Abstract

Undergoing local authority does not always bring with it advantage to the local government, but this may challenge the local government to make efforts to support and fund its governmental develop-ment. On of the ways out is by working in cooperation with private enterprises based the law of local execution. This study is intended to analize the cooperative agreement of local government with build and transfer model which is adopted widely by some local governments in Indonesia. Through  normative juridical study along with statute and case approaches, it is found the coopera-tive agreement of build and transfer in Indonesia is ruled by some official regulations which have different substantive points and have conflicted norms and vague rules related to legal subyect, procedures or mechanism of having agreement. In the future  it  is needed to issue legal decision re-lated to cooperative agreement between the local government and private enterprises which is more comprehensively in order to resolve the legal affairs or disputes.  Key words:  build and transfer, infrastructure, bouwheer

Abstract

Abstract The research analyzes about how the Indonesian Law regulates on shares divestment and how the divestment practice conducted by Local government of West Nusa Tenggara.Through the normative approach (normative study) and case approach. It was concluded that the law in Indonesian has not regulated, the process of shares divestment by the Government (Local Company). However Trough the Legal analogy method so the Acts Number 1 Year 2004 on State treasury and some of its implementation regulations applicable to the investments and divestments process. Likewise, as long as the divestment cooperation aims to build the public infrastructure so that the President Regulation Number 65 Year 2005 refers to President Number 13 Year 2010 could be umbrella of law.In the process of shares divestment of PT. NNT, it is found that there were procedural mistakes by the Government of West Nusa Tenggara, as well as there was collaboration agreement contain a conflict of norm, so that it has potential of loss to the state. Keywords:  the Cooperation Agreement, Divestiture Shares Abstrak Penelitian ini mengkaji bagaimana hukum di Indonesia mengatur tentang divestasi saham dan bagaimana praktek divestasi saham itu dilakukan oleh pemerintah Daerah Nusa Tenggara Barat. Dengan melalui pendekatan normatif (studi normative)  dan pendekatan kasus, maka disimpulkan bahwa hukum di Indonesia belum mengatur tentang proses divestasi saham oleh pemerintah ( Perusahaan Daerah). Akan tetapi melalui metode analogi hukum maka UU No.1 Tahun 2004 tentang Perbendaharaan Negara dan beberapa peraturan pelaksanannya dapat diterapkan terhadap proses investasi dan divestasi. Begitupula sepanjang yang menyangkut kerjasama divestasi itu bertujuan untuk membangun infrastruktur publik maka Perpres No.67 tahun 2005 jo Perpres No.13 Tahun 2010 dapat dijadikan payung hukum. Ditemukan kesalahan prosedur dalam proses divestasi saham PT.NNT oleh Pemerintah NTB dan adanya perjanjian Kerjasama yang mengandung konflik norma sehingga berpotensi merugikan Negara (daerah) Kata Kunci: Perjanjian Kerjasama, Divestasi Saham

Abstract

The major improvement of franchise practices in Indonesian within the last 10 (ten) years has speeded to many region. Yet the government and local government under informed about the exact concept and regulation of franchise. Therefore this research meant to find out the concept of franchise and how the government regulate franchise agreement and its relation with transfer of technology. This research in a normative research as a way to depth study legal norms in various primary and secondary legal sources in Indonesia. In fact, in Indonesian the practice of franchise has developed widely without having a particular law to regulate formulate a law to regulate franchise particularly, as the regulation in form of government  regulation (PP No. 42 of 2007) is inadequate to solve the complex legal problem of franchise practice.Keyword : franchise, agreement, transfer of technology

Abstract

The Shares divestment Process of PT NTT becomes interesting legal problem to criticize because the case of shares divestment that involves a big company foreign company in gold mining sector that happened in Indonesia especially in West Nusa Tenggara.The research analyze about how the Indonesian Law regulates on shares divestment and how the divestment practice conducted by Local government of West Nusa Tenggara. Abstract

Debtors as legal subjects are entitled to legal protection, both preventive and repressive, written or unwritten. The legal protection provided is an implementation of the principle of recognition and dignity that is rooted in Pancasila and the Constitution. This study aims to analyze the protection and legal remedies of the debtor in withdrawing the confiscation of fiduciary guarantees without going through a court auction. This research is a normative legal research. The results of this study include: The debtor's legal effort in withdrawing a fiduciary guarantee without going through a court auction is to ask the creditor to show a Fiduciary Guarantee Certificate issued by the Fiduciary Registration Office. If the creditor cannot show a fiduciary guarantee certificate, then the debtor does not need to submit the collateral, because the creditor does not have the right to execute the collateral.

Abstract

Research result shown that: (1) the arrangement of legal protection and tribute on people’s rights to manage land resources has stated on in Article 18B of Institutional Law (UUD) 1945 (as a constitutional right), Article 28 I of UUD 1945 and Law number 19 of 1999 (considered as one of human rights). In the elucidation of Article 22 UUPA (Law of the land) has beed clarified that to own land ownership right could be throught land occupation, this way is feasible according to adat law where National land law based on adat law (according to Article 5 UUPA). (2) the implementation of legal protection toward ownership holders in Rowok case is still away from expectation, this could be seen from the way the government and security officer treated land owner such as committed an eviction, tumbled-down their house and some people who insist to stay on their land were arrested by security officer under allegation of law for entering people’s property without permission whereas they occupied the land previously as a place to stay and place to live.

Abstract

This study aimed to examine and analyze the legal position of the the Supervision Commission as the only institution dealing with competition law in Indonesia legal system and determine the existence of law enforcement of the Commission as the only institution related to tender collusion (conspiracy) viewed from the Indonesian legal perspective. This was a normative study (research), with a statutory and conceptual approach. The results of this study indicated that the position of the Supervision Commission as the only institution dealing with competition law in Indonesia in the justice system was independent from the influence of other institutions in resolving disputes on unfair business competition in Indonesia; and the existence of the Commission is the only institution dealing with competition law in Indonesia in carrying out its duties and authorities in accordance with the mandate of the Law Number 5 of 1999 concerning the prohibition of monopolistic practices and unfair business competition.

Abstract

This research was conducted to find out how the concept of abuse of authority in criminal acts of corruption after the enactment of Law Number 30 of 2014 concerning Government Administration; and How was law enforcement in handling criminal acts of corruption after the enactment of the Law Number 30 of 2014. This research was a normative legal research. The approach used in this research was the statutory approach, the conceptual approach, and the comparative approach. From the results of the study it could be concluded that the concept of abuse of authority in criminal acts of corruption after the entry into force of Law Number 30 of 2024 concerning Government Administration was the Abuse of authority in accordance with Article 17 of Law No. 30 of 2014. Law No. 30 of 2014 focused on preventing abuse of authority. Aspects of criminal acts of corruption were first proven based on administrative law. In the process of law enforcement, if there was indeed an abuse of authority, then it became the basis by law enforcement officials to investigate or investigate allegations of corruption against the abusers of authority, whereas if in testing the abuse of authority by the State Administrative Court, the evidence was not proven, of course these actions could not be used as a basis for conducting investigations.

Abstract

Penelitian ini bertujuan untuk menganalisis Bagaimanakah perlindungan hukum terhadap korban perdagangan orang di Indonesia? Dan Apa dasar pertimbangan hakim dalam memutus perkara tindak perdagang orang dalam Putusan Nomer 85/PID.SUS/2-21/PN.SEL. Penelitian ini merupakan penelitian hukum normatif, dengan menggunakan metode pendekatan Undang-undang (Statute Aproach), Pendekatan Konseptual (Conceptual Aproach) dan Pendekatan kasus (casse approach). Bahan-bahan hukum yang mengikat yang terdiri dari Kitab Undang-Undang Hukum Pidana, Undang-Undang Nomor 26 Tahun 2000 tentang Hak Asasi Manusia, Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 Undang-Undang Nomor 23 Tahun 2003 tentang Perlindungan Anak. Undang-Undang Nomor 21 Tahun 2007 tentang Pemberantasan Tindak Pidana Perdagangan Orang, Undang-Undang Nomor 13 Tahun 2006 tentang Perlindun gan Saksi dan Korban. Bahan hukum yang diperoleh berdasarkan studi dokumen kemudian diolah dan dianalisis dengan metode penafsiran norma hukum. Cara berfikir yang digunakan adalah deduktif. Penelitian yang dilakukan maka akan diperoleh hasil sebagai berikut yaitu Secara yuridis normatif perlindungan hukum bagi korban perdagangan orang sebelum keluarnya Undang-Undang Nomor 21 Tahun 2007 perdagangan orang sudah diatur dalam KUHP, dan Undang-Undang Nomor 21 Tahun 2007 tentang Pemberantasan Tindak Pidana Perdagangan Orang yang dimaksud dengan Tindak Pidana Perdagangan. Bahwa dasar pertimbangan hakim dalam mengadilii dan memutus perkara perdagangan orang adalah Sesuai dengan data pada Dinas Tenaga Kerja dan Transmigrasi Prov. Berdasarkan fakta-fakta yang terungkap di persidangan tersebut Majelis berpendapat bahwa perbuatan Terdakwa telah memenuhi kuafifikasi “membantu melakukan” perbuatan yang dapat dikualifikasikan sebegai perbuatan perdagangan orang, sebagaimana dimaksud dalam ketentuan da!am Pasal 1 angka 1 Undang-undang Nomor 21 Tahun 2007 tentang Pemberantasan Tindak Pidana Perdagangan Orang
