Abstract

In order to improve the similarity of peoples to perform passing off reputation on the other side, now, therefore, mark breaching is especially motivated by a desire to gain benefit in the goods and services trade with the other mark which has been famous or popular or with the passing off owner mark or well-known mark. Trading of the trademark in well-known mark speed on selling to the market will undoubtedly profit quickly. The behavior in violation of the law harmed a company's reputation. With regard to the "EIK, EIKA, and EIKA brand" trademark issue, this journal seeks to discover how the "EIK" trademark is protected in Indonesia against well-known foreign marks that are not registered in Indonesia. A qualitative normative legal study employing a statute and case method. The statute used in this study is Law No. 20 of 2016 governing Marks and Geographical Indications, while the case used in this study is Supreme Court Decision No. 1300 K/Pdt.Sus-HKI/2017. The results of this study show that Law No. 20 of 2016 Governing Marks and Geographical Indications solely protects trademark rights based on registration. The Supreme Court judges gave substantial and correct consideration to the evidence in the case between the EIK brand and EIK, EIKA, and EIKA.

Abstract

AbstrakMerek merupakan hal yang penting dalam perkembangan ekonomi bagi pengusaha, sehingga tidak sedikit pengusaha yang memanfaatkan dan tidak bertanggung jawab menggunakan, meniru dan bahkan mendaftarkan merek terkenal orang lain atas nama dirinya. Penelitian ini menggunakan metode penelitian yurisdis normatif dengan menggunakan metode perundang-undangan (Statue Approach), dan pendekatan kasus (Case Approach) pendekatan kepada Perundang-undangan Nomor 15 Tahun 2001 tentang Merek. Sedangkan pendekatan kasus berdasarkan Putusan Mahkamah Agung 557 K/Pdt.Sus-HKI/2016. Hasil penelitian menunjukkan bahwa merek dagang asing dilindungi selama merek tersebut sudah terdaftar di negaranya dalam hal ini negara anggota konvensi, peraturan-peraturan tersebut dibebaskan dalam penerapannya oleh setiap anggota konvensi. Akan tetapi kebebasan dalam hal ini kebebasan yang tidak bertentangan dengan ketentuan-ketentuan konvensi internasional. Adapun pertimbangan hakim Pengadilan Niaga memutuskan menolak legal standing penggugat dengan alasan yang mengajukan bukanlah badan hukum yang bersangkutan. Mahkamah Agung telah dinyatakan sudah tepat karena pertimbangan-pertimbangan yang dilakukan oleh hakim sudah sesuai dengan perundang-undangan yang berlaku. Kata Kunci : Perlindungan Merek, Merek Terdaftar, Merek Asing.

Abstract

This study aims to evaluate the judge's legal reasoning in the judgment Number: 4/Pdt.Sus. Peace Cancellation/2019/PN.Niaga.Jkt.Pst. Jo. Number 718K/Pdt.Sus-Pailit/2019, as well as how the cancellation of the homologation of the postponement of debt payment obligations led to insolvency. Analysis of the matter between PT Arpeni Pratama Ocean Line Tbk and PT CIMB Niaga in their respective roles as debtor and creditor. Due to the debtor's negligence with the homologated peace document, the creditor petitions the Commercial Court to annul the peace agreement. At the level of the Commercial Court, the court denied the demand for cancellation. The Creditors file an appeal with the Supreme Court in response to the verdict of the Commercial Court Judge. The Supreme Court judge observed in his ruling that he had approved the creditor's motion to reject the reconciliation. This study combines a descriptive-analytical research technique in conjunction with a legal research strategy consisting of a normative juridical or statutory approach and qualitative analysis methodologies. Case research for Decision Number 4/Pdt.Sus.Cancellation of Peace/2019/PN.Niaga.Jkt.Pst. Jo. Number 718K/Pdt.Sus-Pailit/2019 revealed that the judge's legal considerations at the first level were in conflict with several Civil Code articles and the principle of balance in Law Number 37 of 2004 concerning Bankruptcy and Suspension of Temporary Debt Payment Obligations. The judge of the Supreme Court who accepts the petition for peace annulment declares the debtor bankrupt with all legal consequences.

Abstract

Abstract      Protection every right to appear from the result the people creativity in the field of trading and industry, so improvement in the similarity of the peoples to perform passing off reputation on the other side, now therefore mark breaching especially motivated by wished for obtaining of benefit in the goods and services trading with utilized by the other mark which has been famous or popular or with the passing off owner mark or well known mark. Trading of trademark in well known mark speed on selling to the market and then certainly will obtain well benefit in the fast time. The activity unbreach of law which breach right a company known by mentioned passing off reputation.      This journal aims to find out how the legal protection of foreign brands in Indonesia against well-known marks which are foreign marks that are not registered in Indonesia in trademark registration in Indonesia, which applies the first to file system principle, in relation to the dispute over the "EIK" trademark with the "EIK, EIKA and EIKA brand".      This type of research uses a qualitative normative juridical research with a statute approach and a case approach. The statute approach in this study refers to Law Number 20 of 2016 concerning Marks and Geographical Indications, while the case approach is by examining a case that has become a court decision with permanent legal force which in this case is Supreme Court Decision Number 1300 K/Pdt.Sus-HKI/2017.      The results of this study indicate that Law Number 20 of 2016 concerning Marks and Geographical Indications only provides protection for trademark rights based on registration because it adheres to a constitutive system. The consideration of the judges of the Supreme Court in deciding the case between the EIK brand and EIK, EIKA and EIKA has given sufficient and correct consideration because it does not only refer to Law Number 20 of 2016 but also refers to the evidence in court.Key words                                      : Legal Protection, Foreign Well Known Mark, Basically The Same, Constitutive system

Abstract

This thesis examines force majeure in construction service businesses influenced by the 2019 corona virus pandemic (COVID-19). This thesis explores the application of Article 47 paragraph (1) letter j of Law Number 2 of 2017 concerning Construction Services, which regulates coercion, to construction service enterprises affected by the development of the corona virus pandemic epidemic 2019 (COVID-19). This subject is relevant because the proliferation of COVID-19 in the construction service business has sparked a debate regarding the relevance of coercive conditions for construction service organizations facing impediments in completing their business activities. This is normative statutory legal research. (State and case) (case approach). This study employs literature to obtain data. This literature study collects documents and data for content analysis. According to the study, service businesses affected by the COVID-19 epidemic should use force majeure. This follows the classification of force majeure as relative, subjective, temporary, particular, and exclusive. Force majeure has legal ramifications in the construction service company, including contract termination, renegotiation, and worker compensation.
