemed disturbing, they will be arrested and brought to the Social Service and summoned by the family, a report is made in the form of an agreement as an effort to prevent it from happening again. During the coaching street children are given spiritual showers, as well as training and useful teachings. So that later street children will get provisions for a more decent life and can work with the skills that have been given.

Abstract

The indigenous people of Lampung Saibatin are adherents of the Islamic religion. However, in the marriage tradition, there are still several gender-biased customs that are not in harmony or even contrary to the values of Islamic teachings. The formulation of the problem in this article is how is the level of compatibility between the marriages of the Lampung Saibatin indigenous people and the teachings of Islam they believe? The purpose of this article is to describe the concept of marriage in the Qur'an and marriage customs in the Lampung Saibatin indigenous community and their compatibility with Islamic teachings through the study of gender verses in the Qur'an. The method used is qualitative, with a sociological approach. The focus of this study is to present an interpretation of the gender verse, then relate it to what is practiced by the Lampung Saibatin indigenous people in their marriage customs. The results of the study show: First, there is still a gap between the teachings adopted by the Lampung Saibatin indigenous people and their marriage customs. Second, gender inequality is still often practiced in the marriage customs of the Lampung Saibatin indigenous people. Third, referring to the values of religious teachings adopted by the indigenous people of Lampung Saibatin, it is a solution to the gender injustice in their marriage customs. Fourth, the local wisdom in the marriage of the Lampung Saibatin indigenous people in ending conflicts between families and minimizing the divorce rate. The results of this study contribute to explaining the marriage customs in the internal Lampung Saibatin indigenous community and enlightening the external parties that it is not always what is traditions by a Muslim community is a representation of their religious teachings. Besides, not all marriage practices in the traditional Lampung Saibatin community are poor because there are the values of local wisdom in their marriage customs.

Abstract

Salah satu bidang usaha yang tetap konsisten dan berkembang dalam perekonomian nasional salah satunya adalah Usaha Mikro, Kecil, dan Menengah (UMKM). Dengan maraknya pertumbuhan usaha saat ini persaingan pasarpun semakin ketat.Peralihan tren pemasaran dari konvensional (offline) ke media online menyebabkan para pelaku UMKM yang tidak memanfaatkan potensi digital marketing kehilangan kesempatan untuk lebih mengembangkan bisnisnya. Sosialisasi ini diikuti oleh 10 (Sepuluh) orang para pelaku UMKM yang berada di Desa Kasui Pasar Way Kanan. Para pelaku UMKM di sini masih kurang inovatif dalam mengembangkan usahanya. Umumnya, mereka belum menggunakan daya pikir yang kreatif untuk menggunakan digital marketing dengan memanfatkan jejaring sosial sebagai media pemasaran.Sosialisasi ini dilakukan dengan dengan tujuan untuk membentuk usaha kecil yang produktif dan mengikuti perkembangan zaman. Para peserta sosialisasi sangat antusias dengan materi dan pemaparan yang disampaikan.Kondisi ini diharapkan dapat memotivasi para pelaku UMKM mempraktekkan ilmu yang didapat, sehingga usahanya semakin berkembang dan dapat bersaing pada pasar yang lebih luas.

Abstract

Sebagai lembaga pendidikan, SDN 03 Kasui Pasar Way Kanan tanggap dengan perkembangan teknologi. Dengan dukungan SDM yang di miliki sekolah ini siap untuk berkompetisi dengan sekolah – sekolah lainnya dalam pelayanan informasi publik. Teknologi Informasi, menjadi sarana bagi SDN 03 Kasui Pasar Way Kanan untuk memberi pelayanan informasi secara cepat, jelas, dan akuntable. Dari layanan ini pula, sekolah siap menerima saran dari semua pihak yang akhirnya dapat menjawab Kebutuhan masyarakat. Target dari kegiatan pengabdian kepada masyarakat ini adalah mengedukasi kepada tenaga pengajar serta para siswa tentang pemanfaatan Chromebook, proses kegiatan belajar mengajar lebih menarik dan meningkatkan inovasi serta kolaborasi antara siswa dan guru,membuat digital classroom menjadi lebih personal dan menarik. Sejak pandemi covid- 19, aktifitas belajar mengajar di SDN 03 Kasui Pasar Way Kanan memang dihentikan sementara dan baru digelar kembali namun masih terbatas, hal ini membuat Pemerintah melakukan transformasi kedalam system manajer berbasis teknologi dengan meluncurkan perangkat Chromebook, Sehingga membuat kami tertarik untuk memperkenalkan dan memperlihatkan fitur fitur yang ada didalam Chromebook ini, agar siswa dan siswi SDN 03 Kasui Pasar Way Kanan paham bilamana program pemerintah ini terselenggarakan. Karena Cara belajar yang dapat dengan mudah diserap adalah yang melibatkan penglihatan, pendengaran, dan gerakan.

Abstract

Upah lembur adalah gaji yang dibayarkan pada saat pekerja bekerja melebihi waktu kerja. Penerapan upah lembur bagi karyawan pada lembaga pembiayaan leasing masih menjadi perhatian, di antaranya ketidaksesuaian antara nominal dari hasil perhitungan lembur. Hal ini menimbulkan pertentangan antara buruh dan perusahaan dikarenakan perbedaan nominal upah lembur dan jam kerja yang diperoleh karyawan. Kemudian kesalahan seperti salah hitung nominal upah lembur yang diberikan kepada karyawan dan ketidakterbukaan perusahaan mengenai perhitungan upah lembur karyawan. Tujuan penelitian ini untuk mengetahui perhitungan upah lembur berdasarkan peraturan pemerintah No. 35 tahun 2021 dan menganalisis perhitungan lembur menurut hukum ekonomi syariah. Jenis penelitian ini adalah penelitian lapangan bersifat deskriptif analitis, menggunakan sumber data primer dan sekunder. Populasi penelitian yaitu sebanyak 20 orang karyawan. Berdasarkan hasil penelitian ditemukan bahwa implementasi perhitungan upah lembur karyawan yang dibayarkan tidak sesuai dengan jam kerja lembur karyawan. Karyawan hanya dibayarkan upahnya apabila karyawan bekerja sudah melebihi 3 jam dahulu. Apabila waktu kerja kurang dari 3 jam, maka upah lembur karyawan tidak dibayarkan sesuai dengan peraturan pemerintah No. 35 tahun 2021.
